To guarantee the success if network- centric operations, warfighters need the ability to extract and share critical task-relevant information to develop and maintain the situation awareness that is so critical far effective team performance. As such, the design of emerging technologies and systems must adopt a "user-centric" approach, with consideration for human information processing capabilities and limitations. This Article offers arhetoricalanalysis of the term "lawfare. " It examines the term within the context of its historical genesis, and reviews its evolving definition. Drawing upon insights from non-legal disciplines, the Article argues that rhetorically, "lawfare" indicates alternative and critical ways to think of law in relation to war.

This dissertation analyzes approximately fifty American films that feature predominantly heterosexual interfaith/intercultural romantic, sexual or marital relations between Jewish and Gentile protagonists. It asks what political or social ideals can be illustrated by these portrayals, and how these films can be taken cumulatively to explore trends in modern life. The author places liberalism at the heart of the mainstream Hollywood discourse on intermarriage, and shows how films that run counter to the expectations of liberal romances may reflect communitarian critiques of liberal tenets.

The pattern of regulatory reform in financial services regulation follows a predictable pattern in democratic states. A hyperactive market generates a bubble, the bubble deflates, and much financial pain ensues for those individuals who bought at the top of the market. The financial mess brings the scrutiny of politicians, who vow "Never again!" A political battle ensues, with representatives of the financial services industry fighting a rearguard action to preserve its prerogatives amidst cries for the bankers' scalps. This article explores contradictions in Italy’s relationship with the Mediterranean basin, setting Tunisia as a focal point. Tunisia was a paradoxical case at the intersection of Italy’s foreign policy: it was a former Roman imperial colony with a strategic location, but it was also a large and vibrant Italian emigrant settlement, like the Italian “colonies” of Buenos Aires, Sao Paolo, New York, and San Francisco. This situation caused much confusion in debates over how Italy should develop its international influence. Although soldiers of Operations Iraqi Freedom (OIF) and Enduring Freedom (OEF) encounter combat-related concussion at an unprecedented rate, relatively few studies have examined how evaluation context, insufficient effort, and concussion history impact neuropsychological performances in the years following injury. The current study explores these issues in a sample of 119 U.S. veterans (OEF/OIF forensic concussion, n = 24; non-OEF/OIF forensic concussion, n = 20; OEF/OIF research concussion, n = 38; OEF/OIF research without concussion, n = 37). The OEF/OIF forensic concussion group exhibited significantly higher rates of insufficient effort relative to the OEF/OIF research concussion group, but a comparable rate …

This paper examines the emerging media flow in the new media economy of Asia by focusing on the networking of media exchange among three growing production centers. It argues that the nation-state has come to play an increasingly important role in the development of a pan-Asian cultural economy in the online gaming industries of Asia. New cultural production centers have created a rising regional growth corridor between South Korea, Singapore and China. Operating under the assumption that the average college student knows little to nothing about the Supreme Court and significant cases in the field of American constitutional law, the author hypothesizes that this ignorance is due not to an inability to understand the material, but an unwillingness on the part of the average student to expend the effort necessary to decipher the "legalese" of an average Supreme Court opinion. This article considers a major debate in the American and European counterterrorism analytic community – whether the primary terrorist threat to the West is posed by hierarchical, centralized terrorist organizations operating from geographic safe havens, or by radicalized individuals conducting a loosely organized, ideologically common but operationally independent fight against western societies – and this debate’s implications for both jus ad bellum and jus in bello. This paper presents findings of an exploratory study to evaluate the impact of humanitarian photography on the generation of sympathy and donation behavior. Considering the large amount of money spent each year by charity organizations on marketing strategies, it seems crucial to shed light on the persuasive impact of images in this context. The overarching purpose of this study was to discern what impact, if any, a number of features in a photograph have on sympathetic reactions. Specifically the author examined facial expressions (sad vs. happy), eye contact vs. no eye contact and total number of subjects portrayed. Findings supported …

Since the end of the Sino-Vietnamese War in 1979, Northeast Asia and its comprising countries have avoided international conflict as well as any regional set has done over the past few decades. The absence of nuclear weapons among Japan, South Korea, and Taiwan, in particular, is striking, given their technological and scientific capabilities. Though each of those countries has come close at times to developing their own nuclear weapons, one factor or another contributed to the failure of those upstart programs. This thesis explores the obstacles in establishing a consistent and effective response framework for humanitarian catastrophe and the importance of maintaining a sustained dialogue to this end. It does so by recognizing the underlying conflict between two positions: the norm of non-intervention of states into the affairs of others, and the protection of individuals caught in the middle of violent conflict. The importance of working towards a resolution of this conflict is illustrated through the case study of Darfur, where a divided international community led an insufficient response to the crisis that can ultimately be judged as a failure. The resolution of multiple use conflicts through place-based (national forest-specific) legislation has recently received increased interest. Most of these proposals combine wilderness designation, restoration objectives, economic development, funding arrangements, and other provisions, in a conservation package to be considered by Congress. Interest in the place-based legislative approach is precipitated by numerous factors, including perceptions of agency gridlock, problems related to forest planning, unresolved roadless and wilderness issues, and the embrace of collaboration. Though the national forests have a more unified governing framework than other federal land systems, the U.S. Forest Service has implemented place-based legislation in a few cases. This …
