The Challenges Of Calculating The Benefits Of Providing Access To Legal Services, J. J. Prescott

In this invited essay, I explore how policymakers and other public-interested actors have empirically calculated the benefits of providing low-income access to civil legal services in the past, and how they might improve upon existing methods going forward. My argument proceeds in five parts. First, I briefly explain the optimal approach to allocating public funds from a welfare economics perspective. Second, I introduce the challenges of valuing “benefits” in the context of the public provision of legal services. Private litigation is the predominant means of antitrust enforcement in the United States. Other jurisdictions around the world are increasingly implementing private enforcement models. Private enforcement is usually justified on either compensation or deterrence grounds. While the choice between these two goals matters, private litigation is not very effective at advancing either one. Compensation fails because the true economic victims of most antitrust violations are usually downstream consumers who are too numerous and remote to locate and compensate. Deterrence is ineffective because the time lag between the planning of the violation and the legal judgment day is usually so long …

Supreme Court Justices frequently divide on questions of original meaning, and the divisions have a way of mapping what we might suspect are the Justices’ leanings about the merits of cases irrespective of originalist considerations. The same is true for law professors and other participants in constitutional discourse: people’s views of original constitutional meaning tend to align well with their (nonoriginalist) preferences for how present constitutional controversies should be resolved. To be sure, there are exceptions. Some people are better than others at suspending presentist considerations when examining historical materials, and some people are better than others at recognizing when …

Landowner Attitudes Toward Elk Management In The Pine Ridge Region Of North-Western Nebraska, R. Daniel Crank, Scott E. Hygnstrom, Kit M. Hams

Little is known about attitudes of landowners toward elk (Cervus elaphus) on privately-owned land. We mailed questionnaires to agricultural landowners in the Pine Ridge region of northwestern Nebraska in both 1995 and 1997 to determine attitudes toward elk populations and management of elk. Fifty-six percent (n = 214) of respondents in 1995 and 57% (n = 461) in 1997 were in favor of free-ranging elk. Motivation for those in favor of elk was utilitarian (opportunity to view and hunt elk), ecological (return of a native species), and economic (benefits from increased tourism and leased land for elk hunting). …

Introduced oryx (Oryx gazella gazella) have expanded into the San Andres Mountains of south-central New Mexico, but little is known of concurrent habitat used by oryx and desert mule deer (Odocoileus hemionus crooki); the latter in New Mexico is a species of special concern that has declined significantly since the introduction of oryx. We used fecal-pellet and browse surveys in combination with presence modeling to identify differences in relative use of habitat types, distribution, and browsing of highly palatable, highly preferred (hereafter, key) plant species during 2004 to 2006 to assess the potential for direct competition …
