The Potential Contribution Of Adr To An Integrated Curriculum: Preparing Law Students For Real World Lawyering, Jean R. Sternlight
The Potential Contribution Of Adr To An Integrated Curriculum: Preparing Law Students For Real World Lawyering, Jean R. Sternlight
Scholarly Works
This Article briefly reviews the long history of critiques of legal education that highlight the failure to adequately prepare students for what they will and should do as attorneys. It takes a sober look at the hurdles reformers face when trying to make significant curricular changes and proposes a modest menu of reforms that interested faculty and law schools can largely achieve without investing substantial additional resources. This Article emphasizes the special contributions that alternative dispute resolution (ADR) can provide to legal education more generally. ADR instruction is an important corrective to a curriculum that routinely conveys the erroneous implication …
Post-Diaster Family Resilience: The Use Of Humor As A Coping Strategy, Bridgette Boe O'Connor
Post-Diaster Family Resilience: The Use Of Humor As A Coping Strategy, Bridgette Boe O'Connor
LSU Master's Theses
The purpose of this study was to investigate the use of humor as a coping strategy among Hurricane Katrina survivors. The data for this study were collected in the first wave of a larger project on families and disasters. Using Geographic Information Systems (GIS) by combining Census data with storm damage estimates and purposive sampling, 50 participants affected by Hurricane Katrina from a single suburban community in Southern Louisiana in early spring 2006 were recruited and interviewed. When the interviews were qualitatively analyzed with a focus on humor, it became clear that families used humor even at such a devastating …
The Feminization Of Private Investigation: A Sociological Analysis, Jessica Simpson Pearce
The Feminization Of Private Investigation: A Sociological Analysis, Jessica Simpson Pearce
LSU Doctoral Dissertations
This dissertation outlines the occupation of private investigation and the role that females play within that profession. The difficulties women experience in male-oriented occupations remains noteworthy in sociological research today. Progress has been made, yet many barriers still exist for women. These include structural, social, and cultural factors that influence women and/or the jobs that they hold. With the completion of interviews with twenty-six female private investigators, I was able to analyze the existing structural, interactional, and gender barriers which moderate the number of women that work as private investigators. Few studies have examined this occupation and this gap may …
Gender Differences And Cultural Contexts: Psychological Well-Being In Cross-National Perspective, Makiko Hori
Gender Differences And Cultural Contexts: Psychological Well-Being In Cross-National Perspective, Makiko Hori
LSU Doctoral Dissertations
This study examines gender differences in psychological well-being and its causal factors in 33 countries. Previous studies documented women’s vulnerability in mental health, and according to social role explanations, gender differences in mental health are attributed to gendered socialization and gender roles assigned to men and women. Gender differences in mental health thus should disappear when we see gender-neutral socialization and social roles. I incorporate contextual factors, such as the country-level gender equality and gender norms, and argue that the effects of gender and family-related factors at the individual-level on psychological well-being are conditional on societal-level factors in each country. …
Stereotype And Representation Of Near And Middle Eastern Peoples In La Bande Dessinee, Brandon Matthew Thomas
Stereotype And Representation Of Near And Middle Eastern Peoples In La Bande Dessinee, Brandon Matthew Thomas
LSU Master's Theses
Representation of social groups in the comics is serious. In 2006, a series of twelve cartoons published in a Danish newspaper sparked a controversy that precipitated the deaths of hundreds of people. The images depicted Mohammed and other images that supposedly mocked Islam. All across Europe, the Middle East, and North Africa protesters paraded through the streets, some calling for the death of the cartoonists. Trials in Europe over the publication of these cartoons resulted in several firings. Counter protests have also arisen. These protesters found grievance with the firings, claiming that the freedom of the press was being violated …
Social Shopping For Fashion, Jiyun Kang
Social Shopping For Fashion, Jiyun Kang
LSU Doctoral Dissertations
In spite of the significance of social shopping in the context of fashion consumption, its definitions, boundaries, and explanations have not yet been systematically established in literature. The purpose of Study 1 was to develop a reliable and valid scale of social shopping for fashion. With the scale, Study 2 aimed to develop and test a structural model of social shopping process. In Study 1, a three-step procedure for scale development was followed: item generation, scale purification, and scale validation. As a result, a five-dimensional scale, along with sixteen behavioral items, was developed representing distinctive dimension of social shopping for …
In Vitro And In Vivo Evaluation Of A Brucella Putative Hemagglutinin, Lauren E. Duhon
In Vitro And In Vivo Evaluation Of A Brucella Putative Hemagglutinin, Lauren E. Duhon
LSU Doctoral Dissertations
