The Implications Of Unbelief: Tracing The Emergence Of Distinctively ShiʿI Notions Regarding The Food And Impurity Of Non-Muslims, David M. Freidenreich Jan 2011

The Implications Of Unbelief: Tracing The Emergence Of Distinctively ShiʿI Notions Regarding The Food And Impurity Of Non-Muslims, David M. Freidenreich

Faculty Scholarship

The distinctively Shiʿi conception of non-Muslims as bearers of a contagious form of impurity emerges gradually, reaching its classical form only in the 5th/11th century. Contrary to common scholarly presumptions, Q. 9.28 does not constitute the point of origin for this conception but rather serves as retroactive justification for its validity. This essay utilizes ḥadīth collections and works of law from the 2nd/8th through 5th/11th centuries to trace the emergence of Shiʿi notions regarding the impurity of non-Muslims and the parallel emergence of distinctively Shiʿi norms regarding the meat of animals slaughtered by non-Muslims. It concludes by suggesting that the …

Short-Term And Long-Term Effects Of Orthopedic Biodegradable Implants, Ami R. Amini, James S. Wallace, Syam P. Nukavarapu Jan 2011

Short-Term And Long-Term Effects Of Orthopedic Biodegradable Implants, Ami R. Amini, James S. Wallace, Syam P. Nukavarapu

Articles - Patient Care

Presently, orthopedic and oral/maxillofacial implants represent a combined $2.8 billion market, a figure expected to experience significant and continued growth. Although traditional permanent implants have been proved clinically efficacious, they are also associated with several drawbacks, including secondary revision and removal surgeries. Non-permanent, biodegradable implants offer a promising alternative for patients, as they provide temporary support and degrade at a rate matching tissue formation, and thus, eliminate the need for secondary surgeries. These implants have been in clinical use for nearly 25 years, competing directly with, or maybe even exceeding, the performance of permanent implants. The initial implantation of biodegradable …

The Gendered Lives Of Legal Aid: Lay Lawyers, Social Workers, And The Bar, 1863-1960, Felice J. Batlan Jan 2011

The Gendered Lives Of Legal Aid: Lay Lawyers, Social Workers, And The Bar, 1863-1960, Felice J. Batlan

All Faculty Scholarship

The Gendered Life of Legal Aid, 1863-1960 (manuscript in process) will be the first monograph on the history of civil legal aid in the United States. By closely examining the history of legal aid in New York, Chicago, and Boston, it presents a number of arguments with wide-ranging implications and it is animated by a host of conflicts. These include the relationship between legal aid and citizenship, the changing status of domestic relations law, the interactions between lawyers and social workers and their different understandings of the role and nature of law, what services legal aid should provide, and even …

Green Diesel: Finding A Place For Algae Oil (Symposium Editor), Fred P. Bosselman Jan 2011

Green Diesel: Finding A Place For Algae Oil (Symposium Editor), Fred P. Bosselman

All Faculty Scholarship

The prospect of obtaining domestically-produced biodiesel from algae has attracted wide investor interest. Although many analysts predict that economic production is five to ten years away, the production process involves such a wide range of environmental and land use issues that it is not premature to begin thinking about the kinds of places in which “green biodiesel” could be efficiently made in the United States. Our land use and environmental laws were all drafted by people who never imagined the possibility that huge volumes of algae would be an important energy resource; nor could they have known that the location …

From Control To Communication: Science, Philosophy And World Trade Law, Sungjoon Cho Jan 2011

From Control To Communication: Science, Philosophy And World Trade Law, Sungjoon Cho

All Faculty Scholarship

Science has recently become increasingly salient in various fields of international law. In particular, the WTO Sanitary and Phytosanitary (SPS) Agreement stipulates that a regulating state must provide scientific justification for its food safety measures. Paradoxically, however, this ostensibly neutral reference to science tends to complicate treaty interpretation. It tends to take treaty interpretation beyond a conventional methodology under the Vienna Convention on the Law of Treaties, which is primarily concerned with clarifying and articulating the treaty text. The two decades old transatlantic trade dispute over hormone-treated beef is a case in point. This article demonstrates that beneath the controversy …

The Dark Side Of The Force: The Legacy Of Justice Holmes For First Amendment Jurisprudence, Steven J. Heyman Jan 2011

The Dark Side Of The Force: The Legacy Of Justice Holmes For First Amendment Jurisprudence, Steven J. Heyman

