Religious And Political Virtues And Values In Congruence Or Conflict?: On Smith, Bob Jones University, And Christian Legal Society, Linda C. Mcclain

Faculty Scholarship

A basic tension in the U.S. constitutional and political order exists between two important ideas about the relationship between civil society and the state: (1) families, religious institutions, voluntary associations, and other groups are foundational sources, or “seedbeds,” of virtues and values that undergird constitutional democracy, and (2) these same institutions guard against governmental orthodoxy and overweening governmental power by generating their own distinctive virtues and values and by being independent locations of power and authority. The first idea envisions a comfortable congruence between civil society and government: the values and virtues - and habits and skills - cultivated in …

Involuntary Servitude, Public Accommodations Laws, And The Legacy Of Heart Of Atlanta Motel V. United States, Linda C. Mcclain Jan 2011

Involuntary Servitude, Public Accommodations Laws, And The Legacy Of Heart Of Atlanta Motel V. United States, Linda C. Mcclain

Faculty Scholarship

In Heart of Atlanta Motel v. United States (1964), the U.S. Supreme Court unanimously affirmed Congress’s power under the Commerce Clause to pass Title II, the public accommodations component of the Civil Rights Act of 1964 (CRA). The Johnson Administration expressed hope that this unanimous decision would aid the “reasonable and responsible acceptance” of the CRA. A less familiar legacy of this case is the role played by the Thirteenth Amendment and its declaration that “neither slavery and involuntary servitude . . . shall exist within the United States.” The owner of the Heart of Atlanta Motel unsuccessfully invoked this …

Privacy Rights And Public Families, Khiara Bridges

Faculty Scholarship

This Article is based on eighteen months of anthropological fieldwork conducted among poor, pregnant women receiving prenatal care provided by the Prenatal Care Assistance Program (“PCAP”) at a large public hospital in New York City. The Prenatal Care Assistance Program (“PCAP”) is a special program within the New York State Medicaid program that provides comprehensive prenatal care services to otherwise uninsured or underinsured women. This Article attempts to accomplish two goals. The first goal is to argue that PCAP’s compelled consultations – with social workers, health educators, nutritionists, and financial officers – function as a gross and substantial intrusion by …

Rit Influenza Virus Database And Evidence For Differential Selection Pressures On Geographically Distinct Human Influenza A/H3n2 Virus Populations, Bindhu Satheeshkumar Jan 2011

Rit Influenza Virus Database And Evidence For Differential Selection Pressures On Geographically Distinct Human Influenza A/H3n2 Virus Populations, Bindhu Satheeshkumar

Theses

Increasing amounts of data available from influenza virus genome sequencing projects have necessitated the need for centralized repositories for the collection, integration, and dissemination of these data to researchers for further research. The RIT Influenza Virus Database, a complete genome database for influenza viruses, has been created with a web interface so that users could query for viruses of interest and download complete genome sequences and metadata of isolates. The interface of the database is publicly accessible at http://bucatini.bioinformatics.rit.edu/bindhuURMC/. Even though it is known that influenza viruses are under constant evolution at the surface glycoproteins to develop drug resistance or …

The Second Amendment As Interpreted By Congress And The Court, Sean J. Kealy Jan 2011

The Second Amendment As Interpreted By Congress And The Court, Sean J. Kealy

Faculty Scholarship

In the last two years, the U.S. Supreme Court has finally offered a reasoned interpretation of the Second Amendment. By the slimmest of majorities in District of Columbia v. Heller and McDonald v. City of Chicago, the Supreme Court held that the Second Amendment supplies an individually-held right to bear arms; the government may place reasonable restrictions on gun ownership, but neither the federal government nor an individual state can deprive a person of their right to possess a handgun. Despite many pages of opinion, however, the majority in Heller offers an unsatisfying explanation for why the Second Amendment …

