"A Cage Of Ovulating Females" : Mary Breckinridge And The Politics Of Contraception In Rural Appalachia, Dana Allen Johnson
"A Cage Of Ovulating Females" : Mary Breckinridge And The Politics Of Contraception In Rural Appalachia, Dana Allen Johnson
Theses, Dissertations and Capstones
Mary Breckinridge and the Frontier Nursing Service have been the focus of intense scholarly effort over the last twenty years. Scholarship on Mary Breckinridge has centered on her healthcare reform work in Appalachia and its effects on the local residents and culture. This thesis examines the oral contraceptive trial that the FNS performed in Leslie County in the late 1950s and early 1960s. Although Breckinridge and the FNS maintained a restrictive contraceptive stance, they paradoxically permitted the contraceptive trial to be conducted on their patients in Leslie County. The decision to participate in the contraceptive trial resulted from a complex …

Growth And Age At Reproductive Maturity Of The Carolina Pigmy Rattlesnake, Sistrurus M. Miliarius (Reptilia: Serpentes), Kevin Robert Messenger
Theses, Dissertations and Capstones
Growth and age at reproductive maturity are life history attributes that play an important role in the development of proper management strategies. The Carolina Pigmy Rattlesnake, Sistrurus m. miliarius, is one of two dwarf rattlesnake species. The subspecies ranges from eastern NC to nearly the southern tip of SC and into the northeastern portion of GA. In NC, where the species’ status is of Special Concern, fragmentation and land development have destroyed most of its historic range. Its small size also makes it highly susceptible to predation. In some parts of the range, commercial collection is another pressure the species …
Design And Performance Analysis Of Genetic Algorithms For Topology Control Problems, Cem Safak Sahin
Design And Performance Analysis Of Genetic Algorithms For Topology Control Problems, Cem Safak Sahin
Dissertations, Theses, and Capstone Projects
In this dissertation, we present a bio-inspired decentralized topology control mechanism, called force-based genetic algorithm (FGA), where a genetic algorithm (GA) is run by each autonomous mobile node to achieve a uniform spread of mobile nodes and to provide a fully connected network over an unknown area. We present a formal analysis of FGA in terms of convergence speed, uniformity at area coverage, and Lyapunov stability theorem.
This dissertation emphasizes the use of mobile nodes to achieve a uniform distribution over an unknown terrain without a priori information and a central control unit. In contrast, each mobile node running our …
How Counseling Helps: An In-Depth Look At Domestic Violence Counseling, Sonya V. Crabtree-Nelson
How Counseling Helps: An In-Depth Look At Domestic Violence Counseling, Sonya V. Crabtree-Nelson
Dissertations
Intimate partner violence (IPV) is currently described by trauma researchers as a social epidemic (Briere & Jordan, 2004) . The array of domestic violence services we currently have in the United States were started 30 years ago by women victims assisting other women. Currently, the services we have for victims of IPV are largely unchanged and the literature lacks information on what is helpful to victims of IPV in a domestic violence counseling setting. The research points to the fact that women seeking domestic violence counseling experience an array of physical and mental health sequelae as a result of the …
Exploring The Relationship Between Work, Family And Religion Among Clergy Families, Lenore Johnson
Exploring The Relationship Between Work, Family And Religion Among Clergy Families, Lenore Johnson
Dissertations
Studies examining how working adults manage the competing demands of family, home and work shed light on the interconnectedness of public and private life. The notion that private life is a refuge separate from work is highly contested, and the experiences of clergy families add further support to such claims. However, while clergy families experience many of the same strains as other families, the relationship between public and private life is noticeably impacted by the inclusion of religion, adding further complications to the process of balancing multiple responsibilities. In this study, I explore the complex relationship between these aspects of …
An Overarching Defense Of Kant's Idea Of The Highest Good, Alonso Villaran
An Overarching Defense Of Kant's Idea Of The Highest Good, Alonso Villaran
Dissertations
The main goal of this dissertation is to develop an overarching defense of Kant's idea of the highest good, against the criticisms pointed out in the English-speaking world, within the framework of the so-called "Beck-Silber controversy."
As it is known, since the second half of the last century, when the "Beck-Silber controversy" started, Kant's idea of the highest good has been subject to a massive attack. These attacks motivated, in turn, the emergence of a counterforce of defenders, a group that I attempt to join through this work. Particularly, I have identified six criticisms against Kant's idea of the highest …
Forced-Exercise Alleviates Neuropathic Pain In Experimental Diabetes: Effects On Voltage-Gated Calcium Channels, Sahadev A. Shankarappa
Forced-Exercise Alleviates Neuropathic Pain In Experimental Diabetes: Effects On Voltage-Gated Calcium Channels, Sahadev A. Shankarappa
Dissertations
