In 1890, Samuel Warren and Louis Brandeis proposed a privacy tort and seventy years later, William Prosser conceived it as four wrongs. In both eras, privacy invasions primarily caused psychic and reputational wounds of a particular sort. Courts insisted upon significant proof due to those injuries’ alleged ethereal nature. Digital networks alter this calculus by exacerbating the injuries inflicted. Because humiliating personal information posted online has no expiration date, neither does individual suffering. Leaking databases of personal information and postings that encourage assaults invade privacy in ways that exact significant financial and physical harm. This dispels concerns that plaintiffs might …

This working paper deals with the U.S. approach for governing the safety of offshore oil and gas operations and preventing major accidents during exploratory drilling and production. It evaluates the statutory and regulatory framework, and agency implementation and reliance on industrial standards, and then suggests reforms to improve the efficacy of this governance system. References are made to the blowout at the drilling rig operated by British Petroleum to support the evaluation and reforms. Mechanism Of N-Methylation By The Trna M1g37 Methyltransferase Trm5., Thomas Christian, Georges Lahoud, Cuiping Liu, Katherine Hoffmann, John J Perona, Ya-Ming Hou

Trm5 is a eukaryal and archaeal tRNA methyltransferase that catalyzes methyl transfer from S-adenosylmethionine (AdoMet) to the N(1) position of G37 directly 3' to the anticodon. While the biological role of m(1)G37 in enhancing translational fidelity is well established, the catalytic mechanism of Trm5 has remained obscure. To address the mechanism of Trm5 and more broadly the mechanism of N-methylation to nucleobases, we examined the pH-activity profile of an archaeal Trm5 enzyme, and performed structure-guided mutational analysis. The data reveal a marked dependence of enzyme-catalyzed methyl transfer on hydrogen ion equilibria: the single-turnover rate constant for methylation increases by one …

Scattering matrix elements are calculated for the nonadiabatic inelastic collision B (2Pjₐ) + H2 (1Σ+g, ν, ј) ↔ B (2Pj’ₐ) + H2 (1Σ+g, ν’, j’). This calculation utilizes the effective potential energy surfaces for this collision generated by Garvin along with a correction to the asymptotic H2 potential. Wavepackets are propagated on these surfaces using a split-operator propagator. This propagation yields correlation functions between reactant and product Møller states which are used to calculate the scattering …

The focus of this present study is to perform the following tasks:

* Develop a hydrodynamic and water quality model of the reservoir formed by the Amaila Falls Hydroelectric Project

* Develop and run modeling scenarios

Water quality model simulations of the 23.3 km2 reservoir for Amaila Falls Hydroelectric Project were conducted for low, average, and high flow years. A scenario with no vegetation removed from the reservoir for an average flow was also simulated. Conditions downstream of the reservoir were also modeled using a river model.

For years, high-tech companies have amassed patents in order to deter patent litigation. Recently, a secondary market for patents has flourished, making it more likely that patents that would otherwise sit on the shelf will end up in the courtroom. This Article explores the current patent ecosystem, which includes both “arms race” and “marketplace” paradigms, in depth. I distinguish “patent-assertion entities,” entities that use patents primarily to obtain license fees rather than to support the development or transfer of technology, from other types of non-practicing entities. The 1969 case Stanley v. Georgia forbade the government from restricting the books that an individual may read or the films he may watch “in the privacy of his own home.” Since that time, the Supreme Court has repeatedly emphasized that Stanley’s protection applies solely within the physical boundaries of the home: While obscene books or films are protected inside of the home, they are not protected en route to it—whether in a package sent by mail, in a suitcase one is carrying to one’s house, or in a stream of data obtained through the Internet. Since the Supreme Court’s widely criticized decision in DeShaney v. Winnebago County Department of Social Services, the principle that the Constitution affords no relief for a social worker’s failure to prevent harm to a child has been described as a “staple of our constitutional law.” Whatever might be said about this principle on its own terms, it produces very troubling incentives for social workers, who may still face constitutional tort liability when they act affirmatively to intervene in troubled families—the unjustified removal of a child from her parents’ custody, after all, is the sort of infringement proscribed by our Constitution’s …

