Modernizing Marriage, Adam Candeub, Mae Kuykendall Jul 2011

Modernizing Marriage, Adam Candeub, Mae Kuykendall

University of Michigan Journal of Law Reform

This Article proposes to modernize the archaic procedures states use to authorize marriages so as to provide legal flexibility, promote efficiency, and enhance individual choice. Almost universally, states require couples' presence within their borders, however briefly, for a ceremony. After considering the historical and policy rationales for this requirement and finding them either obsolete or incoherent, we propose that states offer marriages to those outside their borders. Such distance marriages could occur via video-conference, using the internet or even telephone, with readily available safeguards to prevent fraud. This simple reform would allow certain couples who cannot marry under local law …

University of Michigan Journal of Law Reform

This Note proposes that the Washington State Legislature amend its Public Records Act to exempt from public disclosure personal information legally required to be disclosed by signers of referendum petitions. This Note also proposes that the Washington State Legislature designate an electronic system, to be detailed in its election law, by which referendum petitions can be checked for fraud without violating the right to anonymous expression protected by the First Amendment. Part I describes Washington State's referendum process and the path of Doe v. Reed, the case animating the reform presented in this Note. Part II illustrates how the rise …

Emphasizing Substance: Making The Case For A Shift In Political Speech Jurisprudence, Anastasia N. Niedrich Jul 2011

Emphasizing Substance: Making The Case For A Shift In Political Speech Jurisprudence, Anastasia N. Niedrich

University of Michigan Journal of Law Reform

Political speech is vital to a functioning democracy and is highly protected. That much is hardly disputed. What courts, legal scholars, and those seeking to convey a political message do dispute is how political speech should be identified and protected, and who should decide what constitutes political speech. This Note looks at the history of political speech doctrine and critiques two intent-based approaches that have been proposed by First Amendment scholars to define political speech. This Note proposes a solution to many problems inherent in defining, identifying, and protecting political speech within intent-based frameworks, arguing that focusing on intent creates …

Ataxia Telangiectasia Mutated Kinase Plays A Protective Role In Β-Adrenergic Receptor-Stimulated Cardiac Myocyte Apoptosis And Myocardial Remodeling, Cerrone R. Foster, Mahipal Singh, Venkateswaran Subramanian, Krishna Singh

ETSU Faculty Works

β-Adrenergic receptor (β-AR) stimulation induces cardiac myocyte apoptosis and plays an important role in myocardial remodeling. Here we investigated expression of various apoptosis-related genes affected by β-AR stimulation, and examined first time the role of ataxia telangiectasia mutated kinase (ATM) in cardiac myocyte apoptosis and myocardial remodeling following β-AR stimulation. cDNA array analysis of 96 apoptosis-related genes indicated that β-AR stimulation increases expression of ATM in the heart. In vitro, RT-PCR confirmed increased ATM expression in adult cardiac myocytes in response to β-AR stimulation. Analysis of left ventricular structural and functional remodeling of the heart in wild-type (WT) and ATM …

Present Bias And Criminal Law, Richard H. Mcadams Jul 2011

Present Bias And Criminal Law, Richard H. Mcadams

Coase-Sandor Institute for Law & Economics Research Paper Series

Although "present bias" (or weakness of will, impulsiveness, myopia, or bounded willpower) was flagged as an issue for legal examination by Tom Ulen and Russell Korobkin over a decade ago, the concept has received insufficient attention in the legal field—and most of that attention has focused on its implications for the regulation of credit and savings. But, as demonstrated by this Article, the inconsistency of time preferences has wider implications, especially for criminal law. First, present bias may have significant implications for the general deterrence of crime. Individuals with time-inconsistent preferences may give in to immediate temptations to offend, even …

Techniques To Promote Garry Oak Seedling Growth And Survival In Areas With High Levels Of Herbivory And Competition, David R. Clements, Seth Luginbill, David A. Jordan, Randall Dragt

