Strong Medicine: Toward Effective Sentencing Of Child Pornography Offenders, Kristin Carlson
Strong Medicine: Toward Effective Sentencing Of Child Pornography Offenders, Kristin Carlson
Michigan Law Review First Impressions
In recent years, possessors of child pornography have entered the federal criminal justice at an alarming rate. In 2006, child pornography cases accounted for sixty-nine percent of the child exploitation cases that were prosecuted federally. Average federal sentences for these offenses also rose sharply, by about 300 percent over the past fourteen years. The mean sentence imposed for child pornography offenses increased from thirty-six months in 1994 to 109 months by 2008. The severe sentences imposed on possessors of child pornography in federal courts have inspired an ongoing deb ate. Critics feel the U.S. Sentencing Guidelines are too harsh on …

Moving Beyond Citation Analysis: How Surveys And Interviews Enhance, Enrich, And Expand Your Research Findings, Susann Devries, Robert Kelly, Paula M. Storm
Faculty Scholarship - University Library
A traditional mixed methods research model of citation analysis, a survey, and interviews was selected to determine if the Bruce T. Halle Library at Eastern Michigan University owned the content that faculty cited in their research, if the collection was being utilized, and what library services the faculty used. The combination of objective data gleaned from the citation analysis and survey coupled with the personal, in-depth information gained from the interviews was instrumental in increasing the value of the study for its use in collection management decisions, and showed how effectual the services and collection are in supporting the research …

Ideology forms and colors our attitudes and values in ways that lead to a tendency to accept or reject data according to how well or how poorly they cohere with that ideology. Previous research has suggested that the ideological divide in criminology is between criminologists who focus on strictly environmentalist theories that give short shrift to individual differences, and those who focus on individual differences and are favorably disposed to the biological sciences (Wright & Miller, 1998; Walsh & Ellis, 2004). The former tend to be radicals and liberals and the latter tend to be conservatives and moderates, although there …

In 2009, British epidemiologists Richard Wilkinson and Kate Pickett published "The Spirit Level: Why Greater Equality Makes Societies Strong", in which they argue that severely unequal societies produce high rates of ‘social pain”: adverse outcomes including school drop out, teen pregnancy, mental health problems, lack of social trust, high mortality rates, violence and crime, low social participation. Their volume challenges the belief that the extent of poverty in a community predicts negative outcomes. They assert instead that the size of the inequality gap defines the material and psychological contours of the chasm between the wealthiest and the most impoverished, enabling …

I am proud to introduce the 19th annual Southwestern Oklahoma State University Fact Book. The Fact Book provides a ready source of information to answer frequently asked questions about the University and its operations. Unless otherwise noted, the information in this Fact Book came from computer-generated reports that are printed following the tenth class day of each fall semester. Because of student fluctuations during the semester, numbers will not match other published enrollment numbers that may be based on enrollment at the end of a semester.

Conference Theme
The philosophy of criminal law is at a turning point in Canada. The adoption of the Charter of Rights and Freedoms has given the Supreme Court of Canada unprecedented latitude to engage with principles of moral, political, and legal philosophy when elaborating its criminal law jurisprudence. Be it in the context of discussions about the constitutionalization of various aspects of moral innocence, the harm principle, the rule of law, the availability of legal rights to …

Criminal Procedure Crime Victims' Bill Of Rights, Georgia State University Law Review
Georgia State University Law Review
The Act provides for crime victims’ rights in Georgia and creates substantive mechanisms for directing agencies to carry out these victim’s rights. These include the right to be present and heard in the sentencing phase of a criminal proceeding against the accused, including proceedings in juvenile court. The Act also provides that victims must be notified regarding the disposition of criminal proceedings or the status of the accused, such as release or escape, and requires the prosecuting attorney or the corrections department to provide such notice. Judges are also required to make a finding in every case as to whether …

