Health Care Reform In Transition: Incremental Insurance Reform Without An Individual Mandate, Lawrence O. Gostin, Elenora E. Connors
Health Care Reform In Transition: Incremental Insurance Reform Without An Individual Mandate, Lawrence O. Gostin, Elenora E. Connors
Georgetown Law Faculty Publications and Other Works
A major access problem exists in the private insurance market for individuals with preexisting conditions, who are either denied coverage or charged exorbitant premiums. In effect, individuals are denied coverage for exactly what they need, which jeopardizes their health and the financial security of their family. Before health reform passed, discussions surrounding incremental reform took place, including perhaps the most politically compelling – prohibiting insurers from denying coverage to those with preexisting health conditions. Insurance is based upon the principles of spreading risk of individuals across a population to ensure that everyone can afford medical care when he or she …

To Be Muslim Or "Muslim-Looking" In America: A Comparative Exploration Of Racial And Religious Prejudice In The 21st Century, Sheryll Cashin
To Be Muslim Or "Muslim-Looking" In America: A Comparative Exploration Of Racial And Religious Prejudice In The 21st Century, Sheryll Cashin
Georgetown Law Faculty Publications and Other Works
This Essay begins with a confession. In taking implicit association tests ("IATs") designed to measure my unconscious attitude toward two particular demographic groups, I discovered that I, an African-American, harbored a "slight automatic preference" for Europeans over blacks and for "other people" over "Arab-Muslims." Both of these results were contrary to my professed or conscious assertions of neutrality. Why would a pro-integration scholar who seeks to promote cross-racial understanding and inclusion exhibit such implicit biases? And why is it that a majority of others who take these tests register similar implicit biases? The point of my confession is to underscore …
Sovereignty, Integration And Tax Avoidance In The European Union: Striking The Proper Balance, Lilian V. Faulhaber
Sovereignty, Integration And Tax Avoidance In The European Union: Striking The Proper Balance, Lilian V. Faulhaber
Georgetown Law Faculty Publications and Other Works
As the need to raise revenue becomes more pressing and public opposition to tax avoidance increases, the European Court of Justice has made it more difficult for the twenty-seven Member States of the European Union to prevent tax avoidance and shape fiscal policy. This article introduces the new anti-avoidance doctrine of the European Court of Justice and analyzes it from the perspective of taxpayers, Member States and the European Union legal order as a whole. This doctrine is problematic becasue it has created a legislative vacuum in Europe. No European Union institution has the authority to regulate direct taxation without …
Information Integration For Graph Databases, Ee Peng Lim, Aixin Sun, Anwitaman Datta, Chang Kuiyu
Information Integration For Graph Databases, Ee Peng Lim, Aixin Sun, Anwitaman Datta, Chang Kuiyu
Research Collection School Of Computing and Information Systems
With increasing interest in querying and analyzing graph data from multiple sources, algorithms and tools to integrate different graphs become very important. Integration of graphs can take place at the schema and instance levels. While links among graph nodes pose additional challenges to graph information integration, they can also serve as useful features for matching nodes representing real-world entities. This chapter introduces a general framework to perform graph information integration. It then gives an overview of the state-of-the-art research and tools in graph information integration.

