Towards A New Lens Of Analysis: The History And Future Of Religioius Exemptions To Child Neglect Statutes, Gregory Engle

In order to analyze the religious exemptions, this paper will begin with their history. Part II looks at the Child Abuse Prevention and Treatment Act of 1974 (CAPTA) the statute that precipitated their spread, as well as the justifications that it was bolstered upon: Free Exercise of religion and parental rights. The Equal Protection critique follows as Part III, followed by Part IV that discusses the traditional critique, grounded in the Establishment Clause. In Part V, the article will finish with an explanation of why the Equal Protection critique is a much stronger criticism.

Resilient Transportation Systems In A Post-Disaster Environment: A Case Study Of Opportunities Realized And Missed In The Greater New Orleans Region, 2010, James R. Amdal, Stanley L. Swigart

Based upon our research in Post-Katrina New Orleans, we define transportation resiliency as a system’s ability to function before, during and after major disruptions through reliance upon multiple mobility options. The importance of a resilient transportation system becomes more apparent during disasters where multiple options for mobility are necessary for both passenger and goods movement due to the potential loss of one or more modes.
Post-Katrina New Orleans offers a unique opportunity to investigate pre-disaster planning and post-disaster recovery activities in a major metropolitan city where all modes of transportation were either severely damaged or completely destroyed. In response to …

This essay is an expanded version of my submission to the digital economy consultation. It opens with general issues such as digital policy leadership, cost issues, and emphasizes the need for a principle-based strategy that embraces the benefits associated with “open,” whether open access, open spectrum or open data. It then provides specific recommendations on a wide range of issues including tele- communications policy, privacy, and copyright.

Lessons Learned, Lessons Lost: Immigration Enforcement's Failed Experiment With Penal Severity, Teresa A. Miller

This article traces the evolution of “get tough” sentencing and corrections policies that were touted as the solution to a criminal justice system widely viewed as “broken” in the mid-1970s. It draws parallels to the adoption some twenty years later of harsh, punitive policies in the immigration enforcement system to address perceptions that it is similarly “broken,” policies that have embraced the theories, objectives and tools of criminal punishment, and caused the two systems to converge. Reaching Equilibrium In Tobacco Litigation, James A. Henderson Jr., Aaron Twerski

Recent pro-plaintiff developments in tobacco litigation may lead to the conclusion that such litigation will go on endlessly and threaten the financial viability of the tobacco industry. This article takes the opposite position. Although the industry may take some near-term losses, it is far more likely that tobacco companies will survive short-term losses and that tobacco litigation will reach a stable equilibrium within the next fifteen to twenty years. The threat of third-party payer claims is no longer viable. Courts have unanimously rejected them. The Supreme Court—along with the rest of the country—has long divided over the question whether the United States has yet achieved a “post-racial” society in which race no longer matters in significant ways. How, if at all, this debate is resolved carries enormous implications for constitutional and statutory antidiscrimination law. Indeed, a post-racial discomfort with noticing and acting upon race supports a zero-sum approach to equality: if race no longer matters to the distribution of life opportunities, a decision maker’s concern for the disparities experienced by members of one racial group may be seen as inextricable from its intent to …

Making Strange Bedfellows: Enlisting The Cooperation Of Undocumented Employees In The Enforcement Of Employer Sanctions, Farhang Heydari

Conventional wisdom dictates that in order to control undocumented immigration, the law should punish employers who hire unauthorized workers Although decades have passed with employer sanctions laws in place, it is indisputable that effective enforcement remains elusive. In fact, rather than consistently targeting employers, U.S. immigration authorities have more often focused on individual immigrants. Recently, however, with immigration policy at the forefront of national attention, there has been a call for a renewed focus on the nation's worst offending employers. But after years of lax enforcement, immigration authorities are in a poor position to effectively change their strategy. To help …

Correcting Mandatory Injustice: Judicial Recommendation Of Executive Clemency, Joanna M. Huang

In 1987, the United States political and social systems lost trust in the judiciary and severely limited its authority by enacting the mandatory Federal Sentencing Guidelines. During this period, many judges were forced to impose sentences they viewed as unjust. Trust in the judiciary was restored in 2005, when United States v. Booker made the Sentencing Guidelines advisory. Despite the increase in judicial discretion, however, judges are still unable to correct sentences imposed during the intervening eighteen years because Booker does not apply retroactively. Unfortunately, the executive and legislative branches are similarly unable to provide adequate remedies. Congressional action is …

This study was designed to explore the relationship between the presence of a school resource officer and a safe school climate, as well as, increased student achievement. Additionally, the perceptions of public school superintendents regarding the impact of school resource officers on safe school climate and academic success were investigated using the Correlates of Effective Schools as a framework. The research was divided into sections to observe two sets of data. Section I included an examination of Missouri school districts with a student population of 2,000 or less, comparing 20 schools with school resource officers to 20 schools without school …
