Enumerating Old Themes? Berle’S Concept Of Ownership And The Historical Development Of English Company Law In Context, Lorraine E. Talbot

Seattle University Law Review

This paper offers some tentative suggestions as to why Berle’s work has been read and interpreted so selectively in the United Kingdom. I suggest that this must be partly attributable to the historical developments in English company law that entrenched the notion of shareholder ownership claims. Specifically, unincorporated associations’ normative values—that members are owners and there is no distinction between small organizations with no share dispersal and large organizations with wide share dispersal—have a continuing influence on this entrenched notion of shareholder ownership claims. The 'Where' And 'How' Of Exploration And Exploitation: Balancing Leadership Styles To Drive Innovation And Performance, Ann Kowal Smith

Student Scholarship

Using a global sample of public companies, we explored the relationships among transformational and transactional leadership, exploration and exploitation and performance. First, balanced leadership styles drive more innovative learning outcomes than either single style. Second, elements of an expanded framework of innovative learning, including “where” ideas are sourced and “how” they are shared, fully mediate the relationship between leadership and performance. Specifically, “how” drives earnings growth and “where” drives revenue growth. We propose a nuanced ambidexterity, whereby leaders balance not only exploration and exploitation, but also idea sourcing and idea sharing to unleash their organization’s collective wisdom and drive performance.

Much of the research in IT innovation diffusion has been in the study of the diffusion of common technological innovations that intersect human activity in business processes (e.g. web-based e-commerce). There has been less research into the diffusion of specialized technologies in high risk environments where the potentially highly negative but low probability consequences of adopting the technology can affect the adoption decision. Such technologies are employed by highly trained individuals whose work is enhanced and transformed by the IT use. Anion exchange reactions of nanodimensional layered metal hydroxide compounds are utilized to create materials with targeted physical and chemical properties and also as a means for controlled release of intercalated anions. The kinetics of this important class of reaction are generally characterized by model-based approaches. In this work, a different approach based on isothermal, isoconversional analysis was utilized to determine effective activation energies with respect to extent of reaction. Two different layered metal hydroxide materials were chosen for reaction with chloride anions, using a temperature range of 30−60 °C. A novel biomaterial formed by the immobilization of the Aminopeptidase from Aeromonas proteolytica (AAP) on synthetic Mg2+ and Al3+ ion-containing layered double hydroxide (LDH) particles was prepared. Immobilization of AAP on the LDH particles in a buffered, aqueous mixture is rapid such that the maximum loading capacity, 1 × 10−9 moles of AAP/mg LDH, is achieved in a few minutes. X-ray powder diffraction of LDH samples before and after treatment with AAP indicates that the enzyme does not intercalate between the layers of LDH, but instead binds to the surface. Immobilization Of Motile Bacterial Cells Via Dip-Pen Nanolithography, Dorjderem Nyamjav, Sergey Rozhok, Richard C. Holz

A strategy to bind bacterial cells to surfaces in a directed fashion via dip-pen nanolithography (DPN) is presented. Cellular attachment to pre-designed DPN generated microarrays was found to be dependent on the shape and size of the surface feature. While this observation is likely due in part to a dense, well formed mercaptohexadecanoic acid (MHA) monolayer generated via DPN, it may also simply be due to the physical shape of the surface structure. Motile Pseudomonas aeruginosa bacterial cells were observed to bind to DPN generated mercaptohexadecanoic acid/poly-L-lysine (MHA/PLL) line patterns, 'blocks' made up of eight lines with 100 nm spacings, …

Affinity Capillary Electrophoretic Study Of K+/Na+ Selectivity Of Hexaarylbenzene-Based Polyaromatic Receptor, Sille Ehala, Rajendra Rathore, Emanuel Makrlik, Petr Toman, Václav Kašička

Affinity capillary electrophoretic (ACE) study has proved the selectivity of hexaarylbenzene-based polyaromatic receptor (R) for K+ ion over Na+ ion. The apparent binding constants of the R complexes with K+ and Na+ ions were determined from the dependence of effective electrophoretic mobility of R on the concentration of the above alkali metal ions in the background electrolyte using a non-linear regression analysis. The apparent binding constants (Kb) of the K-R+ and Na–R+ complexes in methanolic medium were evaluated as log Kb = 3.20 ± 0.22 for the K–R+ complex, and log Kb≅−0.7 for the Na–R+ complex.

In addition to judicial education programs that the Law and Economics Center conducts, we also have a division that focuses on public policy research, known as the Searle Civil Justice Institute. In November, we held a public policy roundtable where we commissioned a variety of research and brought together a group of experts, both academic and practitioner experts, to discuss the issue of balancing the appropriate roles of markets, litigation, and regulation. And the notion there is that each one - markets, litigation, and regulation - can and probably should play a role in addressing various consumer harms.

A improved preparation of the pentadentate ligand α,α,α′,α′-tetra(pyrazolyl)lutidine, pz4lut, and the syntheses of three new alkyl-substituted pyrazolyl derivatives pz4′4lut (pz4′ = 4-methylpyrazolyl), pz*4lut (pz* = 3,5-dimethylpyrazolyl), and pzDIP4lut (pzDIP = 3,5-diisopropylpyrazolyl) are described. Red algal parasites are unusual because the vast majority of them parasitize species with which they share a recent common ancestor. This strategy has earned them the name “adelphoparasites,” from the Greek, adelpho, meaning “kin.” Intracellular adelphoparasites are very rare in nature, yet have independently evolved hundreds of times among the floridiophyte red algae. Much is known about the life history and infection cycle of these parasites but nearly nothing in known about their genomes. We sequenced the mitochondrial genomes of the free-living Gracilariopsis andersonii and its closely related parasite Gracilariophila oryzoides to determine what effect a parasitic lifestyle has …

The distribution of organisms within a community can often be determined by the degree of plasticity or degree of specialization of resource acquisition. Resource acquisition is often based on the morphology of an organism, behavior, or a combination of both. Performance tests of feeding can identify the possible interactions that allow one species to better exploit a prey item. Scavenging behaviors in the presence or absence of a competitor were investigated by quantifying prey selection in a trophic generalist, spiny dogfish Squalus acanthias, and a trophic specialist, smooth-hounds Mustelus canis, in order to determine if each shark scavenged …

This picture may bring to mind many things, but I suspect that many legal writing professors in our (past or present) incarnations as practicing attorneys would not look at this image and think, "My job is a lot like that." Copyright law performs a number of important functions. It facilitates public access to knowledge and a wide range of uses of creative works of authorship, and, in so doing, it helps educate our populace, enrich our culture, and promote free speech, free expression, and democratic values. It provides opportunities for rights holders to recoup investments in creating and disseminating their works and to enjoy the fruits of whatever success arises from the public's uses of their works.