As I Recall..., Megan Gulland Jan 2011

As I Recall..., Megan Gulland

Theses

This body of work presents a visual memoir of my childhood. Told through these self-portraits, this work captures the essence of my memories. Though the sculptures portray my present age as storyteller, the content comes from my childhood. I am exploring the roots of my love of storytelling by joining my passion for clay with the events of my past. The process of making these portraits, for me, closely reflects the process of growing up. In a similar way, as I built, I learned the limits and possibilities of the clay. Now, even as an adult I reflect on my …

Modeling Lean Six Sigma In The Small Packaging Industry In India, Robin Patel Jan 2011

Modeling Lean Six Sigma In The Small Packaging Industry In India, Robin Patel

Theses

This thesis is a result of my interest in implementing Lean Six Sigma into Indian packaging companies because the Indian industry is growing at 18-20% annually (Samal, 2010). This growth rate is expected to triple in the next five years. With USA outsourcing to foreign nations this substantial growth, as I envision the USA companies who are seeking India packaging materials will benefit from my original approach for converting the Indian packaging industry using Lean Six Sigma. I have a strong personal and professional desire to improve the manufacturing within India. It is the country in which I grew up …

Les Devoirs De L'Arbitre: Ni Un Pour Tous, Ni Tous Pour Un, William W. Park Jan 2011

Les Devoirs De L'Arbitre: Ni Un Pour Tous, Ni Tous Pour Un, William W. Park

Faculty Scholarship

Fans of the Alexandre Dumas novel Three Musketeers will remember that the adventure includes a fourth young man, d'Artagnan, who hopes to become one of the King’s guards, along with his friends Athos, Porthos, and Aramis, living by the motto “All for one, one for all”. Likewise, an arbitrator’s generally include four key obligation: accuracy, fairness, and efficiency, as well as vigilance in promoting an enforceable award. Prevailing litigants normally hope that the arbitral process will lead to something more than a piece of paper. To this end, they expect arbitrators to avoid giving reasons for annulment or non-recognition to …

Background: We tested the hypothesis that 5-Hydroxydecanoic acid (5HD), a putative mitoKATP channel blocker, will reverse sepsis-induced cardiodynamic and adult rat ventricular myocyte (ARVM) contractile dysfunction, restore mitochondrial membrane permeability alterations and improve survival. Methodology/Principal Findings: Male Sprague-Dawley rats (350-400 g) were made septic using 400 mg/kg cecal inoculum, ip. Sham animals received 5% dextrose water, ip. The Voltage Dependent Anion Channels (VDAC1), Bax and cytochrome C levels were determined in isolated single ARVMs obtained from sham and septic rat heart. Mitochondria and cytosolic fractions were isolated from ARVMs treated with norepinephrine (NE, 10 µmoles) in the presence/absence of 5HD …

Martha, Jeremiah B. Knapp, Samson William Smith, Kevin C. Stein, Dee R. Denver

Biology Faculty Publications and Presentations

Background: Mutations that impair mitochondrial functioning are associated with a variety of metabolic and age-related disorders. A barrier to rigorous tests of the role of mitochondrial dysfunction in aging processes has been the lack of model systems with relevant, naturally occurring mitochondrial genetic variation. Toward the goal of developing such a model system, we studied natural variation in life history, metabolic, and aging phenotypes as it relates to levels of a naturally-occurring heteroplasmic mitochondrial ND5 deletion recently discovered to segregate among wild populations of the soil nematode, Caenorhabditis briggsae. The normal product of ND5 is a central component of the …

Cd-Induced Responses In Plasma Ionic Regulation And Oxidative Stress In Rainbow Trout (O. Mykiss) Or Lake Whitefish (C. Clupeaformis) During Chronic Waterborne Exposure, Amanda Mancini Jan 2011

Cd-Induced Responses In Plasma Ionic Regulation And Oxidative Stress In Rainbow Trout (O. Mykiss) Or Lake Whitefish (C. Clupeaformis) During Chronic Waterborne Exposure, Amanda Mancini

Theses and Dissertations (Comprehensive)

