Natural instream flow regimes are necessary for the ecological health of streams, including the maintenance of healthy fish populations. Economic interests such as agriculture, mining, and other industries remove water from streams, which can negatively affect fish populations. Wintertime diversions of water affect autumn-spawning salmonids such as brown trout and bull trout; they occur at the critical egg-to-fry development phase, possibly reducing oxygen flow to the eggs and increasing the rate of sub-gravel freezing. Since the turn of the twentieth century, mining activities have contaminated the floodplain and streambed of Silver Bow Creek, Montana, resulting in a streambed devoid of life and severely contaminated with heavy metals. In the mid nineteen seventies, up-stream water treatment facilities were upgraded and water quality improved, bringing benthic invertebrates back to reaches of Silver Bow Creek. The extent and concentration of toxicants in and around the streams of the Upper Clark Fork River Basin resulted in the designation of over 100 miles of river as Federal Superfund sites. The application of non-metric forensic anthropological techniques produces results that are sometimes not always scientifically valid. Using the commonly accepted techniques to produce a biological profile (age, sex, ancestry, height, pathology and trauma), an application of the methods is utilized and critiqued in the analysis of The University of Montana forensic case 29 (UMFC 29). Using the accepted techniques in forensic anthropology, UMFC 29 was identified as a Black Male with an age range of 35-65 years and a height of 5’3’’-5’6’’. The context of this thesis is the long-debated issue of whether or not adult second language (L2) development is basically similar to child first language (L1) development. The thesis approaches the issue through research dealing with L1 acquisition of Chinese classifiers and a pilot study of L2 adult classifier acquisition. First, evidence that children acquire specific classifiers earlier than measure classifiers is discussed and explained in light of existing language learning theories. There are millions of acres of forestland in the Western United States that could benefit from fuel reduction treatments to improve forest health and reduce wildfire fuels. These treatments generate forest residues that are typically piled and burned. However, with increasing concerns about energy security, high oil prices, air quality from pile burning and climate change, there is great interest in examining ways to economically use these residues as a renewable energy source. Located in southeastern Montana, the Northern Cheyenne Reservation sits within the Powder River Basin energy development boundary. The Northern Cheyenne Tribe (Tribe) has had a long history of resisting energy development on the reservation. The Tribe has also opposed off-reservation development that impacts reservation water, air, and cultural resources. Current coal bed methane and coal mine developments near the reservation threaten the quality of life for the Northern Cheyenne people. Citizen science programs that use trained volunteers may be a cost-effective method for monitoring wildlife at large spatial and temporal scales. However, few studies have compared inferences made from data collected by volunteers to professionally collected data. In Glacier National Park (GNP), Montana, I assessed whether citizen science is a useful method to monitor mountain goat (Oreamnos americanus) populations. I compared estimates of mountain goat abundance by volunteers at 32 sites throughout GNP to estimates by biologists and raw counts from aerial surveys at a subset of 25 and 11 sites, respectively. When applying prescribed fire to long-unburned but fire-dependent ecosystems managers require better decision-support models to determine appropriate conditions for achieving desired effects. Prolonged combustion in duff accumulations at the base of large conifers can lead to fine root mortality, cambial injury, enhanced susceptibility to bark beetle attack, and possibly tree death. Pre-burn sampling to predict duff mound consumption from measurable attributes is vital in order to limit the deleterious effects of prolonged smoldering combustion. Bartonella quintana, a Gram-negative bacterial pathogen, causes Trench fever, bacillary angiomatosis and endocarditis. Transmitted by the human body louse (Pediculus humanus corporis), the agent has a tropism for erythrocytes in humans. In vitro growth requires an extraordinary concentration of hemin, and genomic analyses indicate several potential uptake systems and iron-responsive regulators. Transcription of the hbp genes (hemin binding protein genes) is responsive to alterations in available hemin and an HbpA homolog in B. henselae reportedly functions as a hemin receptor in E. coli hemA strain EB53. B. quintana hbpA was not able to complement EB53, indicating that …

