Inclusive Teaching Circles : Mechanisms For Creating Welcoming Classrooms., Sharon E. Moore, Sherri L. Wallace, Gina Schack, M. Shelley Thomas, Linda Lewis, Linda Wilson, Shawnise Miller, Joan D'Antoni

Faculty and Staff Scholarship

This essay examines the Inclusive Teaching Circle (ITC) as a mechanism for faculty development in creating instructional tools that embrace an inclusive pedagogy reflecting diversity, cultural competence and social justice. We describe one group’s year-long participation in an ITC at a large, metropolitan research university in the south. Next, we share several members’ strategies for promoting more inclusive and equitable learning for students in our classrooms. Finally, we consider the implications of ITCs for its group participants and the professorate at large.

Mechanisms Of Apoptosis In Crustacea : What Conditions Induce Versus Suppress Cell Death?, Michael Menze, Grady Fortner, Suman Nag, Steven Hand Jan 2010

Mechanisms Of Apoptosis In Crustacea : What Conditions Induce Versus Suppress Cell Death?, Michael Menze, Grady Fortner, Suman Nag, Steven Hand

Faculty and Staff Scholarship

Arthropoda is the largest of all animal phyla and includes about 90% of extant species. Our knowledge about regulation of apoptosis in this phylum is largely based on findings for the fruit fly Drosophila melanogaster. Recent work with crustaceans shows that apoptotic proteins, and presumably mechanisms of cell death regulation, are more diverse in arthropods than appreciated based solely on the excellent work with fruit flies. Crustacean homologs exist for many major proteins in the apoptotic networks of mammals and D. melanogaster, but integration of these proteins into the physiology and pathophysiology of crustaceans is far from complete. Whether apoptosis …

Utilizing The School Health Index To Foster University And Community Engagement., Kristi Mcclary King

Faculty and Staff Scholarship

A Coordinated School Health Program maximizes a school’s positive interaction among health education, physical education, health services, nutrition services, counseling/psychological/social services, health school environment, health promotion for staff, and family and community involvement. The purpose of this semester project is for undergraduate health education students to (1) explain the Coordinated School Health Program, (2) assess local schools’ health programs and policies using the School Health Index, (3) develop a School Health Improvement Plan, and (4) present their findings and recommendations for improving their schools’ physical activity, nutrition, tobacco prevention, asthma, and safety policies and programs.

Could Decision Trees Help Improve Farm Service Agency Lending Decisions?, Benjamin P. Foster, Jozef Zurada, Douglas K. Barney Jan 2010

Could Decision Trees Help Improve Farm Service Agency Lending Decisions?, Benjamin P. Foster, Jozef Zurada, Douglas K. Barney

Faculty and Staff Scholarship

This study examines whether a statistically derived decision tree could serve as a means to improve U.S.A. Farm Service Agency lending decisions. The study is a substantial extension and reanalysis of an earlier work by Barney, Graves and Johnson, (1999). Results indicate that a decision tree could be a valuable tool for Farm Service Agency employees in their lending decisions. The decision tree provides as good or better predictive accuracy than neural networks and logistic regression models at reasonable cutoff levels of Type II to Type I costs of lending. The decision tree also meets the transparency criteria for Farm …

Othering Obama : How Whiteness Is Used To Undermine Authority, David S. Owen Jan 2010

Othering Obama : How Whiteness Is Used To Undermine Authority, David S. Owen

Faculty and Staff Scholarship

In this paper, I argue that the sociocultural structuring property of whiteness has been utilized to marginalize President Obama and effectively undermine his presidential authority. Whiteness functions in a largely invisible and ostensibly deracialized way to normalize the interests, needs, and values of whites, while at the same time marginalizing and devaluing the voice of people of color. Analyzing the health care debate through this theoretical lens generates insights into how the debate reproduced the system of racial oppression, and how whiteness functions in political discourse.

Associative / Dissociative Cognitive Strategies In Sustained Physical Activity: Literature Review And Proposal For A Mindfulness-Based Conceptual Model, Paul Salmon, Scott Hanneman, Brandon Harwood Jan 2010

Associative / Dissociative Cognitive Strategies In Sustained Physical Activity: Literature Review And Proposal For A Mindfulness-Based Conceptual Model, Paul Salmon, Scott Hanneman, Brandon Harwood

Faculty and Staff Scholarship

We reviewed and summarize the extant literature on associative/dissociative cognitive strategies used by athletes and others in circumstances necessitating periods of sustained attention. This review covers studies published since a prior publication by Masters and Ogles (1998), and, in keeping with their approach, offers a methodological critique of the literature. We conclude that the distinction between associative and dissociative strategies has outlived its usefulness since initially proposed in an earlier era of ground-breaking research by Morgan and Pollock (1977) that was influenced to some extent by psychodynamic thinking. In recent years there has been an evolutionary shift in concepts of …

The Impact Of Reading First On Reading Achievement Scores In A Midwestern Elementary School, Julie Thomas Jan 2010

The Impact Of Reading First On Reading Achievement Scores In A Midwestern Elementary School, Julie Thomas

Dissertations and Theses @ UNI

Schools are facing tremendous pressure to demonstrate student proficiency through reading achievement scores. The recommendations from the report from the National Reading Panel (NICHD, 2000) concluded that fluency and comprehension are two of five essential areas in reading instruction. The principles of Reading First programs are based on the findings of the National Reading Panel. Many schools across the nation have received Reading First funds with the intent of increasing reading achievement scores. Federal Reading First funding is provided to school districts that meet state requirements for eligibility. This funding is provided to districts to assist schools in assessing reading …

