Fire In The Southern U.S: Administrative Laws And Regulations In The Southeast And Wildfire Distribution In Mississippi, Branden Tolver Aug 2010

Fire In The Southern U.S: Administrative Laws And Regulations In The Southeast And Wildfire Distribution In Mississippi, Branden Tolver

Theses and Dissertations

Wildfires in the United States present a complexity of problems for private landowners and policy makers. This thesis takes a look at two key issues faced by private and government stakeholders; the first being a lack of knowledge regarding current prescribed fire laws and regulations. A legal review of administrative laws and regulations for prescribed burning in the Southeastern United States in the context of management-based regulation is used to address this issue. It was found that regulation for prescribed burning has shifted to a more management–based regime. The second is an empirical study of wildfire distribution in the state …

City Of Las Vegas, Department Of Building And Safety: Valuation Based Fee Schedule Analysis, Darcy Adelbai-Hurd, Vicki L. Brown, Josh Turley, Mary Ann Weidner

UNLV Theses, Dissertations, Professional Papers, and Capstones

The City of Las Vegas Building and Safety Department (B & S) is being forced to make a number of difficult decisions regarding the structure of fees charged for the various services it provides. Like many building departments nationwide, B & S is experiencing the financial impact of the current economic decline affecting the construction industry. These fees directly affect B & S’ ability to staff the department in a manner that enables them to deliver an adequate level of service. With construction permits issued by B & S plummeting from an all-time high of 19,147 in 2004 to 5,093 …

A Tale Of Two Silos: Collaborative School Facility Planning In Post-Katrina New Orleans, Lauren Mikulak Aug 2010

A Tale Of Two Silos: Collaborative School Facility Planning In Post-Katrina New Orleans, Lauren Mikulak

LSU New Orleans Theses and Dissertations

Cities and schools are traditionally planned in separate silos by local governments and school boards. Collaborative school facility planning (CSP) unites these two silos and integrates decision-making by city and school entities. This research addresses the relationship between urban planning and school facility planning in New Orleans, Louisiana, where CSP is particularly important in light of rebuilding efforts since Hurricane Katrina. The researcher examines the extent, challenges, and opportunities for CSP in New Orleans. Based on interviews and recent planning texts, little collaboration existed in the past; but the decommissioning of 52 New Orleans public school facilities presents an unmistakable …

Economic Impact Of Local Immigration Regulation: An Empirical Analysis, Huyen Pham, Pham Hoang Van Aug 2010

Economic Impact Of Local Immigration Regulation: An Empirical Analysis, Huyen Pham, Pham Hoang Van

Faculty Scholarship

A wave of local anti-immigration laws has swept the country, triggering contentious debate and raising significant legal and policy issues. One critical dimension that has been largely ignored, however, is the economic impact of these laws: Are jurisdictions with them better off economically than those without them?

In the first empirical study of this issue, we analyze the economic impact of local anti-immigration laws. The laws take differentformssome authorize local police to enforce federal immigration laws, some restrict benefits like housing and employment to those with legal immigration status, and some require all government transactions to be conducted in English …

Staying Neutral: How Washington State Courts Should Approach Negligent Supervision Claims Against Religious Organizations, Kelly H. Sheridan Aug 2010

Staying Neutral: How Washington State Courts Should Approach Negligent Supervision Claims Against Religious Organizations, Kelly H. Sheridan

Washington Law Review

The torts of negligent hiring, supervision, and retention place a duty on employers to prevent their employees from using the places, things, or tasks entrusted to them to harm foreseeable victims. The negligent employment torts create an independent duty under which plaintiffs may pursue an action when suits brought under a vicarious liability or breach of fiduciary duty theory would fail. For victims of sexual misconduct by religious leaders, negligent supervision claims against religious organizations are a crucial means of remedying serious and lasting injuries. Washington state law recognizes negligent supervision, and Washington courts have applied it to religious organizations, …

Procedural Rules Under Washington's Public Records Act: The Case For Agency Discretion, William D. Richard Aug 2010

Procedural Rules Under Washington's Public Records Act: The Case For Agency Discretion, William D. Richard

Washington Law Review

Voters adopted Washington’s Public Records Act (PRA) in 1972 as part of a broader ballot measure to enhance openness in state government. The PRA requires state government agencies, including statewide agencies and municipalities, to establish procedures so that the public can request copies of records agencies generate. The PRA exempts certain records from disclosure, and other statutes and case law supply additional exemptions. When an agency refuses to disclose records, the requester may ask a court to determine whether an exemption applies. If no exemption applies, the court may compel disclosure of the records and impose monetary penalties against the …