During chronic exposure to Cd or other metals, freshwater fish generally undergo physiological changes that results in acclimation, following a phase of damage and subsequent repair. The mechanisms associated with deleterious cellular effects induced by Cd throughout long-term exposures are less understood than those of acute toxicity, and may relate to an over-production of reactive oxygen species. The objectives of the present study were to examine the changes in, and relationship between, tissue-specific oxidative damage and antioxidant response, as well as plasma ionic regulation and tissue accumulation, in two freshwater salmonids throughout chronic Cd exposure. Rainbow trout (O. mykiss …

Linking Cd Accumulation And Effect In Resistant And Sensitive Freshwater Invertebrates, Tony Straus Jan 2011

Linking Cd Accumulation And Effect In Resistant And Sensitive Freshwater Invertebrates, Tony Straus

Theses and Dissertations (Comprehensive)

There has been recent discussion within the field of environmental toxicology as to the viability of using the bioaccumulation of a chemical toxicant to predict toxic effects. Current literature has shown this concept to carry some merit, although there is a major flaw in that with many cases, namely those involving sensitive species, body burdens cannot be reliably linked to effects (Adams et al. (2010)). Bearing this issue in mind the goal of this thesis was to assess the viability of using bioaccumulation as a measure of effect in a different way.

The proposed idea utilized Cd accumulation in a …

The Evolution Of Sexual Reproduction In Cuscuta (Convolvulaceae), Michael Wright Jan 2011

The Evolution Of Sexual Reproduction In Cuscuta (Convolvulaceae), Michael Wright

Theses and Dissertations (Comprehensive)

Cuscuta (Convolvulaceae), the dodders, is a genus of ca. 200 species of obligate stem parasites distributed across a great diversity of habitats worldwide. The existence of a handful of species that are dangerous crop weeds has led researchers to historically focus on their growth and control. Consequently, there is a dearth of information about their biodiversity, ecology, and in particular their reproductive biology. This thesis surveys aspects of sex allocation, floral evolution, floral rewards for pollinators, and mechanisms of reproductive assurance across the genus. I demonstrate that Cuscuta has evolved a broad spectrum of breeding systems, from obligate selfing to …

This study is intended to examine the effectiveness of Muslim spiritual caregivers in the context of Canadian Muslims’ health care. Cross-sectional ethnographic research with fifteen Muslim spiritual caregivers and interviews with them were conducted.

Our results show that even though the majority of Muslim spiritual caregivers have no formal training in Western psychotherapy intervention, they nonetheless play …

Exegetical And Extispicic Readings Of The Bible In Turkana, Kenya, And North America, Kevin P. Lines Jan 2011

Exegetical And Extispicic Readings Of The Bible In Turkana, Kenya, And North America, Kevin P. Lines

The Asbury Journal

While a missional hermeneutic elucidates missiological interpretation of scripture, translation would be the key descriptive of missiological me of scripture. Articulating, a Turkana extispicic hermeneutic as both a critical and a valid process for interpreting the Bible, this paper proposes that Christians have the opportunity to engage in alternative intercontextual critical hermeneutical processes when "reading" the Bible. This engagement could reveal an ontic expansion of God-if we are able to overcome eclectic diversity and the fear of relativism. Three locations: theological institutions, missionaries, in the church, and diaspora communities are suggested for practical application of intercontextual hermeneutics.

Characterization Of Photochromogenic Mycobacterium Spp. From Chesapeake Bay Striped Bass Morone Saxatilis, D. T. Gauthier, A. M. Helenthal, M. W. Rhodes, W. K. Vogelbein, H. I. Kator

Biological Sciences Faculty Publications

A large diversity of Mycobacterium spp. has been isolated from striped bass Morone saxatilis in Chesapeake Bay, USA. The new species M. shottsii and M. pseudoshottsii are the dominant isolates, while the classical fish pathogen M. marinum is found much less frequently. M. fortuitum and M. chelonae, other Mycobacterium spp. known to commonly infect fishes, have not yet been aseptically isolated from striped bass within Chesapeake Bay. While M. pseudoshottsii and M. shottsii have been phenotypically and genotypically characterized, other less common mycobacterial isolates have not. In the present study, we describe 17 photochromogenic isolates from Chesapeake …

