The State Environmental Quality Review Act (SEQRA), the statute that requires the preparation of environmental impact statements (EISs) for discretionary actions by state and local governments that may have a significant effect on the environment, has long been by far the most fertile source of environmental litigation in New York. That is still so, but the volume has declined, probably because much of such litigation grows out of disputes over proposed construction projects, and there are fewer of those in the recent recession.

When Jonathan Cannon, Michael Vandenbergh, and I started planning this conference last summer, we planned to call it “Implementing Climate Change Legislation.” We assumed that by today a new law aimed at addressing climate change would be in place, or at least would be in the final polishing stage, in the United States. We even imagined that the federal agencies would be rolling up their sleeves to implement not only the new U.S. climate law but also our part of the comprehensive climate pact that the nations of the world had agreed to in Copenhagen.

Greenhouse Gas Disclosure Requirements Are Proliferating, Michael B. Gerrard

While climate change legislation is mired in Congress, several units in the Obama administration have been using their existing statutory authority to adopt rules or guidance requiring extensive disclosures about greenhouse gases (GHGs) in a wide variety of contexts. Every registered public company, the operators of many industrial facilities, and those involved in significant federal actions are now or will soon be covered by one or more of these requirements.

What impact does a forced sale have upon a property owner's wealth? And do certain characteristics of a property owner such as whether they are rich or poor or whether they are black or white, tend to affect the price yielded at a forced sale? This Article addresses arguments made by some courts and legal scholars who have claimed that certain types of forced sales result in wealth maximizing, economic efficiencies. The quest for integrating financial markets into a single global marketplace has produced a host of legal and regulatory measures over the past two decades aimed at taming national protectionism, easing access to foreign markets, and lowering the regulatory burden for financial intermediaries that operate trans-nationally. Home country regulation and supervision – based on commonly agreed prudential standards – has become the core principle in the design of regulatory structures. This principle, first established as the “Basel Concordat” in a series of reports issued by the Bank of International Settlement in Basel has also informed financial regulation in the EU. …

Vaccine informatics is an emerging research area that focuses on development and applications of bioinformatics methods that can be used to facilitate every aspect of the preclinical, clinical, and postlicensure vaccine enterprises. Many immunoinformatics algorithms and resources have been developed to predict T- and B-cell immune epitopes for epitope vaccine development and protective immunity analysis. Vaccine protein candidates are predictable in silico from genome sequences using reverse vaccinology. Systematic transcriptomics and proteomics gene expression analyses facilitate rational vaccine design and identification of gene responses that are correlates of protection in vivo. This paper examines the emerging media flow in the new media economy of Asia by focusing on the networking of media exchange among three growing production centers. It argues that the nation-state has come to play an increasingly important role in the development of a pan-Asian cultural economy in the online gaming industries of Asia. New cultural production centers have created a rising regional growth corridor between South Korea, Singapore and China. By situating online game regulations against the backdrop of the grand scheme of Internet information control, this paper offers a comprehensive, in-depth overview of the regulatory framework wherein the Chinese online video game industry operates. The topics analyzed include the bureaucratic regulatory structure, the ground rules for Web cafes operations, the complicated set of controversial market entry conditions and qualifications for online game distribution services as well as the multitude of concerted official measures and state-centered initiatives with the intent to foster particular genres of patriotic, morally-uplifting game titles and to build a core list of national production clusters.

The purpose of this study was to explore the valuation process of community college library end-users as they decide which information resources to use when conducting research. This study was designed as an exploratory study using Q methodology and focused on five specific information resources that community college library end-users routinely use in their research process: the Internet, the reference librarian, books, newspapers, and subscription databases. Little is known about the valuation hierarchy that end-users overlay on these resources when deciding which ones to use to address a specific research need.

Standards of practice for hospital electrocardiogram monitoring were recommended in 2004 by the American Heart Association; however they are not widely followed. Many nurses monitor in a single lead regardless of diagnosis and are unable to differentiate wide QRS complex tachycardias. The purpose of this project was to evaluate the effectiveness of an interactive web-based education program combined with unit-based collaborative learning activities on both telemetry staff nurses‘ knowledge of dysrhythmias and their monitoring practices for patients at risk for wide QRS complex tachycardias. The goal of ecological restoration is to return degraded or altered ecosystems to their pre-disturbed state with respect to ecosystem structure, function, and composition. In the current study the research objective was to reestablish high levels of biodiversity on two restored pine plantations as well as restore a native pine flatwoods ecosystem. Managed, even-aged pine flatwoods are now the most extensive ecosystem in North Florida, comprising approximately 70% of the forested landscape. Stress has been identified as one of the primary factors influencing the structure of food webs, but few conclusions about the effects of stress on community dynamics have emerged. This study examined generalities that exist between salt stress and insect herbivore responses. Ambient salinity was artificially increased by adding 1.3 kg/m2 of salt to six different plant species: Avicennia germinans, Baccharis halimifolia, Batis maritima, Borrichia frutescens, Iva frutescens, and Spartina alterniflora. The purpose of the present study was to examine differences in alcohol use for Black and White college students at a small private university in the southeast United States. The researcher investigates the effect of viewing positive and negative cosmetic surgery images, with short descriptive scenarios, on acceptance of cosmetic surgery. Two hundred ninety-nine participants were assigned to view one of three conditions: positive before/after cosmetic surgery pictures and an accompanying scenario, negative pictures and scenario, or no pictures or scenario (control), followed by the Acceptance of Cosmetic Surgery Scale (ACSS, Henderson-King & Henderson-King, 2005), the Body Parts Satisfaction Scale (Berscheid, Walster, & Bohrstedt, 1973), and the Physical Self Description Questionnaire (Marsh, Richards, Johnson, Roche, & Tremayne, 1994). John Berryman's The Dream Songs encompasses an extensive and complex negation of characterization and structure, offering a method of interpretation that focuses on the negations and the absences expressed in and presented by the song cycle. Through his nonlinear account of his life and through the historical and literary allusions he uses to express himself, Henry obscures any effort for readers to discover a stable, absolute identity. Like Henry himself, his unnamed companion unsuccessfully fulfills a variety of roles that critics have attempted to prescribe for him; he fails to perform any notable thematic or structural purpose for the poem, …

Context: Latent heat of fusion of ice increases heat removal. Thus, a greater ice to water ratio during cooling and following immersion could enhance cooling efficacy. Moreover, a greater ice to water ratio could shorten treatment durations without reducing residual cooling effectiveness. Objective: Compare interface and muscle temperatures during and post-immersion using 2 ice to water ratios and treatment durations. Design: Crossover trial. Setting: Laboratory. This paper analyzes the rapid changes of the hog industry in the state of Illinois, with a focus on the impact of increasing scale on local communities and environments. Theory on externalities, regional economics, and efficiencies is explored. A literature review looks at past studies on effects to local environments, health, land values, and economic vitality and explores potential solutions. A regression model is used to determine the impact of increased hog concentration on local Illinois employment rates to see if local economies are strengthened or weakened by large hog operations.
