Jurisprudence And Psychology, Dan Priel Jan 2010

Jurisprudence And Psychology, Dan Priel

Comparative Research in Law & Political Economy

I argue that much of the work in analytic jurisprudence has been concerned with two questions that have not been adequately distinguished: (a) an inquiry about the concept of law, and (b) an explanation of the important features of the practice of law. It is often assumed that the two inquiries are the same. In this essay I distinguish the two and argue that work in psychology provides important insights about both. With regard to the first, I argue that much jurisprudential conceptual analysis is challenged by psychological work on concepts. With regard to the second, I argue that legal …

Abridging Constitutional Rights: Sexting Legislation In Ohio, Weronika Kowalczyk Jan 2010

Abridging Constitutional Rights: Sexting Legislation In Ohio, Weronika Kowalczyk

Cleveland State Law Review

What happens when you combine technology, raging adolescent hormones, and rash decisions? As we have seen these past few years, one outcome is “sexting” the trend of teenagers transmitting sexually suggestive text messages or photographs through cell phones and similar communication devices. In 2009, the media was saturated with stories pertaining to sexting, from discussing the ramifications of engaging in it including cyber bullying, slashed reputations, and serious criminal charges to providing guidelines for what parents and educators could do to control or prevent it. Though sexting includes the transmission of messages as well as photographs, the majority of media …

The Role And Positioning Of Public Relations In Non Profit Organisations: A Case Study Analysis, Gillian Lyons Jan 2010

The Role And Positioning Of Public Relations In Non Profit Organisations: A Case Study Analysis, Gillian Lyons

Theses

This study aims to explore the role and positioning of public relations (PR) in non-profit organisations (NPO’s). Two case studies are explored namely the Mercy Hospital Foundation and the Cork Simon Community. The lack of research in the area along with the belief that NPOs rely on PR more than any other industry prompted the research idea for this study.

The literature review deals with the need for PR to be accepted as a management function with many leading theorists agreeing on the matter. According to Grunig (1992), the organisational effectiveness theories provide organisations with the formula to make their …

Rights As Footprints: A New Metaphor For Contemporary Human Rights Practice, Katharine Young, Jeremy Perelman Jan 2010

Rights As Footprints: A New Metaphor For Contemporary Human Rights Practice, Katharine Young, Jeremy Perelman

Northwestern Journal of Human Rights

As the discourse of human rights becomes ever more widespread, the analysis of contemporary human rights practice must contend with its pluralistic and contradictory features. In this Article, we introduce the metaphor of rights as "footprints." We suggest that this metaphor captures the expressive and constitutive role of rights, and provides a critical tool with which to understand the accomplishments of the human rights field. In doing so, we document a right-to-health campaign in Accra, Ghana, which sought to end the human rights infringements that arose from the financing of health care through user fees. These infringements occurred when public …

Incorporation Or Symbiosis: Haitians And African Americans In Mattapan, Alix Cantave Jan 2010

Incorporation Or Symbiosis: Haitians And African Americans In Mattapan, Alix Cantave

Trotter Review

As Haitians continue to move to the United States in large numbers seeking economic opportunities and refuge from political repression and environmental degradation, their relationship with African Americans has also become more obvious. Haitians are settling in larger numbers in predominantly African American neighborhoods, and their U.S.-born children identify with African Americans and face many of the same issues as black youth in urban America. As Zéphir observed, Haitians remain an isolated group. This group centripetality greatly influences the relationship between Haitians and African Americans as well as how African Americans perceive Haitians as a group. This article examines the …

Commentary, Kenneth J. Cooper Jan 2010

Commentary, Kenneth J. Cooper

Trotter Review

It’s an explanation often heard around Boston. Why hasn’t the city ever elected a black mayor? Because the black community is “too small.” Why can’t the community sustain an FM radio station? And why does it have difficulty keeping afloat a weekly newspaper, even a soul food restaurant? Again, the answer comes: the community is too small. The irreconcilable flaw of this line of reasoning is exposed when it is expanded to the whole country. Black mayors have been elected in any number of cities with smaller black populations, proportionally, than the 25 percent in Boston—Los Angeles, San Francisco, and …

