For many post-conflict countries like Peru, the end of gunfire does not necessarily imply an end to internal conflict. Remaining post-conflict societal friction may even be as threatening to long-lasting peace as the war itself. This situation may be attributed, in part, to the media’s failure to adequately mediate conflicting views of a country’s history—its causes and consequences, its villains and heroes. Certainly, newspapers, radio, and television, as well as the newly emerging micromedia (e.g., e-mail) and middle media (e.g., web logs or “blogs”), reach huge audiences on a daily basis before, during, or after conflict. Judicial selection, including judicial resignations, nominations, and confirmations, is comprised of a patchwork of traditions, rules, and constitutional provisions. The Constitution does not explicitly detail a formalized process at any stage of the appointments process, but checks and balances have organically developed and changed over time as the process has become more politicized. The question becomes, then, whether conditional resignations comport with this system or the Framers’ intent. At the Supreme Court level, conditional resignations are rare. Shortly thereafter, American ground forces were committed and played an important role in the ouster of the Taliban and the creation of a new Afghan government. Has the early part of the twenty-first century shown the most dramatic revolution in the role of law in armed conflict in history? Evidence suggests that it has. Today, for example, allegations about civilian casualties often dominate our discussions about strategy in irregular war, itself a phenomenon that, according to the National Defense Strategy, will preoccupy our military services for years to come. Collective Action Federalism: A General Theory Of Article I, Section 8, Neil S. Siegel, Robert D. Cooter

The Framers of the United States Constitution wrote Article I, Section 8 in order to address some daunting collective action problems facing the young nation. They especially wanted to protect the states from military warfare by foreigners and from commercial warfare against one another. The states acted individually when they needed to act collectively, and Congress lacked power under the Articles of Confederation to address these problems. Section 8 thus authorized Congress to promote the “general Welfare” of the United States by tackling many collective action problems that the states could not solve on their own.

Few concepts in international law are more controversial than lawfare. This essay contends that lawfare is best appreciated in the context of its original meaning as ideologically neutral description of how law might be used in armed conflict. It emphasizes that although law may be manipulated by some belligerents for nefarious purposes, it can still serve to limit human suffering in war. In discussing the current state of the concept of lawfare, the essay reviews several contentious areas, and recognizes the concerns of critics. The paper concludes that lawfare is still a useful term, and is optimized when it is …

Patterns Of Indigenous Resilience In The Amazon: A Case Study Of Huaorani Hunting In Ecuador, Flora Lu

Journal of Ecological Anthropology

This paper takes a resilience approach to examining human forager-prey dynamics using as a case study Huaorani hunting in the Ecuadorian Amazon. I compare methodologically similar datasets collected in the same Huaorani villages in 1996-1997 and 2001. Rather than assuming that human hunters simply act on prey species and linearly drive them to depletion, a resilience approach views this dynamic as a complex social and ecological system characterized by feedbacks, nonlinearities, uncertainty, unpredictability, and non-equilibrium dynamics. Using a computer simulation of human foragers and prey (published previously), I highlight how even using relatively simple assumptions, the human forager-prey relationship exhibits …

Arbitrary arrest and detention, oftentimes used to curtail the freedom of opinion and expression, as well as the right to association and peaceful assembly, has continued to characterize Iranian regimes since the 1979 Islamic Revolution. Such arrest and detention of human rights defenders (HRD)–who individually or with others act to protect and promote human rights—has demonstrated the repressive nature of the Iranian regime. Human rights lawyers, civil society representatives, journalists, and women’s rights movements and trade union activists are among the most commonly targeted HRD.

In President Obama’s first year in office, he failed in combating al-Qa’eda, the Taliban, and associated forces. President Obama wished to change the perception on the ‘War on Terror’ established by the Bush Administration, but instead created more confusion and frustration in an attempt to change old policies.

Most notably, President Obama refused to irrevocably and sternly tell the American public that the conflict with al-Qa’eda was indeed a war. The Bush Administration’s first action taken after 9/11 was the pronouncement that the United States was at war. President Obama instead referred to the conflict as an “overseas contingency operation.” …

I begin this study with the formalistic essays of Michael Oakeshott and Susan Sontag, observing the precarious position of aesthetics in contemporary literary discourse. Rather than fit the novels Under the Volcano and the Alexandria Quartet into normative Kantian or New Critical frameworks, I follow the course of alchemical allusions in Lowry’s novel and relate them to the troubled theme of modern love in Durrell’s, writing in an experiential, plot-driven manner towards a narrative describing the effects of these texts upon my fiction. After I discuss the traces of Sade in Durrell, the metafictional novelette “Dolor” concludes the project, betraying …

Network covert channels provide two entities the ability to communicate stealthily. Hypertext Transfer Protocol (HTTP), which accounts for approximately half of all traffic on the Internet (Burke, 2007), has become the fertile ground for various network covert channels. Proliferation of network covert channels throughout the World Wide Web and other areas of cyberspace has raised new security concerns and brought both challenges and enhancements to the area of Information Warfare. Somalia is approaching a daunting anniversary: in 2011, the country will begin its twentieth consecutive year without an effective centralized government. The fall of the Soviet supported Siad Barre government in 1991 created a power vacuum that was filled by warlords, clans and, most recently, Islamists. Fourteen interim governments have failed to supplant those forces. Health infrastructure and the general health of the population have been devastated as a result. Precious few organizations are still providing health-related services. Unfortunately, recent events suggest that this crisis is going to get worse before it gets better.

The lawfare critique offers a provocative challenge to the use of law and legal process in the context of the Arab-Israeli conflict. It has been used to question the legitimacy of numerous lawsuits filed by individuals harmed in the conflict. The lawfare critique is misguided, however, because it fails to recognize that the purpose of any legal system is to offer a viable alternative to the use of force.
