For many years, researchers have attempted to find a link between beauty and labor market outcomes. Although many important findings have been noted in these studies, the beauty analysis utilized was a subjective measurement. This subjective method, while important, may have external factors creating bias in the rating itself. In this study, the impact of beauty is applied to criminals and their sentences. Using a computer based symmetry measurement tool, an objective beauty measurement will be utilized. This study will seek to uncover whether or not criminals who are less attractive, measured through facial symmetry, receive harsher prison sentences than …

Policing: A Sociologist’S Response To An Anthropological Account, Peter Moskos
Policing: A Sociologist’S Response To An Anthropological Account, Peter Moskos
Publications and Research
Social science writing should not ape quantitative science in format, structure, or style. If we can’t explain ourselves to others in a style both illuminating and interesting, we won’t and don’t deserve to be taken seriously. Too many in the Ivory Tower cling to the belief that research and academic writing must conform to a “scientific” format. Quality writing is more art than science. To be relevant, writing need not be – indeed should not be – rooted in a limited model of “hypothesis, replicable experiment, findings, discussion.” The more jargon and sociobabble we anthropologists, sociologists, and ethnographers spew out, …

Rethinking Guardianship (Again): Substituted Decision Making As A Violation Of The Integration Mandate Of Title Ii Of The Americans With Disabilities Act, Leslie Salzman
University of Colorado Law Review
In every state, when an adult has a diminished capacity to make decisions about personal affairs or property management, a court may transfer the individual's right to make decisions to a guardian. This Article argues that, in most cases, it would be preferable to support decision making rather than supplant it through guardianship, and then seeks to locate a right to receive such support as a less restrictive alternative to the substituted decision making that characterizes guardianship. Building on the reasoning in Olmstead v. L.C. and subsequent decisions interpreting the Americans with Disabilities Act's integration mandate, this Article argues that …
Examining The Impact Of California's Medical Marijuana Program On Public Health, John C. Lamb
Examining The Impact Of California's Medical Marijuana Program On Public Health, John C. Lamb
CMC Senior Theses
The debate surrounding marijuana legalization has increased its popularity in recent years, as the state of California seriously considers the complete legalization of the substance for those ages 21 and over. This would make California the first government in recorded history to regulate the cultivation and sale of marijuana on a commercial level. Advocates back the economic positives concerning high tax revenues, but those opposed argue that the dangers associated with public health greatly outweigh any monetary gain. The present study attempts to reveal the possible public health concerns, even potential benefits, caused by marijuana use and its distribution. Specifically, …
Reform In California's Immigration Enforcement And Immigration Court, Nelson E. Gil
Reform In California's Immigration Enforcement And Immigration Court, Nelson E. Gil
CMC Senior Theses
According to the Department of Homeland Security, Office of Immigration Statistic, California accounts for approximately 2,600,000 illegal immigrants in 2009. This number represents about 25 percent of the entire estimated illegal immigrant population in the United States, which is roughly 10.8 million. Between 2003 and 2008, the U.S. government removed 1,446,338 noncitizens from the United States. This rise in deportation is a result o the changes that have been enacted by the federal government over the years that transformed the nature of immigration enforcement. This thesis explores the California Immigration Enforcement system from the programs established to apprehend illegal aliens …

The National Right To Counsel Act: A Congressional Solution To The Nation's Indigent Defense Crisis, Cara H. Drinan
Scholarly Articles
For decades, scholars and practitioners have criticized the deplorable quality of legal representation available to poor criminal defendants across the country. Yet states continue to give short shrift to the constitutional rights of poor defendants. This article proposes a new piece of federal legislation designed to ameliorate the chronic inadequacies of public defense systems, while respecting federalism and leaving in tact the states’ ability to devise and implement appropriate public defense systems. The centerpiece of this proposed legislation is a cause of action in federal court that allows indigent defendants to seek equitable relief for systemic Sixth Amendment violations on …
Baseless Pleas: A Mockery Of Justice, Mari Byrne
Baseless Pleas: A Mockery Of Justice, Mari Byrne
Fordham Law Review
This Note addresses the ethicality of the baseless plea, a guilty plea entered by a defendant for a crime that everyone in the courtroom—judge, prosecutor, defense attorney, and defendant—knows the defendant did not commit. Used in the interest of efficiency and leniency, the baseless plea allows a defendant to plead guilty to a crime that has no basis in the facts of the case. Though used by courts in numerous jurisdictions, baseless pleas have been largely unaddressed as courts have sought to conceal the practice and as commentators have therefore failed to detect it. This Note seeks to remedy that …
Psychiatric Status, Self Control And Violence: Application Of The General Theory Of Crime, Feodor A. Gostjev
Psychiatric Status, Self Control And Violence: Application Of The General Theory Of Crime, Feodor A. Gostjev
Master's Theses and Capstones
Previous studies have suggested that psychiatric patients are more likely to be violent then the individuals in the general population. This thesis uses data collected in MacArthur Violence Risk Assessment Study to compare violent behaviors perpetrated by psychiatric patients in 10 weeks after their release from a psychiatric hospital and by subjects living in a similar community setting. Furthermore, Gottfredson and Hirschis's (1990) self control theory is applied to examine etiological causes of violence. The outcomes suggest that psychiatric patients were more likely to be violent during the study period than the community control subjects. The difference in violence rates …

Washington and Lee Law Review
My initial reaction to Brett Shockley's Note, Protecting Due Process from the PROTECT Act: The Problems with Increasing Periods of Supervised Release for Sexual Offenders, was to admire his courage. Not many people would undertake a discussion of possible injustice to child pornographers, who surely rank with terrorists and drug dealers as the most reviled and least sympathetic claimants for fair treatment. Shockley puts aside the moral condemnation these people deserve, and focuses on the morality of Procedure-the rule of Law if you will-divorced from the worthiness, or lack thereof, of particular defendants. As students of criminal Procedure come to …