Overcoming Defiance Of The Constitution: The Need For A Federal Role In Protecting The Right To Counsel In Georgia, Stephen B. Bright, Lauren Sudeall Lucas
Faculty Publications By Year
In their issue brief, Mr. Bright and Ms. Lucas discuss the problems that have existed in Georgia’s indigent defense system since Gideon was handed down. They contend that “[a]ll three branches of Georgia’s government have failed in their constitutional responsibility to ensure that poor people accused of crimes are effectively represented by competent lawyers.” They also argue that “[t]he federal government, which has made immense contributions to the prosecution of criminal cases in Georgia through grants to law enforcement, prosecutors, and courts, shares responsibility for the integrity of Georgia’s criminal justice system and the enforcement of the constitutional right to …

Dereliction Of Duty: Training Schools For Delinquent Parents In The 1940s, Sarah K. S. Shannon
The Journal of Sociology & Social Welfare
Parental culpability for juvenile delinquency has permeated social welfare thought and practice throughout U.S. history. This article presents a case study of one Midwestern municipality's efforts to create a training school for parents as a remedy for delinquency in the 1940s. The case study illustrates how city leaders attempted to put theory about delinquency causation into practice by forging a collaborative intervention strategy among various community partners including public schools, social welfare agencies, and law enforcement. In light of the case study, this article examines historical and contemporary efforts to punish parents of juvenile delinquents.
Brady's Bunch Of Flaws, Daniel S. Medwed
Brady's Bunch Of Flaws, Daniel S. Medwed
Washington and Lee Law Review
The 1970s television program The Brady Bunch provided a lighthearted and optimistic portrayal of American family life. A divorced man with three brown-haired boys married a divorced woman with three blonde daughters. They melded together into a happy, well-adjusted crew committed to mad-cap adventures accompanied by syrupy background music. Yet the promise of The Brady Bunch was illusory. Divorce has wreaked havoc on this country. The problems that derive from divorce and remarriage are multifaceted; they seldom lend themselves to tidy resolution in thirty minutes, let alone a lifetime. The show provided a distractionand a disservice. It sent an inaccurate …
The Worldwide Accountability Deficit For Prosecutors, Ronald F. Wright, Marc L. Miller
The Worldwide Accountability Deficit For Prosecutors, Ronald F. Wright, Marc L. Miller
Washington and Lee Law Review
In democratic governments committed to the rule of Law, prosecutors should be accountable to the public, just like other powerful government agents who make important decisions. The theoretical need for prosecutor accountability, however, meets practical shortcomings in criminal justice systems everywhere. Individual prosecutors everywhere express allegiance to the rule of Law through the wise decisions made by each prosecutor and across offices as a whole. But the claim "trust us" does not in fact generate the level of public trust that one should expect in a government of Laws. Institutional strategies to guarantee prosecutor accountability all fall short of the …

Introduction, Erik Luna, Marianne Wade
Introduction, Erik Luna, Marianne Wade
Washington and Lee Law Review
Today, American prosecutors exercise enormous discretion in a sequence of decisions-from initial case acceptance or declination, to charging and plea bargaining, to pre-trial and trial strategy, to sentencing upon conviction-often without meaningful internal or external review. In many jurisdictions, the prosecution effectively makes the Law, enforces it against particular individuals, adjudicates their guilt, and sets their punishment. For all intents and purposes, prosecutors are the criminal justice system through their awesome, deeply problematic powers.
The French Prosecutor In Question, Jacqueline S. Hodgson
The French Prosecutor In Question, Jacqueline S. Hodgson
Washington and Lee Law Review
Both the pre-trial and dispositive roles of the French prosecutor have continued to expand over the last decades with a resulting shift in power away from the trial judge and the juge d'instruction. The recommendations of the Liger Commission in 2009 went beyond the redistribution of authority and proposed the abolition of the juge d'instruction, placing the prosecutor in charge of all criminal investigations, even the most serious, complex, and sensitive. At the same time, the prosecutor's role and status has been challenged in a number of ways-in particular concerning her function as judicial supervisor of the detention and interrogation …