In the summer of 2003, the University of Idaho conducted an archaeological field school at the Nora Creek site under the direction of Dr. Mark Warner at a Swedish homestead just east of Troy, Idaho. The field school unearthed a plethora of historical artifacts including metal, glass, ceramic, and faunal items left behind by the inhabitants of the Johanson homestead in Nora, Idaho. Historical documentation indicates that the Johansons immigrated to America from Sweden in 1882 and they arrived in Nora in 1891. Currently, the lack of accurate in situ pH measurements limits our understanding of natural pH variability. In order to predict future pH changes in the oceans, quality high temporal resolution pH data are needed. This work used the newly developed Submersible Autonomous Moored Instrument for pH (SAMI-pH), a fully autonomous, in situ spectrophotometric pH sensor, to study oceanic pH variability. The recovery of a scorifier, or roasting dish, at Feature 131 in Coloma, Montana led to the theory that the feature represented an assayer’s household. Historical documentation, in the form of a personal diary, revealed that the assayer at Coloma, Chester Pray, shared a cabin with another man. This revelation led to a particular question: what would the material record of an all-male household look like? Advertising as a field has long been required to pay for itself---money spent reaching potential consumers will evaporate if that potential is not realized. Academic marketers look at advertising through a traditional lens, measuring input (advertising) and output (purchases) with methods from TV and print advertising. In the literature on "new governance" forms of regulation, the blurring of traditional boundaries is a pervasive but largely implicit theme. This Article makes this theme explicit, and argues that the capacity to blur boundaries is one of new governance's signature strengths. New governance regulation frequently blurs the roles of regulatory actors, the stages of regulation, the modes of regulation, the functions of a regulatory regime; and the structure of the regulatory regime. Federalism At The Cathedral: Property Rules, Liability Rules, And Inalienability Rules In Tenth Amendment Infrastructure, Erin Ryan

This Article explores the consequences for good governance of poorly constructed legal infrastructure in the Tenth Amendment context, and recommends a simple jurisprudential fix: exchanging a property rule for the inalienability remedy rule that the Supreme Court used to protect the anticommandeering entitlement in New York v. United States. Grounded in a values-based theory of American federalism, it shows how the New York inalienability rule unnecessarily removes tools for resolving interjurisdictional quagmires - exemplified by the radioactive waste capacity problem at the heart of the New York litigation - by prohibiting novel forms of state-federal bargaining. Comparative civil procedure has had little influence in American jurisprudence and commentary, in part because of American procedure's deep and widespread exceptionalism. But this may be changing, at least in certain areas. The American notice pleading standard, for example, which has long been considered exceptional, shows signs of trending toward the fact pleading models of foreign countries. Congressional experimentation with heightened pleading in statutes such as the Private Securities Litigation Reform Act and the Supreme Court's recent pronouncements in Iqbal v. This study examined the relationship between discourse, identity and culture within the diverse membership of the Muslim Students Association, University of Montana. Previous organizational identity research has discussed how identity is fluid, how identity regulation occurs between the organization and membership, and that identity is formed through discourses. Additionally, the literature also shows us how these identity influencing discourses are themselves influenced by culture. One of the themes weaving in and out of Sir Gawain and the Green Knight is that of virtue: Gawain’s shield proclaims his virtue, yet at the end of the Green Chapel scene, he exclaims vice has destroyed his virtue, leaving him “faulty and false.” This scene has troubled critics and students, however, for many consider his reaction excessive for his default on the rules of a courtly game. The present paper contends that the notion of virtue written for Gawain naturalizes embodied virtue. Medieval studies today may be precisely characterized by quidditas. The Aristotelian term quidditas became central to the development of medieval scholastic inquiry in the West when, in 1066 Anselm of Canterbury wrote the Monologion. This eleventh-century foray into the revival of Aristotelian thought is also seen in Porphyry’s third-century translations of Aristotle and in Boethius’ sixth-century concern with universals elaborated in his commentaries on universals and categories. For Anselm and the developing model of medieval scholastic thought, the Monologion and its immediate successor, the Proslogian, assert a double discourse of the difference between quidditas and haeccitas, …

Saints And The Social Order: Alexander Barclay’S The Life Of St. George, Maggie Gallup Kopp

This paper examines The Life of St. George, Alexander Barclay’s 1515 translation of a humanist Latin prose poem. Barclay, who styled himself a laureate in the tradition of Lydgate, adapts laureate poetic practice in order to address a noble audience in a bid to gain court patronage. Barclay’s emendations and additions transform the hagiography of England’s patron saint into a commentary on traditional English ideals of citizenship and good governance, aimed at an audience comprised of both common citizens and noble elites, including, as this paper argues, the young king Henry VIII.

In 1822, the American actor, poet, and playwright John Howard Payne wrote a song called “Home! Sweet Home!” It became an instant hit, and its refrain, “[b]e it ever so humble, there's no place like home,” has become etched in our cultural memory. The author L. Frank Baum echoed this sentiment with a twist at the end of his novel The Wonderful Wizard of Oz.
