Sovereignty, Integration And Tax Avoidance In The European Union: Striking The Proper Balance, Lilian V. Faulhaber Jan 2010

Sovereignty, Integration And Tax Avoidance In The European Union: Striking The Proper Balance, Lilian V. Faulhaber

Georgetown Law Faculty Publications and Other Works

As the need to raise revenue becomes more pressing and public opposition to tax avoidance increases, the European Court of Justice has made it more difficult for the twenty-seven Member States of the European Union to prevent tax avoidance and shape fiscal policy. This article introduces the new anti-avoidance doctrine of the European Court of Justice and analyzes it from the perspective of taxpayers, Member States and the European Union legal order as a whole. This doctrine is problematic becasue it has created a legislative vacuum in Europe. No European Union institution has the authority to regulate direct taxation without …

Information Integration For Graph Databases, Ee Peng Lim, Aixin Sun, Anwitaman Datta, Chang Kuiyu

Research Collection School Of Computing and Information Systems

With increasing interest in querying and analyzing graph data from multiple sources, algorithms and tools to integrate different graphs become very important. Integration of graphs can take place at the schema and instance levels. While links among graph nodes pose additional challenges to graph information integration, they can also serve as useful features for matching nodes representing real-world entities. This chapter introduces a general framework to perform graph information integration. It then gives an overview of the state-of-the-art research and tools in graph information integration.

The Eternal Jew: Jewish Victimization Through Marginalization, Joshua Fishlock Jan 2010

The Eternal Jew: Jewish Victimization Through Marginalization, Joshua Fishlock

Open Access Master's Theses

This thesis examines the phenomenon of Jewish marginalization in Nazi Germany using the film The Eternal Jew as a representative example. Specifically this study identified sources of guilt in post World War I German culture and the steps taken by the Nazi's to alleviate that guilt through victimization of the Jews. Results show that the Nazi's played upon cultural beliefs of German superiority and antisemitism in order to create a public reality of the Jews as the Other. This disidentification of the Jews from the German population increased the effectiveness of the usage of the Jews as scapegoats for the …

Whose Identity Is It Anyway? A Study Of The Media's Representation Of Iraq Citizens And Their Culture, Joyce L'Heureux Jan 2010

Whose Identity Is It Anyway? A Study Of The Media's Representation Of Iraq Citizens And Their Culture, Joyce L'Heureux

Open Access Master's Theses

What happens to our perceptions when provided with an invitation by news media, specifically print media, to accept what is presented as reality? Does what we read in the news media constrict our thinking and create an acceptance of the words as they are written, a type of cultural blindness to the qualities, the humanness and individuality of other cultures? Or, do we read the words on the paper and open our lens to create a greater understanding of individuals who differ from us in values, attitudes and beliefs? The truth is the same stories which provide us with an …

Adapting To Climate Change With Law That Bends Without Breaking, Holly Doremus Jan 2010

Adapting To Climate Change With Law That Bends Without Breaking, Holly Doremus

San Diego Journal of Climate & Energy Law

Climate change, the key environmental challenge of this century, is a tough problem for law in many ways. The topic of this panel, instrument choice, highlights a particularly difficult, important, and under-recognized aspect of the climate change challenge: the difficulty of devising a system of environmental law that combines the flexibility necessary to deal with a changing world with the rigidity and accountability essential to hold us to the difficult task of environmental protection.

This article provides critical annotations of English-language reference sources, published since 1990, and available both in print and online, in an effort to aid librarians collecting and weeding materials for human rights research.

Jam Tomorrow: Distributive Justice And The Limits Of International Economic Law, Barbara Stark Jan 2010

Jam Tomorrow: Distributive Justice And The Limits Of International Economic Law, Barbara Stark

Hofstra Law Faculty Scholarship

The chasm between the rich and the poor has become unfathomable. This Article asks whether existing international economic law can bridge this chasm and effectuate distributive justice. "Distributive justice" itself is an ambiguous goal. This Article inquires, as a threshold question, what, exactly, is required for actual "distributive justice". It takes as a starting point the relatively modest objective of the Millennium Development Goals-to halve the number living in extreme poverty by 2015. It argues that this objective is not going to be achieved under the aegis of international economic law for two reasons. First, distributive justice is not an …

Towards A U.S. Army Officer Corps Strategy For Success: Retaining Talent, Michael J. Colarusso Dr., Casey Wardynski Colonel, David S. Lyle Colonel Jan 2010

Towards A U.S. Army Officer Corps Strategy For Success: Retaining Talent, Michael J. Colarusso Dr., Casey Wardynski Colonel, David S. Lyle Colonel

Books, Monographs & Collaborative Studies

Over the last 3 decades, dramatic labor market changes and well-intentioned but uninformed policies have created significant officer talent flight. Poor retention engenders substantial risk for the Army as it directly affects accessions, development, and employment of talent. The Army cannot make thoughtful policy decisions if its officer talent pipeline continues to leak at current rates. Since the Army cannot insulate itself from labor market forces as it tries to retain talent, the retention component of its officer strategy must rest upon sound market principles. It must be continuously resourced, executed, measured, and adjusted across time and budget cycles. Absent …