Exercise is now established as an integral adjunct to the management of diabetes. Diabetic polyneuropathy, a painful complication of diabetes, remains untreatable, emphasizing a critical need for improved therapeutic strategies. Recent evidence suggests that exercise may facilitate recovery of peripheral nerve function in diabetes. However, the mechanism by which exercise protects against diabetes-induced nerve dysfunction is unknown. In this dissertation we hypothesized that forced-exercise protects against experimental DPN by preventing glucose-associated alterations of voltage-gated calcium currents (VGCC) in small diameter dorsal root ganglion (DRG) neurons. Using behavioral, nerve-electrophysiology and patch-clamp methodology we examined the functional consequences of forced-exercise (treadmill, 5.4 …
Moral Distress And Avoidance Behavior In Nurses Working In Critical Care And Non-Critical Care Units, Mary Jo De Villers
Moral Distress And Avoidance Behavior In Nurses Working In Critical Care And Non-Critical Care Units, Mary Jo De Villers
Dissertations
Significance: Nurses facing impediments to what they perceive as moral practice may experience inner turmoil, frustration, and moral distress. These scenarios may culminate in resignation from employment at the individual level, increased attrition at the systems level, and poor patient outcomes, including increased morbidity and mortality.
Purpose: To explore the relationships between moral distress and avoidance thoughts and behavior between nurses currently practicing in critical care and non-critical care settings.
Methods: A descriptive cross-sectional comparative design was used. The sample was comprised of a randomized subset of 370 critical care nurses, a convenience sample of 87 nurses from a nursing …
Joy As Attunement And End In The Philosophies Of Martin Heidegger And Henri Bergson, Justin Albert Harrison
Joy As Attunement And End In The Philosophies Of Martin Heidegger And Henri Bergson, Justin Albert Harrison
Dissertations
Martin Heidegger claims that attunement is one of the primordial ways in which Dasein understands its world. He focuses on anxiety as the fundamental attunement in which Dasein can more authentically uncover its Being. However, it is necessary to ask if anxiety is the only attunement out of which one can most authentically appropriate Being. Heidegger seems to have an unexamined bias in favor of "negative" attunements (anxiety, boredom) and never undertakes an extended analysis of "positive" moods such as joy or happiness. This dissertation is an examination of joy as a fundamental attunement through the works of Henri Bergson …
Factors Of Body Image Dissatisfaction Among High School Female Athletes, Trisha Margaret Karr
Factors Of Body Image Dissatisfaction Among High School Female Athletes, Trisha Margaret Karr
Dissertations
The relation between sport type and body image dissatisfaction was investigated with a sample of high school female athletes living in the Chicago area. In order to assess sport type, gymnastics, cross country, and softball were designated for the comparison of aesthetic, endurance, and ball sports. Low family cohesion and high independence were predictive of body image concerns among gymnasts, whereas high cohesion and infrequent conversations about sport participation with mothers were associated with body dissatisfaction among runners. Although body mass index was a risk factor for body image concerns across all sports, athletic self-efficacy was protective against body dissatisfaction …
I Love You (But I Can't Look You In The Eyes): Explicit And Implicit Self-Esteem Predict Verbal And Nonverbal Response To Relationship Threat, Julie Longua Peterson
I Love You (But I Can't Look You In The Eyes): Explicit And Implicit Self-Esteem Predict Verbal And Nonverbal Response To Relationship Threat, Julie Longua Peterson
Dissertations
Research has revealed the value of studying communication patterns, both verbal and nonverbal, in couple conflict discussions (Gottman & Levenson, 2000; Noller, Feeney, Bonnell, & Callan, 1994). In fact, the study of behavioral reactions to relationship conflict has been central to predicting important relationship outcomes, such as relationship satisfaction and breakup (e.g. see Gottman, 1998 for a review). The goal of the current dissertation was to explore how explicit (i.e., conscious, deliberate) and implicit (i.e., unconscious, automatic) self-esteem correspond to people's self-reported approach and avoidance verbal and nonverbal behaviors following a relationship threat manipulation (Study 1) and people's observer-rated approach …
Testing The Relationship Between Body Dysmorphic Disorder And Pathological Skin Picking Using A Bidimensional Model Of ‘Fear’ And ‘Anger', Nicole Christine Egan
Testing The Relationship Between Body Dysmorphic Disorder And Pathological Skin Picking Using A Bidimensional Model Of ‘Fear’ And ‘Anger', Nicole Christine Egan
Dissertations and Theses @ UNI
Body image concerns are pervasive throughout Western culture, but there is a subset of the population who become so preoccupied with specific aspects of their appearance that it leads to clinically significant distress and impairment in their daily lives. This study examined symptoms of two disorders dealing with body concerns: Body Dysmorphic Disorder (BDD) and Pathological Skin Picking (PSP). The primary purpose of this study was to use the bidimensional model of 'fear' and 'anger' (Lara et al., 2006) to test the relationship between BOD & PSP. The model suggests that BDD and PSP are both characterized by high 'anger' …

