Systematic Development And Validation Of A Course Of Instruction In Prior Learning Assessment, John D. Mcnally
Systematic Development And Validation Of A Course Of Instruction In Prior Learning Assessment, John D. Mcnally
USF Tampa Graduate Theses and Dissertations
Many post-secondary schools across the country offer adult working students an opportunity to obtain at least partial credit for work and life experiences in their curriculum through portfolios. The primary goal of this project was to design, develop and evaluate a portfolio course for adult students at a small independent university. Design emphasized adult learning theory and incorporated instructional design best practices throughout. Also significant to the design was the implementation of the Quality Matters ™ Rubric. The project focus was to intertwine the six assumptions of adult learning theory while implementing best practices and effective instructional strategies, and to …

An Analysis Of Crime Statistics To Tourist Areas And Non-Tourist Areas In New Orleans, Kim H. Williams
An Analysis Of Crime Statistics To Tourist Areas And Non-Tourist Areas In New Orleans, Kim H. Williams
Caesars Hospitality Research Summit
The economic impact of travel and tourism to New Orleans, Louisiana is immense. In New Orleans, tourism is one of the leading industries which accounts for the city’s economic recovery in Post-Katrina New Orleans. Tourism was one of the major industries to the New Orleans economy and accounted for 35% or $210 million of the City of New Orleans’ annual operating budget (New Orleans Tourism Marketing Corporation, 2008). Yet, tourism leaders and officials are plagued with the negative perception of crime as New Orleans tops U.S. cities as the murder capital of the United States (McCarthy, 2007). The negative perception …

"You Crossed The Fog Line!" - Kansas, Pretext, And The Fourth Amendment, Melanie Wilson
"You Crossed The Fog Line!" - Kansas, Pretext, And The Fourth Amendment, Melanie Wilson
Scholarly Works
This article examines orders recently decided in the District of Kansas to show, circumstantially, that Kansas police are using "fog-line" traffic infractions as an excuse to stop out-of-state cars driven by people of Hispanic ethnicity and to investigate for drug trafficking. If a stop uncovers contraband, the defendant is charged with a crime, sometimes in federal court. At a subsequent hearing to evaluate a defendant’s motion to suppress the contraband, the officer testifies to his reason for the stop – “You crossed the fog line,” “drifted from your lane of travel,” or “failed to maintain a single lane.” The officer …
Women's Participation In Transitional Justice Mechanisms: Comparing Transitional Processes In Timor Leste And Sierra Leone, Holly L. Guthrey
Women's Participation In Transitional Justice Mechanisms: Comparing Transitional Processes In Timor Leste And Sierra Leone, Holly L. Guthrey
Electronic Theses and Dissertations
Women tend to suffer a disproportionate amount of sexual and reproductive violence during periods of conflict, though they generally participate at a lower rate than men in transitional justice processes. Because participation is discussed in procedural justice literature as being crucial to securing feelings of justice and dignity within victims of violence, the lack of women’s participation in transitional process indicates that justice outcomes could suffer without equitable participation of women. In light of this issue, this study uses a comparative case study analysis method to investigate women’s involvement in the transitional justice processes in Timor Leste and Sierra Leone …

Assessing Student Learning Outcomes In Aqip Accredited Community And Technical Colleges, Constance M. Schwass
Assessing Student Learning Outcomes In Aqip Accredited Community And Technical Colleges, Constance M. Schwass
Dissertations
Accreditation in higher education institutions continues to be regarded as the seal (f) obstacles encountered that may impede the assessment of student learning outcomes processes. Responses from 75 individuals (a 52.4% response rate) responsible for their college's assessment of student learning revealed that assessment plans at these AQIP accredited institutions do exist, and are written, implemented, and embedded as part of their institutional culture and operational strategy. Significant differences between General and Occupational Education programs were found in the use of comparative data, communication with external stakeholders, faculty involvement in the assessment practices, perceived levels of improvement in the teaching/learning …

Missouri Law Review
Even though almost everyone concedes that the caseload crisis in Missouri is real, the dire state budget situation makes a significant infusion of new resources virtually impossible. So if Missouri, like most other states, is truly broke, then realistically can the state find the funds needed to fix its broken indigent defense system? That was the question at the heart of the Symposium. The Symposium presenters and commentators, most of whom had worked at some point in their career as a public defender, brought a wealth of experience to the discussion. While the presentations and comments made that day, together …

Public Defender Elections And Popular Control Over Criminal Justice, Ronald F. Wright
Public Defender Elections And Popular Control Over Criminal Justice, Ronald F. Wright
Missouri Law Review
Part I of this Article reviews the existing evidence about the election of criminal justice officials and presents new evidence about the campaigns and outcomes in public defender elections. Voters respond to candidates for the public defender's office much in the same way that they react to candidates for the prosecutor's office: they choose the incumbent, even more often than they do for legislators and chief executives.2 The candidates themselves also behave fairly similarly in public defender and prosecutor election campaigns. Both the prosecutor and the defender candidates spend a disappointing amount of time in their campaign speeches discussing the …
Ethical Obligations Of Indigent Defense Attorneys To Their Clients, Phyllis E. Mann
Ethical Obligations Of Indigent Defense Attorneys To Their Clients, Phyllis E. Mann
Missouri Law Review
This Article is a basic introduction to the provision of indigent defense services in state courts throughout the country and the ethical obligations of the attorneys who provide those services. First, the Article briefly quantifies what currently exists in our right to counsel systems - what we know, and what we do not know. The Article then discusses the rules that generally govern the ethics of representation provided by indigent defense attorneys. Third, the Article examines the measures by which attorneys can know whether they are fulfilling and will continue to fulfill their ethical obligations. Finally, the Article discusses the …
Raising The Bar: Standards-Based Training, Supervision, And Evaluation, Adele Bernhard
Raising The Bar: Standards-Based Training, Supervision, And Evaluation, Adele Bernhard
Missouri Law Review
In this short Article, I sketch the methodology my colleagues and I at Pace Law School use to incorporate practice standards into our clinical teaching and reflect on how a standards-based teaching paradigm could be adapted to the training, supervision, and evaluation of public defenders. Then, I briefly consider how standards and standards-based teaching assist in the administration of assigned counsel plans and in the evaluation of the performance of public defender organizations. Although this Article does not cover any of these topics in depth, my goal is to introduce the reader to a standards-based approach to teaching and suggest …