Ixodes Affinis (Acari: Ixodidae) In Southeastern Virginia And Implications For The Spread Of Borrelia Burgdorferi, The Agent Of Lyme Disease, Robyn M. Nadolny, Chelsea L. Wright, Wayne L. Hynes, Daniel E. Sonenshine, Holly Gaff

Biological Sciences Faculty Publications

Ixodes affinis Neumann is a hard-bodied (ixodid) tick known to be a competent vector for Borrelia burgdorferi, the agent of Lyme disease, and agents of other human diseases (Keirans et al. 1999). Ixodes affinis has been reported in Florida, Georgia, and South Carolina and throughout coastal North Carolina (Clark et al. 1998, Harrison et al. 2010). Harrison et al. (2010) indicated that I. affinis was established throughout the coastal plain of North Carolina up to the Virginia border and suggested that I. affinis might occur in Virginia.

Biological Sciences Faculty Publications

The human genome comprises approximately 8-9% of human endogenous retroviruses (HERVs) that are transcribed with tissue specificity. However, relatively few organs have been examined in detail for individual differences in HERV transcription pattern, nor have tissue-to-cell culture comparisons been frequently performed. Using an HERV-specific DNA microarray, a core HERV transcription profile was established for the human kidney comparing 10 tissue samples. This core represents HERV groups expressed uniformly or nearly so in non-tumour kidney tissue. The profiles obtained from non-tumour tissues were compared to 10 renal tumour tissues (renal cell carcinoma, RCC) derived from the same individuals and additionally, to …

The Role Of Taste And Calories In Access-Induced Excessive Sweets Consumption By The Rat, Adam Celejewski Jan 2011

The Role Of Taste And Calories In Access-Induced Excessive Sweets Consumption By The Rat, Adam Celejewski

Theses and Dissertations (Comprehensive)

For individuals diagnosed with Binge Eating Disorder (BED) or Bulimia Nervosa (BN) eating is often manifested in intermittent bouts of gorging, a behaviour that is similar to excessive consumption of rewarding drugs in addiction (American Psychiatric Association, 2000; Corwin & Grigson, 2009; Epstein & Shaham, 2010). Our laboratory has found that sucrose solution intake by rats escalates markedly when provided on Discontinuous Access (DisA; 24h once every 3 or 4 days) schedules but is maintained at lower, stable levels with Continuous Access (ConA; ad lib) schedules (Hewitt & Eikelboom, 2008). Once DisA/ConA consumption differences are established, they persist even …

Specters Of Law: Why The History Of The Legal Spectacle Has Not Been Written, Peter Goodrich Jan 2011

Specters Of Law: Why The History Of The Legal Spectacle Has Not Been Written, Peter Goodrich

Articles

The article examines the intersection of law, theology, and visual/performance elements, arguing that legal discourse often overlooks the significance of typography, imagery, and theatricality. It highlights how legal texts use formatting techniques like bold and italics to convey meaning and draws parallels with theological concepts, such as the duality of power and the role of images in governance. The analysis critiques the legal tradition for neglecting these performative aspects and emphasizes the need to recognize law as a theater that denies its own theatricality.

Trait Anxiety And Trait Disgust In Spider Phobia, Laura Vernon, Michiyo Hirai Jan 2011

Trait Anxiety And Trait Disgust In Spider Phobia, Laura Vernon, Michiyo Hirai

Psychological Science Faculty Publications

There is evidence for the role of trait anxiety in the specific phobias, and spider phobia in particular. Recently, trait disgust has received attention in relation to specific phobia and researchers and theorists have begun to address its contributions to phobia etiology, maintenance, and treatment processes. There is now strong evidence that a trait or dispositional proneness to experience disgust is related to spider phobia. What is perhaps more important is emerging evidence that both trait anxiety and trait disgust may contribute to spider phobia severity independently of one another. However, the overall picture is far from clear and distinguishing …

