An Affair To Remember: The State Of The Crime Of Adultery In The Military, Katherine Annuschat Nov 2010

An Affair To Remember: The State Of The Crime Of Adultery In The Military, Katherine Annuschat

San Diego Law Review

The recent cases against Penland and Yee demonstrate with clarity the military's willingness to pursue adultery prosecutions for questionable motives. In light of this fact, and the obsolescence of these statutes in the public mind, adultery should be removed from the enumerated offenses under article 134. Part II will discuss the history of the crime of adultery in American jurisprudence, including the current state of adultery as a crime, as well as the current public opinion on adultery in light of several recent high-profile adultery scandals in the media.

Part III will delve into the history of adultery prosecutions in …

Admitting Guilt By Professing Innocence: When Sentence Enhancements Bases On "Alford" Pleas Are Unconstitutional, Anne D. Gooch

Vanderbilt Law Review

A few days before Christmas in 1994, in Vineland, New Jersey, Charles Apprendi, Jr. was drunk. At 2:04 a.m., he fired several shots from a .22 caliber gun into the home of an African-American family in his neighborhood. By 3:05 a.m., he had been arrested and had admitted that he was the shooter. Apprendi was interrogated for several hours after these events. At 6:04 a.m., he apparently stated that he committed the crime because the victims were black, but he later retracted this statement. Apprendi was indicted on twenty-three counts in connection with the shooting, and eventually pleaded guilty to …

Don’T Forget Due Process: The Path Not (Yet) Taken In § 2254 Habeas Corpus Adjudications, Justin F. Marceau Nov 2010

Don’T Forget Due Process: The Path Not (Yet) Taken In § 2254 Habeas Corpus Adjudications, Justin F. Marceau

UC Law Journal

Countless articles and judicial opinions have been devoted to the task of deciphering the scope and application of the limitations on habeas corpus relief announced in the Anti- Terrorism and Effective Death Penalty Act of 1996 (AEDPA). Over the past ten years courts and scholars have developed an intricate framework of analysis for nearly every subsection of § 2254. The decade-long process of interpretation and commentary has been characterized by questions of statutory meaning and federalism that appear to be as irresolvable for courts as they are intriguing to academics. But in the rush to sort out the minutiae of …

Banking Crime Analysis And The Effectiveness Of Banking Supervision: Combining Game Theory And The Analytical Network Process Approach, Piter Abdullah Oct 2010

Banking Crime Analysis And The Effectiveness Of Banking Supervision: Combining Game Theory And The Analytical Network Process Approach, Piter Abdullah

Bulletin of Monetary Economics and Banking

A failed bank can spark a deep financial crisis throughout the whole country when ironically it may simply have been triggered by a banking crime perpetrated by an insider, i.e. the banker. Although banking crimes may pose a significant threat to financial sector stability, the potential risk of internal fraud has, hitherto, not been taken into account in banking supervision processes. This paper analyzes the effectiveness of banking supervision to uncover potential risks of banking crimes by combining game theory and the analytical network process approach. In this paper, the author conducts two games with three players; the banker, the …

The Troy Davis case is one of the best known and most important Georgia criminal cases in history. The case is now a cause celebre all around the world. There is a Troy Davis website.

In 1991 after a 12-day trial and two hours of deliberation, a jury convicted Troy Davis of the 1989 murder of Mark McPhail, an off-duty Savannah police officer shot three times with a handgun in a parking lot while working a late-night, part-time security job at a Greyhound bus station in downtown Savannah. Database Concepts In A Virtual World, Janet L. Ochs Oct 2010

Database Concepts In A Virtual World, Janet L. Ochs

Regis University Student Publications (comprehensive collection)

This project explored the use of a 3-D virtual world in an introductory database course to reduce the amount of time required to learn database concepts. A Second Life 3-D model was built to clarify database concepts and students used the model to create a Microsoft Access inventory database. Thereafter, the students provided feedback by answering a voluntary survey. Eighty two percent of the students surveyed agreed that the 3-D model clarified terms such as records, tables, primary keys and relationships. Seventy five percent of the students believed that the model reduced the amount of time required to learn these …
