The Jurisprudence Of Police Intelligence Files And Arrest Records, James B. Jacobs
The Jurisprudence Of Police Intelligence Files And Arrest Records, James B. Jacobs
National Law School of India Review
Law enforcement involves the twin objectives of prevention and punishment. Criminal and conviction records are often used as parameters to determine the punishment appropriate for an offender. This article considers constitutional issues that arise from the creation of arrest records and police intelligence files, and the resulting stigma attached to the names contained therein. By discussing the use of these investigative aids, and highlighting the dissonance between the records and actual convictions, the article makes a case against the use of these records in ways that incorrectly stigmatise members of civil society. It concludes by suggesting models by which the …

Branch Office Of The Prosecutor: The New Role Of The Corporation In Business Crime Prosecutions, Harry First
Branch Office Of The Prosecutor: The New Role Of The Corporation In Business Crime Prosecutions, Harry First
Faculty Articles
The Article describes the evolution of the public corporation's role in the criminal justice process-from potential defendant to "branch office of the prosecutor," partnering with the government in investigating business crime-and assesses the impact of this evolution on criminal justice policy. The first part of the Article describes the branch-office role, tracing its development back to the 1970s, and shows how it has come to be routine for public corporations to assist prosecutors in their investigations. The second part of the Article discusses the implications of this shift in institutional role. The Article first argues that the public corporation's branch-office …

Msculine Identity And The Education And Parental Involvement Of African American Teen Fathers, Milissa Mcclaire Gary
Msculine Identity And The Education And Parental Involvement Of African American Teen Fathers, Milissa Mcclaire Gary
College of Education Theses and Dissertations
African American males are more likely to become teenage fathers than their white counterparts, and the risk is increased for those living in low-income communities. This qualitative work is a case study exploring the life experiences of one African American teen father from a working class urban area. The research investigates the ways in which conceptions of masculinity impact the identity formation and parental engagement of African American teen fathers. It also explores the ways in which they may seek to fulfill multiple, and often competing, social roles including father, student, and young Black man in society. The findings acknowledge …

Prosecutorial Sound Bites: When Do They Cross The Line?, Laurie L. Levenson
Prosecutorial Sound Bites: When Do They Cross The Line?, Laurie L. Levenson
Georgia Law Review
Even good prosecutors can cross the line. This is particularly true when it comes to media sound bites in high-profile cases. The Supreme Court held in Gentile v. Nevada State Bar, 501 U.S. 1030 (1991), that while lawyers have the First Amendment right to make comments to the press, they do not have the right to make comments that have a "substantial likelihood of materially prejudicing an adjudicative proceeding." This broad standard gives little guidance to prosecutors as they try to frame their public remarks. A much better guide is found in 28 C.F.R. § 50.2. These federal regulations at …
Waiving Good-Bye To Inconsistency: Factual Basis Challenges To Guilty Pleas In Federal Courts, William T. Stone Jr
Waiving Good-Bye To Inconsistency: Factual Basis Challenges To Guilty Pleas In Federal Courts, William T. Stone Jr
Georgia Law Review
Rule 11(b)(3) of the Federal Rules of CriminalProcedure
requires courts to determine that criminal defendants'
guilty pleas have a factual basis. Once a district court
accepts a guilty plea, appellate courts diverge in their
willingness to review challenges to the sufficiency of the
plea's factual basis. Some federal circuits hold that a
factual basis challenge is waived by the guilty plea. Other
jurisdictions will review a defendant's factual basis
challenge on appeal. Despite the lack of clarity on this
point, the Supreme Court has not yet provided guidance
and the federal circuit courts have not offered a great deal
of …
Charter Detention And The Exclusion Of Evidence After Grant, Harrison And Suberu, Jonathan Dawe, Heather Mcarthur
Charter Detention And The Exclusion Of Evidence After Grant, Harrison And Suberu, Jonathan Dawe, Heather Mcarthur
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
In July 2009 the Supreme Court of Canada released R. v. Grant, R. v. Suberu, R. v. Harrison and R. v. Shepherd. The quartet of judgments made major changes to the law governing the section 9 right against arbitrary detention, the section 10(b) right to counsel and the exclusion of unconstitutionally obtained evidence under section 24(2). This article discusses the importance of the decisions, which clarified the meaning of detention, established that unlawful detentions are necessarily arbitrary and determined that rights to counsel must be given “immediately” upon detention. Most significantly, Grant overturned 22 years of settled section 24(2) jurisprudence …