Brucellosis, a zoonotic disease caused by Brucella spp., presents both health and economic difficulties for livestock, wildlife, and humans. While brucellosis is nearly eradicated in the United States, the disease remains detrimental in many countries worldwide. Attempts to produce a safe and effective small ruminant vaccine have been met with limited success. The current vaccine for bovine brucellosis in the United States is B. abortus RB51. This strain transiently colonizes the host and induces a cell-mediated immune response. Levels of protection have not been demonstrated in goats and thus it is considered a relatively poor caprine vaccine that probably does …
Community College Success: A Multi-Site Program Evaluation Of Postsecondary Career And Technical Education, Kimberly Tynes
Community College Success: A Multi-Site Program Evaluation Of Postsecondary Career And Technical Education, Kimberly Tynes
LSU Doctoral Dissertations
Postsecondary career and technical institutions are required to follow a set list of performance indicators in order to receive federal Carl Perkins funding (Perkins IV Accountability, 2009). Within those indicators includes measuring technical skills attainment, which the state of Mississippi chooses to utilize program-specific standardized assessments known as the MS- CPAS2 assessment. The purpose of this multi-site program evaluation was to determine which programs are meeting the assessment passing requirements and to determine how they are achieving success. The rationale for this study was to evaluate the components inherent in successful programs in order to aid other programs who may …
Mapping The Digital Divide In Neighborhoods: Wi-Fi Access In Baton Rouge, Louisiana, Luke Driskell
Mapping The Digital Divide In Neighborhoods: Wi-Fi Access In Baton Rouge, Louisiana, Luke Driskell
LSU Master's Theses
The communication made possible by the Internet has leveled the global playing field in some ways, but helped maintain traditional inequalities as well. The “digital divide” refers to disparities in telecommunication access and use from global to local scales. This study uses access point mapping to quantify local Internet access in Baton Rouge, Louisiana. A Wi-Fi access point (router) density was obtained and compared to various demographic and socioeconomic attributes in neighborhoods. Fieldwork confirmed the expectation that traditionally disadvantaged groups would have the lowest rates of Wi-Fi ownership, but median household income was unexpectedly less related than race, education, and …
The Care Plan As An Indicator Of Change In Nursing Science Instruction: A Textbook-Based Analysis, Lindsay Bratton-Mullins
The Care Plan As An Indicator Of Change In Nursing Science Instruction: A Textbook-Based Analysis, Lindsay Bratton-Mullins
LSU Doctoral Dissertations
Sciences are critical in nursing education to aid the nurse in understanding health and disease processes. Accrediting bodies for nursing education have emphasized that educators teach in ways that encourage critical thinking and, therefore, produce safe-practicing, competent nurse graduates. Nursing care plans best reflect nursing education’s central goals. Because of its longevity of use and familiarity, in this study, the nursing care plan was used as a proxy for nursing science’s learning objectives. This research was a study of the nursing care plan as an indicator for change in nursing science education in the United States to determine if change …
Play It Loud: Hip Hop In The Language Arts Classroom, B Cord Mckeithen
Play It Loud: Hip Hop In The Language Arts Classroom, B Cord Mckeithen
LSU Master's Theses
Hip-hop music and its place in education has been thoroughly researched over the last two decades by many scholars and educators from all over the world. This research paper discusses hip-hop’s merit in the classroom, building upon prior research from books and journal articles, along with my own research that I conducted with students at a southern Louisiana high school. Educators in the field of language arts must find new methods when it comes to teaching our youth and leave behind many of the traditional ways that previous generations were accustomed to. The idea of hip-hop in education, in this …

The Louisiana Sinfonietta, A New Orchestral Model, And An Original Composition, Concerto For Guitar And Symphony Orchestra, Op. 12, Ronaldo Cadeu De Oliveira
LSU Doctoral Dissertations
This dissertation is divided into two parts. Part one is a historical paper about the chamber orchestra known as The Louisiana Sinfonietta and is divided into seven chapters. In the introduction I explain the methods used to conduct this research. Chapter one is an introduction that discusses the problem of the possible end of the long tradition of the symphony orchestra. Chapter one also investigates how the organizational model used by the Louisiana Sinfonietta may be a sign of a new orchestral model, one that may solve many of the problems that orchestras are facing today. Chapters two, three, and …
The Price Of Conflict: War, Taxes, And The Politics Of Fiscal Citizenship, Ajay K. Mehrotra
The Price Of Conflict: War, Taxes, And The Politics Of Fiscal Citizenship, Ajay K. Mehrotra
Articles by Maurer Faculty
Since 2003 American political leaders and lawmakers have been committed to the simultaneous pursuit of tax cuts and military excursions abroad. Just a few decades ago, when military hawks were also deficit hawks, such a position would have seemed incongruous. This essay reviews, War and Taxes, a provocative and fascinating new book that seeks to explain the apparent dissonance of recent American wartime tax policy. In contrast to conventional wisdom which presumes that wartime patriotism has always and everywhere trumped self-interest, War and Taxes shows that the history of U.S. wartime taxation is not quite such a heroic tale. By …
