Economic Development At The Cost Of Indigenous Land, Brian Chama Jan 2011

Economic Development At The Cost Of Indigenous Land, Brian Chama

Ethnic Studies Review

The notion of economic development has affected the general welfare of indigenous groups worldwide. The major conflict has been on land ownership claims on which they have occupied for many years and government quest to bring about economic development. The indigenous groups have struggled to retain their lands despite appealing to both customary and international laws. The paper argues as to whether customary law and international law are vital sources for indigenous land claims. It also presents empirical cases to land claims while making these arguments within the context of economic development.

Counting The Costs Of A Global Anglophonic Hegemony: Examining The Impact Of U.S. Language Education Policy On Linguistic Minorities Worldwide, Stephen M. Harper Jan 2011

Counting The Costs Of A Global Anglophonic Hegemony: Examining The Impact Of U.S. Language Education Policy On Linguistic Minorities Worldwide, Stephen M. Harper

Indiana Journal of Global Legal Studies

As the need for efficient communication between global participants in academia, business, and politics has grown in recent decades, English has quickly become the dominant universal language in these arenas. Language policy scholars have noted, however, that the rapid spread of English could present a substantial threat to the linguistic diversity of the world, as some scholars have estimated that as many as fifty percent of the world's languages will be extinct by the end of the twenty-first century. This Note argues that the United States' current stance in the area of language education will contribute to this global language …

To The Orphaned, Dispossessed, And Illegitimate Children: Human Rights Beyond Republican And Liberal Traditions, Siba N. Grovogui Jan 2011

To The Orphaned, Dispossessed, And Illegitimate Children: Human Rights Beyond Republican And Liberal Traditions, Siba N. Grovogui

Indiana Journal of Global Legal Studies

After the Helsinki Accords, the collapse of the Soviet Union and its empire, and the collapse of states in Africa and elsewhere, many in the West have come to envisage the enforcement of human rights as a practical matter. Human rights are thus incorporated in normative regimes under the rubrics of either the rule of law or the responsibility to protect to be held against the purveyors of violence. I do not discount the normative underpinnings of the related stands taken today by states and transnational and national civil society organizations. I wish to insist on the futility of envisaging …

The Human Right To Health And Hiv/Aids: South Africa And South-South Cooperation To Reframe Global Intellectual Property Principles And Promote Access To Essential Medicines, Erika George Jan 2011

The Human Right To Health And Hiv/Aids: South Africa And South-South Cooperation To Reframe Global Intellectual Property Principles And Promote Access To Essential Medicines, Erika George

Indiana Journal of Global Legal Studies

The HIV/AIDS pandemic has had a devastating and disproportionate impact in countries of the Global South. The experience of an individual infected with HIV in Africa is very different than that of an individual infected with HIV in America. Life expectancy varies sharply. The ability or inability to access medicines essential for treatment accounts for much of the variance. This article examines how the rhetoric of human rights used in the context of South Africa's AIDS crisis resonated across the Global South, resulted in a powerful social movement for access to medicines, and contributed to important changes in international intellectual …

"Cultural Fatigue": The State And Minority Rights In Botswana, Jacqueline Solway Jan 2011

"Cultural Fatigue": The State And Minority Rights In Botswana, Jacqueline Solway

Indiana Journal of Global Legal Studies

The circulation and intersection of supranational rights, discourses, and practices with local struggles have contributed to victories, disappointments, and in many instances, new articulations and understandings of rights for local people. In Botswana, the everincreasing interaction of minority groups with international institutions, laws and conventions, nongovernmental groups (NGOs), and the Botswana courts has created a dialectic that continues to reshape vernacular rights discourses. The state has also been a party in this evolving dialectic and has found new means of intervening in the process. The Botswana state prides itself on its liberal practices and has received international acclaim as a …

The Impact Of The User Interface On Simulation Usability And Solution Quality, Bruce Ray Montgomery Jan 2011

The Impact Of The User Interface On Simulation Usability And Solution Quality, Bruce Ray Montgomery

CCAC Theses and Dissertations

This research outlines a study that was performed to determine the effects of user interface design variations on the usability and solution quality of complex, multivariate discrete-event simulations. Specifically, this study examined four key research questions: what are the user interface considerations for a given simulation model, what are the current best practices in user interface design for simulations, how is usability best evaluated for simulation interfaces, and specifically what are the measured effects of varying levels of usability of interface elements on simulation operations such as data entry and solution analysis. The overall goal of the study was to …

Humanized Mouse Models Of Hiv Infection, Paul W. Denton, J. Victor Garcia Jan 2011