Anger, Cognition, Ideology: What Crash Can Show Us About Emotion, Sue J. Kim
College of Arts & Sciences Professional Work
Sue J. Kim’s essay “Anger, Cognition, Ideology: What Crash Can Show Us About Emotion” argues for the relevance and importance of cognitive studies to ethnic and postcolonial literary studies, and vice versa. After surveying recent developments in the field of cognitive studies, the essay combines cultural and cognitive approaches in order to examine anger in and around the 2005 Paul Haggis film Crash.
The Eternal Jew: Jewish Victimization Through Marginalization, Joshua Fishlock
The Eternal Jew: Jewish Victimization Through Marginalization, Joshua Fishlock
Open Access Master's Theses
This thesis examines the phenomenon of Jewish marginalization in Nazi Germany using the film The Eternal Jew as a representative example. Specifically this study identified sources of guilt in post World War I German culture and the steps taken by the Nazi's to alleviate that guilt through victimization of the Jews. Results show that the Nazi's played upon cultural beliefs of German superiority and antisemitism in order to create a public reality of the Jews as the Other. This disidentification of the Jews from the German population increased the effectiveness of the usage of the Jews as scapegoats for the …
Whose Identity Is It Anyway? A Study Of The Media's Representation Of Iraq Citizens And Their Culture, Joyce L'Heureux
Whose Identity Is It Anyway? A Study Of The Media's Representation Of Iraq Citizens And Their Culture, Joyce L'Heureux
Open Access Master's Theses
What happens to our perceptions when provided with an invitation by news media, specifically print media, to accept what is presented as reality? Does what we read in the news media constrict our thinking and create an acceptance of the words as they are written, a type of cultural blindness to the qualities, the humanness and individuality of other cultures? Or, do we read the words on the paper and open our lens to create a greater understanding of individuals who differ from us in values, attitudes and beliefs? The truth is the same stories which provide us with an …

Adapting To Climate Change With Law That Bends Without Breaking, Holly Doremus
Adapting To Climate Change With Law That Bends Without Breaking, Holly Doremus
San Diego Journal of Climate & Energy Law
Climate change, the key environmental challenge of this century, is a tough problem for law in many ways. The topic of this panel, instrument choice, highlights a particularly difficult, important, and under-recognized aspect of the climate change challenge: the difficulty of devising a system of environmental law that combines the flexibility necessary to deal with a changing world with the rigidity and accountability essential to hold us to the difficult task of environmental protection.

Human Rights Reference Sources: A Critical Annotated Bibliography, Chad M. Kahl, Stephanie Davis-Kahl
Faculty and Staff Publications – Milner Library
The area of human rights has had significant attention both nationally and internationally in the press and in the political arena. While there is a renewed commitment to human rights advocacy, there is also an upward trend in popular culture of depictions of torture. This article provides critical annotations of English-language reference sources, published since 1990, and available both in print and online, in an effort to aid librarians collecting and weeding materials for human rights research.
Jam Tomorrow: Distributive Justice And The Limits Of International Economic Law, Barbara Stark
Jam Tomorrow: Distributive Justice And The Limits Of International Economic Law, Barbara Stark
Hofstra Law Faculty Scholarship
The chasm between the rich and the poor has become unfathomable. This Article asks whether existing international economic law can bridge this chasm and effectuate distributive justice. "Distributive justice" itself is an ambiguous goal. This Article inquires, as a threshold question, what, exactly, is required for actual "distributive justice". It takes as a starting point the relatively modest objective of the Millennium Development Goals-to halve the number living in extreme poverty by 2015. It argues that this objective is not going to be achieved under the aegis of international economic law for two reasons. First, distributive justice is not an …

Towards A U.S. Army Officer Corps Strategy For Success: Retaining Talent, Michael J. Colarusso Dr., Casey Wardynski Colonel, David S. Lyle Colonel
Towards A U.S. Army Officer Corps Strategy For Success: Retaining Talent, Michael J. Colarusso Dr., Casey Wardynski Colonel, David S. Lyle Colonel
Books, Monographs & Collaborative Studies
Over the last 3 decades, dramatic labor market changes and well-intentioned but uninformed policies have created significant officer talent flight. Poor retention engenders substantial risk for the Army as it directly affects accessions, development, and employment of talent. The Army cannot make thoughtful policy decisions if its officer talent pipeline continues to leak at current rates. Since the Army cannot insulate itself from labor market forces as it tries to retain talent, the retention component of its officer strategy must rest upon sound market principles. It must be continuously resourced, executed, measured, and adjusted across time and budget cycles. Absent …
A Film Marketing Action Plan (Fmap) For Film Induced Tourism Destinations, Noelle O'Connor
A Film Marketing Action Plan (Fmap) For Film Induced Tourism Destinations, Noelle O'Connor
Doctoral
This research study examines the impact of film induced tourism and destination branding on locations featured in popular films and television series. It also investigates the characteristics of film induced tourism and determines if the key film and tourism stakeholders support the integration of film into Yorkshire’s (UK) tourism product. Yorkshire was selected as the case study area, as it has been the film location for many popular television series and is the subject of much location research within the tourism discipline. The need for a thorough investigation into the film induced tourism phenomenon was particularly evident from the literature …
The Village Voice: Masculine Identity Construction Within An Interpretive Community, Deirdre Duffy
The Village Voice: Masculine Identity Construction Within An Interpretive Community, Deirdre Duffy
Conference papers
This paper looks at how young Irish men construct their masculine self/identity/body keeping in mind the mediated world within which they find themselves, and considering their own more immediate social surroundings and influences, that is to say, their interpretive community. The research paper combines Foucault’s later writings on technologies of the self with literary theory, using critics such as Stanley Fish (1980) and his work on ‘Interpretive Communities’ to inform the study.