American Economic Development, Managerial Corporate Capitalism, And The Institutional Foundations Of The Modern Income Tax, Ajay K. Mehrotra
American Economic Development, Managerial Corporate Capitalism, And The Institutional Foundations Of The Modern Income Tax, Ajay K. Mehrotra
Articles by Maurer Faculty
Histories of the modern American income tax have generally focused on the role that social and political forces have played in the development of a new tax system. This article seeks to move beyond the social and political determinants to examine the economic factors that facilitated the adoption of the modern, graduated income tax. Without marginalizing the importance of social and political factors, the central aim of this article is to make a modest contribution to the legal and political historiography of the U.S. income tax by highlighting how changing material economic conditions afforded social groups, political reformers, and lawmakers …
Measuring Children's Social Support Networks: Eco-Mapping Protocol, Lauren Burnett
Measuring Children's Social Support Networks: Eco-Mapping Protocol, Lauren Burnett
LSU Master's Theses
The purpose of this project was to explore the use of an eco-mapping protocol for measuring children’s social support networks. The project investigated two research questions: (1) what are the similarities and differences in the information provided by three informants in the eco-mapping protocol?, and (2) what information do eco-maps provide about children’s social support networks? Ten four-year-old children, their families, and teacher participated in the creation of eco-maps. Each informant identified the major people in the child’s support network, described relationships, and identified the type and developmental area of support provided by each individual. All the information was graphically …
Public Perception And The Oil Industry: An Analysis Of Oil Employees' And Nigerians' Opinions Regarding Exxon Mobil And Shell Oil's Corporate Social Responsibility Efforts, Liana L. Narcisse
Public Perception And The Oil Industry: An Analysis Of Oil Employees' And Nigerians' Opinions Regarding Exxon Mobil And Shell Oil's Corporate Social Responsibility Efforts, Liana L. Narcisse
LSU Master's Theses
This study looked at oil industry employees’ and Nigerians’ perceptions of Exxon Mobil and Shell Oil as socially responsible corporations and the role the two-step flow model of communication plays in shaping these publics’ impressions of the companies. Measures of participants’ perceptions of corporate social responsibility (CSR) were developed using Carroll’s 1971 three-dimensional model of CSR and Ketola’s (2008) holistic model of CSR. This study found that for both companies participants had average to less-than-favorable perceptions of the companies’ socially responsible behavior, according to the various categories of CSR. However, employees were more likely to view the companies more favorably …
Designing Irishness: Ethnicity, Heritage, And Imagined Connection To Place Through Language, Thomas James Sullivan
Designing Irishness: Ethnicity, Heritage, And Imagined Connection To Place Through Language, Thomas James Sullivan
LSU Doctoral Dissertations
In North America, those who are descended from "old world" immigrant groups—for example Germans, Greeks, Italians, Poles, and Irish—are thought to be assimilated or acculturated into the mainstream American culture. Since the late 1970s, however, sociologists have observed how a number of white ethnics, particularly those descended from third- and fourth-generation (and beyond) immigrants, continue to maintain a link to an ethnic group. This phenomenon—labeled symbolic or optional ethnicity—is now seen as a latter-stage development in the larger process of assimilation and ethnic-group identification. In this dissertation I show how the meaning of Irish identity has evolved in North America …
The Joint Law Venture: A Pilot Study, Jayanth K. Krishnan
The Joint Law Venture: A Pilot Study, Jayanth K. Krishnan
Articles by Maurer Faculty
This pilot study evaluates the effectiveness of law firms entering into joint ventures, an increasingly eyed business model particularly by American and British lawyers seeking to expand into promising financial markets. One country at the center of the joint venture experiment has been Singapore. With the strong encouragement of the Singaporean government (which has long embraced foreign investment), various elite law firms from the United States and Britain have been partnering with domestic Singaporean law firms for over the past decade. Because these foreign firms were traditionally barred from practicing Singaporean law on their own, the ‘joint law venture,’ or …
One Is The Loneliest Number: The Single Taxpayer In A Joint Return World, Lily Kahng
One Is The Loneliest Number: The Single Taxpayer In A Joint Return World, Lily Kahng
UC Law Journal
The United States is one of the few developed countries to retain the joint income tax return, available for heterosexual married couples only. Since its adoption in 1948, its underlying assumptions have been challenged on many valid grounds, and yet it remains firmly embedded in mainstream political and policy discourse. In recent years, most of the debate surrounding the joint return has focused on reducing marriage penalties, bonuses, and determining who among the universe of couples ought to be extended the benefit of the marriage bonuses. The treatment of single people has received almost no attention.