Forgotten Migrations From The United States To Hispaniola, Ryan Mann-Hamilton Jan 2010

Forgotten Migrations From The United States To Hispaniola, Ryan Mann-Hamilton

Trotter Review

At the first Hamilton family reunion, held in Samaná, Dominican Republic, in 2002, I took the opportunity to question my aunts and uncles about our family’s history and to share the story of our migration to the town with the mass of youngsters gathered for the event. Most of my cousins were amazed by the intricate details of movement, displacement, and transformation because they had never heard these stories before. The reaction that stood out came from a younger cousin brought up in Brooklyn. With a disconcerted look, he asked innocently, “So we’re black?” It had never dawned upon him, …

Heavy Metal: An Anthropological Approach To A Religious Phenomenon, Alexandra Durazo Jan 2010

Heavy Metal: An Anthropological Approach To A Religious Phenomenon, Alexandra Durazo

Whittier Scholars Program

This essay will consider whether the experience of heavy metal music can be understood as a religious phenomenon. Through field research and an exploration of ways to understand religion, I will show that the culture of heavy metal music parallels that of a religious phenomenon while considering whether heavy metal culture qualifies as a legitimate religion. From first-hand experience as well as observation and analysis and using anthropological methods of field research, I have gathered data in a journal to provide evidence of my experiences and analysis at heavy metal concerts from May 2, 2009 to April 8, 2010. I …

Should New Bills Of Rights Address Emerging International Human Rights Norms? The Challenge Of "Defamation Of Religion", Robert C. Blitt Jan 2010

Should New Bills Of Rights Address Emerging International Human Rights Norms? The Challenge Of "Defamation Of Religion", Robert C. Blitt

Northwestern Journal of Human Rights

The emerging international human rights norm of "defamation of religion," an ongoing flashpoint in debates at the United Nations (UN) and elsewhere, merits the attention of all parties playing a role in the drafting of new bills of rights. This article uses the case study of defamation of religion, as an emerging norm and the current debate over a possible Australian bill of rights, to argue that a well-rounded drafting process. This drafting process should contemplate the relevancy and impact of emerging norms as a means of enhancing the process, deepening domestic understanding of rights, and ensuring an outcome instrument …

Heroes And Villains: Increasing Fan Involvement In Pursuit Of “The Elusive Fan”, Thomas S. Mueller, John C. Sutherland Jan 2010

Heroes And Villains: Increasing Fan Involvement In Pursuit Of “The Elusive Fan”, Thomas S. Mueller, John C. Sutherland

Journal of Applied Sport Management

The sport consumption experience apparently facilitates a higher symbolic meaning, indicating a symbolic communicative role in the social psyche of consumers. Involvement with group members in the social (sport) setting appears to influence attendees’ self-concept. Despite a postmodern shift to individuality, Americans still choose to exist within the parameters of collective traditions and within communities of shared interests through the social institution of sport (Bellah, 1985). According to Rein et al. (2006), one of seven vital way sport properties can attract/retain such elusive fans involves heightening their attractions to the properties by emphasizing rivalries, which, in turn, increases fan involvement. …

Towards A Jurisprudence Of Hybridity, Paul Schiff Berman Jan 2010

Towards A Jurisprudence Of Hybridity, Paul Schiff Berman

GW Law Faculty Publications & Other Works

Debates about non-state normative communities often devolve into clashes between two polarized positions. On the one hand, we see the desire to eradicate difference through forced obeisance to a single overarching state norm. On the other, we see claims of complete autonomy for non-state lawmaking, as if such non-state communities could plausibly exist in isolation from the communities that both surround and intersect them.

