Aesthetics And The Philosophy Of Art, 1840-1900, Gary Shapiro Jan 2010

Aesthetics And The Philosophy Of Art, 1840-1900, Gary Shapiro

Philosophy Faculty Publications

The question can be raised whether the category or discipline of philosophical aesthetics existed before the eighteenth century. Unlike "logic:' "ethics:' and "physics:' a traditional Stoic division of philosophy with great staying power, "aesthetics" is clearly a product of modernity. As Paul O. Kristeller demonstrated in "The Modern System of the Arts:' it was in the eighteenth century that the idea of the aesthetic as a distinctive human capacity and the parallel consolidation of the notion of the fine arts crystallized in the writings of (mostly) French, German, and English philosophers and critics. The modern concepts of art and aesthetics …

Prolonged Injustice In Urban America, Jametta Magwood, Edith M. Williams, Saundra H. Glover Jan 2010

Prolonged Injustice In Urban America, Jametta Magwood, Edith M. Williams, Saundra H. Glover

Faculty Publications

Environmental inequality is the suggestion that the working class, the poor, persons of color, and ultimately the economically disadvantaged are subjected to living conditions that may prove to be hazardous both personally, professionally, and also to the infrastructure of the urban communities that these people inhabit. These injustices affect not only housing but education, quality healthcare access, and access to employment. This article investigates the distinct relationship of environmental inequalities imposed in urban communities that are promoted by a prominent institution: the government. It has been suggested that the government is primarily controlled by individuals who are incapable of identifying …

Reproduction, Distribution, And "Making Available", James Gibson Jan 2010

Reproduction, Distribution, And "Making Available", James Gibson

Law Faculty Publications

When an individual makes a music or movie file available for downloading by others, without the permission of the copyright owner, is that an infringing act? Or does infringement take place only when the file is actually downloaded?

This thorny copyright issue is at the heart of much of the controversy over file-sharing. It’s relatively simple for a copyright owner to prove that a file has been made available for download, but it’s much harder to prove that a download has actually occurred. So if liability attaches to the mere act of “making available,” record labels and movie studios will …

Quantifying Individual Potential Contributions Of The Hybrid Sulfur Electrolyzer, John A. Staser, Maximilian B. Gorensek, John W. Weidner Jan 2010

Quantifying Individual Potential Contributions Of The Hybrid Sulfur Electrolyzer, John A. Staser, Maximilian B. Gorensek, John W. Weidner

Faculty Publications

The hybrid sulfur cycle has been investigated as a means to produce clean hydrogen efficiently on a large scale by first decomposing H2SO4 to SO2, O2, and H2O and then electrochemically oxidizing SO2 back to H2SO4 with the cogeneration of H2. Thus far, it has been determined that the total cell potential for the hybrid sulfur electrolyzer is controlled mainly by water transport in the cell. Water is required at the anode to participate in the oxidation of SO2 to H2SO4 …

Evaluation Of Testing And Implementation Of Evidence-Based Rn Bedside Swallow Screen For Dysphagia: A Clinical Practice Change, Edith Matesic Jan 2010

Evaluation Of Testing And Implementation Of Evidence-Based Rn Bedside Swallow Screen For Dysphagia: A Clinical Practice Change, Edith Matesic

DNP Projects

Stroke patients initially experience dysphagia approximately 42 - 67% of the time with noted improvement reducing rates to approximately 43% at seven days post-acute event (Perry & Love, 2001). The dysphagia experienced by these patients makes them at high risk to develop aspiration pneumonia. Overall, the financial impact of reducing aspiration pneumonia reduces the national cost of morbidity, mortality, and disability burden in this population. There is no generally recognized swallow screen. Program evaluation objectives were to establish a valid, reliable, cost effective, and easy to administer evidence RN bedside swallow screen for dysphagia to keep acute stroke patients safe …

From a technical perspective, future research will need to explore the viability of tools specifically designed to facilitate the semantic annotation of …

The Use Of Organizational Behavior Management In Training Applied Behavior Analysis Methods In Residential Settings: A Review, Katherine M. Stegman Jan 2010

The Use Of Organizational Behavior Management In Training Applied Behavior Analysis Methods In Residential Settings: A Review, Katherine M. Stegman

Research Papers

Applied behavior analysis has a long history of success in showing therapeutic gains within human service settings. The need to train all types of staff in behavior analytic methods is crucial to the continuation of this tradition. Research has shown organizational behavior management (OBM) to be effective in teaching others to implement behavior analytic programs. However, OBM appears to be largely absent from human service settings. The present research paper reviews the literature in this area, examines trends, and makes suggestions for future research.

