The Impact Of L2 Dialect On Learning French Vowels: Native English Speakers Learning Que´Be´Cois And European French, Wendy Baker-Smemoe, Laura Catharine Smith Jan 2010

The Impact Of L2 Dialect On Learning French Vowels: Native English Speakers Learning Que´Be´Cois And European French, Wendy Baker-Smemoe, Laura Catharine Smith

Faculty Publications

This article examines how a second language (L2) dialect affects how accurately the L2 is perceived and produced. Specifically, the study examined differences between the production and perception of French vowels /i/, /y/, and /u/ by learners of either Quebec French (QF) or European French (EF). These vowels differ across the two varieties, both acoustically and because of assibilation of /t-d/ before /i-y/ for QF versus EF. As a result of these differences, QF has an additional acoustic cue with which to contrast /u/ and /i-y/. Anglophone learners of QF or EF were asked to identify and discriminate both QF …

On Death And Magic: Law, Necromancy And The Great Beyond, Eric J. Gouvin Jan 2010

On Death And Magic: Law, Necromancy And The Great Beyond, Eric J. Gouvin

Faculty Scholarship

Every now and then, our legal system interacts with the spirit world, whether by virtue of seances being used in establishing the defense in a criminal matter or being used by the prosecution to impugn the defendant, or because of the impact that ghosts may have on stigmatized property or by virtue of houses being built on cemeteries, like in the movie "Poltergeist." Our legal system has an uneasy relationship with the spirit world and this chapter in the book explores that relationship.

Reply: Exploring Panel Effects, Pauline Kim Jan 2010

Reply: Exploring Panel Effects, Pauline Kim

Scholarship@WashULaw

This Reply responds to methodological criticisms of an earlier empirical study of panel effects on the United States Court of Appeals, Deliberation and Strategy on the United States Courts of Appeals, which appeared in the University of Pennsylvania Law Review. That study found that federal appellate judges appeared to be more or less open to influence by their panel colleagues depending upon how the preferences of the panel members align with the preferences of the circuit as a whole. On the other hand, their willingness to avoid dissents and go along with their panel colleagues seemed unaffected by their relative …

Prosser's Privacy Law: A Mixed Legacy, Neil M. Richards, Daniel J. Solove Jan 2010

Prosser's Privacy Law: A Mixed Legacy, Neil M. Richards, Daniel J. Solove

Scholarship@WashULaw

This Article examines the complex ways in which William Prosser shaped the development of the American law of tort privacy. Although Prosser certainly gave tort privacy an order and legitimacy that it had previously lacked, he also stunted its development in ways that limited its ability to adapt to the problems of the Information Age. His skepticism about privacy, as well as his view that tort privacy lacked conceptual coherence, led him to categorize the law into a set of four narrow categories and strip it of any guiding concept to shape its future development. Prosser’s legacy for tort privacy …

Flirting As A Liminal Experience: A Dialogue Between A Philosophical-Phenomenological Understanding Of Liminality And An Empirical-Existential Study Of Flirting, Rune Lassen Mølbak Jan 2010

Flirting As A Liminal Experience: A Dialogue Between A Philosophical-Phenomenological Understanding Of Liminality And An Empirical-Existential Study Of Flirting, Rune Lassen Mølbak

Electronic Theses and Dissertations

In this dissertation I bring out concealed aspects of the lived experience of flirting by studying it neither as a subjective act nor as an objective behavior, but as a liminal event. Liminality is an anthropological concept that designates a realm of experience that falls outside identity and mutually exclusive binaries. I argue that flirting is a liminal experience in so far as it is an experience that both constitutes me through the other and is constituted by me as a way of relating to the other. What is primary is thus not self or other, but the relation or …

The Puzzle Of Brandeis, Privacy, And Speech, Neil M. Richards Jan 2010

The Puzzle Of Brandeis, Privacy, And Speech, Neil M. Richards

Scholarship@WashULaw

Most courts and scholarship assume that privacy and free speech are always in conflict, even though each of these traditions can be traced back to writings by Louis D. Brandeis – his 1890 Harvard Law Review article “The Right to Privacy” and his 1927 concurrence in Whitney v. California. How can modern notions of privacy and speech be so fundamentally opposed if Brandeis played a major role in crafting both? And how, if at all, did Brandeis recognize or address these tensions? These questions have been neglected by scholars of First Amendment law, privacy, and Brandeis. In this paper, I …

The Unsettling ‘Well-Settled’ Law Of Freedom Of Association, John D. Inazu Jan 2010

The Unsettling ‘Well-Settled’ Law Of Freedom Of Association, John D. Inazu

Scholarship@WashULaw

This article argues that the Supreme Court’s categories of expressive and intimate association first announced in its 1984 decision, Roberts v. United States Jaycees, are neither well-settled nor defensible. These indefensible categories matter deeply to groups that have sought to maintain an unpopular composition and message in the face of antidiscrimination laws. These groups have been denied associational protections. They have been forced to change their composition - and therefore their message. They no longer exist in the form they once held and desired to maintain.

The Roberts categories of intimate and expressive association are at least partly to blame. …

Constructing Systemic Safeguards Against Informant Perjury, Peter A. Joy Jan 2010

Constructing Systemic Safeguards Against Informant Perjury, Peter A. Joy

Scholarship@WashULaw

Reliance on an informant's testimony as the primary basis for charging and convicting the accused is fraught with problems. While the hypothetical explicitly addresses the ethical dilemmas defense counsel faces when her client is trading false testimony in exchange for a reduced charge and shorter sentence, the hypothetical also implicitly illustrates the inadequacies of our criminal justice system's current handling of testimony from cooperating witnesses.

