Data for this investigation come from 36 qualitative in-depth interviews completed between February and April 2010. The aim of the research was to conduct a process evaluation of Gateway Foundation programming for state probation and parole clients in St. Louis and jointly produce a final report for the organization. The specific research questions focused on (1) the challenges men face as they attempt to overcome substance abuse; (2) how those challenges are related to past experiences with crime, including offending and victimization; and (3) the effectiveness of Gateway programming, from the points of view of program participants, including whether there …
School Factors That Promote Academic Resilience In Urban Latino High School Students, Christine Michelle Fallon
School Factors That Promote Academic Resilience In Urban Latino High School Students, Christine Michelle Fallon
Dissertations
The purpose of this ex post facto quantitative study was to examine the relationship between the academic optimism of schools and academic resilience in urban Latino high school students attending those schools. This study sought to address three research ideas. First, it was hypothesized that, consistent with previous research, student achievement is related to the level of academic optimism of schools. A second purpose of the study was to examine the relationship between academic achievement with academic resilience for students with multiple risk factors, specifically, Latino students from low SES backgrounds attending an urban high school. Thirdly, it was hypothesized …
Domestic Violence Or Elder Abuse? Why It Matters For Older Women, Teresa Kilbane, Marcia K. Spira
Domestic Violence Or Elder Abuse? Why It Matters For Older Women, Teresa Kilbane, Marcia K. Spira
Social Work: School of Social Work Faculty Publications and Other Works
Law enforcement and legal services are 2 systems that respond to reports of abuse against women through programs such as adult protective services (APS) and domestic violence (DV). APS and DV systems operate independently and define the cause of the abuse differently. The designation of a woman as having suffered domestic violence or having been abused often depends on which system she enters. This designation can lead to different options for women to obtain services. Aging may further complicate access and usability of these systems to respond to the needs of abused elderly. Using vignettes, this article explores the definitions …

Cap And Trade': Reducing Carbon Emissions And The Climate Change Act 2008, Megan Phillips
Cap And Trade': Reducing Carbon Emissions And The Climate Change Act 2008, Megan Phillips
The Plymouth Law and Criminal Justice Review
The Climate Change Act 2008 came into force on the 26th November 2008 with the aim of establishing effective regulatory mechanisms to limit the UK's carbon emissions and to mitigate the effects of climate change. The Act effectively introduces two elements into the legal system for reducing the UK's net carbon emissions. First, the legislation enacts measures to mitigate the current damage made to the climate, by introducing carbon reduction commitments and setting targets for industry sectors. Second, it enables the Secretary of State to adapt policies according to the progress of the system, information for which will be provided …
Challenging Compulsory Admission To Hospital Under The Mental Health Act 1983, Harry Perrin
Challenging Compulsory Admission To Hospital Under The Mental Health Act 1983, Harry Perrin
The Plymouth Law and Criminal Justice Review
The Mental Health Act 1983 provides for compulsory admission to hospital, under criteria designed to ensure individuals are not detained wrongly. This article examines the primary legal means by which compulsory admission can be challenged. Habeas corpus and judicial review offer means of examining the legality of a decision, based on the decision-making procedure. The efficacy of these mechanisms in mental health cases has come under scrutiny from the European Court of Human Rights. The Mental Health Review Tribunal conversely is equipped to examine legality based on the merits of the decision. The potential for conflict here, however, lies in …
The Concept Of Consent Under The Sexual Offences Act 2003, Jacqueline Scott
The Concept Of Consent Under The Sexual Offences Act 2003, Jacqueline Scott
The Plymouth Law and Criminal Justice Review
The concept of consent is fundamental in considering the crime of rape under the Sexual Offences Act 2003 (SOA). Consent was placed on a statutory footing for the first time by the SOA which defines consent alongside evidential and conclusive presumptions under sections 74-76, respectively. This article explores the position that unfortunately, neither significant clarity nor enhanced protection appears to have been embraced or achieved by the incorporation of consent.
Gender Based Crimes At The International Court, Sophie O'Connell
Gender Based Crimes At The International Court, Sophie O'Connell
The Plymouth Law and Criminal Justice Review
The International Criminal Court (ICC) was established in 2002 and its Statute (Rome Statute1 ) was heralded as an advanced enumeration of gender based crimes. However, in the three cases before the Court in which charges have been confirmed: The Prosecutor v Thomas Lubanga Dyilo2 (Lubanga), The Prosecutor v Germain Katanga and Mathieu Ngudjolo Chii 3 (Katanga and Ngudjolo) and The Prosecutor v Jean-Pierre Bemba Gombo4 (Bemba) there are either no charges for gender based crimes as in Lubanga5 or the charges are not comprehensive. This article examines why despite the extensive provision in the Rome Statute the ICC is …

