Paying The Price For Black Masculinity: Investigating Sexual Behaviors Contributing To Hiv/Aids Infection And Death Of Black Women, Porsche Monic Terry

Theses Digitization Project

According to the Center for Disease Control (2005), African American women account for 64% of the nearly 127,000 women living with HIV/AIDS in the United States. The author conducted qualitative interviews with 30 adult Black males with a history of practicing Down Low (DL) sexual behavior-- engaging in homoerotic activities with their female partners. The purpose of this study is to provide insight into the DL subculture and to obtain useful information that is crucial to understanding how the DL male's personal struggles with sexuality and masculinity contribute to the disporportionate amount of Black women contracting HIV/AIDS.

The Torture Of Alleged Terrorists Necessary For Public Safety Or A Criminal Act?, Michaela Clark Jan 2010

The Torture Of Alleged Terrorists Necessary For Public Safety Or A Criminal Act?, Michaela Clark

Undergraduate Review

Torture is defined in a variety of ways by many different sources. According to the World Medical Association’s (WMA) Declaration of Tokyo, torture is defined as, “the deliberate, systematic, or wanton infliction of physical or mental suffering by one or more people acting alone or on the orders of any authority, to force another person to yield information, to make a confession, or for any other reason.” The Declaration of Tokyo was passed in 1975 and updated many times, most recently in 2006. This is a landmark document that has been used as a model for other medical statutes. The …

The Myth Of The Female Sex Offender, Chelsea Horrocks Jan 2010

The Myth Of The Female Sex Offender, Chelsea Horrocks

Undergraduate Review

More than 300,000 women and nearly 100,000 men were forcibly raped in 1995 (Tjaden & Thoennes, 2006). The National Violence Against Women (NVAW) Survey, the last nationwide survey on rape, which had 8,000 male and 8,000 female participants, found that one of every six women and one of every thirty-three men is raped at some point in their lifetime. Thirty-two percent of the women and sixteen percent of the men were injured during their rape. In another nationwide telephone survey, twenty-two percent of 3,000 adults reported being sexually abused (Vandiver, 2002).

A Review Of Rape Statistics, Theories, And Policy, Gary Lowell Jan 2010

A Review Of Rape Statistics, Theories, And Policy, Gary Lowell

Undergraduate Review

Rape is defined in the laws of Massachusetts as “[s]exual intercourse or unnatural sexual intercourse by a person with another person who is compelled to submit by force and against his will or by threat of bodily injury” (Mass. Gen. Laws Ann. ch. 277, § 39, 2009). Although traditional definitions of rape have been that only a female can be raped and only a male can rape, “courts have held that the rape statutes in their jurisdictions are gender-neutral and apply equally to perpetrators of either sex” (Lynton, 1995). Still, since male on female rape is more prevalent (see Gonzales, …

Tops Off To Dancing: An Exotic Form Of Nightlife, Jessica Sanspree Jan 2010

Tops Off To Dancing: An Exotic Form Of Nightlife, Jessica Sanspree

Mahurin Honors College Capstone Experience/Thesis Projects

This ethnographic research investigates the culture of exotic dancing in two exotic dance clubs in Bowling Green, Kentucky. By conducting interviews with a former exotic dancer and completing ethnographic observations in the field of an exotic dance club, I explore how exotic dancers in Bowling Green create and perform sexuality as a method of making money. I examine the rules and regulations, such as "Dancer's etiquette," established and enforced by dancers in order to enforce social order. Furthermore, I assess my informant's perception of identity regarding her role as an exotic dancer, including her reaction to the negative stigmas that …

A Moral Investigation Of Torture In The Post 9.11 World, Joe Moloney Jan 2010

A Moral Investigation Of Torture In The Post 9.11 World, Joe Moloney

Undergraduate Review

The field of philosophy is unique, as it allows one to logically examine issues in all disciplines, from science to politics to art. One further important discipline that philosophy examines is criminal justice. In this respect, one approach philosophy can take when examining criminal justice is to assess each issue by questioning its morality—that is, whether an action within the issue is right or wrong based upon a system of ethics. This approach concerns the subfield of philosophy known as ethics, a subfield that includes questions concerning what is morally good and morally bad. When one is faced with an …

Firearm Transaction Disclosure In The Digital Age: Should The Government Know What Is In Your Home?, 27 J. Marshall J. Computer & Info. L. 497 (2010), Elaine Vullmahn

UIC John Marshall Journal of Information Technology & Privacy Law

This comment examines the primary arguments for continuing to prohibit the federal government from establishing a federal firearm registry. The Background section of this comment surveys the development of laws restricting firearm sales and requiring federal firearm licensed dealers to maintain pertinent records. This section also describes how, if enacted, the Blair Holt’s Firearm Licensing and Registration Act of 2009, known as H.R. 45, would, through the creation of federal firearm registry, expose electronic records of private citizens’ firearm purchases and ownership to possible government abuse. The Analysis section examines why H.R. 45 is not the correct means for achieving …

International Human Rights Law And Constitutional Rights: In Favour Of Synergy, Fiona De Londras Jan 2010

International Human Rights Law And Constitutional Rights: In Favour Of Synergy, Fiona De Londras

