On The Front Lines: Educating Teachers About Bullying And Prevention Methods, Aviva Twersky Glasner Jan 2010

On The Front Lines: Educating Teachers About Bullying And Prevention Methods, Aviva Twersky Glasner

MARC Publications

Problem statement: Bullying is a serious problem in American schools and is characterized by aggressive behavior distinguished by unequal power and the intention to cause physical, social, or emotional harm to others Bullying is evolving from the classic image of a big schoolyard bully picking on smaller kids to a more technologically, sophisticated model of kids using cyber technology to electronically tease, bully and harass their peers with texting, voicemails, emails and posts on public websites, like Facebook, that are popular with young students. While parents are and should be encouraged and trained to recognize understand the insidious nature of …

The Devil Is In The Lack Of Details, Ann Killenbeck Jan 2010

The Devil Is In The Lack Of Details, Ann Killenbeck

School of Law Faculty Publications and Presentations

In an interesting and potentially important article, Professor Deirdre M. Bowen declares that her goal "is to scrutinize what happens when the judiciary and anti-affirmative action activist groups exploit color blindness to rationalize away affirmative action admissions policies."' She argues that her research and her study demonstrate that "reactionary 'color blindness' does not actually show that "affirmative action is no longer necessary." Instead, she believes the results of her study establish that anti-affirmative action forces have embraced an "ideal [that] does not appear to exist" and are "promoting a deeply flawed discourse [by asserting] that affirmative action causes stigma."My emphasis …

Sexual Risk And High Risk Behavior Among Substance Abusing Adolescents In Hartford, Connecticut : Implications For Effective Treatment Delivery, Rosalie Simichak

UCHC Graduate School Masters Theses 2003 - 2010

Substance use and high risk sexual behavior have significant health consequences for adolescents who engage in these behaviors, including HIV, STD transmission, teen pregnancy, and an array of other associated health problems. The Hartford Youth Project (HYP) established by the Connecticut Department of Children and Families, offers a system of substance abuse treatment which has proven to be effective in reducing adolescent engagement in such high risk behavior. In this study, the data generated by the HYP are examined in conjunction with data derived from a qualitative review of existing services in order to identify a sexual risk profile for …

Retribution And The Experience Of Punishment, Christopher J. Buccafusco, J. Bronsteen, J. Masur Jan 2010

Retribution And The Experience Of Punishment, Christopher J. Buccafusco, J. Bronsteen, J. Masur

All Faculty Scholarship

In a prior article, we argued that punishment theorists need to take into account the counterintuitive findings from hedonic psychology about how offenders typically experience punishment. Punishment generally involves the imposition of negative experience. The reason that greater fines and prison sentences constitute more severe punishments than lesser ones is, in large part, that they are assumed to impose greater negative experience. Hedonic adaptation reduces that difference in negative experience, thereby undermining efforts to achieve proportionality in punishment. Anyone who values punishing more serious crimes more severely than less serious crimes by an appropriate amount - as virtually everyone does …

Welfare As Happiness (With J. Bronsteen & J. Masur), Christopher J. Buccafusco

All Faculty Scholarship

Perhaps the most important goal of law and policy is improving people’s lives. But what constitutes improvement? What is quality of life, and how can it be measured? In previous articles, we have used insights from the new field of hedonic psychology to analyze central questions in civil and criminal justice, and we now apply those insights to a broader inquiry: how can the law make life better? The leading accounts of human welfare in law, economics, and philosophy are preference-satisfaction - getting what one wants - and objective list approaches - possessing an enumerated set of capabilities. This Article …

Notes From The Field: The Criminalization Of Undocumented Migrants: Legalities And Realities, Tanya Golash-Boza

Societies Without Borders

Undocumented migrants are not criminals. Detention is not prison. Deportation is not punishment. These are truths in the legal system of the United States. However, undocumented migrants are treated like criminals; detainees feel as if they are in prison; and deportees experience their exclusion as punishment. This article examines the contradictions between legal arguments which indicate that immigration proceedings are not criminal proceedings and the experiences of deportees who often feel as if they were treated like criminals and that banishment from the country in which they have lived most of their lives is a cruel punishment.

Wayne State University Associated BioMed Central Scholarship

Abstract

Background

Two counter trends in injury mortality have been separately reported in the US in recent times - a declining suicide rate and a rapidly rising unintentional poisoning mortality rate. Poisoning suicides are especially difficult to detect, and injury of undetermined intent is the underlying cause-of-death category most likely to reflect this difficulty. We compare suicide and poisoning mortality trends over two decades in a preliminary assessment of their independence and implications for suicide misclassification.

Methods

Description of overall and gender- and age-specific trends using national mortality data from WISQARS, the Web-based Injury Statistics Query and Reporting System, maintained …

A Model For Easily Incorporating Team-Based Learning Into Nursing Education, Heidi A. Mennenga, Tish Smyer Jan 2010

A Model For Easily Incorporating Team-Based Learning Into Nursing Education, Heidi A. Mennenga, Tish Smyer

College of Nursing Faculty Publications

A sense of urgency exists among nurse educators to determine the best possible teaching strategies to create a rich, engaging learning environment for students. With the calls for transformation, innovation, and excellence in nursing education from the American Association of Colleges of Nursing, the National Council of State Boards of Nursing, and the National League for Nursing, educators may determine that current teaching strategies fall short. Team-based learning, an innovative teaching strategy, offers educators a structured, student-centered learning environment and may be effective in teaching necessary skills to students. An overview of how this strategy fosters many of the essential …

Fact Or Fiction: The Legal Construction Of Immigration Removal For Crimes, Maureen A. Sweeney Jan 2010

Fact Or Fiction: The Legal Construction Of Immigration Removal For Crimes, Maureen A. Sweeney

Faculty Scholarship

Thousands of long-term legal permanent residents are deported from the United States each year because they have been convicted of criminal offenses, many quite minor. These deportations occur without any of the constitutional safeguards that generally protect criminal defendants. Immigration authorities rely on cases asserting that such deportations are not punishment for the crime, but merely collateral consequences of the conviction. This article challenges that reasoning. It argues that its factual and doctrinal foundation has completely disintegrated over the last 20 years. Far-reaching changes in immigration law and enforcement have rendered deportation for aggravated felonies a “definite, immediate and largely …

Collateral Consequences Of Criminal Convictions: Confronting Issues Of Race And Dignity, Michael Pinard Jan 2010

Collateral Consequences Of Criminal Convictions: Confronting Issues Of Race And Dignity, Michael Pinard

Faculty Scholarship

This article explores the racial dimensions of the various collateral consequences that attach to criminal convictions in the United States. The consequences include ineligibility for public and government-assisted housing, public benefits and various forms of employment, as well as civic exclusions such as ineligibility for jury service and felon disenfranchisement. To test its hypothesis that these penalties, both historically and contemporarily, are rooted in race, the article looks to England and Wales, Canada and South Africa. These countries have criminal justice systems similar to the United States’, have been influenced significantly by United States’ criminal justice practices in recent years, …
