The Myth Of Buick Aspirin: An Empirical Study Of Trademark Dilution By Product And Trade Names, Paul J. Heald, Robert Brauneis
The Myth Of Buick Aspirin: An Empirical Study Of Trademark Dilution By Product And Trade Names, Paul J. Heald, Robert Brauneis
Cardozo Law Review
Trademark dilution is a highly controversial cause of action that has been the subject of hundreds of law review articles, but no significant scientific work. We analyze sixty years of telephone white pages, corporate and LLC naming data, advertisements from the New York Times, Wall Street Journal, and Washington Post, state and federal trademark databases, and all recorded dilution litigation. Our data strongly suggest that famous trademarks are frequently borrowed for use as trade names in services, but almost never as trade marks on products. Given that Congress based anti-dilution legislation on the assumption that uses like …
The Limitations Of An Economic Agency Cost Theory Of Trust Law, Lee-Ford Tritt
The Limitations Of An Economic Agency Cost Theory Of Trust Law, Lee-Ford Tritt
Cardozo Law Review
Should the donor's specific interests or potentially conflicting theoretical economic principles control the creation and administration of trusts? In a highly influential article advancing an agency cost framework for trust law, Harvard Law Professor Robert Sitkoff suggests retooling trust law to focus on wealth maximization and to minimize costs stemming from an assumed misalignment of the interests between deemed "principals" and "agents" within the trust setting. An agency cost theory of trust law, however, reduces the complex, highly idiosyncratic, and emotionally charged nature of trust law into a simple business relationship. Given the special nature of trust law and practice …

Sunday Driver/Jip3 Binds Kinesin Heavy Chain Directly And Enhances Its Motility, Faneng Sun, Chuanmei Zhu, Ram Dixit, Valeria Cavalli
Biology Faculty Research
Neuronal development, function and repair critically depend on axonal transport of vesicles and protein complexes, which is mediated in part by the molecular motor kinesin‐1. Adaptor proteins recruit kinesin‐1 to vesicles via direct association with kinesin heavy chain (KHC), the force‐generating component, or via the accessory light chain (KLC). Binding of adaptors to the motor is believed to engage the motor for microtubule‐based transport. We report that the adaptor protein Sunday Driver (syd, also known as JIP3 or JSAP1) interacts directly with KHC, in addition to and independently of its known interaction with KLC. Using an in vitro motility assay, …

An In Vitro Spectroscopic Analysis To Determine The Chemical Composition Of The Precipitate Formed By Mixing Sodium Hypochlorite And Chlorhexidine, James B. Nowicki, Daniel S. Sem
Chemistry Faculty Research and Publications
Introduction—The purpose of this in vitro study was to determine the chemical composition of the precipitate formed by mixing sodium hypochlorite (NaOCl) and Chlorhexidine (CHX), and relative molecular weight of the components.
Methods—Using commercially available chlorhexidine gluconate (CHXg), a 2% solution was formed and mixed in a 1:1 ratio with commercially available NaOCl producing a brown precipitate. The precipitate as well as a mixture of precipitate and pure chlorhexidine diacetate (CHXa) was then analyzed using 1D and 2D NMR spectroscopy.
Results—The 1D and 2D NMR spectra were fully assigned, in terms of chemical shifts of all proton …
Effects Of The Herbicide Atrazine On The Behavior Of The Checkered Gartersnake (Thamnophis Marcianus), Katie Chamberlain
Effects Of The Herbicide Atrazine On The Behavior Of The Checkered Gartersnake (Thamnophis Marcianus), Katie Chamberlain
Biology Theses
Atrazine is one of the most commonly used herbicides in the United States and one of the most popular weed-killers worldwide, being utilized in over 80 countries. Despite the effectiveness of atrazine, there has been growing concern over the potential harmful effects this chemical may have on non-target species exposed to this chemical. Few studies, however, have been performed on the effects of this chemical on reptiles, in particular snakes. This study examined the effects of environmentally relevant concentrations of atrazine on the foraging, antipredator, thermoregulatory, and courtship behaviors of the checkered gartersnake (Thamnophis marcianus). Effects of atrazine appeared negligible …
Team Collaboration In Virtual Worlds: The Role Of Task Complexity, Parichart Sattayanuwat
Team Collaboration In Virtual Worlds: The Role Of Task Complexity, Parichart Sattayanuwat
College of Business: Dissertations, Theses, and Student Research
Virtual worlds are three-dimensional, computer-generated worlds where team collaboration can be facilitated through the use of shared virtual space and mediated using avatars. In this study, we examined the effect of task complexity on team collaboration. We used a puzzle game in Second Life as the collaborative task and manipulated task component complexity by varying the number of pieces in the puzzle. We hypothesized that task complexity would influence team trust, team process satisfaction, and one‘s attraction to the team in virtual team collaboration. The experimental results indicate that task complexity has significant effects on team trust and team process …

