Commenting On Cannabis: Testing News Fragmentation Using Reader Comments On California's Proposition 19, John D. Beecham

This content analysis studies reader comments on news articles pertaining to the issue of California’s Proposition 19—the “Tax Cannabis Initiative” to legalize marijuana. It investigates whether these reader message boards are consistent with news fragmentation theory, by examining whether the distribution of “yes” and “no” opinion on alternative media sites’ message boards is more homogenous than the distribution of opinions on mainstream news sites’ message boards. This study also uses a thematic analysis to investigate whether the mainstream media, as represented by editorial board endorsements by daily California newspapers, influences themes used by reader comments on Proposition 19. With the recent growth in farmers markets and the demand for local, fresh foods there has been a push to allow individuals to produce and sell foods made in their homes. This report will explain why Mississippi should follow the trend set by over 30 states to allow in-home production and sale of certain low-risk or non-potentially hazardous foods like baked goods, jams, jellies, and dried herbs. This report will lay out current Mississippi law regarding the processing of such non-potentially hazardous foods in home kitchens; compare Mississippi law to the laws employed in other states; and make recommendations for …

The Devils Lake, North Dakota, region has experienced a dramatic wet cycle since 1992 that has caused the lake level to rise nearly 30 feet. The resulting flooding has negatively impacted the residents, infrastructure, and communities in the region. Additional flooding could pose an unacceptable risk of an uncontrolled overflow that could cause catastrophic flooding downstream. This report presents the results of an intensive Federal interagency effort that was initiated to assess the status of the efforts of each major Federal agency actively addressing the flooding in the area of Devils Lake and options for additional near-term actions within existing …

This report is the local evaluation of an Intelligent Transportation System deployment for the Cumberland Gap Tunnel and U.S. 25E corridor in Tennessee and Kentucky. Since its inception in 1894, Article XIV of the New York State Constitution has served as a baseline for environmental protection of the New York Forest Preserve. Yet today it has become apparent to those who study or simply enjoy the Adirondack and Catskill regions that our goal in preservation is much more. We preserve wilderness so we can hold on to a piece of the past, a piece of America’s history. Ingress/Egress Incidents Involving Wheelchair Users In A Fixed-Route Public Transit Environment, Karen L. Frost, Gina Bertocci, Sheryll Sison

The objectives of this study were to characterize the ingress and egress activities of wheeled mobility device (WhMD) passengers using fixed-route large, accessible transit vehicles (LATVs), and to examine factors associated with incidents occurring on ramps. A retrospective review of public transit video surveillance footage of WhMDseated passengers accessing fixed-route LATVs was conducted. Ingress and egress activities were characterized based on travel conditions and characteristics of the WhMD and LATV ramp. Incidents were identified based on predetermined criteria, and chi-square analysis was performed to identify WhMD and/or ingress/egress characteristics associated with incidents. Video records of 250 WhMD trips were analyzed. …

This is an introductory essay to Volume 23, Number 2, of the FEDERAL SENTENCING REPORTER, which considers the state of American criminal justice policy in 2010, two years after the "Change" election of 2008. Part I of the essay paints a statistical picture of trends in federal criminal practice and sentencing over the last half-decade or so, with particular emphasis on sentence severity and the degree of regional and inter-judge sentencing disparity. The statistics suggest that the expectation that the 2005 Booker decision would produce a substantial increase in the exercise of judicial sentencing discretion and a progressive abandonment of …

As commercial space faring capabilities spread, a need is growing for new approaches to safeguard the common interests of humanity in space. The 1967 Outer Space Treaty declares in its opening article that, “exploration and use of outer space, including the Moon and other celestial bodies, shall be carried out for the benefit and in the interests of all countries, irrespective of their degree of economic or scientific development, and shall be the province of Mankind”. This study determined the state of the practice and emerging trends in developing greenhouse gas (GHG) thresholds of significance for use under the California Environmental Policy Act (CEQA). To describe the adopted, proposed or considered approaches for developing thresholds of significance by air districts and the thought processes behind these decisions, information was obtained through surveys and phone interviews from twelve employees of air districts in California, State agencies, and consultants that are considered experts on this issue. Even in tough economic times, the work of administrative agencies seems to continue with particularly robust growth at the state level. The number of contested agency cases seems to be rising, even those involving the most trivial details. Although the idea of more government is not fashionable in most corridors, higher levels of activity by existing governmental agencies will be the norm until the state's economic picture achieves measurable improvement.

Does Ricci Herald A New Disparate Impact?, Joseph Seiner, Benjamin N. Gutman

Federal law has long prohibited not just intentional discrimination by employers, but also practices that have an unintentional disparate impact on minorities. A cryptic passage at the end of the Supreme Court's recent decision in Ricci v. DeStefano may signal a sea change for this disparate impact doctrine. Ricci, a lawsuit about a civil-service exam for firefighters, received widespread attention as a case about intentional discrimination. We show that the opinion also can be read to suggest a new affirmative defense for employers facing claims of disparate impact. Before Ricci, disparate impact was a purely no-fault doctrine.