The Impact Of Task Conflict On Virtual Team Performance And Cohesiveness, Wilawan Onkman, Anil Ustun, Pilar Pazos, Ana Maria Canto

Engineering Management & Systems Engineering Faculty Publications

This paper examined the impact of task conflict on team performance and cohesiveness. Twelve virtual teams participated in two sessions with two difficulty levels. Each task consisted of a survival simulation. Teams communicated using a text-based communication media (chat). A mixed methods approach combining both quantitative and qualitative data was used. Performance was measured using expert ratings, and cohesiveness was measured using a modified version of Seashore's Cohesiveness Index. Content analysis was utilized to evaluate the level of task conflict on the team. This study provides some initial evidence on the effects task conflict on virtual team performance.

Dopamine Modulates The Lateral Giant Neuron And Serotonergic Facilitation In Crayfish, Joshua Scott Titlow Jan 2010

Dopamine Modulates The Lateral Giant Neuron And Serotonergic Facilitation In Crayfish, Joshua Scott Titlow

Theses, Dissertations and Capstones

The lateral giant (LG) neural circuit is a model system used to study the function of individual neurons. The LG circuit is part of a tail flip escape reflex that is a defensive behavior for crayfish. This thesis begins by addressing the effects of dopamine (DA), a neurotransmitter involved in normal and abnormal behaviors of most animals. Here it is shown that dopamine decreases the excitability of the LG neuron, a trigger for the escape reflex. An electrophysiology protocol was used to mimic sensory input to the LG neuron. Stimulating a sensory nerve in the last ganglion with an electrode …

John Chrysostom, Maruthas And Christian Evangelism In Sasanian Iran, Walter Stevenson Jan 2010

John Chrysostom, Maruthas And Christian Evangelism In Sasanian Iran, Walter Stevenson

Classical Studies Faculty Publications

Neither John Chrysostom’s efforts to evangelize in Sasanid Persia nor the conflict fought between Rome and Persia in 421 have drawn a great deal of attention.1 So this paper will attempt to navigate the 20 years from John’s initial efforts up to the outbreak of the war without much modern support. Beginning from a series of clues in ancient sources I will try to gather apparently unrelated narratives into a story of how John inadvertently contributed to the even that Kenneth Holum called ‘Pulcheria’s Crusade’. Not that this war earned any of the historical significance of the later crusades. …

Background:Cultural and ethnic roots impact women’s fertility and delivery preferences This study investigated whether the likelihood of cesarean delivery, primary cesarean, and vaginal delivery after cesarean (VBAC) varies by maternal national origin.

Mehods: We conducted a nation-wide, population-based, observational study using secondary data from Taiwan. De-identified data were obtained on all 392,246 singleton live births (≥500 g; ≥20 weeks) born to native-born Taiwanese, Vietnamese and mainland Chinese-born mothers between January 1 2006 and December 31 2007 from Taiwan’s nation-wide birth certificate data. Our analytic samples consisted of the following: for overall cesarean likelihood 392,246 births, primary cesarean 336,766 (excluding …

Rethinking Adverse Possession: An Essay On Ownership And Possession, Carol N. Brown Jan 2010

Rethinking Adverse Possession: An Essay On Ownership And Possession, Carol N. Brown

Law Faculty Publications

In the wake of the present real estate crisis, there has been prolonged discussion of the wrongdoing that led to systemic failures in the national real estate market. The mortgage crisis caught the nation’s attention because of its large scale and its rippling effect throughout the economy. Equally nefarious is the impact of adverse possession on the rights of individual property owners. While a single adverse possession does not affect the national market in the same way as the mortgage crisis did, to the individual owner, the wrongdoing, in the form of a trespass, that ripens into title, is just …