Practical Rationality, The Disciplinary Obligation, And Authentic Mathematical Work: A Look At Geometry, Deborah Moore-Russo, Michael Weiss
Practical Rationality, The Disciplinary Obligation, And Authentic Mathematical Work: A Look At Geometry, Deborah Moore-Russo, Michael Weiss
The Mathematics Enthusiast
Grossman and McDonald (2008) recently argued that the research community needs to move its “attention beyond the cognitive demands of teaching … to an expanded view of teaching that focuses on teaching as a practice (p. 185).” Building on the work of Bourdieu (Bourdieu and Wacquent, 1992; Bourdieu, 1985, 1998), Herbst and Chazan (2003, 2006) have written about mathematics teaching as a practice, just as law and medicine are considered practices, in an attempt to better understand the rationality that produces, regulates, and sustains mathematics instruction. This practical rationality is the commonly held system of dispositions or the “feel for …
Hearts, Bellies, And The Hunger Of Heroes: Intertraditional Agonistic Discourse Between The Iliad And Odyssey, Israel Mcmullin
Hearts, Bellies, And The Hunger Of Heroes: Intertraditional Agonistic Discourse Between The Iliad And Odyssey, Israel Mcmullin
Foreign Languages & Literatures ETDs
Within this thesis I argue that the Iliad and Odyssey, as representatives of sub-genres within the larger archaic Greek epic tradition, engage in a shared agonistic discourse with one another in order to demonstrate that the hero of each epic is superior to that of its competitor. In order to trace this agonistic discourse, I examine the manner in which each epic employs the terms thumos, 'heart,' and gaster, 'belly,' to define itself in opposition to its competing epic sub-genre. Traditionally scholars have considered the Odyssey the more recent of the two epics and, thus, relying upon the Iliad. However, …
Evaluating Mitochondrial Uncoupling Potentials Of A7e And Dnp In Saccharomyces Cerevisiae : Implications For Human Obesity, Roger Vaughan
Evaluating Mitochondrial Uncoupling Potentials Of A7e And Dnp In Saccharomyces Cerevisiae : Implications For Human Obesity, Roger Vaughan
Individual, Family, and Community Education ETDs
Obesity is one of the most prevalent maladies in the United States and is a major cause of preventable death. Weight loss supplements frequently claim uncoupling as a mechanism of action. Uncoupling agents could be used for weight loss because they disrupt mitochondrial metabolism thereby reducing adenosine triphosphate (ATP) yield. Consequently, metabolic efficiency diminishes increasing basal metabolic rate. 2,4-Dinitrophenol (DNP) successfully uncouples but was banned in 1938 because of a narrow window between efficacy and toxicity. PURPOSE: To measure the ability of a blend that reportedly contains 17-dihydroxy-delta-5-etiocholane-7-one and p-methylcarbonylethylphenol and other substances (A7E), a purported uncoupling agent, to interfere …
When Knowing Just Isn't Enough: Examining The Role Of Moral Emotions In Health Decision Making Using The Theory Of Planned Behavior, Kate Duangdao
When Knowing Just Isn't Enough: Examining The Role Of Moral Emotions In Health Decision Making Using The Theory Of Planned Behavior, Kate Duangdao
Department of Psychology: Dissertations, Theses, and Student Research
A proposed integrated Theory of Planned Behavior (TPB) model aimed to examine the role of moral emotions and two health outcomes: prosocial behaviors and smoking outcomes. Based on Tangney’s work with shame and guilt-proneness, it was expected that those more prone to guilt would engage in more prosocial behaviors and those more prone to shame would engage in more smoking behaviors. Prosocial behaviors were found to be negatively associated with smoking outcomes. However, results suggested that guilt and shame-proneness seem to function similarly in predicting behavioral outcomes. Components within the TPB were generally positively correlated with each health outcome, however …
New Stable Isotope Record Of Paleoecological Change In The Late Neogene Of The Western Great Plains From Enamel In Large Mammals, Zachary Kita
Department of Earth and Atmospheric Sciences: Dissertations, Theses, and Student Research
An expansion of C4 grasslands occurred between 6 and 8 million years ago in the Great Plains of North America, as evidenced by a marked shift to more 13C-enriched carbon isotope compositions from large fossil mammal tooth enamel and paleosol carbonates. Prior to this expansion, habitats were comprised of exclusively C3 vegetation. To explore this problem I present a compilation of bulk stable carbon (δ13C) and oxygen (δ18O) isotope values from a variety of large mammals from 6 localities that span from the late Clarendonian to the late Blancan in Nebraska. As expected, …
Intervention To Increase Knowledge And Consumption Of Folate-Rich Foods Based On The Health Belief Model, Lindsay M. Labrosse
Intervention To Increase Knowledge And Consumption Of Folate-Rich Foods Based On The Health Belief Model, Lindsay M. Labrosse
Department of Nutrition and Health Sciences: Dissertations, Theses, and Student Research
Folate is important in the prevention of birth defects and in the maintenance of general health. Even after mandatory fortification, many people are still not consuming the RDA of 400 mcg/day. Consuming a diet rich in naturally high-folate foods, as opposed to supplementation, may offer additional health benefits and promote an overall healthy diet.
The purpose of this pilot study was to test the hypothesis that a learner-centered educational intervention based on the Health Belief Model (HBM) will successfully increase knowledge and consumption of folate-rich foods, while increasing positive beliefs about folate and health. A two group parallel control trial …

