Copyright law is a glaring and unjustified exception to the rule that the government may not prohibit speech without a showing that it causes real harm. While the First Amendment sometimes protects even harmful speech, it virtually never allows the prohibition of harmless speech. Yet, while other speech-burdening laws, such as defamation and right-of-publicity laws, require that the defendant's speech is likely to cause harm, copyright law does not make harm a requirement of infringement. Copyright law considers harm to the market for the copyrighted work as a factor in fair use analysis, but harm is not always required and …

In an effort to remove the disincentives to self-regulation created by the decision in Stratton Oakmont, Inc. v. Prodigy Services Co., and to avoid the onslaught of litigation that would otherwise likely have ensued, Congress passed § 230 of the Communications Decency Act in 1996. Inequitable Sentencing For Possession Of Child Pornography: A Failure To Distinguish Voyeurs From Pederasts, Jesse P. Basbaum

This Note identifies several infirmities of United States Sentencing Guideline section 2 G2.2, the sentencing scheme for possession of child pornography. The production and web-based dissemination of child pornography images has increased substantially over the past decade. The Department of Justice has aggressively prosecuted these crimes under the rationale that (r) possession of child pornography leads to contact offenses, (2) demand drives supply, and (3) the mere availability of an image or video constitutes continued and indirect abuse of the child depicted. This study examines how the institutional characteristics of local television news stations affect the stations’ coverage of state legislative news. Focusing on the state of Louisiana, the researcher conducts in-depth interviews with news workers from the seven media markets in the state. The interviews were focused toward the decision makers in the newsroom in order to examine the process that determines the newscast the audience receives. The interview discussions centered on the news making process. During the second half of the 20th century, changes in gender relations and equality have led to substantial shifts in many aspects of American life. As one feature of society, the relationship between social structure and crime has also changed with the shift from traditional to nontraditional views of gendered interaction. In particular, what were once thought to be invariant structural predictors of homicide may, in fact, have varying explanatory power over time; in particular, measurements of disadvantage and population structure may not equally affect men and women between 1970 and 2000. High concentrations of Ni in soils and aquifers have been observed worldwide, causing several potential human health impacts. Small, high-yielding binary Ti vectors of Agrobacterium tumefaciens were constructed. All four basic components of the vector, ColE1 replicon (715 bp) for Escherichia coli, VS1 replicon (2,659 bp) for A. tumefaciens, a bacterial kanamycin resistance gene (999 bp), and the T-DNA region (170 bp), were modified to reduce the vector size to 4,566 bp and to introduce a number of mutations to increase the copy number and other functionality. The transcriptional direction of VS1 replicon can be the same as that of ColE1 replicon (co-directional transcription), or opposite (head-on transcription) as in the case of widely used vectors (pPZP or …

