On The Origin Of Biological Functions, Alexander Umantsev Jun 2011

On The Origin Of Biological Functions, Alexander Umantsev

Chemistry and Physics Faculty Working Papers

We consider the problem of structure and functions of the first forms of living matter and present a hypothesis that they were formed through a physico-chemical process known as dendritic crystallization. According to this hypothesis the branching, dendritic structures helped build living systems by lending them functions so that organic chemical evolution is just one natural consequence of the evolution of matter in the universe. We conclude that a self-replicating biological system with adaptation emerged from simple molecules using completely abiotic mechanism of formation, which acted simultaneously or intermittently at different places on the early Earth and created similar structures …

In fall 2010, the Caster Center for Nonprofit and Philanthropic Research administered a survey to explore the impact of student-led applied projects on client organizations and the local community. The survey is the second part of a community impact study of the Masters of Arts in Nonprofit Leadership and Management (NLM) at the University of San Diego. The survey was distributed to client organizations during the 2010-2011 academic year to assess client organization satisfaction and successful use of the projects. The survey investigated whether applied projects had an impact on the organization’s operations or the community, and if so, to …

The Problem Of Enforcing Nature's Rights Under Ecuador's Constitution: Why The 2008 Environmental Amendments Have No Bite, Mary Elizabeth Whittenmore Jun 2011

The Problem Of Enforcing Nature's Rights Under Ecuador's Constitution: Why The 2008 Environmental Amendments Have No Bite, Mary Elizabeth Whittenmore

Washington International Law Journal

In 2008, Ecuador became the first nation to give rights to nature when it ratified constitutional amendments (new articles 71-74) that grant the environment the inalienable right to exist, persist, and be respected. Environmentalists hope Ecuador’s amendments will lead to improvement in a country devastated by resource exploitation, and that other countries will follow. Yet, many wonder whether the amendments will be enforced. This comment argues that—all things considered—successful execution of the amendments is unlikely. Ecuador’s President has not demonstrated a sincere intention or ability to implement the amendments. Further, plaintiffs who sue under the amendments face significant legal barriers, …

The following aspects are covered: The overall scheme for preventing and redressing medical errors and adverse events, including regulation, criminal and civil liability, and social and private insurance, and the relationships among these various systems; the details of the applicable liability and compensation systems, including criteria defining qualification for compensation, causation and "loss of chance," liability for failure to obtain informed consent, as well as matters of proof and gathering of evidence. The authors note the difficulty they had in obtaining empirical data on medical errors and …

The Story Of A Character: Establishing The Limits Of Independent Copyright Protection For Literary Characters, Samuel J. Coe Jun 2011

The Story Of A Character: Establishing The Limits Of Independent Copyright Protection For Literary Characters, Samuel J. Coe

Chicago-Kent Law Review

Copyright law provides writers with a way to protect their original works of authorship, but courts often disagree over the scope of this protection and how far it can be extended for the fictional characters appearing within literary works. Characters like Holden Caulfield and James Bond have become extremely valuable forms of intellectual property, but even for such iconic figures it can be difficult to separate the character from the story to determine where one work ends and the other begins. To address this issue, the Second Circuit follows the "distinctly delineated" test, which asks whether a character has been …

High-Density Lipoprotein Metabolism In Human Apolipoprotein B100 Transgenic/Brown Adipose Tissue Deficient Mice: A Model Of Obesity-Induced Hyperinsulinemia, Sarah J. Ehlers, Stephanie M. Larson, Heather E. Rasmussen, Young-Ki Park, Ji-Young Lee Jun 2011

High-Density Lipoprotein Metabolism In Human Apolipoprotein B100 Transgenic/Brown Adipose Tissue Deficient Mice: A Model Of Obesity-Induced Hyperinsulinemia, Sarah J. Ehlers, Stephanie M. Larson, Heather E. Rasmussen, Young-Ki Park, Ji-Young Lee

Department of Nutrition and Health Sciences: Faculty Publications

Obese and diabetic humans display decreased plasma high-density lipoprotein cholesterol (HDL-C) concentrations and an increased risk for coronary heart disease. However, investigation on HDL metabolism in obesity with a particular emphasis on hepatic ATP-binding cassette transporter A1 (ABCA1), the primary factor for HDL formation, has not been well studied. Human apolipoprotein B100 transgenic (hApoBtg) and brown adipose tissue deficient (BATless) mice were crossed to generate hApoBtg/BATless mice. Male and female hApoBtg and hApoBtg/BATless mice were maintained on either a regular rodent chow diet or a diet high …

Medical Malpractice In Austria, Bernhard A. Koch Jun 2011

Medical Malpractice In Austria, Bernhard A. Koch

Chicago-Kent Law Review

This article presents the Austrian law governing compensation for medical malpractice in an overview. After a glimpse at the healthcare and social insurance system, the regulatory framework is outlined, with an obvious particular focus on tort and contract law. Apart from the special case where informed consent is lacking, the various elements of a claim that patients may have mirror the general requirements of tort and contract liability in Austria, which is why the brief sketch may also serve to give at least some basic insight into that part of the legal system in general. Furthermore, peculiar approaches in handling …