Sex Representation On The Bench: Legitimacy And International Criminal Courts, Nienke Grossman
Sex Representation On The Bench: Legitimacy And International Criminal Courts, Nienke Grossman
All Faculty Scholarship
This essay examines the relationship between legitimacy and the presence of both male and female judges on international criminal court benches. It argues that sex representation – an approximate reflection of the ratio of the sexes in the general population – on the bench is an important contributor to legitimacy of international criminal courts. First, it proposes that sex representation affects normative legitimacy because men and women bring different perspectives to judging. Consequently, without both sexes, adjudication is inherently biased. Second, even if one rejects the proposition that men and women "think differently", sex representation affects sociological legitimacy because sex …
Balancing Liberty, Dignity And Safety: The Impact Of Domestic Violence Lethality Screening, Margaret E. Johnson
Balancing Liberty, Dignity And Safety: The Impact Of Domestic Violence Lethality Screening, Margaret E. Johnson
All Faculty Scholarship
This Article undertakes the first ever analysis of the consequences of the justice and legal system’s extensive use of lethality assessment tools for women subjected to abuse. An increasing number of states are now requiring their police, prosecutors, civil attorneys, advocates, service providers, and court personnel to assess women in order to obtain a score that indicates the woman’s lethality risk because of domestic violence. The mandated danger assessment screen of all women subjected to violence focuses only on the risk of homicide and thereby limits the definition of what is domestic violence. In addition, the accompanying protocol for the …

In Momentum: The Navigation, Narration, And Negotiation Of Continuing Professional Development By Mid-Career Artists In South West England, Karen Mary Smith
Other Faculty of Arts, Humanities and Business Theses
This thesis explores the Continuing Professional Development (CPD) of mid-career artists in England and the South West of England in particular during 2000 to 2010. It identifies what their needs are and asks what CPD means to them; how they navigate their careers through their practice; how they articulate their needs; and how they negotiate to fulfil those needs. It examines to what extent the providers’ thinking about, and provision of, CPD in the region is aligned with the needs of the artists themselves. The individual narratives of artists are represented at the centre of this research. The research was …
The Habitual Eccentricities Of The Solons Of Staffordshire: An Investigation Of The Circumstances Surrounding The Parliamentary Enquiry Into The Ill-Treatment Of Mrs Eliza Price Of Brierley Hill, 1845, David Cox
The Plymouth Law and Criminal Justice Review
This article investigates the circumstances surrounding a dramatic petition read out in the House of Commons in the late spring of 1845 which detailed the alleged ill-treatment of a heavily pregnant young married woman from Brierley Hill, Staffordshire by two parish constables acting upon the instructions of a county magistrate. What began as a minor squabble in two competing provincial magistrates' courts in the rapidly urbanizing Black Country resulted in a Parliamentary Enquiry and quickly escalated into a nationally aired debate on the capability and legality of the methods used by both the provincial magistracy and police to arrest, detain …
"A Mysterious, Arcane And Unique Corner Of Our Constitution": The Law Relating To The Duchy Of Cornwall, John Kirkhope
"A Mysterious, Arcane And Unique Corner Of Our Constitution": The Law Relating To The Duchy Of Cornwall, John Kirkhope
The Plymouth Law and Criminal Justice Review
Historically, legally and constitutionally the Duchy of Cornwall has been consistently referred to as 'simply' a 'private estate' allowing it to enjoy a privileged status with significant benefits and concessions. This article argues that this is a somewhat anachronistic position and one that demands further investigation not least because of the opaque nature of the institution and its accountability within a twenty-first century constitutional framework.