The scant attention paid …
Abuse Of Rights: The Continental Drug And The Common Law, Anna Di Robilant
Abuse Of Rights: The Continental Drug And The Common Law, Anna Di Robilant
UC Law Journal
This Article deploys a comparative approach to question a widely shared understanding of the impact and significance of abuse of rights. First, it challenges the idea that abuse of rights is a peculiarly civilian "invention," absent in the common law. Drawing on an influential strand offunctionalist comparative law, the Article identifies the "functional equivalents of the doctrine in the variety of malice rules and reasonableness tests deployed by American courts in the late-nineteenth and earlytwentieth century in fields as diverse as water law, nuisance, tortious interference with contractual relations, and labor law. The Article investigates the reasons why in the …
Cross-Race Advising Relationships: The Role Of Race In Advising Relationships Between Black Doctoral Student Protégés And Their White Faculty Advisors, Marco Javon Barker
Cross-Race Advising Relationships: The Role Of Race In Advising Relationships Between Black Doctoral Student Protégés And Their White Faculty Advisors, Marco Javon Barker
LSU Doctoral Dissertations
The purpose of this phenomenological study was to examine the role of race in cross-race advising relationships between White faculty advisors and their Black doctoral student protégés. I examined the racial context of doctoral education experiences and relationships between doctoral students and faculty. Blacks with doctoral degrees comprise only 0.3% of those 18 years and older and only 3.5% of those with doctoral degrees (U.S. Census, 2000). Although there has been an increase in the number of Blacks enrolling in doctoral programs (Cook & Cordova, 2006), Nettles and Millett (2006) found that Blacks and Latin Americans have higher attrition rates …
Probing The Finance Gap Theory: Does Gender Affect Campaign Contributions?, Rhonda Wrzenski
Probing The Finance Gap Theory: Does Gender Affect Campaign Contributions?, Rhonda Wrzenski
LSU Doctoral Dissertations
In our field, scholarly literature contends that women win a similar percentage of the vote and raise a similar amount of money as their male opponents when they campaign (Newman 1994; Burrell 1994; Seltzer et al. 1997; Dolan 2006; Darcy et al. 1994; Wilhite and Theilmann 1986; Burrell 1985; Uhlaner and Schlozman 1986; Welch et al. 1985). However, women are still underrepresented at all levels of government and this may be a function of biases in the campaign finance network that have gone largely undetected. Differences may be more readily apparent at the sub-national level and among particular classes of …
Dietary Resistant Starch Improved Maternal Glycemic Control In Goto-Kakizaki Rat, Li Shen
Dietary Resistant Starch Improved Maternal Glycemic Control In Goto-Kakizaki Rat, Li Shen
LSU Doctoral Dissertations
Treatment for maternal hyperglycemia is limited on account of safety concerns for fetus. Our previous work has shown that inclusion of resistant starch in the diet decreases body fat accumulation in rodents, increases GLP-1 at both the gene expression level and plasma levels, and improves glucose tolerance in STZ-induced diabetic mice. However, studies concerning dietary resistant starch and maternal hyperglycemia are scarce. In this project, we examined the effects of dietary resistant starch in pregnant Goto-Kakizaki (GK) rats to improve glycemic control. Animal experiments were conducted to test the hypotheses. In study 1, the female GK rats were randomly grouped …
Student Perspectives On Study Abroad: The Case Of Louisiana State University's Summer Internships In The French Alps, Terri Lee Schroth
Student Perspectives On Study Abroad: The Case Of Louisiana State University's Summer Internships In The French Alps, Terri Lee Schroth
LSU Doctoral Dissertations
While many studies have been conducted on study abroad programs, few have sought to examine the inner workings of a short-term, non-traditional (non-classroom based) program, particularly from the participants’ point-of-view. This in-depth case study explores a short-term (4-week) cultural and linguistic internship program, “LSU in the French Alps,” as well as the perspectives of four program participants. This research was conducted during four phases of the study abroad experience: the pre-departure orientation (4 days on LSU’s main campus), the in-country stay (4 weeks in the French Alps), re-entry into the United States (first 10 days upon return), and post study …
The Relationship Among Self-Efficacy, Negative Self-Statements, And Social Anxiety In Children: A Mediation, Brittany Nicole Moree
The Relationship Among Self-Efficacy, Negative Self-Statements, And Social Anxiety In Children: A Mediation, Brittany Nicole Moree
LSU Master's Theses
