Habeas And (Non-)Delegation, Paul Diller
Habeas And (Non-)Delegation, Paul Diller
University of Chicago Law Review
Although the Constitution's Suspension Clause explicitly mentions the writ of habeas corpus, it does not require that Congress make the writ available in its common-law form at all times. Rather, the Clause has long been understood to permit Congress to replace the writ with an alternative procedure, so long as that remedy is an adequate and effective substitute for habeas corpus. Under this functional view of the Suspension Clause, Congress might delegate responsibility for performing the habeas review function to an entity other than an Article III court, so long as the substitute procedure allows a detainee to challenge the …
Arrival Then Denial: Interpreting §203(A) Of The Clean Air Act, Analyzing Evidentiary Challenges, & Assessing Conflicting Statutory Directives, Jesse Levine
Distinguished Student Research Papers
An “arrival then denial” occurs when uncertified engines arrive at a U.S. port, but are denied entry to the U.S. by Customs & Border Protection (Customs). Why does this matter? In most cases these uncertified engines are sent back to the country of origin. However, due to resource constraints, a sizeable number of uncertified engines slip past Customs and enter the U.S. each year. Uncertified engines, without proper controls, have been estimated to emit at least 30% more emissions than their certified counterparts. Such emissions exacerbate climate change, acid rain, and air quality generally. EPA attorneys assert that their best …

Ylat Youth Leadership Advisory Team: An Innovative Approach To Systems Improvement, Marie Zemler Wu Mpp, Penthea Burns Msw, Marty Zanghi Msw, Dianna Walters
Children, Youth, & Families
The Youth Leadership Advisory Team (YLAT) brings together young people who are involved with the child welfare system and creates opportunities for them to learn and practice leadership and advocacy skills. YLAT is a three-way partnership including the Muskie School of Public Service at the University of Southern Maine, Maine's Department of Health and Human Services, and Maine's youth in care. Amid a comprehensive system reform, YLAT has been a guiding force and a clear voice. YLAT has enjoyed many successes and garnered attention--including requests for replication--across the nation. This paper grew from a desire to clearly articulate the YLAT …

Women In The Down Economy: Impacts Of The Recession And The Stimulus In Massachusetts, Randy Albelda, Christa Kelleher
Women In The Down Economy: Impacts Of The Recession And The Stimulus In Massachusetts, Randy Albelda, Christa Kelleher
Publications from the Center for Women in Politics and Public Policy
The “Great Recession” is affecting everyone in one way or another, but not everyone is affected in the same way. Women’s and men’s work (both in and out of the labor force) still differs, so we can expect that the economic crisis has had a distinct impact on women as well as their families. This policy brief discusses how the down economy has differentially impacted women and men in Massachusetts and the gendered implications of federal stimulus spending. It also identifies potential opportunities to promote gender equality as the United States, and Massachusetts in particular, attempt to move beyond the …
You Better Smile When You Say "Cheese!": Whether The Photograph Requirement For Drivers' Licenses Violates The Free Exercise Clause Of The First Amendment, Lauren N. Harris
You Better Smile When You Say "Cheese!": Whether The Photograph Requirement For Drivers' Licenses Violates The Free Exercise Clause Of The First Amendment, Lauren N. Harris
Mercer Law Review
All fifty states require that a licensee's photograph be included on his or her driver's license. While many people willingly comply with the photograph requirement and say "Cheese!" without complaint, the photograph requirement presents an obstacle to others that may in fact prevent them from obtaining valid drivers' licenses even though they are otherwise qualified. The photograph requirement causes a problem when an applicant for a driver's license has religious beliefs that forbid the taking of his or her photograph. An applicant is faced with the dilemma of following his or her religious beliefs or obtaining a valid driver's license …

Social Justice Implications Of The Organism Metaphor, Gerald V. O'Brien
Social Justice Implications Of The Organism Metaphor, Gerald V. O'Brien
The Journal of Sociology & Social Welfare
The denigration of marginalized groups is frequently supported through the widespread employment of metaphors that present a pejorative image of the group in question. The organism metaphor, wherein the target group is portrayed as a threat to the integrity of the social body, is a particularly important metaphoric theme in the advancement of social injustice. Drawing largely from primary source documents, this paper provides an overview of the organism metaphor as it has been employed historically to denigrate various social subgroups. Implications for the social work profession are discussed.

Reverberation-Chamber Test Environment For Outdoor Urban Wireless Propagation Studies, Helge Fielitz, Kate A. Remley, Christopher L. Holloway, Qian Zhang, Qiong Wu, David W. Matolak
Faculty Publications
We introduce a test environment to replicate the well-known clustering of reflections in power delay profiles arising from late-time delays and reflections. Urban wireless propagation environments are known to exhibit such clustering. The test setup combines discrete reflections generated by a fading simulator with the continuous distribution of reflections created in a reverberation chamber. We describe measurements made in an urban environment in Denver, CO, that illustrate these multiple distributions of reflections. Our comparison of measurements made in the urban environment to those made in the new test environment shows good agreement.

In The Weeds: Homeowners Falling Behind On Their Mortgages, Lenders Playing The Foreclosure Game, And Cities Left Paying The Price, Kristin M. Pinkston
Southern Illinois University Law Journal
As the rate of mortgage foreclosures has risen, the plight of evicted homeowners and the significant financial losses for banks have become common knowledge. Remarkably absent from the discussion, however, has been the extreme hardship placed on municipalities. Municipalities face not only increased crime, neighborhood blighting, and severe public health and safety risks, but also great financial burdens. This economic strain is amplified by what has become a sort of “foreclosure game” for many foreclosing mortgagees. In short, some mortgagees evict homeowners in the midst of foreclosure proceedings, elect not to maintain and repair the subject property, and in some …
Looking Beyond Lopez: Enforcing The Sex Offender Registration And Notification Act Under The Commerce Clause, Laura Barke
Looking Beyond Lopez: Enforcing The Sex Offender Registration And Notification Act Under The Commerce Clause, Laura Barke
Southern Illinois University Law Journal
The Sex Offender Registration and Notification Act was intended to combat the presence of sex offenders nationwide by providing the public with access to a detailed registry containing each sex offender’s current location. Since its enactment, however, litigants have challenged the constitutionality of the Act on a multitude of grounds. This Comment focuses on whether Congress has the power under the Commerce Clause to criminally punish an offender who travels in interstate commerce and fails to register or update his registry. Although the majority of courts have upheld this provision, their opinions have varied as to the source of Congress’s …