Unpredictability In Patent Law And Its Effect On Pharmaceutical Innovation, Christopher M. Holman Jun 2011

Unpredictability In Patent Law And Its Effect On Pharmaceutical Innovation, Christopher M. Holman

Missouri Law Review

Part II of this Article summarizes the current R&D crisis confronting the pharmaceutical industry and the accompanying drop-off in innovative output from this important technological sector. Part III explains Mr. Armitage's "view from industry," which attributes a significant causative effect to unpredictability in the patent system. Part IV provides two Lilly case studies involving generic challenges to two of the company's important drugs, Gemzar and Strattera, in which the company has suffered as a result of this unpredictability. Part V identifies three distinct forms of unpredictability in patent law: unpredictability caused by the proliferation of loosely defined standards rather than …

Pleading Panic: Pure Emotional Damages As Sickness Or Disease For Bodily Injury Claims, Joseph N. Blumberg Jun 2011

Pleading Panic: Pure Emotional Damages As Sickness Or Disease For Bodily Injury Claims, Joseph N. Blumberg

Missouri Law Review

On the surface, Derousse v. State Farm Mutual Automobile Insurance. Co. may be a relatively minor matter of statutory interpretation: Does Missouri insurance law require coverage for pure emotional distress caused by uninsured motorists? In answering the question, however, the court's generous rules of interpretation signal its recent willingness to expand recovery for emotional distress claims. Traditionally, Missouri took a conservative approach to allowing emotional damages in tort claims. Derousse is a stark example that the old regime is a relic.

Materials Characterization Of Bamboo And Analysis Of Bonding Strength And Internal Strength As A Structural Member In Reinforced Concrete, Nithi Plangsriskul, Nicholas Dorsano Jun 2011

Materials Characterization Of Bamboo And Analysis Of Bonding Strength And Internal Strength As A Structural Member In Reinforced Concrete, Nithi Plangsriskul, Nicholas Dorsano

Materials Engineering

This study evaluates the potential to utilize bamboo as reinforcement in concrete structural members.  In this project, the mechanical properties of bamboo were tested, specifically force required to embed a 0.5” diameter ball 0.016” into the bamboo samples and its bonding strength with concrete.  One type of bamboo, Bambusa Oldhamii, was cut into eight sections, approximately 2.54 cm wide, along the length of the culm.  The compression test recorded the bamboo’s strength at eight points along the length of the internode and at three points along the transverse direction of each specimen.  Bambusa Oldhamii’s specimen base 1 data for inner, …

Faking Altruism: The True Nature Of Giving, Kristina L. Barker Jun 2011

Faking Altruism: The True Nature Of Giving, Kristina L. Barker

Communication Studies

I want to see if students are capable of donating to charities. I have picked the American Red Cross to donate to and in support of helping the disaster in Japan. This is a huge effort publicly and students have seen the destruction on a daily basis. I want to see how much students are willing to donate and if different selling strategies make a difference on donations. I will be promoting sunglasses as a gift incentive for donations, with each pair raising $3.60 towards relief efforts. I will be selling the incentives in-group settings and to individual students on …

The Effect Of Processing Parameters And Methylcellulose On Texture And Consumer Acceptability Of A Non-Melting Dairy Protein Gel, Joshua Goldman Jun 2011

The Effect Of Processing Parameters And Methylcellulose On Texture And Consumer Acceptability Of A Non-Melting Dairy Protein Gel, Joshua Goldman

Master's Theses

The overall goal was to understand the capabilities of a dairy based meat alternative.  This was done in three phases: 1) the production of a dairy protein gel as a base for a dairy based meat alternative, 2) texturization of the dairy protein gel base to produce a nugget like texture, and 3) a consumer test to determine the acceptability of the dairy based nugget compared to meat and meat alternatives on the market.

For phase I, a dairy protein gel base was tested to understand the textural attributes.  Milk to whey percentages and level of acidification were examined to …

Assessing The Role Of Conspecific Attraction In Habitat Restoration For Henslow’S Sparrows In Iowa, Jennifer A. Vogel, Rolf R. Koford, David L. Otis Jun 2011

Assessing The Role Of Conspecific Attraction In Habitat Restoration For Henslow’S Sparrows In Iowa, Jennifer A. Vogel, Rolf R. Koford, David L. Otis

The Prairie Naturalist

The presence of conspecific individuals may provide important cues about habitat quality for territorial songbirds. We tested the ability of a conspecific song playback system to attract Henslow’s sparrows to previously unoccupied restored habitat. We successfully attracted Heslow’s sparrows to 3 of 7 treatment plots using conspecific song playbacks and we found no Henslow’s sparrows in control plots. The addition of social cues using playback systems in restored grassland habitats may aid conservation efforts of Henslow’s sparrows to available habitat.