Evidence suggests that general self-efficacy, one’s beliefs about his or her global abilities, and social self-efficacy, one’s beliefs in his or her ability to navigate social situations, are strongly connected to levels of social anxiety. Negative self-statements, also known as negative self-referent cognitions, have also been linked with levels of social anxiety. Although self-efficacy and negative self-statements have been shown to be important variables in the phenomenology and maintenance of social anxiety in children, they have yet to be examined in conjunction with one another. The purpose of this study was to examine the relationship between negative self-statements and selfefficacy …
Hoffman V Red Owl Stores And The Limits Of The Legal Method, Robert E. Scott
Hoffman V Red Owl Stores And The Limits Of The Legal Method, Robert E. Scott
UC Law Journal
According to the overwhelming majority view, promissory estoppel is not an appropriate ground for legally enforcing statements made during preliminary negotiations unless there is a "clear and unambiguous promise" on which the counterparty reasonably and foreseeably relies. Bill Whitford and Stewart Macaulay were among the first scholars to note the apparent absence of such a promise in the case of Hoffman v. Red Owl Stores. Several years ago, after studying the trial record, I concluded that the best explanation for the breakdown in negotiations was the fundamental misunderstanding between the parties as to the amount and nature of Hoffmann's equity …
Charity And Information: Correcting The Failure Of A Disjunctive Social Norm, Brian Broughman, Robert Cooter
Charity And Information: Correcting The Failure Of A Disjunctive Social Norm, Brian Broughman, Robert Cooter
Articles by Maurer Faculty
Charitable donations fund social goods that the state and markets undersupply. Despite widespread belief in the importance of private charity, most Americans donate little or nothing. Experiments in behavioral economics show that anonymity, not human nature, causes low contributions. Anonymity poses a particular challenge for charity because of the special character of the obligation. Charity is a disjunctive social norm, meaning the obligation is owed to ‘A or B or C or …’. Disclosure of each individual’s aggregate conduct is necessary for the effectiveness of any disjunctive social norm. To revitalize charity we propose a public registry where each taxpayer …
Sodom's Shadow: The Uncertain Line Between Public And Private Morality, Todd E. Pettys
Sodom's Shadow: The Uncertain Line Between Public And Private Morality, Todd E. Pettys
UC Law Journal
In citizens' debates about issues of public policy, we frequently encounter what this Article calls the "divine accountability thesis"-the controversial claim that the divine realm will punish a city, state, or nation unless it performs or proscribes certain forms of conduct. Many of us reject that claim, but its persistent usage in numerous societies over the past five thousand years teaches us a great deal about citizens' political selfconceptions. This Article begins by arguing that the divine accountability thesis illustrates human beings' deeply ingrained tendency to regard their political communities as discrete moral entities, individually deserving of punishment or reward. …
Reflections On Teaching: Dwelling In A Third Space, Sean William Buckreis
Reflections On Teaching: Dwelling In A Third Space, Sean William Buckreis
LSU Doctoral Dissertations
What does it mean to teach well? What does it mean to be a good teacher? These are questions that have been asked for hundreds if not thousands of years; yet, an unequivocal answer has not been reached. Drawing on Thomas Kuhn’s (1962/1996) concept of a paradigm, it is easy to see that the field of curriculum is anything but paradigmatic. Competing philosophical, psychological, and sociological schools of thought, for example, all support differing ideas of what “good teaching” looks like, and teacher education programs often reflect this diversity of thought. The situation does not end at the borders of …
The Role Of Daily Routines In Adolescents Diagnosed With Attention-Deficit/Hyperactivity Disorder, David N. Landry
The Role Of Daily Routines In Adolescents Diagnosed With Attention-Deficit/Hyperactivity Disorder, David N. Landry
LSU Doctoral Dissertations
Researchers consistently report both immediate and long-term benefits of establishing daily routines during childhood (e.g., increased physical health, medical treatment adherence, homework completion, and family communication). Increasing routines is also an essential component of evidence-based treatment programs for childhood externalizing problems (i.e., impulsivity, hyperactivity, and noncompliance). Research indicates that ADHD children respond particularly well to the regularity and predictability offered by daily routines. However, relatively few studies have examined the role that routines play on the adjustment and development of adolescents. In part, this is due to the lack of assessment tools available that specifically measure adolescent routines. The Adolescent …