University Faculty Publications and Creative Works

Though regeneration of Garry oak (Quercus garryana) seedlings within Garry oak ecosystems is important to maintain this threatened habitat, seedling regeneration is often poor. Two independent studies were initiated in the early 2000s to examine questions surrounding Garry oak recruitment: one at the Crow's Nest Ecological Research Area (CNERA) on Salt Spring Island, BC, and another at the Pacific Rim Institute for Environmental Stewardship (PRI) on Whidbey Island, WA. In both areas, Garry oak seedlings were caged and monitored for growth and relative health. Over 8 years at CNERA, growth of caged plants outpaced growth of controls, which was indicative …

A New Language For Heroes: Odysseus, Ajax, And Sophistic Language In Attic Tragedy, Scott Barnard Jul 2011

A New Language For Heroes: Odysseus, Ajax, And Sophistic Language In Attic Tragedy, Scott Barnard

Foreign Languages & Literatures ETDs

My objective in this project is to explore the ways in which the Homeric figures of Odysseus and Ajax are reinterpreted for the tragic stage by Sophocles and Euripides, with particular emphasis on the presence of marked sophistic modes and values of speech. My thesis begins with an overview of the sophistic movement and a discussion of the philosophical and stylistic tenets of sophism. Based on these, I theorize that during fifth century Be a civic anxiety over the power of sophistic rhetoric develops in Athens and finds unique expression in tragic poetry. Next, I define the particular rhetorical styles …

Ceramic Resource Selection And Social Violence In The Gallina Area Of The American Southwest, Connie Irene Constan Jul 2011

Ceramic Resource Selection And Social Violence In The Gallina Area Of The American Southwest, Connie Irene Constan

Anthropology ETDs

This dissertation examines the relationship between social violence and ceramic resource procurement. Do people in middle-range societies alter resource use in response to conflict? Specifically, does social strife influence the distance to which potters in middle-range societies will travel to collect ceramic resources? Distance and quality are primary elements in clay selection. Clay is heavy, so for many potters distance is the determining factor in clay selection (Arnold 1985, 2000). Arnold (1985, 2000) estimated procurement thresholds using worldwide ethnographic data from 111 traditional societies. He found that for both clays and tempers, people prefer to travel only one kilometer, but …

The Evolutionary Ecology Of Human Infancy, Amanda Veile Jul 2011

The Evolutionary Ecology Of Human Infancy, Amanda Veile

Anthropology ETDs

Infancy is a time of profound energetic trade-offs, and in many South American native groups, infant growth is stunted and mortality by infectious disease is high. The goal of this dissertation was to explore the nature of human infancy from a life history theoretical perspective. Specifically, I investigated infant growth, feeding patterns, and thymic development in two South American native populations, the Tsimane of Bolivia and the Pumé of Venezuela. This broad goal is addressed through four specific goals: 1) to model the weaning transition using behavioral data collected in Tsimane communities where infants experience varying mortality rates, 2) to …

This research is an interpretive study of the dynamics of cultural identification as enacted by Chinese individuals living overseas who participate in a virtual online community known as Wenxuecity.com. The study draws on intercultural communication theories of identity proposed by Carbaugh, Collier, and Hecht, as well as on my own integrative framework for the analysis of cultural identity, to explore the self-other interaction in identity enactment, the multidimensionality of identity, and the centrality of communication in processes of identification. Through the application of a qualitative analysis of online discourse, I found three primary forms of cultural identification-- perceptual, strategic, and …

Small Wars Logistics: The Intervention In Haiti, 1915–1934, Jenna Schutz Jul 2011

Small Wars Logistics: The Intervention In Haiti, 1915–1934, Jenna Schutz

Department of History: Dissertations, Theses, and Student Research

Tailored to a unit’s size, scope, and mission, logistics or the practical art of transporting and supplying military forces via air, land, and sea is at the heart of any military operation. During the late nineteenth century the United States became increasingly involved in low intensity conflicts throughout Latin America and the Philippines. The nature of small wars required not only military provisions, but also supplies to help stabilize countries. The 1915 intervention in Haiti by the U.S. Marine Corps and Navy is a prime case study for the flexible bifurcation of logistical efforts to support military and civic operations. …

