The Rudd Government And National Security: Continuity Or Change In The War On Terror?, Daniel Baldino
The Rudd Government And National Security: Continuity Or Change In The War On Terror?, Daniel Baldino
Arts Conference Papers
A vast proportion of the national security architecture to fight the amorphous global ‘war on terror’, created after 9/11, remains untouched. Prime Minister Kevin Rudd has expressed a commitment to ensuring that agencies such as the AFP and ASIO have the expertise, capacity and resources to collect and analyze the information needed to combat terrorism. Rudd has also identified a commitment to stop a terrorist attack while not compromising the integrity of democratic traditions and constitutional processes. This paper will address the tone and direction of the Rudd government’s approach to the problem of terrorism, examine proposed reform in key …
Accountability And Control: The Politics Of Privatisation In Wa, Martin Drum, Daniel Baldino
Accountability And Control: The Politics Of Privatisation In Wa, Martin Drum, Daniel Baldino
Arts Conference Papers
The virtues of privatizing security in Western Australia have been brought into question by the much publicized death of an Indigenous elder in Kalgoorlie at the beginning of 2008. Since that time, there have been a range of instances in WA (and nationally) where the management of prisoner security has been the subject of intense public debate. In this paper, we examine how a government has difficulty in maintaining control of a private company service when contracting it out, yet retains the ongoing responsibility for its success or failure and the exercise of due diligence. In the area of protecting …
The 'New' Exclusionary Rule Debate: From 'Still Preoccupied With 1985' To 'Virtual Deterrence', Donald A. Dripps
The 'New' Exclusionary Rule Debate: From 'Still Preoccupied With 1985' To 'Virtual Deterrence', Donald A. Dripps
Fordham Urban Law Journal
The justices of the Supreme Court have drawn new battle lines over the exclusionary rule. In Hudson v. Michigan, 547 U.S. 586 (2006), a five-justice majority, over a strong dissent, went out of the way to renew familiar criticisms of the rule. Just this January, in Herring v. United States, 129 S.Ct. 695 (2009), the justices again divided five to four. This time the dissenters raised the ante, by arguing that the Court's cost-benefit approach to applying the rule is misguided. For the first time since Justice Brennan left the Court, some of the justices appealed to broader justifications for …

“Utterly Ineffective”: Do Courts Have A Role In Improving The Quality Of Forensic Expert Testimony?, Joseph Sanders
“Utterly Ineffective”: Do Courts Have A Role In Improving The Quality Of Forensic Expert Testimony?, Joseph Sanders
Fordham Urban Law Journal
In Part I, I review the NRC’s stated reasons for giving the courts little or no role in improving forensic evidence and argue that these reasons cannot explain the fact that the same courts have played a significant role in policing expertise in civil cases. Why then have courts been so reluctant to exclude forensic expert evidence? I explore this question in Part II. I argue that two deep seated factors: (1) the courts’ contextual approach to know-ledge, and (2) the limited ability of science to provide causal answers about the particular case, limit the courts’ willingness to raise admissibility …

Moving Upstream Domestic Violence Prevention Initiatives In A Community-Based Advocacy Organization, Myranda Pierce
Moving Upstream Domestic Violence Prevention Initiatives In A Community-Based Advocacy Organization, Myranda Pierce
Theses & ETDs
The focus of this thesis is community education and engagement in the context of domestic and sexual violence prevention at SPARCC (Safe Place and Rape Crisis Center in Sarasota, Florida). This research takes the form of unstructured interviews and participant observation learning alongside educators and leaders in the Sarasota area who teach various groups in the community about domestic and sexual violence issues. Specifically, I discuss various strategies and goals of primary prevention and observe how projects and outreach events put on by the prevention team fit into these goals. I also look at the needs and limitations of the …

Exploring Unmet Needs And Barriers To Phychological And Behavioral Health Services In Rural Appalachia, Sarah Rachel Jarvis
Exploring Unmet Needs And Barriers To Phychological And Behavioral Health Services In Rural Appalachia, Sarah Rachel Jarvis
Theses, Dissertations and Capstones
Residents living in rural communities face many challenges, one of which is the need for adequate mental health services. Various factors including accessibility, quality, and social stigma often impact an individual’s decision to seek services, especially when they are related to psychological distress. This project highlights the characteristics of several rural communities within Appalachia to determine if there is an unmet need for psychological services and what barriers may be keeping potential patients from seeking psychological services. Both archival and survey data will be analyzed to determine the perceived need for psychological services and what barriers community leaders feel are …

Salvia Divinorum: Patterns Of Use, Christie Bowles
Salvia Divinorum: Patterns Of Use, Christie Bowles
Undergraduate Review
This study focuses on 13 salvia divinorum users, specifically seeking to understand the social, situational, and individual factors influencing their decision to use. Through semi-structured, in depth interviews, patterns such as the methods of use, settings of use, other frequently used drugs, and persistence or desistance of use are explored. Currently, there is limited research on salvia or the people who use this drug, and without this substantial research, the most effective way to address salvia use will remain unknown.