All Faculty Scholarship

Modern First Amendment jurisprudence is deeply paradoxical. On one hand, freedom of speech is said to promote fundamental values such as individual self-fulfillment, democratic deliberation, and the search for truth. At the same time, however, many leading decisions protect speech that appears to undermine these values by attacking the dignity and personality of others or their status as full and equal members of the community. In this Article, I explore where this Jekyll-and-Hyde quality of First Amendment jurisprudence comes from. I argue that the American free speech tradition consists of two very different strands: a liberal humanist view that emphasizes …

Federal Power, Non-Federal Actors: The Ramifications Of Free Enterprise Fund, Harold J. Krent Jan 2011

Federal Power, Non-Federal Actors: The Ramifications Of Free Enterprise Fund, Harold J. Krent

All Faculty Scholarship

In Free Enterprise Fund v. Public Company Accounting Oversight Board the Supreme Court invalidated Congress’s decision to protect members of the Board from at will removal by the Securities and Exchange Commission, whose members in turn are protected from at will removal at the hands of the President. In the Court’s view, the congressional structure – in particular, the double layer of tenure insulation -- undermined the Article II imperative that all exercises of significant executive authority be subject to strong supervision by the President. The Court’s insistence in Free Enterprise Fund on formal presidential control over an inferior executive …

Darke County Community Health Assessment, Center For Urban And Public Affairs, Wright State University Jan 2011

Darke County Community Health Assessment, Center For Urban And Public Affairs, Wright State University

Public Health

In 2011, APRI (formerly CUPA) conducted a community health assessment for the Darke County Health Department (DCHD). The survey was based upon the Behavioral Risk Factor Surveillance System (BRFSS) conducted by the Centers for Disease Control and Prevention (CDC), as well as health assessments conducted by neighboring counties and priority health needs within the county. The purpose of the health needs assessment is to assess the prevalence of disease and behavioral risk factors, assess broad community health issues and shape a broader definition of community health, monitor the impact of community health action plans and trends in behavioral modifications and provide …

Reducing Pathological Stress Effects And Increasing Pilot Performance During Unexpected In-Flight Events., Wayne L. Martin, Patrick S. Murray, Paul R. Bates

International Symposium on Aviation Psychology - 2011

The inherent reliability of the modern aircraft means pilots rarely experience actual emergencies, or novel, unexpected events. When events do occur, increased arousal levels may have pathological effects on pilots’ abilities to deal optimally with the situation, leading to increased likelihood of undesired aircraft states. Amygdala based appraisals of unexpected events may cause over-arousal through lack of expectation, lack of previous experience of such events (either directly or vicariously), and through poor individual perceptions of the ability to handle such events. Routine discussion of novel or emergency events widens pilots’ event knowledge database and raises expectation of event occurrence. Individual …

Collegiate Aviation Safety Reporting Systems, Beth M. Beaudin-Seiler Mpa

International Symposium on Aviation Psychology - 2011

The Federal Aviation Administration has paid close attention to the safety reporting systems of the airline industry over the last thirty years. The Aviation Safety Action Programs, housed at NASA, allow pilots and crews to report safety issues into a central database that tracks these reports and provides valuable knowledge to the industry on safety related issues. However extrapolating information that is pertinent to general aviation from these reports, specifically collegiate aviation, is difficult. One of the barriers to data collection is having a commonly understood language among reporters in order to ensure accurate information is reported. The goals of …

Genomic Analysis Of Individual Differences In Ethanol Drinking: Evidence For Non-Genetic Factors In C57bl/6 Mice, Jennifer T. Wolstenholme, Jon A. Warner, Maria I. Capparuccini, Kellie J. Archer, Keith L. Shelton, Michael F. Miles Jan 2011

Genomic Analysis Of Individual Differences In Ethanol Drinking: Evidence For Non-Genetic Factors In C57bl/6 Mice, Jennifer T. Wolstenholme, Jon A. Warner, Maria I. Capparuccini, Kellie J. Archer, Keith L. Shelton, Michael F. Miles

Pharmacology and Toxicology Publications

Genetic analysis of factors affecting risk to develop excessive ethanol drinking has been extensively studied in humans and animal models for over 20 years. However, little progress has been made in determining molecular mechanisms underlying environmental or non-genetic events contributing to variation in ethanol drinking. Here, we identify persistent and substantial variation in ethanol drinking behavior within an inbred mouse strain and utilize this model to identify gene networks influencing such “non-genetic” variation in ethanol intake. C57BL/6NCrl mice showed persistent inter-individual variation of ethanol intake in a two-bottle choice paradigm over a three-week period, ranging from less than 1 g/kg …
