Foreword: New Perspectives On Brady And Other Disclosure Obligations: What Really Works?, Ellen Yaroshefsky Jan 2010

Foreword: New Perspectives On Brady And Other Disclosure Obligations: What Really Works?, Ellen Yaroshefsky

Hofstra Law Faculty Scholarship

Nearly fifty years after the Supreme Court decided Brady v. Maryland, state and federal criminal justice systems appear less than adequate in assuring that prosecutorial disclosure obligations are met. Recent high-publicity cases have highlighted failures to disclose fundamental exculpatory evidence to the defense, whether intentional or not. A November 2009 symposium at the Cardozo School of Law - New Perspectives on Brady and Other Disclosure Obligations: What Really Works? - explored these issues in a unique framework for the criminal justice system. It considered lessons from the fields of medicine, business, psychology, and policing as to their methods for …

Transactional Planning And Advice, Linda Galler, Michael B. Lang Jan 2010

Transactional Planning And Advice, Linda Galler, Michael B. Lang

Hofstra Law Faculty Scholarship

The point of conflicts of interest rules is to protect clients' reasonable expectations that legal advisors and representatives will act on their behalf free from compromising loyalties and influences. Thus, the basic principle embodied in the Model Rules' conflict provisions is that a lawyer may not represent anyone where the interests of another person - a current or former client, perhaps, or the lawyer's own interests - could impair the lawyer's ability to zealously and impartially act on a client's behalf. Resolution of a conflict might entail declining to undertake representation, withdrawing from an existing representation, or obtaining a Client …

Human Rights Reference Sources: A Critical Annotated Bibliography, Chad M. Kahl, Stephanie Davis-Kahl

Faculty and Staff Publications – Milner Library

The area of human rights has had significant attention both nationally and internationally in the press and in the political arena. While there is a renewed commitment to human rights advocacy, there is also an upward trend in popular culture of depictions of torture. This article provides critical annotations of English-language reference sources, published since 1990, and available both in print and online, in an effort to aid librarians collecting and weeding materials for human rights research.

Measurement And Modeling Of Infrared Nonlinear Absorption Coefficients And Laser-Induced Damage Thresholds In Ge And Gasb, T. J. Wagner, M. A. Bohn, Ronald A. Coutu Jr., L. P. Gonzalez, J. M. Murray, K. L. Schepler, S. Guha Jan 2010

Measurement And Modeling Of Infrared Nonlinear Absorption Coefficients And Laser-Induced Damage Thresholds In Ge And Gasb, T. J. Wagner, M. A. Bohn, Ronald A. Coutu Jr., L. P. Gonzalez, J. M. Murray, K. L. Schepler, S. Guha

Electrical and Computer Engineering Faculty Research and Publications

Using a simultaneous fitting technique to extract nonlinear absorption coefficients from data at two pulse widths, we measure two-photon and free-carrier absorption coefficients for Ge and GaSb at 2.05 and 2.5 μm for the first time, to our knowledge. Results agreed well with published theory. Single-shot damage thresholds were also measured at 2.5 μm and agreed well with modeled thresholds using experimentally determined parameters including nonlinear absorption coefficients and temperature dependent linear absorption. The damage threshold for a single-layer Al2O3 anti-reflective coating on Ge was 55% or 35% lower than the uncoated threshold for picosecond or nanosecond …

An Exploratory Study Of The Intrapersonal, Socio-Cultural, And Behavioral Factors That Influence Hiv Risk Behaviors Among Ethnic Subgroups Of Black Heterosexual Men: The Intersection Of The Beliefs And Perceptions Of Black Women, Shalewa Noel-Thomas Jan 2010

An Exploratory Study Of The Intrapersonal, Socio-Cultural, And Behavioral Factors That Influence Hiv Risk Behaviors Among Ethnic Subgroups Of Black Heterosexual Men: The Intersection Of The Beliefs And Perceptions Of Black Women, Shalewa Noel-Thomas

USF Tampa Graduate Theses and Dissertations

Twenty five years after AIDS was first scientifically described, the disease continues to take its toll on the human population. HIV/AIDS disproportionately affects marginalized groups such as poor, underserved, minority populations. In the United States, Blacks become infected with and die from HIV/AIDS more than any other ethnic or racial group. Despite a vast body of literature on HIV/AIDS, little research has focused on black heterosexual men and even fewer studies have explored the context of risk among subgroups of black men.