The Village Voice: Masculine Identity Construction Within An Interpretive Community, Deirdre Duffy Jan 2010

The Village Voice: Masculine Identity Construction Within An Interpretive Community, Deirdre Duffy

Conference papers

This paper looks at how young Irish men construct their masculine self/identity/body keeping in mind the mediated world within which they find themselves, and considering their own more immediate social surroundings and influences, that is to say, their interpretive community. The research paper combines Foucault’s later writings on technologies of the self with literary theory, using critics such as Stanley Fish (1980) and his work on ‘Interpretive Communities’ to inform the study.

Contemporary Contradictions And Challenges Facing Married Fathers And Mothers, Erin K. Holmes, Jennifer Baumgartner, Loren Marks, Rob Palkovitz, Olena Nesteruk

Faculty Publications

Part one of this review chapter provides a brief historical overview of the fathering role. Following this overview, some cultural contradictions and challenges facing fathers, particularly married fathers, are outlined and discussed. Key issues of focus in this section include married fathers balancing economic provision, household work, and involvement in child rearing. Part two of the chapter will overview cultural challenges and contradictions facing mothers, particularly married mothers. The contradictory challenges often inherent in marriage-based mothering include the pressures too simultaneously provide "intensive mothering" and to be extensively involved in a career. In sum, the chapter will illustrate how married …

Developments In Monitoring Techniques For Durability Assessment Of Cover-Zone Concrete, W.J. Mccarter, T. M. Chrisp, G. Starrs, Niall Holmes, L. Basheer, M. Basheer, S. V. Nanukuttan Jan 2010

Developments In Monitoring Techniques For Durability Assessment Of Cover-Zone Concrete, W.J. Mccarter, T. M. Chrisp, G. Starrs, Niall Holmes, L. Basheer, M. Basheer, S. V. Nanukuttan

Conference papers

This paper outlines developments in the use of an embedded multi-electrode sensor to study the response of the cover-zone (surface 50mm) to the changing ambient environment. The sensor enables the measurement of the spatial and temporal distribution of the electrical properties of concrete and temperature within the cover-zone thereby allowing an integrated assessment of cover-zone concrete performance. Both laboratory and field results are presented to highlight the information that can be obtained from embedded sensors. When exposed to the natural environment, the temperature dependence of the electrical response is highlighted and standardization protocols are developed to account for this effect. …

Romantic Relationships And The Physical And Mental Health Of College Students, Scott R. Braithwaite, Raquel Delevi, Frank Fincham Jan 2010

Romantic Relationships And The Physical And Mental Health Of College Students, Scott R. Braithwaite, Raquel Delevi, Frank Fincham

Faculty Publications

This study tested the hypothesis that, analogous to married individuals, college students in committed romantic relationships experience greater well-being than single college students. In a sample of 1,621 college students, individuals in committed relationships experienced fewer mental health problems and were less likely to be overweight/obese. There were no significant differences between groups in frequency of physical health problems. Examination of 2 models suggested that being in a committed romantic relationship decreases problematic outcomes largely through a reduction in sexual partners, which in turn decreases both risky behaviors and problematic outcomes. These results are discussed in the context of how …

On The Applications Of Deterministic Chaos For Encrypting Data On The Cloud, Jonathan Blackledge, Nikolai Ptitsyn Jan 2010

On The Applications Of Deterministic Chaos For Encrypting Data On The Cloud, Jonathan Blackledge, Nikolai Ptitsyn

Conference papers

Cloud computing is expected to grow considerably in the future because it has so many advantages with regard to sale and cost, change management, next generation architectures, choice and agility. However, one of the principal concerns for users of the Cloud is lack of control and above all, data security. This paper considers an approach to encrypting information before it is ‘place’ on the Cloud where each user has access to their own encryption algorithm, an algorithm that is based on a set of Iterative Function Systems that outputs a chaotic number stream, designed to produce a cryptographically secure cipher. …

Sentence Processing: Linking Language To Motor Chains, F Chersi, S Thill, T Ziemke, Am Borghi Jan 2010

Sentence Processing: Linking Language To Motor Chains, F Chersi, S Thill, T Ziemke, Am Borghi

School of Engineering, Computing and Mathematics

A growing body of evidence in cognitive science and neuroscience points towards the existence of a deep interconnection between cognition, perception and action. According to this embodied perspective language is grounded in the sensorimotor system and language understanding is based on a mental simulation process (Jeannerod, 2007 ; Gallese, 2008 ; Barsalou, 2009 ). This means that during action words and sentence comprehension the same perception, action, and emotion mechanisms implied during interaction with objects are recruited. Among the neural underpinnings of this simulation process an important role is played by a sensorimotor matching system known as the mirror neuron …