Gathering Moss: The Nrla's Resistance To Legislative Change , James J. Brudney
Faculty Scholarship
Why has the NLRA been so resistant to legislative change for more than 60 years? How was Congress able to enact two major labor relations laws within a 12-year period (1935 and 1947) but then unable to approve proposed reforms in the years since 1947? In an effort to answer these questions, the article closely examines contemporaneous newspaper accounts from the 1935 and 1947 legislative “successes” as well as from two more recent congressional “failures” in 1978 and 1992. The article’s examination proceeds based on an analytic framework borrowed from political scientist John Kingdon that posits a recurring interplay among …

Confirmatory Legislative History , James J. Brudney

Textualists and intentionalists regularly lock horns over the proper approach to construing statutory language regarded as inconclusive. The interpretive debate seems less contentious, however, when the words of the law are deemed clear. There may be reasonable disagreement as to whether the text at issue in a particular controversy has a plain meaning, but if it does then that meaning arguably preempts further inquiry. Since 1990, Supreme Court majority opinions are replete with declarations such as: "Given [a] straightforward statutory command, there is no reason to resort to legislative history"; or "we do not resort to legislative history to cloud …

Organizations Matter: They Are Institutions, After All, John Linarelli
Scholarly Works
Judge Posner (2010) offers a substantial agenda for organization economics. He advises us on how organization economics can shed substantial light on some of the most pressing social problems of the day. I comment on two of the areas he selects for discussion and offer some comments on the relationship of organization economics to new institutional economics. Judge Posner surely is right to argue that organization economics can help us understand the failures of corporate governance in regulating executive pay. Moreover, with additional and more institutionally nuanced theorizing, organizational economics should further our understanding of the work of judiciaries in …

Can Urban University Expansion And Sustainable Development Co-Exist?: A Case Study In Progress On Columbia University, Patricia E. Salkin, Keith H. Hirokawa
Scholarly Works
This Article employs sustainability as a framework to analyze the recent proposed physical expansion plans of Columbia University for the purpose of illustrating the complexities that arise in urban development and higher education practices, as well as the problems of trying to simultaneously implement both. Governments and courts traditionally provide a high level of deference and leniency in the application of land-use laws and regulations when it comes to siting and expansion issues for educational institutions, yet institutions of higher education, particularly those located in urban areas, create unique dilemmas for sustainability. For example, available land for expansion is often …

