Standardization Of Standard-Form Contracts: Competition And Contract Implications, Mark R. Patterson Nov 2010

Standardization Of Standard-Form Contracts: Competition And Contract Implications, Mark R. Patterson

William & Mary Law Review

Standard-form contracts are a common feature of commercial relationships because they offer the advantage of lower transaction costs. This advantage of standard contracts is increased when there is a second layer of standardization under which multiple firms agree on a standard contract. Trade associations and similar entities often effect standardization of this kind through collective agreement on a standard contract, sometimes under the aegis of state actors. Multifirm contract standardization can provide not only the usual transaction-cost advantages of standard-form contracts, but also increased competition among firms, because a standard contract makes comparison among firms’ offerings easier. But standardization among …

The Role Of Emotions In Fieldwork: A Self-Study Of Family Research In A Corrections Setting, Joyce A. Arditti, Karen S. Joest, Jennifer Lamber-Shute, Latanya Walker Nov 2010

The Role Of Emotions In Fieldwork: A Self-Study Of Family Research In A Corrections Setting, Joyce A. Arditti, Karen S. Joest, Jennifer Lamber-Shute, Latanya Walker

The Qualitative Report

In this study, we document a reflexive process via bracketing techniques and the development of a conceptual map in order to better understand how emotions that arise in the field can inform research design, implementation, and results. We conducted a content analysis of field notes written by a team of researchers who administered an interview to caregivers bringing children to visit an incarcerated family member at a local jail. Our self-examination revealed themes around the team's discomfort connected to the institutional jail setting and intense emotions regarding the life situations of study participants, their treatment by jail staff, and our …

Using Focus Groups In Preliminary Instrument Development: Expected And Unexpected Lessons Learned, Slyvia C. Nassar-Mcmillan, Mary Wyer, Maria Oliver-Hoyo, Amy Ryder-Burge Nov 2010

Using Focus Groups In Preliminary Instrument Development: Expected And Unexpected Lessons Learned, Slyvia C. Nassar-Mcmillan, Mary Wyer, Maria Oliver-Hoyo, Amy Ryder-Burge

The Qualitative Report

Focus groups can be utilized effectively across various stages of instrument development. This article details selected aspects of a process in which they were employed at the initial stages of item generation and refinement in a study of occupational stereotyping. The process yielded rich contextual information about the worldview and corresponding terminology of participants. In addition, the use of a tool developed and previously employed as an approach to clinical case notes (i.e., SOAP notes), produced surprising benefits in documenting the focus group data. The purpose of this paper is to describe this process and highlight the insights that emerged. …

How Does Facebook Browsing Affect Self-Awareness And Social Well-Being: The Role Of Narcissism, Lin Qiu, Han Lin, Angela K. Y. Leung Nov 2010

How Does Facebook Browsing Affect Self-Awareness And Social Well-Being: The Role Of Narcissism, Lin Qiu, Han Lin, Angela K. Y. Leung

Research Collection School of Social Sciences

Social networking sites such as Facebook have become extremely popular recently. In this research, we studied how Facebook browsing affects self-awareness and social well-being. Our results show that after Facebook browsing, individuals high in narcissism raised their public self-awareness while those low in narcissism reduced their public self-awareness. We also found that individuals low in narcissism perceived their friends' lives to be better than their own and consequently experienced negative social well-being and emotion. However, this effect did not occur for individuals high in narcissism.

The Right To Voice Reprised, Christopher Slobogin Nov 2010

The Right To Voice Reprised, Christopher Slobogin

Vanderbilt Law School Faculty Publications

This article appears in a symposium issue of Seton Hall Law Review on courtroom epistemology. In Proving the Unprovable: The Role of Law, Science and Speculation in Adjudicating Culpability and Dangerousness, I argued that criminal defendants ought to be able to present speculative psychiatric testimony if the expert has followed a routinized evaluation process that addresses the relevant legal criterion, an argument based in part on the position that the Constitution can be read to entitle defendants to tell their exculpatory mental state stories. In a recent essay, Professor Lillquist takes aim at this latter rationale, which I called the …

Consider The Source: When The Harasser Is The Boss, Susan Grover, Kimberly Piro Nov 2010

Consider The Source: When The Harasser Is The Boss, Susan Grover, Kimberly Piro

Faculty Publications

In Consider the Source, Susan Grover and Kim Piro argue for a change in the analysis that courts apply to determine whether actionable workplace harassment has occurred. They identify a gap in current doctrine, which allows courts to ignore the status of the harasser as co-worker or supervisor. The authors argue that harassment at the hands of a supervisor is necessarily more severe and pervasive than the same harassment by a coworker. As a result, they recommend that the harasser's identity as a supervisor or co-worker be treated as a necessary consideration when courts assess whether actionable harassment has occurred.

Long-Term Outcomes For The Promoting Care Suicide Prevention Program, Carole Hooven, Jerald R. Herting, Karen A. Snedker

Sociology Faculty Articles and Research

Objectives : To provide a long-term look at suicide risk from adolescence to young adulthood for former participants in Promoting CARE, an indicated suicide prevention program. Methods : Five hundred ninety-three suicide-vulnerable high school youth were involved in a long-term follow-up study. Latent class growth models identify patterns of change in suicide risk over this period. Intervention conditions as well as key risk/protective factors are identified that predict to the long-term …

“They Got A Spot For Us In This School”: Sense Of Community Among Students Of Color With Disabilities In Urban Schools, Ronald D. Crouch

College of Liberal Arts & Social Sciences Theses and Dissertations

School inclusion is the process of educating students with disabilities in general education settings with appropriate support. It is also an attempt to develop schools into supportive learning communities where all students feel they belong. The nationalization of school inclusion (i.e. IDEA) represents a sweeping, second-order change altering how students are taught, how teachers are trained, and the policies and priorities of schools. Prior research indicates that while students and teachers approve of inclusion, both groups face a variety of obstacles when it is put into practice. Additionally, research suggests that the transitions that often take place as a part …

Overcoming The Survivor's Syndrome: Current Theories And Practices, Amy J. Kupec Nov 2010

Overcoming The Survivor's Syndrome: Current Theories And Practices, Amy J. Kupec

College of Liberal Arts & Social Sciences Theses and Dissertations

Due to the current economical times [e.g. the economic depression and millions of jobs cut from the American workforce], the current literature review had two main goals. First, the current literature aimed to not only define the term the survivor's syndrome and the term's history, but also to provide a comprehensive review of the literature surrounding the survivor's syndrome. The survivor's syndrome as defined within the literature is described as the set of emotional and attitudinal characteristics shared by those who have survived a reduction. After reviewing over 60 articles, about 20 articles are presented revealing three main consequences [feelings …