Grant, Suberu And Harrison: Detention, The Right To Counsel And A New Analysis Under Section 24(2): Some Practical Impacts, Jennifer Woollcombe
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This article examines the Supreme Court of Canada’s 2009 landmark Charter decisions. The Court’s most recent statement about what constitutes psychological detention is analyzed and some of the difficulties that arise in the application of the test are highlighted. The article also considers the Court’s new pronouncement that the right to counsel arises immediately upon an investigative detention, and raises concerns about how provision of this expanded right to counsel will operate practically. Finally, the article sets out the new test for admissibility of evidence under section 24(2). Some commentary is provided on the factors that seem most likely to …
Prosecution Of Genocide V. The Fair Trial Principle: Comments On Brown And Others V. The Government Of Rwanda And The Uk Secretary Of State For The Home Department, Mark A. Drumbl
Scholarly Articles
The article examines the 2009 decision of the United Kingdom High Court of Justice to deny the extradition of four genocide suspects to Rwanda owing to fair trial and partiality concerns with the Rwandan judiciary. It begins by reviewing the relevant UK extradition legislation, the pertinent facts and the rationale for the judgment and proceeds to situate this decision within the broader transnational judicial scepticism about the extradition or transfer of genocide suspects to Rwanda. While this scepticism arises from valid concerns regarding the contemporary state of human rights in Rwanda, it nevertheless contributes to the perpetuation of impunity surrounding …

Probable Cause From Probable Bonds: A Genetic Tattle Tale Based On Familial Dna, Jessica D. Gabel
UC Law SF Journal on Gender and Justice
DNA represents the "gold standard" of evidence that solves crimes and obtains convictions. Law enforcement agencies increasingly turn to national and local DNA databanks to generate possible suspects. These searches may "hit" upon databank samples that only partially match the DNA left at a crime scene. The value in a partial match is that it might identify a relative of the perpetrator. Some states have embraced this technique - called familial DNA testing - as a harmless additive to traditional or routine investigatory methods, but at least one state has explicitly banned its use. This Article examines the scientific, legal, …
Crimes Without Punishment: Violence Against Women In Guatemala, Karen Musalo, Elisabeth Pellegrin, S. Shawn Roberts
Crimes Without Punishment: Violence Against Women In Guatemala, Karen Musalo, Elisabeth Pellegrin, S. Shawn Roberts
UC Law SF Journal on Gender and Justice
In Guatemala, impunity for the battering and killing of women is at such levels that perpetrators rightly feel confident that there is no price to pay for their unrestrained violence. Each year the number of women murdered rises precipitously, and there is general consensus that the impunity enjoyed by those responsible is a significant factor in the escalating numbers of killings in Guatemala. As a result, victims are fleeing persecution to the United States, seeking, with little success, asylum. One of the main factors contributing to the delay in deciding asylum cases is the government's fear of "opening the floodgates," …
Use Of Female Interrogators: The Analysis Of Sexualized Interrogations The Detainee Interrogation Working Group Did Not Conduct, Celia Rumann
UC Law SF Journal on Gender and Justice
In the years following the Abu Ghraib scandal, it has become apparent that Lynndie England was punished for the crime of providing the world with photographic evidence of a government policy of using sexuality as a weapon of war. Ms. England's actions were not, as has been asserted, borne of whole cloth out of the sexually deviant minds of young soldiers bent on exploiting prisoners for their own amusement. Rather, they embodied the arguably extreme end of the systematic work of the United States government to engage in sexually deviant exploitation of prisoners purportedly for the collective safety and well-being …

The Experiential Future Of The Law, Adam J. Kolber
Emory Law Journal
Pain, suffering, anxiety, and other experiences are fundamentally important to civil and criminal law. Despite their importance, we have limited ability to measure experiences, even though legal proceedings turn on such measurements every day. Fortunately, technological advances in neuroscience are improving our ability to measure experiences and will do so more dramatically in what I call ¿the experiential future.¿ In this Article, I describe how new technologies will improve our assessments of physical pain, emotional distress, and a variety of psychiatric disorders. I argue that as new technologies emerge to better reveal people¿s experiences, virtually every area of the law …