This Note examines the state of whistleblower protection at the state and federal level. It focuses on the protection granted to whistleblowers of securities fraud under the Sarbanes-Oxley Act of 2002. Most courts considering the statute have required that the plaintiff have had both an objective and subjective belief that securities fraud had been committed. In 2009, the United States Court of Appeals for the Ninth Circuit decided Van Asdale v. International Game Technology. I captured 16 Perimyotis subflavus on property owned by the Indianapolis International Airport, of those 16 animals I obtained roosting data on all 16 and foraging data on 11 individuals. The goal of this project was to see if a short broad winged bat’s foraging and roosting habits were affected by the fragmentation of habitat due to rapid urbanization. Using radio telemetry to find roosts and to create multi-azimuth triangulation I was able to create data points and place them onto a habitat map inside ArcGIS software. The learned helplessness theory asserts that depressed individuals unrealistically believe that they have little to no control over aversive outcomes in their lives. Paradoxically, research on judgment of control has demonstrated that depressed individuals are not necessarily pessimistic, but rather more realistic than non-depressed individuals. Most of the research on depressive realism has investigated individual’s perceived control in situations in which they have no actual control. Few studies have investigated perception of control in situations where control is possible. The purpose of this study was to determine the effects of core strength on the transfer and production of forces in the extremities. Twenty-five division 1 collegiate football players performed a series of medicine ball throws in the forward, reverse, right and left directions in a static and dynamic position. The results of the medicine ball throws were compared to several athletic performance measurements including: push press power, 1RM squat, 1RM bench press, countermovement vertical jump, broad jump, 40 yard dash, 20 yard dash, pro agility to the right and left, and the L drill. The present study evaluated the types of coping strategies for chronic pain implemented by 88 inmates, and the degree to which these inmates possessed an internal versus external locus of control. Based on the findings of previous research, it was expected that inmates would report utilizing passive coping strategies more often than active coping strategies, and that passive strategies would be associated with poorer adjustment to pain in terms of depression, pain intensity, and pain interference with daily activities. The purpose of the current study was to explore some of the ways that possessions may be used symbolically to aid adjustment in first-semester freshmen who are transitioning to college. Based on prior literature, the transition to college is often accompanied by self-discrepancies which may be alleviated through symbolic self-completion using possessions. Overall, 219 students participated in this study. Results indicate that first-semester freshmen, as well as upperclassmen students, rely on the symbolic use of possessions in both managing negative affect and symbolizing the ideal college student identity. Once described as being locally plentiful, declines led to the listing of Crawfish Frogs as a State Endangered Species in 1988. With more than 200 aquatic nonindigenous species (NIS), San Francisco Bay (California, USA) is among the world’s most invaded harbors. Hard-substratum benthic (biofouling) organisms, which dominate NIS richness, have arrived primarily as a result of shipping and aquaculture activity over past centuries. To date there has been no assessment of the leisure craft vector in the Bay. We aimed to characterize (1) biofouling on boats’ submerged surfaces and (2) boater behavior likely to affect the risk of NIS transfers. Wetland restoration is a commonly used approach to reduce nutrient loading to freshwater and coastal ecosystems, with many wetland restoration efforts occurring in former agricultural fields. Restored wetlands are expected to be effective at retaining or removing both nitrogen and phosphorus (P), yet restoring wetland hydrology to former agricultural fields can lead to the release of legacy fertilizer P. Here, we examined P cycling and export following rewetting of the Timberlake Restoration Project, a 440 ha restored riverine wetland complex in the coastal plain of North Carolina. School District Enrollment Forecast Reports

This report presents the results of a demographic study conducted by the Portland State University Population Research Center (PRC). The study includes analysis of population, housing and enrollment trends affecting the District in recent years, estimates of the impacts of housing development on TTSD enrollment, and forecasts of districtwide and individual school enrollments for the 2011-12 to 2020-21 school years. The Tigard-Tualatin School District (TTSD) enrolled 12,393 students in Fall 2010, a decrease of 74 students (0.6 percent) from Fall 2009. The loss occurred at both the elementary and middle school levels, with decreases of 41 students (0.7 percent) in …

Bringing The Endangered Barn Owl Back To Mclean County, Illinois: Implementing A Local Nest Box Program, Anna Groves '11

Outstanding Senior Seminar Papers

Barn owls are an endangered species in Illinois, but populations have been known to increase where nest box programs have been implemented. In conjunction with the John Wesley Powell Audubon Society, a barn owl nest box program was established in McLean County and the surrounding area. Seventeen boxes are now scheduled for construction and installation this winter in the McLean County area in order to enhance existing barn owl populations, and the nest box program will continue in the future through the JWP Audubon.