Comparative Research in Law & Political Economy

This paper is concerned with demonstrating the capacity of international human rights law and domestic constitutional law to have a synergistic relationship that is focused on the ways in which the two sets of standards can be harmonised rather than on questions of ‘superiority’ and ‘inferiority’. Conceiving of the relationship between the two bodies of law in this way requires us to recognise their shared dignitary core and the optimal effect of international human rights law, namely effective rights-protection at the domestic level with international law playing a subsidiary role. This paper uses the example of LGBT rights in European …

The Long Shadow Of Colonialism: The Origins Of The Doctrine Of Emergency In International Human Rights Law, John Reynolds Jan 2010

The Long Shadow Of Colonialism: The Origins Of The Doctrine Of Emergency In International Human Rights Law, John Reynolds

Comparative Research in Law & Political Economy

Amidst the post-war turn to transcend international law’s traditional power structures in the narration and codification of individual rights, colonial interests and legal philosophies retained an influence on the framing of human rights discourse. This essay explores the extent to which the particular conception of the ‘state of emergency’ that was distilled into the normative framework of international human rights law at its inception stemmed specifically from Britain’s traditions of colonial governance and legislation. The evolution of emergency law is traced from martial law in England and the ‘first empire’, through British emergency legislative codes in Ireland and India in …

The Intelligibility Of Extra-Legal State Action: A General Lesson For Debates On Public Emergencies And Legality, François Tanguay-Renaud Jan 2010

The Intelligibility Of Extra-Legal State Action: A General Lesson For Debates On Public Emergencies And Legality, François Tanguay-Renaud

Comparative Research in Law & Political Economy

This is the penultimate draft of an article to be published in Legal Theory. Some legal theorists deny that states can conceivably act extra-legally, in the sense of acting contrary to domestic law. This position finds its most robust articulation in the writings of Hans Kelsen, and has more recently been taken up by David Dyzenhaus in the context of his work on emergencies and legality. This paper seeks to demystify their arguments and, ultimately, contend that we can intelligibly speak of the state as a legal wrongdoer or a legally unauthorized actor.

Killings Of Police In U.S. Cities Since 1980: An Examination Of Environmental Andpolitical Explanations, Stephanie L. Kent Jan 2010

Killings Of Police In U.S. Cities Since 1980: An Examination Of Environmental Andpolitical Explanations, Stephanie L. Kent

Sociology & Criminology Faculty Publications

Most research on killings of police in urban areas attempted to link lethal violence against officers to the violence and disorder in the communities they work. Yet support for this relationship is inconsistent. Fewer studies considered whether local political arrangements affect killings of police. This study attempts to remedy this gap by using recent data to investigate the relationship between the political conditions of large U.S. cities and the number of homicides of police officers in the line of duty in the years 1980, 1990, and 2000. Negative binomial regression analyses suggest that racial income inequality and the size of …

The Implementation Of Restorative Justice In Iceland: A Comparison Of Police- And Expert-Led Conferencing, Hafsteinn Gunnar Hafsteinsson Jan 2010

The Implementation Of Restorative Justice In Iceland: A Comparison Of Police- And Expert-Led Conferencing, Hafsteinn Gunnar Hafsteinsson

Electronic Theses and Dissertations

On first of October 2006 the Ministry of Justice in Iceland launch a restorative justice pilot project. Building on the pilot project data, this thesis evaluates the implementation of restorative justice into the criminal justice system in Iceland by asking victims, offenders and other participants in police- and expert-led conferencing to answer questionnaires' relating to these two types of restorative justice practices to crime. The thesis compares its results with findings from a review conducted by Paul McCold (1998) who more than a decade ago challenged concerns on police facilitated conferencing. The data examined in the present thesis support Paul …

Mandatory Minimalism, Erik Luna, Paul G. Cassell Jan 2010

Mandatory Minimalism, Erik Luna, Paul G. Cassell

Scholarly Articles

One of us (Cassell) is a former federal judge nominated by President George W. Bush, now a “conservative” scholar whose work is often supportive of law enforcement, the death penalty, and the rights of crime victims. The other (Luna) is a “libertarian” who tends to be suspicious of government and adamant about abuses of power, including those by police and prosecutors, and his scholarship has expressed the need for wholesale criminal justice reform (especially in the federal system). If we could find common ground on ways to modify federal mandatory minimums, we hoped that policymakers might share this agreement, perhaps …

Clinton, Ginsburg, And Centrist Federalism, Russell A. Miller Jan 2010

Clinton, Ginsburg, And Centrist Federalism, Russell A. Miller

Scholarly Articles

Politics' and pathology have converged to heighten speculation that Justice Ruth Bader Ginsburg's tenure on the Supreme Court is nearing its end. Even if the imminence of her retirement is greatly exaggerated, the time to reflect on Justice Ginsburg's lasting contribution to American constitutional law has arrived. Justice Ginsburg is best known for her long campaign to promote gender equality. Her successful advocacy on that issue before the Supreme Court throughout the 1970s led President Clinton to conclude, when announcing her nomination to fill Justice Byron White's vacated seat on the high court, that she is to the women's movement …
