Designing Bespoke Transitional Justice: A Pluralist Process Approach, Jaya Ramji-Nogales Oct 2010

Designing Bespoke Transitional Justice: A Pluralist Process Approach, Jaya Ramji-Nogales

Michigan Journal of International Law

Although many scholars agree that contemporary transitional justice mechanisms are flawed, a comprehensive and unified alternative approach to accountability for mass violence has yet to be propounded. Like many international lawyers, transitional justice theorists have focused their assessment efforts on the successes and failures of established institutions. This Article argues that before we can measure whether transitional justice is working, we must begin with a theory of what it is trying to achieve. Once we have a coherent theory, we must use it ex ante, to design effective transitional justice mechanisms, not just to assess their effectiveness ex post. Drawing …

Bibliotherapy, defined most basically, is helping with books (Hynes & Hynes-Berry, 1994). Derived from the Greek words meaning book and therapy, bibliotherapy goals fall usefully into two categories. Clinical bibliotherapy, using books to facilitate specified therapeutic goals with those experiencing significant emotional or behavioral problems, involves trained health and mental health professionals such as psychologists, counselors, psychiatric nurses, or social workers. Developmental bibliotherapy, using books to address situational, transitional, and normal developmental issues, can be implemented by others, like educators or librarians, who work in helping roles. Books provide solace, reassurance, and even escape; they also provide new ideas for …

Epstein's Razor, David G. Owen Oct 2010

Epstein's Razor, David G. Owen

Faculty Publications

Richard Epstein, over a long and distinguished career, has offered inspired insights into how a legal system should be framed to serve the goals of those it governs. In that pursuit, he has relentlessly applied a sharp logic - call it Epstein's Razor - to shave away the detritus of complexity and confusion that surround perplexing problems, leaving standing only truths unscathed by competition among ideas. Over decades of diverse writings on law and political theory, highlighted by his elegant Simple Rules for a Complex World, Professor Epstein offers a vision of law constructed on the view that simplicity in …

Crimes On The Gulf, David M. Uhlmann

Law Quadrangle (formerly Law Quad Notes)

President Obama has called the BP oil spill in the Gulf of Mexico "the worst environmental disaster America has ever faced." Pundits have debated the long-term ecological impact, the effect on jobs, the potential for psychological and physical consequences. The numbers are staggering: more than a dozen lives lost during and after the explosion, about five million barrels of oil spilled, some 1,500 oiled birds found dead, a payout of more than $4 billion by BP-with a lot more to come.

In light of the news story that has captured headlines since BP's well exploded on April 20, we asked …

On The Road Again Consumptives Traveling For Health In The American West, 1840-1925, Jeanne Abrams

Great Plains Quarterly (through 2013)

From the mid-nineteenth century through the first decades of the twentieth century, hundreds of thousands of health seekers, on the advice of their physicians, family members, or popular advertisements, took to the road to "chase the cure" for tuberculosis, the most dreaded disease of the era. Indeed, tuberculosis, also commonly known as consumption or "the White Plague," held the dubious distinction of being the leading cause of death in nineteenth century America. In the first years of the twentieth century 150,000 Americans died of it yearly, and more than ten times that number were afflicted with the disease.1 Whether …

The Barrier Within: Relational Aggression Among Women, Barbara L. Brock Oct 2010

The Barrier Within: Relational Aggression Among Women, Barbara L. Brock

Journal of Women in Educational Leadership

"There has been a lot of rhetoric on women mentoring other women. However, the so-called solidarity of women does not exist. Some women are engaged in competition and sabotage."—A high school principal

Relational aggression among women is alive and well among women in educational leadership. Women who assume leadership positions are sometimes targeted for acts of sabotage perpetrated by female peers and subordinates (Brock, 2008). A review of the literature supports the notion that relational aggression among women is commonplace in other career fields as well (Barash, S. 2006; Briles, 2003; Chesler, 2001; Funke, 2000; Heim & Murphy, 2001; Mooney, …