Using qualitative research methods and a socio-ecological framework, this study explored the intrapersonal, socio-cultural, and behavioral factors that …

Jam Tomorrow: Distributive Justice And The Limits Of International Economic Law, Barbara Stark Jan 2010

Jam Tomorrow: Distributive Justice And The Limits Of International Economic Law, Barbara Stark

Hofstra Law Faculty Scholarship

The chasm between the rich and the poor has become unfathomable. This Article asks whether existing international economic law can bridge this chasm and effectuate distributive justice. "Distributive justice" itself is an ambiguous goal. This Article inquires, as a threshold question, what, exactly, is required for actual "distributive justice". It takes as a starting point the relatively modest objective of the Millennium Development Goals-to halve the number living in extreme poverty by 2015. It argues that this objective is not going to be achieved under the aegis of international economic law for two reasons. First, distributive justice is not an …

Sticky Copyrights: Discriminatory Tax Restraints On The Transfer Of Intellectual Property, Bridget J. Crawford, Mitchell M. Gans Jan 2010

Sticky Copyrights: Discriminatory Tax Restraints On The Transfer Of Intellectual Property, Bridget J. Crawford, Mitchell M. Gans

Hofstra Law Faculty Scholarship

This Article focuses on the federal estate and gift tax treatment of copyright termination rights. The ability of a creative individual to terminate prior copyright transfers serves to protect against economic exploitation. Once a copyright's value has been established in the marketplace, the author (or the author's heirs) enjoys a “second look” at the gift, sale, license or other transfer of a copyright. But copyright termination rights—intended to enhance the economic well-being of authors and artists—undermine estate planning strategies available to owners of other types of property. There is no policy justification for such discrimination, and so this Article proposes …

Towards A U.S. Army Officer Corps Strategy For Success: Retaining Talent, Michael J. Colarusso Dr., Casey Wardynski Colonel, David S. Lyle Colonel Jan 2010

Towards A U.S. Army Officer Corps Strategy For Success: Retaining Talent, Michael J. Colarusso Dr., Casey Wardynski Colonel, David S. Lyle Colonel

Books, Monographs & Collaborative Studies

Over the last 3 decades, dramatic labor market changes and well-intentioned but uninformed policies have created significant officer talent flight. Poor retention engenders substantial risk for the Army as it directly affects accessions, development, and employment of talent. The Army cannot make thoughtful policy decisions if its officer talent pipeline continues to leak at current rates. Since the Army cannot insulate itself from labor market forces as it tries to retain talent, the retention component of its officer strategy must rest upon sound market principles. It must be continuously resourced, executed, measured, and adjusted across time and budget cycles. Absent …

Information Theoretic Approach For Assessing Image Fidelity In Photon-Counting Arrays, Srikanth R. Narravula, Majeed M. Hayat, Bahram Javidi Jan 2010

Information Theoretic Approach For Assessing Image Fidelity In Photon-Counting Arrays, Srikanth R. Narravula, Majeed M. Hayat, Bahram Javidi

Electrical and Computer Engineering Faculty Research and Publications

The method of photon-counting integral imaging has been introduced recently for three-dimensional object sensing, visualization, recognition and classification of scenes under photon-starved conditions. This paper presents an information-theoretic model for the photon-counting imaging (PCI) method, thereby providing a rigorous foundation for the merits of PCI in terms of image fidelity. This, in turn, can facilitate our understanding of the demonstrated success of photon-counting integral imaging in compressive imaging and classification. The mutual information between the source and photon-counted images is derived in a Markov random field setting and normalized by the source-image’s entropy, yielding a fidelity metric that is between …