Public Interest(S) And Fourth Amendment Enforcement, Alexander A. Reinert Jan 2010

Public Interest(S) And Fourth Amendment Enforcement, Alexander A. Reinert

Articles

Fourth Amendment events generate substantial controversy among the public and in the legal community. Yet there is orthodoxy to Fourth Amendment thinking, reflected in the near universal assumption by courts and commentators alike that the amendment creates only tension between privately held individual liberties and public-regarding interests in law enforcement and security. On this account, courts are faced with a clear choice when mediating Fourth Amendment conflicts: side with the individual by declaring a particular intrusion to be in violation of the Constitution or side with the public by permitting the intrusion. Scholarly literature and court decisions are accordingly littered …

Rethinking Guardianship (Again): Substituted Decision Making As A Violation Of The Integration Mandated Of Title Ii Of The Americans With Disabilities Act, Leslie Salzman Jan 2010

Rethinking Guardianship (Again): Substituted Decision Making As A Violation Of The Integration Mandated Of Title Ii Of The Americans With Disabilities Act, Leslie Salzman

Articles

In every state, when an adult has a diminished capacity to make decisions about personal affairs or property management, a court may transfer the individual’s right to make decisions to a guardian. This Article argues that, in most cases, it would be preferable to support decision making rather than supplant it through guardianship, and then seeks to locate a right to receive such support as a less restrictive alternative to the substituted decision making that characterizes guardianship.

Building on the reasoning in Olmstead v. L.C. and subsequent decisions interpreting the Americans with Disabilities Act’s integration mandate, this Article argues that …

A Comparative Study Of The Organizational Culture Of Capra Accredited And Non-Accredited Municipal Park And Recreation Agencies, John E. Farland Jan 2010

A Comparative Study Of The Organizational Culture Of Capra Accredited And Non-Accredited Municipal Park And Recreation Agencies, John E. Farland

Dissertations and Theses @ UNI

The purpose of this study was to explore and examine the organizational cultures of municipal park and recreation agencies in the United States. Further, the study sought to compare the organizational cultures of municipal park and recreation agencies which have achieved accreditation from the Commission on Accreditation for Park and Recreation Agencies (CAPRA) versus those who have not achieved CAPRA accreditation. Organizational culture according to Schein (1985) included characteristics found within a working environment, a pattern of assumptions, both written and assumed, passed on to new members. Authors throughout the literature wrote that all organizations have culture. Accreditation is a …

The Future Of Disparate Impact, Richard A. Primus Jan 2010

The Future Of Disparate Impact, Richard A. Primus

Articles

The Supreme Court's decision in Ricci v. DeStefano foregrounded the question of whether Title VIl's disparate impact standard conflicts with equal protection. This Article shows that there are three ways to read Ricci, one of which is likely fatal to disparate impact doctrine but the other two of which are not.

Message To Congress: Halt The Tax Exemption For Perpetual Trusts, Lawrence W. Waggoner Jan 2010

Message To Congress: Halt The Tax Exemption For Perpetual Trusts, Lawrence W. Waggoner

Articles

The federal estate tax is in abeyance this year. The popular press has picked up on the possibility that the estates of billionaires such as the late George Steinbrenner, who owned the New York Yankees, will escape the tax. The House Ways and Means Committee, chaired by Representative Sander Levin of Michigan, and the Senate Finance Committee, chaired by Senator Max Baucus of Montana, are now considering two questions: what the maximum rate and exemption will be when the estate tax returns and whether the tax will be reinstated for this year. Lurking behind the headlines but equally important is …

The Gulf Spill Context: Peak Oil, Risky Oil, And Energy Strategy, Edward A. Parson Jan 2010

The Gulf Spill Context: Peak Oil, Risky Oil, And Energy Strategy, Edward A. Parson

Articles

As shocking as the situation in the Gulf of Mexico may be, in this broader context it must be regarded as a normal event. That’s not to say that it’s normal in relation to past experience. Rather, the Gulf spill is “the new normal,” in the sense that our current energy strategy—or lack thereof—will make such events increasingly likely, even if we assume conditions of effective regulation and responsible compliance that evidently were not present on the Deepwater Horizon.

Corporate Law In The Shanghai People's Courts, 1992-2008: Judicial Autonomy In A Contemporary Authoritarian State, Nicholas C. Howson Jan 2010

Corporate Law In The Shanghai People's Courts, 1992-2008: Judicial Autonomy In A Contemporary Authoritarian State, Nicholas C. Howson

Articles

In late 2005 China adopted a largely rewritten Company Law that radically increased the role of courts. This study, based on a review of more than 1000 Company Law-related disputes reported between 1992 and 2008 and extensive interactions with PRC officials and sitting judges, evaluates how the Shanghai People's Court system has fared over 15 years in corporate law adjudication. Although the Shanghai People's Courts show generally increasing technical competence and even intimations of political independence, their path toward institutional autonomy is inconsistent. Through 2006, the Shanghai Court system demonstrated significantly increased autonomy. After 2006 and enactment of the new …

Mulieris Dignitatem And The Exclusivity Of Marriage Under Law, Howard Bromberg Jan 2010

Mulieris Dignitatem And The Exclusivity Of Marriage Under Law, Howard Bromberg

Articles

Jesus Christ established monogamy, the marriage of one man to one woman, as the canonical norm of his church and the juridical norm for all nations. This was a unique event in the history of the cultures and religions of the world. The Catholic Church has always defended its canonical norm of monogamy, often with great opposition. Through its influence, monogamy has been established as law in the Western world and in almost all cultures influenced by Western law and norms. The emerging jurisprudence of the United States, however, rejects any religious derivation as the basis of our laws. With …
