Music Markets And Mythologies, 9 J. Marshall Rev. Intell. Prop. L. 831 (2010), Henry H. Perritt, Jr.

UIC Review of Intellectual Property Law

New technologies have started a revolution in the music marketplace. As new business models emerge, major firms in the popular music industry have mounted a campaign on the premise that the world of popular music faces a grave threat from illicit filing sharing. This article makes the case against that campaign. It discusses how new technologies are currently reshaping the marketplace to allow a wider range of new artists, as well as more direct access between musicians and their fans. It also predicts how future demand for popular music will increase due to portability, and ultimately recommends directions for marketplace …

Finding Our Way(S): A Theoretical Model Of Performance Studies And Homeplace, Shauna M. Macdonald Jan 2010

Finding Our Way(S): A Theoretical Model Of Performance Studies And Homeplace, Shauna M. Macdonald

Kaleidoscope: A Graduate Journal of Qualitative Communication Research

Place, space, and homeplace have taken on increasing conceptual significance for performance studies practitioners. Despite a wealth of research, there are few theoretical models within the discipline to which researchers of homeplace can appeal for scholarly guidance. In this paper, I survey recent essays about home, place, and space within two major disciplinary journals to create such a model. Using my own experience with homeplace and performance as a frame, I outline four major orientations toward homeplace displayed within recent performance studies literature. Though my goal is far from exhaustive, I aim both to describe the variety of research projects …

Antitrust Censorship Of Economic Protest, Hillary Greene Jan 2010

Antitrust Censorship Of Economic Protest, Hillary Greene

Faculty Articles and Papers

Antitrust law accepts the competitive marketplace, its operation, and its outcomes as an ideal. Society itself need not and does not. Although antitrust is not in the business of evaluating, for example, the “fairness” of prices, society can, and frequently does, properly concern itself with these issues. When dissatisfaction results, it may manifest itself in an expressive boycott: a form of social campaign wherein purchasers express their dissatisfaction by collectively refusing to buy. Antitrust should neither participate in nor censor such normative discourse. In this Article, I explain how antitrust law impedes this speech, argue why it should not, and …

Case Disposition In The Drug Court: Who Is The Most Central Actor?, Salmon A. Shomade Jan 2010

Case Disposition In The Drug Court: Who Is The Most Central Actor?, Salmon A. Shomade

Political Science Faculty Publications

In recent years, the number of drug courts has proliferated throughout the country. One widely held belief is that the central figure in a drug court is the judge. While the judge may be the central actor in the courtroom, what is not clear is whether the drug court judge is the most central actor in the actual disposition of cases. This article presents the findings of a research project that asked actors participating in staffing about the centrality of the drug court judge. I found that while the drug court judge is a central actor, the most central actor …

Last Stand? The Criminal Responsibility Of War Veterans Returning From Iraq And Afghanistan With Posttraumatic Stress Disorder, Thomas L. Hafemeister, Nicole A. Stockey Jan 2010

Last Stand? The Criminal Responsibility Of War Veterans Returning From Iraq And Afghanistan With Posttraumatic Stress Disorder, Thomas L. Hafemeister, Nicole A. Stockey

Indiana Law Journal

As more psychologically scarred troops return from combat in Iraq and Afghanistan, society's focus on and concern for these troops and their psychological disorders has increased With this increase and with associated studies confirming the validity of the Posttraumatic Stress Disorder (PTSD) diagnosis and the genuine impact of PTSD on the behavior of war veterans, greater weight may be given to the premise that PTSD is a mental disorder that provides grounds for a "mental status defense, " such as insanity, a lack of mens rea, or self-defense. Although considerable impediments remain, given the current political climate, Iraq and Afghanistan …