Examining The Relationship Between Self-Efficacy And Stimulus Processing, Peter J. Rosen Jan 2010

Examining The Relationship Between Self-Efficacy And Stimulus Processing, Peter J. Rosen

Honors Projects

Stimulus processing is an essential cognitive process that plays a vital role in our decision making and task execution. Since stimulus processing has been shown to be an important factor in task performance and cognitive well-being, it is necessary to explore the relationship it has with other psychological variables related to performance, as well as assess ways in which stimulus processing may be enhanced. The authors hypothesized that self-efficacy (SE) may improve performance by enhancing stimulus processing during task completion. To test this hypothesis, we examined the relationships between SE, behavioral measures of task performance, and neural indices of stimulus …

Financial Stress, Neighborhood Stress, And Well-Being: Mediational And Moderational Models, Amy Kapp Jan 2010

Financial Stress, Neighborhood Stress, And Well-Being: Mediational And Moderational Models, Amy Kapp

Honors Projects

This study explores how aspects of the community environment might facilitate the stress-and-coping process – specifically, the protective effects of social integration and high quality neighborhoods on psychological well-being. Previous research suggests that low levels of financial stress, lower neighborhood stress, and social integration are each associated with greater levels of well-being; few studies, however, investigate these contextual variables in conjunction with one another. Data from the Notre Dame Study of Health and Well-Being were used to investigate whether (1) neighborhood stress moderates the relationship between financial stress and psychological well-being and (2) social integration mediates the relationship between neighborhood …

The Village Voice: Masculine Identity Construction Within An Interpretive Community, Deirdre Duffy Jan 2010

The Village Voice: Masculine Identity Construction Within An Interpretive Community, Deirdre Duffy

Conference papers

This paper looks at how young Irish men construct their masculine self/identity/body keeping in mind the mediated world within which they find themselves, and considering their own more immediate social surroundings and influences, that is to say, their interpretive community. The research paper combines Foucault’s later writings on technologies of the self with literary theory, using critics such as Stanley Fish (1980) and his work on ‘Interpretive Communities’ to inform the study.

Bayesian Model Of The Dynamics Of Motion Integration In Smooth Pursuit And Plaid Perception, Kameliya Dimova Jan 2010

Bayesian Model Of The Dynamics Of Motion Integration In Smooth Pursuit And Plaid Perception, Kameliya Dimova

School of Engineering, Computing and Mathematics Theses

In this thesis, a model of motion integration is described which is based on a recursive Bayesian estimation process. The model displays a dynamic behaviour qualitatively similar to the dynamics of the motion integration process observed experimentally in smooth eye pursuit and plaid perception. The computer simulations of the model applied to smooth pursuit eye movements confirm the psychophysical data both in humans and monkeys, and the physiological data in monkeys. The temporal dynamics of motion integration is demonstrated together with its dependence on contrast, size of the stimulus and added noise. A new theoretical approach to explaining plaid perception …

Total Quality Management And Construction Project Management In Libya, Khaled F. Sherif Jan 2010

Total Quality Management And Construction Project Management In Libya, Khaled F. Sherif

School of Engineering, Computing and Mathematics Theses

This thesis sought to explore Total quality management (TQM) implementation and barriers that need to be overcome due to differences between societal cultures, which have become a subject of intense discussion in the wake of the globalisation of the world economy. lnter-societal cultural barriers to TQM implementation were contrasted against the accepted organisational cultural barriers, which are well documented in established literature on this topic. A case study for the analysis was taken from the Libyan construction sector, where TQM is increasingly being reported as being adopted by companies keen to solve quality problems in their industry. This research explored …

Glass Frit As A Hermetic Joining Layer In Laser Based Joining Of Miniature Devices, Qiang Wu, Norbert Lorenz, Kevin Cannon, Duncan Hand Jan 2010

Glass Frit As A Hermetic Joining Layer In Laser Based Joining Of Miniature Devices, Qiang Wu, Norbert Lorenz, Kevin Cannon, Duncan Hand