Monitoring Of Mesenchymal Based Constructs Using Magnetic Resonance Elastography, Evan T. Curtis Jul 2011

Monitoring Of Mesenchymal Based Constructs Using Magnetic Resonance Elastography, Evan T. Curtis

Department of Agricultural and Biological Systems Engineering: Dissertations, Theses, and Student Research

Evaluating the functionality of an engineered material lies in the proper characterization of its material and functional properties. In the treatment of musculoskeletal disorders, engineered bone or fat tissue must behave as an adequate replacement else failure of the material could result in discomfort and further surgical procedures. A significant material characteristic that reflects tissue development is the mechanical properties (i.e. shear strength and viscosity). Shear strength and viscosity provide an indication of how efficient the material is in dissipating energy. Energy dissipation occurs naturally in many tissues including fat and can prevent damage to deeper tissues. Many of the …

Multiple Levels Of Synergistic Collaboration In Termite Lignocellulose Digestion., Michael E. Scharf, Zachary J. Karl, Amit Sethi, Drion G. Boucias

Department of Entomology Faculty Publications

In addition to evolving eusocial lifestyles, two equally fascinating aspects of termite biology are their mutualistic relationships with gut symbionts and their use of lignocellulose as a primary nutrition source. Termites are also considered excellent model systems for studying the production of bioethanol and renewable bioenergy from 2nd generation (non-food) feedstocks. While the idea that gut symbionts are the sole contributors to termite lignocellulose digestion has remained popular and compelling, in recent years host contributions to the digestion process have become increasingly apparent. However, the degree to which host and symbiont, and host enzymes, collaborate in lignocellulose digestion remain poorly …

Effects Of Xenobiotics And Phytotoxins On Reproduction In Food Animals, Kip E. Panter, Bryan L. Stegelmeier Jul 2011

Effects Of Xenobiotics And Phytotoxins On Reproduction In Food Animals, Kip E. Panter, Bryan L. Stegelmeier

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

The influence of natural toxicants and anthropogenic compounds on reproduction in food animals is significant in its economic impact, and the subject requires more research and further experimental substantiation. Confounding factors such as stress, nutritional status, season of the year, animal species involved, genetic variability, disease conditions, management factors, and so forth exacerbate the difficulty of making an accurate diagnosis and thereby may impede progress to improve reproductive performance on an individual operation. The interaction between the reproductive system and xenobiotics (reproductive toxicology) is a relatively new area of study and a subject of increasing interest, especially in the area …

Electronic Theses and Dissertations

Purpose: Continuous flow (CF) left ventricular assist devices (LVAD) support diminishes vascular pressure pulsatility. Despite its recent clinical success and reliability, CF LVAD support has been associated with adverse events including gastrointestinal bleeding, aortic valve insufficiency, and hemorrhagic strokes. To overcome these limitations, we have developed flow/RPM modulation algorithms to provide vascular pulsatility using a CF LVAD. Methods: The effects of timing and synchronizing the CF LVAD flow/RPM modulation to the native ventricle, modulation amplitude, and modulation widths were studied on the native ventricle and vasculature using computer simulation, mock loop, and animal model studies. A total of over 100 …

Feasibility Of Subcutaneous Ecg Leads For Synchronized Timing Of A Counterpulsation Device., Sean P. Warren

Electronic Theses and Dissertations

Background: Emerging circulatory support devices that operate in counterpulsation to the native heart require synchronized timing of device ejection and filling on a beat-to-beat basis with the native heart using a patient's ECG. Surface leads are commonly used for short-term patient monitoring but not appropriate for long-term use, and epicardial and non-thoracotomy leads increase the complexity of the device implant/explant procedures. Subcutaneous leads have been shown to be less susceptible to artifacts than surface leads, require less invasive surgery, and have recently been used successfully with a long-term subcutaneous implantable cardioverter-defibrillator. The objective of this study was to develop subcutaneous …