Humanized Mouse Models Of Hiv Infection, Paul W. Denton, J. Victor Garcia

Biology Faculty Publications

Because of the limited tropism of HIV, in vivo modeling of this virus has been almost exclusively limited to other lentiviruses such as SIV that reproduce many important characteristics of HIV infection. However, there are significant genetic and biological differences among lentiviruses and some HIV-specific interventions are not effective against other lentiviruses in non-human hosts. For these reasons much emphasis has recently been placed on developing alternative animal models that support HIV replication and recapitulate key aspects of HIV infection and pathogenesis in humans. Humanized mice, CD34+ hematopoietic progenitor cell transplanted immunodeficient mice and in particular mice also implanted with …

Read-The-Bill Rule For Congress, A, Hanah Metchis Volokh Jan 2011

Read-The-Bill Rule For Congress, A, Hanah Metchis Volokh

Missouri Law Review

In response to recent high-profile instances of rushed legislation, a political movement has formed to urge legislators to read bills before voting on them. In this Article, I argue that legislators have a duty to read the text of proposed legislation before voting to enact it. Putting aside partisan concerns, a rushed legislative process creates real problems because it forces legislators to vote on bills without having time to properly evaluate the new legal rules that are being imposed on citizens. If a rule or norm of reading the bill can slow the legislative process enough to provide for thorough …

Kindred And A Canticle For Leibowitz As Palimpsestic Novels, Sue Vander Hook Jan 2011

Kindred And A Canticle For Leibowitz As Palimpsestic Novels, Sue Vander Hook

All Graduate Theses, Dissertations, and Other Capstone Projects

This thesis is an investigation of a possible new categorization under the speculative fiction umbrella—a genre called palimpsestic novels. Palimpsestic novels are characterized by layers of time in the past, the present, and sometimes the future. In a fantastical setting, often with nonscientific time travel, the layers illuminate and provide contemporary significance to eras of history that have either become blurred or forgotten through time. The formation of a palimpsestic genre will provide an appropriate categorization for some speculative fiction novels that currently are nebulous mixtures of several genres, have no genre classification at all, or would better fit in …

Implementing A Sheltered Science Course In An Iowa High School, Erin Holt Johnson Jan 2011

Implementing A Sheltered Science Course In An Iowa High School, Erin Holt Johnson

All Graduate Theses, Dissertations, and Other Capstone Projects

English Learners (ELs) entering U.S. schools at the high school level face the enormous challenge of acquiring academic literacy as well as secondary-level content in a relatively short period of time. This difficulty is compounded by the fact that a significant number of the ELs entering at the secondary level are students with limited or interrupted formal educations as a result of family migrations, unequal schooling in their home countries, political unrest or even war. In response to this pressing need to teach language and content simultaneously, many school districts are adopting the sheltered instruction (SI) model. This paper will …

The Limits Of Reproductive Rights In Improving Women's Health, Rachel Rebouché Jan 2011

The Limits Of Reproductive Rights In Improving Women's Health, Rachel Rebouché

UF Law Faculty Publications

South Africa's Choice on Termination of Pregnancy Act (CTOPA) is heralded as one of the most progressive abortion laws in the world. The law permits unfettered access to government-funded abortion services for all women through the twelfth week of gestation, stating in its preamble that "every woman [has] the right to choose whether to have an early, safe and legal termination of pregnancy according to her individual beliefs." Despite increased availability of legal abortions' (and the inclusion of rights to reproductive health care and decision-making in South Africa's Constitution), the number of illegal terminations in South Africa does not appear …

Protecting Equine Rescue From Being Put Out To Pasture: Whether Ranches Dedicated To Abused, Abandoned, And Aging Horses May Qualify For "Agricultural" Classifications Under Florida's Greenbelt Law, Michael T. Olexa, Joshua A. Cossey, Katherine A. Smallwood Jan 2011

Smallwood

UF Law Faculty Publications

Florida's equestrian community is currently experiencing an influx of horse owners and equestrian facilities. This generates opposition within those counties refusing to recognize equestrian property uses as “agricultural.” Subject to the restrictions set out in section 193.461 of the Florida Statutes (otherwise known as the Greenbelt Law) only property “used primarily for bona fide agricultural purposes shall be classified agricultural.” This article addresses whether the use of property to board, train, and graze abused, abandoned, and aging horses (referred to throughout this paper as “rescue” horses) should fall under the Greenbelt Law‟s “agricultural” tax classification. Several points support classifying rescue …

Ancient Laws, Yet Strangely Modern: Biblical Contract And Tort Jurisprudence, Richard H. Hiers Jan 2011

Ancient Laws, Yet Strangely Modern: Biblical Contract And Tort Jurisprudence, Richard H. Hiers

