A Burkean Perspective On Patent Eligibility, Part Ii: Reflections On The (Counter)Revolution In Patent Law, Thomas F. Cotter Jan 2010

A Burkean Perspective On Patent Eligibility, Part Ii: Reflections On The (Counter)Revolution In Patent Law, Thomas F. Cotter

Articles

In 2007, I published an essay in the Berkeley Technology Law Journal, titled A Burkean Perspective on Patent Eligibility, in which I discussed how the United States Court of Appeals for the Federal Circuit and the United States Patent and Trademark Office had discarded various doctrines relating to patent eligibility - among them, rules that all patentable inventions must pertain to the technological arts, that they may not read on mental steps, and that patentable processes must effect a physical transformation - in favor of an approach that asked only whether an invention had practical utility and was predictable in …

Parents' Perceptions And Parental Stress Related Obesity Of Children In United Arab Emirates, Salma Omar Sbait Ai-Nuaimi

Theses

Aim: This study aims to explore parents’ perception of obesity in children and stress related to obesity during childhood period in Emirate of Abu Dhabi in United Arab Emirates.

Background: The prevalence of excess weight among children is increasing in both developed and developing countries. Overweight and obesity are leading cause of the most common health problems in children. The degree of parents’ perception about their child’s weight is likely to play a critical role in the development and management of childhood obesity. Greater parental perception and involvement is likely to encourage more active monitoring and controlling of child’s dietary …

The Burdens Of Ownership: Reasons For Preferring Renting, Sabine Moeller, Kristina Wittkowshi Jan 2010

The Burdens Of Ownership: Reasons For Preferring Renting, Sabine Moeller, Kristina Wittkowshi

Research Collection Lee Kong Chian School Of Business

Purpose: The purpose of this study is to identify and assess the importance of proposed determinants of the growing consumer preference for renting consumer goods, as opposed to the actual transfer of ownership. Design/methodology/approach: Following a qualitative preliminary study and a literature review, six factors are identified as possible determinants of a preference for non-ownership modes of consumption. These are examined in a quantitative study using a sample of 461 members of a German online peer-to-peer sharing network. Hypotheses regarding the proposed determinants are tested using factor analysis and structural equation modelling. Findings: The results show that the demand for …

Work-Family Conflict In Work Groups: Social Information Processing, Support, And Demographic Dissimilarity, Devasheesh P. Bhave, Amit Kramer, Theresa G. Glomb Jan 2010

Work-Family Conflict In Work Groups: Social Information Processing, Support, And Demographic Dissimilarity, Devasheesh P. Bhave, Amit Kramer, Theresa G. Glomb

Research Collection Lee Kong Chian School Of Business

We used social information processing theory to examine the effect of work-family conflict (WFC) at the work group level on individuals' experience of WFC. Consistent with hypotheses, results suggest that WFC at the work group level influences individual WFC over and above the shared work environment and job demands. It was also observed that work group support and demographic dissimilarity moderate this relationship. Moderator analyses suggest that work group social support buffers WFC for individuals but is also associated with a stronger effect of work group WFC on individuals' WFC. Moreover, the work group effect on individuals' WFC was shown …

Personal Digital Assistants: Their Influence On Clinical Decision-Making And The Utilization Of Evidence-Based Practice In Baccalaureate Nursing Students, Carol S. Gorelick Jan 2010

Personal Digital Assistants: Their Influence On Clinical Decision-Making And The Utilization Of Evidence-Based Practice In Baccalaureate Nursing Students, Carol S. Gorelick

Electronic Theses and Dissertations

During the last decade, the advent of the personal digital assistant (PDA) and the development of clinical software specific to nursing practice have changed the way that many nurses manage information and workload. More recently, PDAs have become a standard tool in undergraduate nursing education. Though there is substantial discussion in the literature on PDA technology, the emphasis there has been descriptive and anecdotal. Since 2002, nurse authors have reported that PDA use has reduced medication errors and streamlined data gathering. This has lead to speculation that use of the PDA is a clinical tool that supports evidence-based practice and …

Active And Passive Rorschach Movement Responses: Toward A Historically And Experientially Grounded Revision Of Scoring Criteria, Patrick James Mcelfresh Jan 2010

Active And Passive Rorschach Movement Responses: Toward A Historically And Experientially Grounded Revision Of Scoring Criteria, Patrick James Mcelfresh

Electronic Theses and Dissertations

This study explored the Rorschach Comprehensive System's active and passive (a and p) movement scores and presents revised scoring criteria that reflect both historical commentary and qualitative research. A review of a and p movements included a thorough and reflective reading of historical and contemporary literature on the three movement percepts (i.e., human, animal, and inanimate) and traced the development of the Rorschach active and passive movement superscripts. Active and passive movement responses were then explored through a qualitative research study. Participants took part in a complete Rorschach administration, then wrote vivid descriptions of their movement responses, and finally, engaged …

Flirting As A Liminal Experience: A Dialogue Between A Philosophical-Phenomenological Understanding Of Liminality And An Empirical-Existential Study Of Flirting, Rune Lassen Mølbak Jan 2010

Flirting As A Liminal Experience: A Dialogue Between A Philosophical-Phenomenological Understanding Of Liminality And An Empirical-Existential Study Of Flirting, Rune Lassen Mølbak

Electronic Theses and Dissertations

In this dissertation I bring out concealed aspects of the lived experience of flirting by studying it neither as a subjective act nor as an objective behavior, but as a liminal event. Liminality is an anthropological concept that designates a realm of experience that falls outside identity and mutually exclusive binaries. I argue that flirting is a liminal experience in so far as it is an experience that both constitutes me through the other and is constituted by me as a way of relating to the other. What is primary is thus not self or other, but the relation or …

Increasing amounts of clinical research data are collected by manual data entry into electronic source systems and directly from research subjects. For this manual entered source data, common methods of data cleaning such as post-entry identification and resolution of discrepancies and double data entry are not feasible. However data accuracy rates achieved without these mechanisms may be higher than desired for a particular research use. We evaluated a heuristic usability method for utility as a tool to independently and prospectively identify data collection form questions associated with data errors. The method evaluated had a promising sensitivity of 64% and a …

Sequential Incoherence In A Multi-Party Synchronous Computer Mediated Communication For An Introductory Health Informatics Course, Jorge R Herskovic, J Caleb Goodwin, Pamela A Bozzo Silva, Irmgard Willcockson, Amy Franklin

Online courses will play a key role in the high-volume Informatics education required to train the personnel that will be necessary to fulfill the health IT needs of the country. Online courses can cause feelings of isolation in students. A common way to address these feelings is to hold synchronous online "chats" for students. Conventional chats, however, can be confusing and impose a high extrinsic cognitive load on their participants that hinders the learning process. In this paper we present a qualitative analysis that shows the causes of this high cognitive load and our solution through the use of a …