The focus on the ethical, and perhaps moral, obligations of Lawyer representing a potentially perjurious Client begs larger questions. Are there safeguards the prosecutor's office could employ to ensure that the trial prosecutor, who is …

Professionalization And Public Relations: An Ethical Mismatch, Rhonda Breit, Kristin Demetrious Jan 2010

Professionalization And Public Relations: An Ethical Mismatch, Rhonda Breit, Kristin Demetrious

Graduate School of Media and Communications

This paper explores the ethical culture in which contemporary public relations practitioners’ work and how it relates to the professionalisation of the domain. Focusing on the international umbrella public relations institution Global Alliance (GA) and other important industry bodies such as the Public Relations Institute of Australia (PRIA) and Public Relations Institute of New Zealand (PRINZ), we study how the ‘work’ of a public relations practitioner is described, and as a corollary, what professional and ethical standards are promoted. Our analysis draws on theories of professions (Abbott 1988; Anderson and Schudson 2009; Volti 2008) and narrative (Surma 2004, Herman 2009), …

Contradiction And Duality Within The City: The House Of Arts And Culture, Andrei Sdrula Jan 2010

Contradiction And Duality Within The City: The House Of Arts And Culture, Andrei Sdrula

Architecture Theses and Projects

This project aims to apply the concepts of contradiction and duality as described in the manifesto to reinvigorate and reconnect a portion of the city Bucharest: the capital of Romania. This city has a long history of architectural achievements and disasters, and this intervention gets to the heart of that legacy when it confronts the House of Parliament: a massive megalomaniacal building constructed under the Ceausescu regime in the 1980s. The project addresses the parliament, sector, city, country, and people with first: a master plan, and then a civic building within that master plan that is located in front of …

Aligning Problem Solving And Gameplay : A Model For Future Research And Design, Woei Hung, Richard Van Eck Jan 2010

Aligning Problem Solving And Gameplay : A Model For Future Research And Design, Woei Hung, Richard Van Eck

Teaching, Leadership & Professional Practice Faculty Publications

Problem solving is often discussed as one of the benefits of games and game-based learning (e.g., Gee, 2007a, Van Eck 2006a), yet little empirical research exists to support this assertion. It will be critical to establish and validate models of problem solving in games (Van Eck, 2007), but this will be difficult if not impossible without a better understanding of problem solving than currently exists in the field of serious games. While games can be used to teach a variety of content across multiple domains (Van Eck, 2006b, 2008), the ability of games to promote problem solving may be more …

What About Race After Obama: Individualism, Multiculturalism, Or Assimilationism?, John Berteaux Jan 2010

What About Race After Obama: Individualism, Multiculturalism, Or Assimilationism?, John Berteaux

HCOM Faculty Publications and Presentations

I argue that we do not get an adequate picture of society from liberal conceptions of race and racism. What this analysis does, then, is call for a synthesis of historical, social, and cultural insights to inform and enrich the philosophical conception of race and racism.

The Development Of And Relationship Between Elgin U-46'S Teacher Appraisal System And Mentor Program: 1998-2010, Joseph William Schumacher Jan 2010

The Development Of And Relationship Between Elgin U-46'S Teacher Appraisal System And Mentor Program: 1998-2010, Joseph William Schumacher

Dissertations

This study investigated the historical development of Elgin School District U-46's teacher appraisal system and teacher mentor program during the years of 1998-2010. In 1998 a formal mentor program was implemented for the first time in district history. Shortly thereafter, district and union leadership agreed to revamp the twenty-five-year-old appraisal system. The study aimed to explore how district and union leadership prepared for, adopted, and implemented appraisal and mentoring during this time period through the framework of Thomas Sergiovanni's (1992) sources of authority for leadership.

The research questions of this study focused on five topics: the historical development of the …

The Impact Of Intrusive Advising On Academic Self Efficacy Beliefs In First-Year Students In Higher Education, Lauren Kemner Miller Jan 2010

The Impact Of Intrusive Advising On Academic Self Efficacy Beliefs In First-Year Students In Higher Education, Lauren Kemner Miller

Dissertations

First-year retention rates have seen minimal gains as high numbers of first-year students are leaving college due to insufficient academic skills and inability to adjust to the academic and social life of college. Programs that provide strategies to improve the transition from high school to college and that help develop skills to facilitate academic success are needed. This study presents a mixed method approach to examine intrusive academic advising and the impact of this program on first-year students enrolled at a four-year, private institution. Semi-structured interviews and the College Self Efficacy Inventory were utilized to gather the data.

First-year students …

Psychosocial Development, Well-Being, And Internalizing Symptoms During Emerging Adulthood: An Examination Of Mediating And Moderating Factors, Jennifer Paley Edidin Jan 2010

Psychosocial Development, Well-Being, And Internalizing Symptoms During Emerging Adulthood: An Examination Of Mediating And Moderating Factors, Jennifer Paley Edidin

Dissertations

The current study was the second part of a longitudinal study, which sought to explore psychosocial development in an older population of emerging adults. Specifically, it examined cross-sectional and longitudinal relations between psychosocial development and internalizing symptoms, as well as between psychosocial development and well-being. Possible mediating and moderating factors were also considered. Two hundred and twelve eligible individuals from one private Midwestern University and one small private college on the East Coast, who completed measures as college seniors, were invited to participate in the second wave of the study, approximately 1½ years after graduation. Participants were asked to complete …
