Revisiting The Regulatory Status Of Broadband Internet Access: A Policy Framework For Net Neutrality And An Open Competitive Internet, Lee L. Selwyn, Helen E. Golding
Federal Communications Law Journal
A decade of broadband access deregulation has landed the FCC at a legal deadend. After the D.C. Circuit's Comcast decision, the FCC finds itself unable to enforce its "net neutrality" goals. To reassert its jurisdiction over "net neutrality," the FCC proposes to reclassify broadband Internet access as a Title II "telecommunications service" while continuing to forbear from most other facets of common carrier regulation. The FCC's current dilemma results from an unfortunate combination of unverified predictive judgments associating deregulation with investment; overly optimistic assessments of competition in the consumer broadband market; the abandonment of the "bright line" between transmission and …

Legislative And Regulatory Recommendations To Allow Home-Processing Of Low-Risk Foods In Mississippi, Harvard Law School Mississippi Delta Project
Delta Directions: Publications
With the recent growth in farmers markets and the demand for local, fresh foods there has been a push to allow individuals to produce and sell foods made in their homes. This report will explain why Mississippi should follow the trend set by over 30 states to allow in-home production and sale of certain low-risk or non-potentially hazardous foods like baked goods, jams, jellies, and dried herbs. This report will lay out current Mississippi law regarding the processing of such non-potentially hazardous foods in home kitchens; compare Mississippi law to the laws employed in other states; and make recommendations for …

The Modulation Of Trpm7 Currents By Nafamostat Mesilate Depends Directly Upon Extracellular Concentrations Of Divalent Cations, Xuanmao Chen, Tomohiro Numata, Minghua Li, Yasuo Mori, Beverley A. Orser, Michael F. Jackson, Zhi-Gang Xiong, John F. Macdonald
Molecular, Cellular & Biomedical Sciences
Concentrations of extracellular divalent cations (Ca2+ and Mg2+) fall substantially during intensive synaptic transmission as well as during some pathophysiological conditions such as epilepsy and brain ischemia. Here we report that a synthetic serine protease inhibitor, nafamostat mesylate (NM), and several of its analogues, block recombinant TRPM7 currents expressed in HEK293T cells in inverse relationship to the concentration of extracellular divalent cations. Lowering extracellular Ca2+ and Mg2+ also evokes a divalent-sensitive non-selective cation current that is mediated by TRPM7 expression in hippocampal neurons. In cultured hippocampal neurons, NM blocked these TRPM7-mediated currents with an apparent affinity of 27 μM, as …

Financial Statements Are About To Get A New Look, Clemense Ehoff Jr.
All Faculty Scholarship for the College of Business
In October 2008, The FASB and the IASB issued a discussion letter for comment proposing a complete redesign of financial statements. This was the result of a project that began for both boards in 2001. More than 200 comment letters were received from individuals, accounting firms, professional societies, corporations, and others from the business community. The FASB and IASB have analyzed the input, and are currently preparing an exposure draft scheduled for release in early 2011. This paper reviews the proposed changes to the financial statements, summarizes the favorable and unfavorable responses contained in the comment letters, and examines the …

Many organisations invest heavily in information technology, acquiring the best IT equipment, backup for the best IT equipment, and hiring highly skilled and reputable IT consultants and vendors. While a great IT infrastructure will be critical to business success, its escalating costs have become somewhat prohibitive, thanks, in part, to a vicious lock-in cycle that handcuffs organisations to heavy machines. Enter cloud computing – a new paradigm in IT management that slashes capital expenditure and operating costs. Amazon.com, which runs the world's largest online retail store on a cloud, believes that cloud computing is the way forward for the connected …

Pull Production System Training Guide, Adem Bilgutay
Industrial and Manufacturing Engineering
This book is a series of lessons designed to train operators and managers in pull manufacturing. It begins with a description of the different forms of waste that a system can help to identify and eliminate. The second section details the kanban as a system for controlling flow and as a powerful tool for identifying problems. It will describe the many different variations of kanban that exist to control flow in different production environments and the calculations that allow them to be used effectively. The final section will detail the activities that an operator should engage in when there is …