The Origins Of The Privileges Or Immunities Clause, Part I: “Privileges And Immunities” As An Antebellum Term Of Art, Kurt T. Lash Jan 2010

The Origins Of The Privileges Or Immunities Clause, Part I: “Privileges And Immunities” As An Antebellum Term Of Art, Kurt T. Lash

Law Faculty Publications

Historical accounts of the Privileges or Immunities Clause of Section One of the Fourteenth Amendment generally assume that John Bingham based the text on Article IV of the original Constitution and that Bingham, like other Reconstruction Republicans, viewed Justice Washington’s opinion in Corfield v. Coryell as the definitive statement of the meaning of Article IV. According to this view, Justice Miller in the Slaughterhouse Cases failed to follow both framers’ intent and obvious textual meaning when he distinguished Section One’s privileges or immunities from Article IV’s privileges and immunities.

A close analysis of antebellum law, however, suggests that Justice Miller’s …

An Efficient Electrochemical–Thermal Model For A Lithium-Ion Cell By Using The Proper Orthogonal Decomposition Method, Long Cai, Ralph E. White Jan 2010

An Efficient Electrochemical–Thermal Model For A Lithium-Ion Cell By Using The Proper Orthogonal Decomposition Method, Long Cai, Ralph E. White

Faculty Publications

The proper orthogonal decomposition method was applied to develop an efficient, reduced order electrochemical–thermal model for a lithium-ion cell. This model was validated for discharge simulations over a wide range of C rates and various cooling conditions of the cell. The reduced order model agrees well with the COMSOL model, a commercial finite element method solver, and requires times less computation time than the COMSOL model. The model predictions indicate that the discharge time or percent of capacity removed from the cell at an end of discharge voltage of 3.0 V depends on the rate of the discharge and heat …

Maximizing The Life Of A Lithium-Ion Cell By Optimization Of Charging Rates, Saeed Khaleghi Rahimian, Sean Rayman, Ralph E. White Jan 2010

Maximizing The Life Of A Lithium-Ion Cell By Optimization Of Charging Rates, Saeed Khaleghi Rahimian, Sean Rayman, Ralph E. White

Faculty Publications

Using a dynamic optimization method, the optimum charge currents as a function of cycle number during cycling for the lithium-ion cell are obtained. A single particle physics-based model, which includes capacity fade, was applied to simulate the cell performance under low earth-orbit (LEO) cycling conditions. Useful cell life is defined as the number of cycles before the end of discharge voltage drops below 3.0 V or the cell discharge capacity becomes less than 20% of the original discharge capacity. The simulated useful cell life can be increased by ∼29.28% by varying the charge current.

Theoretical Analysis Of Stresses In A Lithium Ion Cell, Sindhuja Renganathan, Godfrey Sikha, Shriram Santhanagopalan, Ralph E. White Jan 2010

Theoretical Analysis Of Stresses In A Lithium Ion Cell, Sindhuja Renganathan, Godfrey Sikha, Shriram Santhanagopalan, Ralph E. White

Faculty Publications

A mathematical model to simulate the generation of mechanical stress during the discharge process in a dual porous insertion electrode cell sandwich comprised of lithium cobalt oxide and carbon is presented. The model attributes stress buildup within intercalation electrodes to two different aspects: changes in the lattice volume due to intercalation and phase transformation during the charge/discharge process. The model is used to predict the influence of cell design parameters such as thickness, porosity, and particle size of the electrodes on the magnitude of stress generation. The model developed in this study can be used to understand the mechanical degradation …

Multimetallic Electrocatalysts Of Pt, Ru, And Ir Supported On Anatase And Rutile Tio2 For Oxygen Evolution In An Acid Environment, Roderick E. Fuentes, Jake Farell, John W. Weidner Jan 2010

Multimetallic Electrocatalysts Of Pt, Ru, And Ir Supported On Anatase And Rutile Tio2 For Oxygen Evolution In An Acid Environment, Roderick E. Fuentes, Jake Farell, John W. Weidner