Contemporary Contradictions And Challenges Facing Married Fathers And Mothers, Erin K. Holmes, Jennifer Baumgartner, Loren Marks, Rob Palkovitz, Olena Nesteruk
Faculty Publications
Part one of this review chapter provides a brief historical overview of the fathering role. Following this overview, some cultural contradictions and challenges facing fathers, particularly married fathers, are outlined and discussed. Key issues of focus in this section include married fathers balancing economic provision, household work, and involvement in child rearing. Part two of the chapter will overview cultural challenges and contradictions facing mothers, particularly married mothers. The contradictory challenges often inherent in marriage-based mothering include the pressures too simultaneously provide "intensive mothering" and to be extensively involved in a career. In sum, the chapter will illustrate how married …

Developments In Monitoring Techniques For Durability Assessment Of Cover-Zone Concrete, W.J. Mccarter, T. M. Chrisp, G. Starrs, Niall Holmes, L. Basheer, M. Basheer, S. V. Nanukuttan
Conference papers
This paper outlines developments in the use of an embedded multi-electrode sensor to study the response of the cover-zone (surface 50mm) to the changing ambient environment. The sensor enables the measurement of the spatial and temporal distribution of the electrical properties of concrete and temperature within the cover-zone thereby allowing an integrated assessment of cover-zone concrete performance. Both laboratory and field results are presented to highlight the information that can be obtained from embedded sensors. When exposed to the natural environment, the temperature dependence of the electrical response is highlighted and standardization protocols are developed to account for this effect. …
Romantic Relationships And The Physical And Mental Health Of College Students, Scott R. Braithwaite, Raquel Delevi, Frank Fincham
Romantic Relationships And The Physical And Mental Health Of College Students, Scott R. Braithwaite, Raquel Delevi, Frank Fincham
Faculty Publications
This study tested the hypothesis that, analogous to married individuals, college students in committed romantic relationships experience greater well-being than single college students. In a sample of 1,621 college students, individuals in committed relationships experienced fewer mental health problems and were less likely to be overweight/obese. There were no significant differences between groups in frequency of physical health problems. Examination of 2 models suggested that being in a committed romantic relationship decreases problematic outcomes largely through a reduction in sexual partners, which in turn decreases both risky behaviors and problematic outcomes. These results are discussed in the context of how …
On The Applications Of Deterministic Chaos For Encrypting Data On The Cloud, Jonathan Blackledge, Nikolai Ptitsyn
On The Applications Of Deterministic Chaos For Encrypting Data On The Cloud, Jonathan Blackledge, Nikolai Ptitsyn
Conference papers
Cloud computing is expected to grow considerably in the future because it has so many advantages with regard to sale and cost, change management, next generation architectures, choice and agility. However, one of the principal concerns for users of the Cloud is lack of control and above all, data security. This paper considers an approach to encrypting information before it is ‘place’ on the Cloud where each user has access to their own encryption algorithm, an algorithm that is based on a set of Iterative Function Systems that outputs a chaotic number stream, designed to produce a cryptographically secure cipher. …