Corrective Justice For Civil Recourse Theorists, Scott Hershovitz Jan 2011

Corrective Justice For Civil Recourse Theorists, Scott Hershovitz

Articles

Though I think the civil recourse critique of the leading conceptions of corrective justice is in some respects misguided, I do not want to join up to the thrust and parry here. My aim in this Article is to show that there is a better conception of corrective justice than the ones that Goldberg and Zipursky target, that this conception of corrective justice is untouched by the civil recourse critique, and that civil recourse is best understood as a corrective justice account of tort. In other words, I aim to explain corrective justice for civil recourse theorists.

Disease Effects On Lobster Fisheries, Ecology, And Culture: Overview Of Dao Special 6, Donald C. Behringer, Mark J. Butler Iv, Grant D. Stentiford Jan 2011

Disease Effects On Lobster Fisheries, Ecology, And Culture: Overview Of Dao Special 6, Donald C. Behringer, Mark J. Butler Iv, Grant D. Stentiford

Biological Sciences Faculty Publications

Lobsters are prized by commercial and recreational fishermen worldwide, and their populations are therefore buffeted by fishery practices. But lobsters also remain integral members of their benthic communities where predator-prey relationships, competitive interactions, and host-pathogen dynamics push and pull at their population dynamics. Although lobsters have few reported pathogens and parasites relative to other decapod crustaceans, the rise of diseases with consequences for lobster fisheries and aquaculture has spotlighted the importance of disease for lobster biology, population dynamics and ecology. Researchers, managers, and fishers thus increasingly recognize the need to understand lobster pathogens and parasites so they can be managed …

Conservation Status Of Marine Biodiversity In Oceania: An Analysis Of Marine Species On The Iucn Red List Of Threatened Species, Beth A. Polidoro, Cristiane T. Elfes, Jonnell C. Sanciangco, Helen Pippard, Kent E. Carpenter Jan 2011

Carpenter

Biological Sciences Faculty Publications

Given the economic and cultural dependence on the marine environment in Oceania and a rapidly expanding human population, many marine species populations are in decline and may be vulnerable to extinction from a number of local and regional threats. IUCN Red List assessments, a widely used system for quantifying threats to species and assessing species extinction risk, have been completed for 1190 marine species in Oceania to date, including all known species of corals, mangroves, seagrasses, sea snakes, marine mammals, sea birds, sea turtles, sharks, and rays present in Oceania, plus all species in five important perciformfish groups. Many of …

Legal Reasoning And Scientific Reasoning, Phoebe C. Ellsworth Jan 2011

Legal Reasoning And Scientific Reasoning, Phoebe C. Ellsworth

Articles

In my presentation for the 2010 Meador Lectures on Rationality, I chose to compare legal reasoning and scientific reasoning. Both law and science pride themselves on the rationality of their intellectual methods and believe that those methods are designed to analyze questions and reach the correct conclusions by means of reason, free from cognitive or emotional biases. Of course, both law and science often fall short of this ideal at all levels, from the decisions about individual legal cases or scientific studies to the acceptance of general theories. In many ways, the biases that mislead legal and scientific thinkers are …

Habits Of Hate: A Pragmatist Analysis Of Habits Of Racism And Nativism, Terrence Macmullan Jan 2011

Habits Of Hate: A Pragmatist Analysis Of Habits Of Racism And Nativism, Terrence Macmullan

Journal of Hate Studies

There are many different ways of recognizing, describing, and combating racism. This essay extends my previously published research on the topic of whiteness and habit to advance the argument that A) racism (by which I mean primarily white supremacist racism directed against people of color) still exists as a corrosive impediment to the realization of a truly fair and democratic American community, and B) it is best understood as a network of flexible, persistent, yet correctable habits. The primary value of seeing racism in America as being a problem of bad habits rather than as conscious actions or attitudes is …