Use Of Wireline Logs To Estimate Strength Of Cap-Rock Lithologies, Elizabeth S. Petrie, James P. Evans
Graduate Student Posters
The characterization of rock strength for cap rock, low-permeability and high capillary entry pressure, lithologies is important for modeling their response to increased fluid pressures in CO2 sequestration schemes and other geo-engineering operations such as waste disposal and recovery of fluids from plays with insufficient permeability. We investigate Mesozoic fine-grained sequences to evaluate the nature of sedimentological and structural processes that may control the nature of brittle deformation observed in these sequences. To characterize these fine-grained sequences we use a combination of data obtained from outcrop, including fracture orientation and density, lithologic stacking patterns, grain-size distributions and mineralogy to predict …

Efficacy Of The United States Safe Harbor Framework, Margaret M. Beck
Regis University Student Publications (comprehensive collection)
This study assessed the efficacy of the United States Safe Harbor Framework by approximating the size of a population of large United States organizations (50,000 - 500,000 employees) that were eligible to participate in the Safe Harbor that did not participate. The Safe Harbor Framework, administered by the United States Department of Commerce, is a voluntary program that assists United States organizations in complying with the European Union Data Privacy Directive. Out of a population of 337 large organizations, 168 were potentially eligible to participate in the Safe Harbor Framework. One hundred and ten, or 66%, of these organizations did …
Attorney Deceit Statutes: Promoting Professionalism Through Criminal Prosecutions And Treble Damages, Alex B. Long
Attorney Deceit Statutes: Promoting Professionalism Through Criminal Prosecutions And Treble Damages, Alex B. Long
Scholarly Works
Unbeknownst to many lawyers, numerous jurisdictions - including New York and California - have statutes on the books that single out lawyers who engage in deceit or collusion. In nearly all of these jurisdictions, a lawyer found to have engaged in deceit or collusion faces criminal penalties and/or civil liability in the form of treble damages. Until recently, these attorney deceit statutes have languished in obscurity and, through a series of restrictive readings of the statutory language, have been rendered somewhat irrelevant. However, in 2009, the New York Court of Appeals breathed new life into New York’s attorney deceit statute …

This project will take place during the 2006 and 2007 school years. I will be mentoring seven new teachers at the Medina Valley High School for two years. This program is in part a result of the No Child Left Behind Act. It is designed to reduce premature "leakage" from the profession of disillusioned new teachers by providing teachers with a trusted, supportive leadership and to ensure that the new teachers will grow in their profession to benefit their students, school and community. I will also provide spiritual support when needed and asked. I will maintain communications and meet with …

The Surge: General Petraeus And The Turnaround In Iraq, William A. Knowlton , Jr.
NDU Case Studies
When General David H. Petraeus, USA, took command of Multi-National Force–Iraq (MNF–I) on February 10, 2007, beginning his 3d tour and 28th month in Iraq, the situation was grim. Increasing sectarian violence had led to an escalation of killings of civilians in Iraq, with up to 150 corpses being found daily in Baghdad.1 The government of Prime Minister Nouri alMaliki was viewed by almost everyone as ineffective at best, and the U.S. military strategy was not well defined and clearly not working. Iraq appeared to be sliding out of control toward civil war or disintegration, and the United States appeared …

‘‘The Map Proves It’’: Map Use By The American Woman Suffrage Movement, Christina E. Dando
‘‘The Map Proves It’’: Map Use By The American Woman Suffrage Movement, Christina E. Dando
Geography and Geology Faculty Publications
In the early twentieth century, American suffragists used ‘‘a suffrage map’’ showing the spread of women’s suffrage on posters, pamphlets, and broadsides. The map was part of a shift in tactics used by the suffrage movement: leaving the parlours and taking to the streets, the suffragettes were claiming public space. This article explores the verbal and graphic rhetoric of these persuasive maps, as well as the politics of their placement, exploring how suffragettes moulded and used these traditionally masculinist ways of knowing to advance their cause while simultaneously marginalizing women of colour. Their adoption of maps represents an early example …

The Bonded Labor System In Nepal: Exploring Halia And Kamaiya Children’S Life-Worlds, Birendra R. Giri
HIMALAYA, the Journal of the Association for Nepal and Himalayan Studies
Nepal is believed to have thousands of bonded laborers under the so-called haliya and kamaiya systems. The latter was outlawed in 2000 and the former in 2008, following a widespread campaign by local organisations, including the bonded laborers themselves. While state intervention has reportedly discouraged adults from forging an annual haliya or kamaiya contract, even the so-called “systematic rehabilitation” of “freed” kamaiya families has not been entirely successful in offering long-term livelihood alternatives. As a result, patchy reports suggest that children are increasingly taking the jobs done by their parents or elders. This study, which focuses on Musahar and Tharu …