Articles

In this paper, we investigate the feasibility of using a laser as the heat source to drive a hermetic joining process based on a glass frit intermediate layer. The laser allows the necessary heat energy to be provided in a localized manner; important either as part of a multistage process, or to allow thermally-sensitive materials to be used inside the package. Our study includes an investigation of the impact of rough and grooved surfaces on the hermeticity and strength of the join, demonstrating the robust nature of the process, and its ability to allow feed-throughs to the center of package. …

A Categorical Semantics For Fuzzy Predicate Logic, Lawrence Stout Jan 2010

A Categorical Semantics For Fuzzy Predicate Logic, Lawrence Stout

Scholarship

The object of this study is to look at categorical approaches to many valued logic, both propositional and predicate, to see how different logical properties result from different parts of the situation. In particular, the relationship between the categorical fabric I introduced at Linz in 2004 and the Fuzzy Logics studied by Hajek (2003) [5], Esteva et al. (2003) [1], and Hajek (1998) [4], comes from restricting the kind of structures used for truth values. We see how the structure of the various kinds of algebras shows up in the categorical logic, giving a variant on natural deduction for these …

When Does A Category Built On A Lattice With A Monoidal Structure Have A Monoidal Structure?, Lawrence Stout Jan 2010

When Does A Category Built On A Lattice With A Monoidal Structure Have A Monoidal Structure?, Lawrence Stout

Scholarship

In a word, sometimes. And it gets harder if the structure on L is not commutative. In this paper we consider the question of what properties are needed on the lattice L equipped with an operation * for several different kinds of categories built using Sets and L to have monoidal and monoidal closed structures. This works best for the Goguen category Set(L) in which membership, but not equality, is made fuzzy and maps respect membership. Commutativity becomes critical if we make the equality fuzzy as well. This can be done several ways, so a progression of categories is considered. …

A Strategy For The Development Of Lifelong Learning And Personal Skills Throughout An Undergraduate Engineering Pogramme, Gavin Duffy, Brian Bowe Jan 2010

A Strategy For The Development Of Lifelong Learning And Personal Skills Throughout An Undergraduate Engineering Pogramme, Gavin Duffy, Brian Bowe

Conference papers

For many years engineering programmes have placed a stronger emphasis on the development of technical knowledge, understanding and skills at the expense of personal skills such as initiative, creativity, communication, teamwork and lifelong self-directed learning. Recent changes in accreditation criteria call for greater competences in these skills to be achieved in the undergraduate programme. An argument is presented that this requires a change from the traditional approach to engineering education to a group-based project driven one as this is compatible with concurrent development of both technical and non-technical learning outcomes. Just as a clear path of progression exists from the …

On The Applications Of Deterministic Chaos For Encrypting Data On The Cloud, Jonathan Blackledge, Nikolai Ptitsyn Jan 2010

On The Applications Of Deterministic Chaos For Encrypting Data On The Cloud, Jonathan Blackledge, Nikolai Ptitsyn

Conference papers

Cloud computing is expected to grow considerably in the future because it has so many advantages with regard to sale and cost, change management, next generation architectures, choice and agility. However, one of the principal concerns for users of the Cloud is lack of control and above all, data security. This paper considers an approach to encrypting information before it is ‘place’ on the Cloud where each user has access to their own encryption algorithm, an algorithm that is based on a set of Iterative Function Systems that outputs a chaotic number stream, designed to produce a cryptographically secure cipher. …

E-Fraud Prevention Based On The Self-Authentication Of E-Documents, Jonathan Blackledge, Eugene Coyle Jan 2010

E-Fraud Prevention Based On The Self-Authentication Of E-Documents, Jonathan Blackledge, Eugene Coyle