A Simplified Method For Analyzing Factors Contributing To Motorcyclists’ Fatal Injuries In Ohio, Deogratias Eustace, Vamsi Krishna Indupuru
Civil and Environmental Engineering and Engineering Mechanics Faculty Publications
The aim of this paper was to analyze traffic crash data by using a simplified method in determining significant factors that increase the risk of a motorcyclist being fatally injured once involved in a motorcycle crash in Ohio. The concept of overrepresentation, which is similar to relative risk, was used in identifying significant variables associated with the elevated risk of a motorcycle crash resulting into a fatality. The overrepresentation factor (ORF) was calculated for each variable of interest. The ORF offers a simple but powerful procedure of determining whether a certain factor significantly occurs more or less frequently in one …

Much Needed Reform In The Realm Of Public Morals: A Proposed Addition To The Gatt Article Xx(A) "Public Morals" Framework, Resulting From China-Audiovisual, Tyler M. Smith
Cardozo Journal of International and Comparative Law
The note examines the tension between free trade and moral considerations under the GATT and GATS frameworks, focusing on the public morals exceptions in Article XXa of the GATT and Article XIVa of the GATS. It critiques the WTO's current two-tiered jurisprudential framework, particularly the provisional justification standard, for insufficiently addressing the balance between trade restrictions and moral protections. The author proposes a more robust analytical framework requiring states invoking public morals exceptions to demonstrate substantial domestic legislative and executive efforts to protect those morals, ensuring such measures are not mere pretexts for protectionism. This approach aims to foster predictability, …

United States V. Ubs Ag: Has The United States Successfully Cracked The Vault To Swiss Banking Secrecy?, Eric M. Victorson
Cardozo Journal of International and Comparative Law
The article examines the legal and diplomatic efforts of the United States to combat tax evasion by American citizens using Swiss bank accounts, focusing on the landmark case of United States v. UBS AG. It highlights how the U.S. successfully challenged Switzerland's banking secrecy laws through treaty revisions and legal actions, ultimately achieving greater transparency and setting a precedent for international tax enforcement.