Capturing Long-Tailed Black Swan Risk In East Asian Currencies, S. Andrews, K.T Kwek, C.W. Cho

Research Publications (2006 to 2010)

The Global Financial Crisis of 2008 and the Asian Financial Crisis of 1997/1998 are two events that share a common characteristic. Both can be seen as a network crisis, though one is global and the other is regional. The world or region is currently highly inter-connected and inter-dependent through trade, finance and telecommunication networks that transfer information and property rights that shape behaviour across networks. This can be illustrated through behaviour in highly complex and deep financial markets, such as behaviour in currency markets arising from contagion and inter-action between market forces that create unexpected risks. This paper introduces a …

How Do In-Store Environmental Cues Influence Malaysian Shoppers? A Study Of Hypermarket Customers In Malaysia, Y.G. Wee, K.Z. Ahmad Oct 2010

How Do In-Store Environmental Cues Influence Malaysian Shoppers? A Study Of Hypermarket Customers In Malaysia, Y.G. Wee, K.Z. Ahmad

Research Publications (2006 to 2010)

The importance of retail store design and merchandising policies rests in the ability of the physical retail environment to alter shopping reactions and behaviour. Specifically, this research paper examines relationship between physical hypermarket environments, Malaysian shoppers’ emotions and their subsequent shopping behaviour besides considering the role of self regulation as moderator of relationships between consumers’ shopping emotions and their post shopping evaluations. Overall, the findings of this study refute the general postulation that shopping emotions directly influence resource expenditure and shopping values. Results also contradict with previous research which indicates that action oriented shoppers are less responsive to environmental stimuli …

Kesedaran Kanak-Kanak Di Malaysia Terhadap Keselamatan Diri, S.H. Abu Bakar, N. Omar

Research Publications (2006 to 2010)

A Revised Approach To Reducing Labor Abuses And Human Trafficking, Thomas Reuland Oct 2010

A Revised Approach To Reducing Labor Abuses And Human Trafficking, Thomas Reuland

Annual Interdisciplinary Conference on Human Trafficking: 2nd (2010)

In this paper, I challenge current efforts to combat human trafficking. Trafficking is a problem that the law has difficulty preventing, in part, because of market forces. Moreover, the structure of many corporations responds to these market forces, implicates these enterprises in human trafficking, and encourages members of a company to remain complacent in the face of human rights abuses. As corporations strive to increase profit margins on each product they make, they demand low-cost labor and commodify the human beings who satisfy that demand. Meanwhile, branding provides a powerful tool that corporations use to prevent the consumer from recognizing …

A Longitudinal Study Of Student–Teacher Relationship Quality, Difficult Temperament, And Risky Behavior From Childhood To Early Adolescence, Kathleen Moritz Rudasill, Thomas G. Reio Jr., Natalie Stipanovic, Jennifer E. Taylor

Department of Educational Psychology: Faculty Publications

Abstract This study examines the mediating role of student–teacher relationship quality (conflict and closeness) in grades 4, 5, and 6 on the relation between background characteristics, difficult temperament at age 4½ and risky behavior in 6th grade. The longitudinal sample of participants (N = 1156) was from the NICHD Study of Early Child Care and Youth Development. Structural equation modeling was used to estimate paths from (a) background characteristics to student–teacher relationship quality and risky behavior, (b) temperament to student–teacher relationship quality and risky behavior, and (c) student–teacher relationship quality to risky behavior. Findings indicate that students’ family income, gender, …

The Misnomer Of Mdgs? When Goals Are Rights, Erin Mooney Oct 2010

The Misnomer Of Mdgs? When Goals Are Rights, Erin Mooney

Human Rights & Human Welfare

That much more must be done to meet the Millennium Development Goals is evident. The proposals put forth by Douste-Blazy and the new pledges announced at the recent UN MDG Summit are steps in the right direction. More fundamentally, what is required is to recognize that the MDGs are not merely “goals” to aim for, hitting or missing as the case may be. Rather, they are about realizing rights which governments, individually and collectively, have pre-existing legal obligations to uphold and ensure.