Conference papers

We consider a method for preventing e-Fraud in which a binary image is encrypted with a floating point cipher using a convolution operation and the output quantized into a 1-bit array generating a binary image ciphertext. The output is then ‘embedded’ in a host image to hide the encrypted information. Embedding is undertaken either in the lowest 1-bit layer or multiple 1-bit layers. Decryption is accomplished by: (i) extracting the binary image from the host image; (ii) correlating the result with the original cipher. In principle, any cipher generator can be used for this purpose and the method has been …

Authentication Of Biometric Features Using Texture Coding For Id Cards, Jonathan Blackledge, Eugene Coyle Jan 2010

Authentication Of Biometric Features Using Texture Coding For Id Cards, Jonathan Blackledge, Eugene Coyle

Conference papers

The use of image based information exchange has grown rapidly over the years in terms of both e-to-e image storage and transmission and in terms of maintaining paper documents in electronic form. Further, with the dramatic improvements in the quality of COTS (Commercial-Off-The-Shelf) printing and scanning devices, the ability to counterfeit electronic and printed documents has become a widespread problem. Consequently, there has been an increasing demand to develop digital watermarking techniques which can be applied to both electronic and printed images (and documents) that can be authenticated, prevent unauthorized copying of their content and, in the case of printed …

Encryption Using Deterministic Chaos, Jonathan Blackledge, Nikolai Ptitsyn Jan 2010

Encryption Using Deterministic Chaos, Jonathan Blackledge, Nikolai Ptitsyn

Articles

The concepts of randomness, unpredictability, complexity and entropy form the basis of modern cryptography and a cryptosystem can be interpreted as the design of a key-dependent bijective transformation that is unpredictable to an observer for a given computational resource. For any cryptosystem, including a Pseudo-Random Number Generator (PRNG), encryption algorithm or a key exchange scheme, for example, a cryptanalyst has access to the time series of a dynamic system and knows the PRNG function (the algorithm that is assumed to be based on some iterative process) which is taken to be in the public domain by virtue of the Kerchhoff-Shannon …

The Effects Of Harmonics On Power Quality And Energy Efficiency, Alan Harrison Jan 2010

The Effects Of Harmonics On Power Quality And Energy Efficiency, Alan Harrison

Other resources

By making our electricity supply more secure, reliable and versatile will mean that we reduce our reliance upon oil, gas and solid fuels, which mostly exist outside of Ireland and the European community. The majority of our fuel is imported and this makes our economy dependent on outside interests and out of our control. Even more importantly as the world’s fossil fuel reserves are running out and electricity demand is ever increasing.

If we make our electricity networks secure and designed to the highest standards we can import and export electrical energy more easily as our demands change, for example …

The Fractal Market Hypothesis: Applications To Financial Forecasting, Jonathan Blackledge Jan 2010

The Fractal Market Hypothesis: Applications To Financial Forecasting, Jonathan Blackledge

Other resources

Most financial modelling systems rely on an underlying hypothesis known as the Efficient Market Hypothesis (EMH) including the famous Black-Scholes formula for placing an option. However, the EMH has a fundamental flaw: it is based on the assumption that economic processes are normally distributed and it has long been known that this is not the case. This fundamental assumption leads to a number of shortcomings associated with using the EMH to analyse financial data which includes failure to predict the future volatility of a market share value. This book introduces a new financial risk assessment model based on Levy statistics …

Connecting Micro-Generators In Parallel To The Low Voltage Distribution Network Utilising Standard En50438 In The Republic Of Ireland, Liam Murphy Jan 2010

Connecting Micro-Generators In Parallel To The Low Voltage Distribution Network Utilising Standard En50438 In The Republic Of Ireland, Liam Murphy

Other resources

The green agenda has been much to the fore internationally and has particularly had an influence in Republic of Ireland (ROI) where there are ‘green’ ministers in Government. Mr. Eamon Ryan who is the Minister for Communications, Energy and Natural Resources has particularly championed the idea of self generation. The author’s interest in the subject matter is to investigate the up-take of micro-generation and determine the likely short term future along with the grid tie standard i.e. EN50438.

Issues surrounding micro-generation are considered from the international and national perspective and from a customer and generation utility point of view. The …