What Would Coase Do? (About Parking Regulation), Michael Lewyn
Scholarly Works
Like many government regulations, municipal minimum parking requirements exist to prevent externalities - most notably the congestion, pollution and greenhouse gas emissions that occur when motorists drive around a city searching for scarce parking. But because such regulations make parking (and thus driving) cheaper, such regulations may in fact increase congestion and pollution, thus creating, rather than reducing, externalities.
High-Cost Religion, Religious Switching, And Health, Christopher P. Scheitle, Amy Adamczyk
High-Cost Religion, Religious Switching, And Health, Christopher P. Scheitle, Amy Adamczyk
Publications and Research
Previous research has devoted significant attention to understanding the link between health and personal religious beliefs and practices, typically finding that more religious people tend to have better health. However, almost no attention has been given to how switching religious groups or leaving religion altogether is related to self-reported health. Due to selection and causation mechanisms, switching from high-cost groups that are theologically and culturally exclusive could be associated with poor health more than switching from other religious groups. Using data from the 1972 through 2006 General Social Surveys, we examine the relationship between health and religious switching as moderated …

Computer Science Faculty Publications and Presentations
A significant problem of designing 3D virtual worlds (such as metaverses) is developing a scalable architecture that can manage millions of simultaneous users in an interactive 3D environment. This paper presents XPU (Extremely Partitioned Universe), a hierarchical client-server architecture for developing highly scalable metaverses. This design addresses the problem of dynamically partitioning the world to manage network and computing resources.
Birmingham's Jewish Women And Social Reform 1880-1980, Kaye Cochran Nail
Birmingham's Jewish Women And Social Reform 1880-1980, Kaye Cochran Nail
All ETDs from UAB
Many historians and scholars have argued that Jewish women kept a low profile during periods of southern social reform since the late nineteenth century. This thesis reveals a little known pattern of activism among some Birmingham Jewish women, encompassing many trends of social change over one hundred years, from 1880 to 1980. Nineteenth century Jewish women immigrants and migrants brought to the South a social conscience rooted in the traditions of their Jewish faith. They mentored their daughters, sisters, and neighbors in the ways of community goodwill. During the Progressive Era, their numbers and voices grew in the public sphere, …

Putting The Community Back Into The "Community Benefit" Standard, Jessica Berg

Disputes about tax exemption for hospitals are occurring all over the country. Local tax authorities have revoked tax- exempt status for some hospitals. State governments are considering whether to require minimum amounts of charity care in exchange for tax exemption. Congress is debating whether hospitals should remain a part of the nonprofit sector at all. At the same time, uninsured individuals are suing hospitals for unfair billing and collection practices. Creative accounting and expansive definitions of "free" care have led to a variety of non ideal practices by hospitals in order to balance their bottom line, while maintaining tax-exempt status. …
The Parity Cure: Solving Unequal Treatment Of Mental Illness Health Insurance Through Federal Legislation, Christopher J. Churchill
The Parity Cure: Solving Unequal Treatment Of Mental Illness Health Insurance Through Federal Legislation, Christopher J. Churchill
Georgia Law Review
American health care reform has drawn both impassioned critics and vociferous supporters. Although underinsured and uninsured Americans face a dire plight, the mentally ill-even those with private health insurance-confront even greater hurdles. While drawing substantially less outcry, many insurance plans place limits on mental illness coverage that do not apply to physical illnesses. Though Congress recently passed the Mental Health Parity and Addiction Equity Act of 2008 (the MHPAEA), it did not solve the problem. The MHPAEA eliminates some disparity-such as higher deductibles for mental health treatment-but still allows insurers to impose unequal annual coverage limits. Furthermore, the MHPAEA shares the …
The Federal Rules Of Civil Procedure And Legal Realism As A Jurisprudence Of Law Reform, David Marcus
The Federal Rules Of Civil Procedure And Legal Realism As A Jurisprudence Of Law Reform, David Marcus
Georgia Law Review
Since the 1930s, legal realism has weathered claims that its adherents had no use for legal rules and lacked a positive program of law reform. This Article uses the Federal Rules of Civil Procedure, the major procedural reform of the twentieth century, to illuminate more accurately the treatment of rules in realism as well as its constructive potential. It draws upon the published and unpublished writings of Charles Clark, the primary author of the Federal Rules and a leading realist, to describe a realist procedural jurisprudence and to explain why the Federal Rules neatly illustrate this jurisprudence in practice. Part …
