The Limits Of Constitutional Convergence, Eric A. Posner, Rosalind Dixon

Public Law and Legal Theory Working Papers

Globalization, some legal scholars suggest, is a force that makes increasing convergence among different countries' constitutions more or less inevitable. This Essay explores this hypothesis by analyzing both the logic – and potential limits – to four different mechanisms of constitutional convergence: first, changes in global “superstructure”; second, comparative learning; third, international coercion; and fourth, global competition. For each mechanism, it shows, quite special conditions will in fact be required before global convergence is likely even at the level of legal policy. The negotiation of the 2010 Collective Bargaining Agreement brought tense times for professional soccer in the United States. The Major League Soccer Players’ Union sought free agency as a part of the 2010 CBA, a term that would have brought considerable relief from the restrictions imposed through Major League Soccer’s centralized contracting system. In a steadfast effort to retain control, minimize labor costs, and avoid antitrust liability, Major League Soccer refused to yield to the players’ demands. As a result, the parties reached impasse. This Strategic Forum argues that U.S. national security strategy must evolve to address challenges across the global commons — including the sea, air, space, and cyber domains — which are increasingly contested by state and non-state actors. The authors propose a new conceptual framework for understanding domain interrelationships and how operations in one domain can affect access and security in others. By emphasizing assured access and cross-domain integration, the paper outlines strategic and policy implications for defense planning, operational readiness, and long-term deterrence in an interconnected global threat environment.

Constitutional Interpretation Through A Global Lens, Rex D. Glensy

This Article seeks to clarify the current debate concerning the use of non-U.S. persuasive authority within the context of constitutional interpretation. It begins by noting that commentary on comparative constitutional law often fails to make any distinction between foreign domestic sources and international law used comparatively, and thus risks evoking parallels between different systems of law that lack context and plausibility. It then draws on various normative theories and underpinnings of both domestic and international legal regimes to show that a proper comparative enterprise must take this distinction into account. There is a level of frustration among pastors as they try to apply philosophical models of health to troubled churches. These churches have been labeled "troubled" because of the traumatic events they have experienced in the past. These experiences have resulted in barriers to any effort by pastor to transition the church to health. The purpose of this study is to identify the common factors/issues that a troubled church must address in order to progress in the revitalization process. This study seeks to provide a description of the factors/issues that ten troubled churches addressed as they moved toward health.

Last year, as the State of California struggled with a $42 billion budget deficit, its financial inability to correct constitutionally deficient prison conditions led a federal court to order the release of 40,000 state prisoners. In Oregon, Michigan, Connecticut, Vermont, and Delaware, spending on corrections now exceeds spending on higher education. Migrant and seasonal farmworkers play a critical role in the U.S. economy, producing food for the American public, while their suffering is often rendered invisible by their existence on the margins of society. The low wages associated with farm labor combined with the largely undocumented status of this population severely limits access to food, housing, and health care, resulting in poor health outcomes. Through the use of a critical anthropological approach, this research examines the social, cultural, political, and economic context of obesity among Latino migrant and seasonal farmworkers in Central Florida. The threat encompassing the critical computing infrastructure nations depend upon has shifted. A new dynamic of adversaries leveraging a playbook of highly sophisticated, organized, and well funded cyber attacks has emerged. These adversaries penetrate networks using exploits, tools, and techniques that are not detected by traditional client and network security software. Compromised networks stand to lose irreparable amounts of sensitive information and trade secrets if confidentiality is lost. The threat has shifted, but detection and response mechanisms have largely remained the same. They have maintained the same largely ineffective result these advanced adversaries count on.

Though information technology (IT) is increasingly touted as an effective tool through which governments may enhance their development efforts, to date, many IT-related deployments have remained in a pilot stage, which does little to aid governments in understanding macro-level IT policy approaches to confronting development challenges. To address this shortcoming, this article presents a unique nationwide initiative: Macedonia Connects, a multipartner, scaled IT-for-education project wherein every school in the country was equipped with both computers and wireless Internet connections and through which the Internet was made available to citizens across the entire country.