A survey data by Singer et al. (2007) was used to study the factors affecting the adoption of cover crops by the producers at the Corn Belt area of the United States. Data was collected from four states: Illinois, Indiana, Iowa, and Minnesota. Two binomial logit models were used for the econometric analysis. Young Adult horror fiction with female protagonists presents sympathetically the untenable situation of adolescent girls within society whereby they are increasingly pressured to embody a doll-like feminine ideal that deprives them of voice and agency. In Young Adult horror fiction, the monstrous Other problematizes what is presented to girls as “normal” and “natural” feminine behavior. As a double with a difference, the monstrous Other is an iteration of femininity whose similarity to the original implies the possibility of resisting restrictive gender roles. The historiography of tuberculosis, “TB,” covers four periods in the United States. During the Victorian Age, TB was classified as consumption. After Robert Koch’s discovery of the tubercle bacillus in the 1882, the germ theory took precedence. The early 1900s saw the rise of the Sanatorium Age, and finally, the antibiotic revolution of the 1940s and 1950s began the current understanding of the disease. Missing from this periodization is an era in which surgery took precedence as the preferred treatment for tuberculosis. While all seafood has the potential of being associated with foodborne illness, Louisiana blue crabs (Callinectes sapidus) are exposed to Vibrio cholerae, Vibrio parahaemolyticus, Vibrio vulnificus, Listeria monocytogenes and Salmonella species in the estuarine habitat. This study was designed to determine the least amount of time and temperature needed to reduce or eliminate each of the aforementioned bacteria from a single Louisiana blue crab with either boiling or steaming heat treatments. This study examines the newspaper coverage of Richard Jewell during the weeks after the 1996 Atlanta Olympics bombing. Jewell, a security guard working in the Olympic Park on July 27, 1996, was initially hailed as a hero due to his discovery of a bomb minutes before the explosion. After Jewell’s name was leaked to the press as an FBI person of interest in the case, many reporters began to frame Jewell in a negative light and, in some instances, even implied his guilt. This dissertation includes a comprehensive current review of reversible electroporation (EP) and other related physical gene transfection techniques; an overview of results of electrochemogene therapy (ECGT) used to treat naturally occurring spontaneous neoplasms in dogs; and the results of comprehensive, pre-clinical toxicology testing of electrogene therapy (EGT) of a tumor-targeted version of interleukin-12 (IL-12) in mice. Intralesional bleomycin (BLM) and feline interleukin-12 (fIL-12) DNA injection combined with trans-lesional EP resulted in complete cure of two recurrent oral squamous cell carcinomas and an acanthomatous ameloblastoma in a series of six cases of spontaneous neoplasia in pet dogs. Ludox density gradients were used to enrich for Escherichia coli mutants with conditional growth defects and alterations in membrane composition. A temperature-sensitive mutant named Lud135 was isolated with mutations in two related, nonessential genes: yghB and yqjA. yghB harbors a single missense mutation (G203D) and yqjA contains a nonsense mutation (W92TGA) in Lud135. Both mutations are required for the temperature-sensitive phenotype: targeted deletion of both genes in a wild-type background results in a strain with a similar phenotype and expression of either gene from a plasmid restores growth at elevated temperatures. For more than 30 years, college administrators and health communicators have used binge drinking prevention campaigns on university campuses to deter students from this dangerous and life-threatening habit.
Despite the prevalence of such campaigns (Wechsler, Seibring, Liu & Ahl, 2004), binge drinking remains the top public health threat for this population (Wechsler, Dowdall, Davenport, & Castillo, 1995).

Helen Marie Casey’s booklet Portland’s Compromise: the Colored School, 1867–1872 recounts the story of William Brown, an African-American resident of Portland, Oregon, and his role in the first and only case of official segregation of African-American children in Portland Public Schools (PPS) in 1867. After unsuccessfully trying to enroll his children in one of Portland’s only two public elementary schools, Brown appealed to the school board, including directors Josiah Failing, W.S. Ladd, and E.D. The purpose of this study was to explore and determine the level of readiness for lifelong learning of volunteers affiliated with a 4-H youth development program in the southern United States. Based on a literature review, readiness for lifelong learning was conceptualized as incorporating aspects of response to triggers for learning, self-directed learning readiness, and a readiness to overcome deterrents to participation in learning. The Readiness for Lifelong Learning Survey, a 75 item Likert-type scale, was developed and administered online to 1815 adult volunteers who had provided usable emails in a enrollment database system. This thesis presents an investigation of the attitudes upheld by a diverse group of informants towards the word Spanglish and the combination of Spanish and English in speech. A comparison is made of positive and negative attitudes regarding these two concepts along with an analysis of factors that condition these attitudes. Public education has long been the subject of public discontent. Historical events such as the Soviet launch of Sputnik in 1957, the Civil Rights Movement of the 1950s and 1960s, and repeated media reports that U.S. students were outscored by students in many other countries on international tests each prompted federal and state legislation aimed to reform public education. Following a presentation of the relative standing of the United States on three international tests, the history of public schooling in six states, Texas, North Carolina, Kentucky, Maryland, Florida, and Louisiana, is discussed.