R V Southampton And Fatal Medical Negligence: An Anomaly Or A Sign Of Things To Come?, Gavin Ruddy
The Plymouth Law and Criminal Justice Review
A review of statistics concerning fatal medical negligence in the NHS shows that, despite fears of a 'compensation culture' and the right to life protected by Human Rights legislation, only about one in every 1,000 such cases is investigated by the courts. This appears to be largely due to very poor reporting of adverse incidents by health authorities. However, as a result of recent healthcare scandals, the reporting of incidents is expected to significantly increase in the near future. The case of R v Southampton University Hospitals NHS Trust 2006 illustrates the striking effect that enhanced levels of scrutiny can …
Purdy: The First Step On The Road Towards Assisted Suicide, Laura Sayer
Purdy: The First Step On The Road Towards Assisted Suicide, Laura Sayer
The Plymouth Law and Criminal Justice Review
This article considers how likely it is that English law will be amended in the near future to provide legal recognition and acceptance of assisted suicide in light of the 2009 House of Lords decision in Purdy. The extent to which Purdy has acted as a catalyst to generate formal legislative amendment is explored in the light of recent attempts to achieve a change in the law. Within this context the underlying and conflicting arguments of those in support and against the legalisation of assisted suicide are examined.

Creating A Balance In Sentencing Offenders: A Step Towards Restorative Justice, Lindsay Nichols
Creating A Balance In Sentencing Offenders: A Step Towards Restorative Justice, Lindsay Nichols
Master's Theses
Public sentencing preferences often determine the sentencing statutes created by legislators. Extracting public opinion is typically done through mass public opinion polls; however, research has found that these polls often produce misleading findings. In order to accurately dissect the various layers of laypersons' sentencing choices, a victim impact statement (VIS) and a statement of offender remorse were manipulated within a crime scenario depicting moderately severe crimes. A total of 215 participants were randomly assigned to one of the 16 conditions in this 2 (crime type: residential burglary or unarmed robbery) x 2 (VIS: absence or presence) x 2 (offender remorse …

On the campaign trail in 2008, presidential candidate and then-Senator Barack Obama promised to restore America’s place in the world by breaking with many of the national security policies put into effect by President George W. Bush. In January 2009, President Obama made numerous changes to United States foreign policy, including signing an executive order to close the prison at Guantanamo Bay, Cuba and announcing that the United States would not engage in interrogation techniques that constitute torture. In some respects, however, Obama has followed the example of President Bush - for example, in his resuscitation of a specialized military …

“Decision Rules” And Kids: Clarifying The Vagueness Problems With Status Offense Statutes And School Disciplinary Rules, Martin R. Gardner
Nebraska Law Review
Because they are dependent and vulnerable, young people have long been the recipients of governmental policies and legal measures aimed at promoting their welfare and protecting them in circumstances of perceived need. Through its parens patriae power, the state routinely maintains a paternalistic posture in its interactions with minors in hopes of assisting their development into mature and responsible adulthood. In similar fashion, governmentally employed educators are often loosely deemed to act in loco parentis and thus are sometimes thought to assume a quasi-parental relationship with their students. Juveniles are thus the recipients of unique legal attention in a variety …

Can Retributivism Be Progressive? A Reply To Professor Gray And Jonathan Huber, Chad Flanders

Professor David Gray and Jonathan Huber have done a great service in their Response to my Article, “Retribution and Reform.” They have helped me to see the wrong turns in my argument and the areas in which my argument needs to be clarified and amplified. In this brief Reply, I attempt to respond to some of their concerns.

What is the relationship of punishment theory to punishment practice? What should this relationship be? The last twenty years have seen an amazing rise in sophisticated and elegant theories of retributive justice of a Kantian, and more recently, an expressivist variety - a “retributivist revival.” As pure philosophical theorizing goes, this must surely be counted as real progress. But, those same twenty years have also seen increases in the length of criminal sentences, in the amount of activity subject to criminal sanction, and in the sheer number of people behind bars. Professor James Q. Whitman has famously said that we …