Neither of these positions takes seriously the importance of engagement and dialogue across difference. Navigating difference doesn’t require either assimilation or separation; it requires negotiation. Legal pluralists have long charted this process of negotiation, noting, for …

Justice And Elegance For Hedgehogs - In Life, Law, And Literature, Linda C. Mcclain Jan 2010

Justice And Elegance For Hedgehogs - In Life, Law, And Literature, Linda C. Mcclain

Faculty Scholarship

At a time when value pluralism and even value polarization seem to be undeniable facts of contemporary life, Ronald Dworkin unrepentantly defends the unity of value. His point of departure is the Greek poet Archilochus’s saying, “The fox knows many things, but the hedgehog knows one big thing,” made famous in liberal philosopher Isaiah Berlin’s essay, The Hedgehog and the Fox. In his forthcoming book, Justice for Hedgehogs, Dworkin argues for the integration of ethics, personal morality, and political morality and contends that law is a branch of political morality that in turn is a branch of morality, broadly understood. …

Fifth Grade Student Learning And Interest In The American Revolution Through Reading Graphic Novels Compared To Reading Biography Or Other Nonfiction Books, Kari Bosma

Graduate Research Papers

The purpose of this study was to examine student recall of facts, along with enjoyment of reading and interest in the topic when using graphic novels as compared to illustrated nonfiction prose in social studies content area reading. Twenty-two fifth grade students (13 f, 9 m) in a public school in a Midwestern state participated in the study. Half of the students read about the Boston Massacre and Patrick Henry through graphic novels and read about Paul Revere and the Boston Tea Party with illustrated nonfiction texts, with the other half doing the opposite. The mean number of correct ideas …

Dual-Stage Sugar Substitution In Strawberries With A Stevia-Based Sweetener, Juan Garcia-Noguera, Curtis L. Weller, Francisca I. P. Oliveira, Sueli Rodrigues, Fabiano A. N. Fernandes Jan 2010

Dual-Stage Sugar Substitution In Strawberries With A Stevia-Based Sweetener, Juan Garcia-Noguera, Curtis L. Weller, Francisca I. P. Oliveira, Sueli Rodrigues, Fabiano A. N. Fernandes

Department of Agricultural and Biological Systems Engineering: Faculty Publications

The present study introduces and analyzes a new process denominated dual-stage sugar substitution (D3S). This process aims to induce sugar substitution in strawberries. In a first stage, high-calorie sugars (sucrose, fructose and glucose) are partially removed from the fruit samples and in a second stage, low-calorie sugar (stevioside and rebaudioside) is incorporated to the fruit to maintain its sweetness. The process was evaluated by studying the use of ultrasound application in one or both stages of the D3S process. Best performance of the process was obtained by subjecting the fruit samples to ultrasound in the sugar removal stage followed by …

Mediation In Employment And Creeping Legalism: Implications For Dispute Systems Design, Lisa Blomgren Bingham, Susan Summers Raines, Timothy Hedeen, Lisa Marie Napoli

Journal of Dispute Resolution

This article will explore the question of creeping legalism in mediation of statutory disputes arising out of employment. First, it will briefly review the issue of creeping legalism in arbitration. Second, it will introduce dispute systems design (DSD). Third, it will review the analogous debate on legalism in mediation in three design contexts: evaluative mediation of employment disputes in the court-connected setting, grievance mediation embedded in the collective bargaining agreement, and transformative mediation of employment disputes in the United States Postal Service's (USPS's) REDRESS program. Most employees do not face a choice among mediation models; instead, they choose among adjudicative …

Commemoration, Memory, And Forgotten Histories: The Complexity And Limitations Of Australian Army Biography, Peter J. Dean Jan 2010

Commemoration, Memory, And Forgotten Histories: The Complexity And Limitations Of Australian Army Biography, Peter J. Dean

Arts Papers and Journal Articles

Military biography in Australia raises questions about the specific historiography more generally, and about the commemorative and celebratory tendencies in Australian military writing. Recent advances in the field illustrate the continuing tensions within the writing of military history in Australia, and reflect some of the same tendencies elsewhere in the English speaking world.
