The American creed of e pluribus unum--out of many, one--has proven to be an elusive aspiration for societies throughout history. Research suggests that as the diversity of a community increases, its stores of social capital decline. Yet, there exists a growing body of evidence that suggests under certain conditions, patterns of inclusion and collaboration are not only possible but predictable. This project explores theory on effective communication practices, grounded in Habermas's Theory of Communicative Action, as well as research on effective group interaction to suggest that certain communicative capacities and collaborative processes that successfully face the challenge of e …

Student Engagement Differences By Ethnicity And Scale For Ninth Grade Students, Melissa Mcfarland Fattor

Differences on three subscales of student engagement were compared across ethnic groups and by subscale. The ninth grade is often considered a vital juncture that indicates success or failure to graduate high school. When a student goes through a transition he or she often experiences some type of change in student engagement levels and may experience adverse effects in the form of academic, social, and psychological challenges. Researchers of the National Research Council (2004) believe that the engagement process (the successful interaction between the individual and the educational context) is considered a means toward alleviating unsuccessful student outcomes. Grand Jury 2.0: Modern Perspectives on the Grand Jury challenges the American legal culture to re-imagine the grand jury and proposes ways to adapt the grand jury's proud heritage to the needs and realities of modern criminal justice. Strip Searches Of Students: Addressing The Undressing Of Children In Schools And Redressing The Fourth Amendment Violations, Diana R. Donahoe

This Article exposes the problems created by T.L.O. and its progeny, analyzes the Safford decision, and proposes recommendations for lower courts, legislatures, and local school boards to redress the current strip search crisis in public schools. Part II explains the T.L.O. two-prong test and illustrates the problems the T.L.O. Court and lower courts have had in applying it, specifically in strip search cases. Part III analyzes the Safford opinion and its ramifications. Reconceptualizing The Fifth Amendment Prohibition Of Adverse Comment On Criminal Defendants' Trial Sentence, Jeffrey Bellin

Griffin v. California holds that the Fifth Amendment privilege against compelled self-incrimination prohibits a prosecutor from arguing that a defendant’s failure to testify supports an inference of guilt. In the four decades since Griffin was decided, Griffin’s doctrinal underpinnings have been strongly criticized by prominent jurists and commentators, and even Griffin’s contemporary defenders struggle to place the constitutional prohibition of adverse comment on defendant silence within a coherent doctrinal framework.
In light of these largely unanswered criticisms, this Article posits that the current Fifth Amendment-based prohibition of adverse comment is untenable and must be recast in a more narrowly tailored …

A man sets himself on fire in front of the White House in a dispute with the Federal Bureau of Investigation (FBI). He has been working as an informant for the FBI in a high-profile terrorism prosecution and is unhappy with the $100,000 he has been paid so far. He has also been recently convicted of bank fraud. As a result, the government declines to call him as a witness, given the damage his actions have on his credibility and trustworthiness.