Faculty Publications

Anatase and rutile TiO2 were investigated as stable supports for different multimetallic nanoparticles (i.e., Pt:Ru, Pt:Ir, Pt:Ru:Ir, and Ir:Ru) and tested for activity toward the oxygen evolution reaction (OER). Overall, Ir:Ru had the highest activity toward OER (i.e., current per gram of metal) compared to the other multimetallic combinations studied. This bimetallic supported on anatase TiO2 had a 53% higher current per gram of metal than an unsupported electrocatalyst of the same composition. The higher catalyst utilization of the supported electrocatalysts for OER is consistent with small, well-dispersed nanoparticles, which were observed in high resolution transmission electron microscopy images.

Modeling The Noble Metal/Tio2 (110) Interface With Hybrid Dft Functionals: A Periodic Electrostatic Embedded Cluster Model Study, Salai Cheettu Ammal, Andreas Heyden Jan 2010

Modeling The Noble Metal/Tio2 (110) Interface With Hybrid Dft Functionals: A Periodic Electrostatic Embedded Cluster Model Study, Salai Cheettu Ammal, Andreas Heyden

Faculty Publications

The interaction of Aun and Ptn (n=2,3) clusters with the stoichiometric and partially reduced rutile TiO2 (110) surfaces has been investigated using periodic slab and periodic electrostatic embedded cluster models. Compared to Au clusters, Pt clusters interact strongly with both stoichiometric and reduced TiO2 (110) surfaces and are able to enhance the reducibility of the TiO2 (110) surface, i.e., reduce the oxygen vacancy formation energy. The focus of this study is the effect of Hartree–Fock exchange on the description of the strength of chemical bonds at the interface of Au/Pt clusters and the TiO2 (110) surface. Hartree–Fock exchange helps describing …

Child Custody: Don't Worry, A Bet Din Can Get It Right, Jeffrey Haberman Jan 2010

Child Custody: Don't Worry, A Bet Din Can Get It Right, Jeffrey Haberman

Cardozo Journal of Conflict Resolution

This Note aims to explore the reasoning behind the state's reluctance to accept arbitration, including that of the bet din, as a means of resolving child custody disputes. The Note highlights the advantages of arbitration, both in general and when used to determine child custody. The Note examines the arguments proffered by the courts to justify the view that they, and not outside arbitrators, best resolve child custody battles. This Note argues that when two parties agree to arbitrate their divorce settlement before a bet din, the award should be given the same deference as a bet din's resolution of …

The Federal Arbitration Act After Alafabco: A Case Analysis, Benjamin D. Tievsky Jan 2010

The Federal Arbitration Act After Alafabco: A Case Analysis, Benjamin D. Tievsky

Cardozo Journal of Conflict Resolution

In late 2009, a divided Supreme Court of Washington held in Satomi Owners Ass'n v. Satomi, L.L.C. that the arbitration provision in a warranty addendum to a sales contract between a condominium developer and an owners' association was enforceable. Specifically, the court held that the provision was within the reach of the Federal Arbitration Act, and that a Washington state statute preserving the parties' right to litigate with regard to the warranty addendum was therefore preempted. This Note will explore the potential importance of this decision for defining the contours of the applicability of the Federal Arbitration Act (at least …

Transcending Cultural Nationalist And Internationalist Tendencies: The Case For Mutually Beneficial Repatriation Agreements, Joshua S. Wolkoff Jan 2010

Transcending Cultural Nationalist And Internationalist Tendencies: The Case For Mutually Beneficial Repatriation Agreements, Joshua S. Wolkoff

Cardozo Journal of Conflict Resolution

This Note will proffer a critical evaluation of the Italian government's current tactics for reclaiming its patrimony and argue that MBRAs are the most desired framework for resolving repatriation disputes, as they give rise to lasting collaborative relationships between source nations and cultural institutions and strive to keep valued works in the "public trust" without diminishing traditionally insular cultural identities. Thus, successful negotiations must account for competing interests including, inter alia: (i) the emotional currency of the object as assessed from the perspective of the source nation; (ii) the institution's desire to keep disputed works within the public sphere; (iii) …
