Constitutional Torts, Over-Deterrence And Supervisory Liability After Iqbal (2010) (Symposium), Sheldon Nahmod
Constitutional Torts, Over-Deterrence And Supervisory Liability After Iqbal (2010) (Symposium), Sheldon Nahmod
All Faculty Scholarship
My forthcoming Article is divided into the following parts. In Part I, I survey relevant aspects of the law of § 1983 and Bivens. Painting with a broad brush and for the most part descriptively, I maintain that the Court’s concern with over-deterrence has increasingly dominated constitutional torts. In Part II, I address the relevance of that concern for supervisory liability, set out what the Court said about supervisory liability in Iqbal and very briefly summarize the pre-Iqbal circuit consensus on supervisory liability. In Part III, I delve more deeply into the nature of supervisory liability and conclude that the …
Concepts Of The Body In The Zhuangzi, Deborah A. Sommer (司馬黛蘭)
Concepts Of The Body In The Zhuangzi, Deborah A. Sommer (司馬黛蘭)
Religious Studies Faculty Publications
In this essay Sommer explores how the Zhuangzi, a Chinese philosophical text that dates to the third or fourth centuries BCE, uses different terms for the human body. She explores each term's different fields of meaning: the body might appear as gong 躬, a sanctimonious ritualized body; shen 身, a site of familial and social personhood; xing 形, an elemental form that experiences mutations and mutilations; or ti 體, a complex, multilayered corpus whose center can be anywhere but whose boundaries are nowhere. The Zhuangzi is one of the richest early Chinese sources for exploring conceptualizations of the visceral …

Contextualizing The Software Patent Debate In Canada: A Practical Approach To Policy Development, Conrad Delbert Seaman
Contextualizing The Software Patent Debate In Canada: A Practical Approach To Policy Development, Conrad Delbert Seaman
Osgoode Hall Review of Law and Policy
There has been ongoing international debate regarding the patentability of software for at least 15 years. Despite being bound by international laws, which deal directly with the patentability of software (TRIPS), individual countries continue to justify vastly different legislative and practical patent regimes in this field of innovation. In a very traditional and conservative fashion Canada has placed itself carefully on the fence in this debate adopting an approach which falls somewhere between that of the U.S. and Europe, providing little practical guidance for businesses, lawyers or software developers in the industry. This paper seeks to establish an approach, solution …

Bahasa dan Seni: Jurnal Bahasa, Sastra, Seni, dan Pengajarannya
This study reports on an internal evaluation of an in service training in Indonesia called English Language Training for Islamic Schools (ELTIS). The data obtained from questionnaires were cross-referenced through document reviews and focus group discussions. A total of 187 Islamic junior high school teachers responded to the questionnaire. The questionnaire asked about any improvements they expe- rienced, the support from their schools to apply the new knowledge and skills, and the relevance of the training to their needs. The results showed that the English abili- ty and the teaching skills of the teachers had improved. Support from the schools …