UF Law Faculty Publications

People generally, and even most biblical scholars, tend to view biblical law as, at best, a random patchwork of odd and antiquated commandments and rules. The present Article demonstrates that many biblical laws can be understood to have functioned in biblical time, in ways remarkably similar to various laws characterized in modern Anglo-American jurisprudence as contract and tort law. In particular, the Article points out that the biblical tort laws found in Exodus 21:18 through 22:17 are structured along lines closely parallel to concepts found in modern tort law jurisprudence. Many of the biblical laws considered here give expression to …

The Limitations Of An Economic Agency Cost Theory Of Trust Law, Lee-Ford Tritt Jan 2011

The Limitations Of An Economic Agency Cost Theory Of Trust Law, Lee-Ford Tritt

UF Law Faculty Publications

Should the donor's specific interests or potentially conflicting theoretical economic principles control the creation and administration of trusts? In a highly influential article advancing an agency cost framework for trust law, Harvard Law Professor Robert Sitkoff suggests retooling trust law to focus on wealth maximization and to minimize costs stemming from an assumed misalignment of the interests between deemed "principals" and "agents" within the trust setting. An agency cost theory of trust law, however, reduces the complex, highly idiosyncratic, and emotionally charged nature of trust law into a simple business relationship. Given the special nature of trust law and practice-where …

Ultrastructural Localisation Of Chromium In Ocimum Basilicum, Roya Bishehkolaei, Hamid Fahimi, Sara Saadatmand, Taher Nejadsattari, Mehrdad Lahouti, Forouzan Tabatabaei Yazdi

Turkish Journal of Botany

Ocimum basilicum L. seedlings were exposed to different concentrations of Cr (0-8 mg L^{-1} of Cr^{3+}) to evaluate the cellular localisation of chromium, plant accumulating capacity, and potential cellular defence mechanisms against Cr stress. Dried plant tissues (roots and shoots) were exposed to X-ray microanalysis for element determination (including Cr, Cu, Zn, Co, Ni, and Mo). Results showed that the highest amount of Cr had accumulated in the roots of the plants treated with 8 mg L^{-1} of Cr^{3+}, while less Cr was transported to the shoots. TEM micrographs of Ocimum basilicum root cortex cells exposed to 4, 6, and …

Author Meets Reader, Scholar Meets Worker: An Introduction To The Section On Labor Relations And Employment Law 2011 Aals Panel Presentation, Rachel Arnow-Richman

UF Law Faculty Publications

This article introduces the AALS Section on Labor Relations & Employment’s January 2011 Program, 'Author Meets Reader: Jack Getman’s Restoring the Power of Unions,' while exploring the significance of the contemporaneous union boycott of the Union Square Hilton, the primary site of the AALS 2011 Meeting. When the national leadership of the AALS proved unresponsive to UNITE HERE’s entreaties, a group of interested law professors undertook to convince the organization to relocate its conference using a combination of direct appeals to AALS leadership and grassroots mobilization of faculty attendees. Like many of the union movements described in Jack Getman’s monograph …

Comparison Genomics Of Oryza Rufipogon Chromosome Eight Centromere With Other Species Centromeres, Kalyani Ginjupalli

Theses, Dissertations and Culminating Projects

Centromeres are playing a key role in proper segregation of sister chromatids during mitosis and meiosis. At the centromere region in the chromosome, spindle microtubules attached to the kinetochores that direct the chromosome segregation during mitosis and meiosis. Although centromeric function is conserved among different organisms, there is no conservation of centromeric DNA sequences ranging from budding yeast which has a consensus sequence of approximately 125 base pairs (bp) on each chromosome to Caenorhabditis elegans species which has a holocentric centromere that spans the entire chromosome. However, there are some common proteins that form the kinetochore, such as CENH3 and …

An Examination Of The Emerging Feminist Voice In Zora Neale Hurston's Their Eyes Were Watching God And Kate Chopin's The Awakening, Fran Shultz Jan 2011

An Examination Of The Emerging Feminist Voice In Zora Neale Hurston's Their Eyes Were Watching God And Kate Chopin's The Awakening, Fran Shultz

Theses, Dissertations and Culminating Projects

Zora Neale Hurston and Kate Chopin lived and wrote in different eras, but each woman was ahead of her time in terms of her depiction of women s roles and responsibilities in the patriarchal societies in which she lived. Due to the similarities in the feminist themes depicted by the female protagonists in Hurston s Their Eyes Were Watching God and Chopin’s The Awakening, this paper will trace the beginnings of a distinctly feminist voice emerging through these two works. Hurston’s portrayal of Janie’s journey to achieve autonomy represents the empowerment of the nascent African- American female voice within the …
