Paying Women For Their Eggs For Use In Stem Cell Research, Pamela Foohey
Paying Women For Their Eggs For Use In Stem Cell Research, Pamela Foohey
Articles by Maurer Faculty
On June 11, 2009, the Empire State Stem Cell Board (“Board”), which administers the $600 million in New York State funds allotted to stem cell research, voted to allocate a portion of those funds to compensate women up to $10,000 for “donating” their eggs for use in stem cell research. The Board's decision makes New York the first state to affirmatively allow state funds to be used to compensate women for providing their eggs for use in stem cell research beyond mere reimbursement of associated medical and other expenses, and, similarly, distinguishes it from most international countries, which either prohibit …

Generating System Requirements For A Mobile Digital Evidence Collection System: A Preliminary Step Towards Enhancing The Forensic Collection Of Digital Devices, Ibrahim Baggili
Electrical & Computer Engineering and Computer Science Faculty Publications
Collecting digital devices in a forensically sound manner is becoming more critical since 80% of all cases have some sort of digital evidence involved in them (Rogers, 2006, p. 1) .The process of documenting and tagging digital devices is cumbersome and involves details that might not apply to other types of evidence, since each evidence item has unique physical characteristics (Hesitis & Wilbon, 2005, p. 17). The process becomes less manageable when a large number of digital devices are seized. This paper examines the information and issues investigators should be aware of when collecting digital devices at crime scenes. Furthermore, …

To Each His Own Jury: Dual Juries In Joint Trials Note, Kaitlin A. Canty
To Each His Own Jury: Dual Juries In Joint Trials Note, Kaitlin A. Canty
Connecticut Law Review
This Note explores the dual jury system in which each defendant in a joint trial has his or her own jury to decide guilt or innocence. In 1968, in Bruton v. United States, the Supreme Court ruled that despite any limiting instruction, a defendant’s right to confrontation is violated when an incriminating out-of-court confession is admitted against him when the confesser does not testify. This decision called into question courts’ ability to try defendants jointly. Shortly thereafter, courts began impaneling two juries simultaneously to decide the guilt or innocence of each defendant. This procedure was first approved by the federal …

The Warren Court's Regulatory Revolution In Criminal Procedure, Eric J. Miller
The Warren Court's Regulatory Revolution In Criminal Procedure, Eric J. Miller
Connecticut Law Review
The standard story taught to American lawyers, purporting to describe the Warren Court’s criminal procedure “revolution,” is mostly wrong. The story claims that the Court, motivated by liberal egalitarianism, engaged in a rights-expanding jurisprudence that made it harder for the police to search, seize, and interrogate criminal defendants. But frightened by the popular backlash against high crime rates, and in particular the passage of the Omnibus Crime Control and Safe Streets Act of 1968, in Terry v. Ohio a cowed Court shifted from its rights-expanding to a rights-constricting phase, making it easier for the police to search and seize criminal …
Rethinking Consent In A Big Love Way, Cheryl Hanna
Rethinking Consent In A Big Love Way, Cheryl Hanna
Michigan Journal of Gender & Law
This Article is based on a presentation at the Michigan Journal of Gender and Law as part of their symposium "Rhetoric & Relevance: An Investigation into the Present & Future of Feminist Legal Theory." In it, I explore the problem of categorical exclusions to the consent doctrine in private intimate relationships through the lens of the HBO series Big Love, which is about modern polygamy. There remains the normative question both after Lawrence v. Texas and in feminist legal theory of under what circumstances individuals should be able to consent to activity that takes place within the context of a …

The Excitement Of Interdictory Ideas: A Response To Professor Anders Walker, Marc O. Degirolami
The Excitement Of Interdictory Ideas: A Response To Professor Anders Walker, Marc O. Degirolami
Scholarly Articles
Having canvassed admirably the historical changes to the criminal law case book over the twentieth century, Professor Anders Walker's article suggests that criminal law ought to concern itself with the business of training future prosecutors and defense attorneys by eliminating, or at least greatly reducing, the place of moral and political reflection in the course, which was in any event the supercilious indulgence of elite law schools that disprized criminal practice. His normative prescriptions are of a piece with much that is currently in vogue in criticisms of legal education: that it is impractical, that it does not respond to …
