Regulating Charities In The Twenty-First Century: An Institutional Choice Analysis, Lloyd Hitoshi Mayer, Brendan M. Wilson Jan 2010

Regulating Charities In The Twenty-First Century: An Institutional Choice Analysis, Lloyd Hitoshi Mayer, Brendan M. Wilson

Journal Articles

For more than fifty years scholars, practitioners, and government officials have debated whether the federal government, the state governments, or the charitable sector itself can best ensure that charity leaders fulfill their fiduciary duties. The dramatic growth of this sector, recent highly publicized governance scandals, and a push in Congress and the IRS for more federal involvement in this area have now brought this issue to a head. This article lays a foundation for resolving the dispute by developing an institutional choice framework for considering and comparing the various available options. Applying that framework, the article concludes that the best …

Disclosures About Disclosure, Lloyd Hitoshi Mayer Jan 2010

Disclosures About Disclosure, Lloyd Hitoshi Mayer

Journal Articles

An often overlooked aspect of the Supreme Court’s recent decision in Citizens United v. FEC is the sharply contrasting factual accounts regarding disclosure of independent election-related spending. For eight of the Justices, such disclosure is constitutionally defensible because it enables voters to make informed decisions. For Justice Thomas, however, such disclosure is constitutionally suspect because of its potential to result in retaliation and related chilling of First Amendment speech in the form of financial contributions. The continuing importance of these contrasting narratives can be found not only in the pending Supreme Court case of Doe v. Reed, in which the …

Primacy Of Conscience: A Pastoral Theological Construction Of Agency For Catholic Moral Decision-Making, Donald Augustine Rickard Jan 2010

Primacy Of Conscience: A Pastoral Theological Construction Of Agency For Catholic Moral Decision-Making, Donald Augustine Rickard

Electronic Theses and Dissertations

A significant pastoral problem for some Catholics flows from the dissonance they experience when attempting to integrate certain Church teachings with the leading of their conscience as they make moral decisions. All Catholics do not accept every established moral answer or position provided by the Church and integrating those differences between the Church teaching and one's conscience can be difficult--a difficulty affecting parishioner, priest, and Church. This problem is, in part, rooted in and reinforced by the fact that there are two theological strands in the Church's tradition regarding morality. One strand suggests that the moral response is to obey …

A Study Of The Coping Strategies Of Financially Vulnerable Families Facing The Child Care Cliff, Susan J. Roll Jan 2010

A Study Of The Coping Strategies Of Financially Vulnerable Families Facing The Child Care Cliff, Susan J. Roll

Electronic Theses and Dissertations

For many families child care is a necessity for economic self sufficiency, as without it caretakers cannot enter and stay in the workforce. However, for many low-income families childcare expenses are so high that they often cannot afford it without government support. The focus of this study was to understand how families make decisions about childcare in relation to government support. Of specific interest are low-income families who receive the government supported child care subsidy in Colorado known as the Colorado Child Care Assistance Program (CCCAP).

CCCAP is a part of work support benefits that are provided by the State …

A Qualitative Study Of Heterosexual Ally Development Among The Traditional Student Population At A Mid-Sized Midwestern University, Miranda Therese Ambuske Jan 2010

A Qualitative Study Of Heterosexual Ally Development Among The Traditional Student Population At A Mid-Sized Midwestern University, Miranda Therese Ambuske

Masters Theses

The purpose of this study conducted, at a mid-sized Midwestern university, was to examine the ally development of heterosexual college students, specifically with gay, lesbian and bisexual populations. Five participants who were current college students, who self-identified as heterosexual allies, took part in open-ended life-history interviews in which they were asked to share their perspective on what may have affected their ally development. The interviews specifically probed what, if any, institutional resources, faculty or staff members may have assisted in their development, as well as if any precollege factors made them more susceptible to developing into an ally in college. …

Pedagogy In Teacher Education: Art Without Fram, Alexander Cuenca Jan 2010

Pedagogy In Teacher Education: Art Without Fram, Alexander Cuenca

Journal of Inquiry and Action in Education

The term pedagogy has been appropriated in education discourse as simply strategies of instruction. This instrumental understanding of pedagogy has reified the term both in the vernacular of education and in research of teaching and teacher education, leading the scientific pursuit of pedagogy to exclude the relationship between pedagogy and pedagogue. Based on this concern, this paper will consider the artistic and relational dimensions of pedagogy in teacher education. Drawing on the work of Max van Manen, John Dewey, and Mikhail Bakhtin, this paper seeks to sketch a more holistic understanding of pedagogy in teacher education. Afterwards, I suggest self-study …

A Kachina By Any Other Name: Linguistically Contextualizing Native American Collections, Rachel Elizabeth Maxson Jan 2010

A Kachina By Any Other Name: Linguistically Contextualizing Native American Collections, Rachel Elizabeth Maxson

Electronic Theses and Dissertations

Museums collect and care for material culture, and, increasingly, intangible culture. This relatively new term for the folklore, music, dance, traditional practices, and language belonging to a group of people is gaining importance in international heritage management discourse. As one aspect of intangible cultural heritage, language is more relevant in museums than one might realize. Incorporating native languages into museum collections provides context and acts as appropriate museology, preserving indigenous descriptions of objects. Hopi katsina tihu are outstanding examples of objects that museums can re-contextualize with native terminology. Their deep connection to Hopi belief and ritual as well as their …

Graduate Curricula In Software Engineering And Software Assurance: Need And Recommendations, T. B. Hilburn, Andrew J. Kornecki Jan 2010

Graduate Curricula In Software Engineering And Software Assurance: Need And Recommendations, T. B. Hilburn, Andrew J. Kornecki

Department of Electrical Engineering and Computer Science - Daytona Beach

In discussions about the development and use of computer systems and software products, the term “professional software engineer” is used repeatedly. In the last two decades there has been significant effort devoted to enhancing and advancing the state of professional software engineering (SwE) – new software engineering processes, methods, tools, and practices; creation of a software engineering body of knowledge [1]; development of a code of ethics and professional conduct [2], and software certification and licensing programs [3] . In 1989 the Software Engineering Institute (SEI) of Carnegie Mellon University published a landmark report on graduate education in software engineering …

Expression Of Hcmv Ie1 In The U87mg Cell Line Augments Resistance To Temozolomide , Richard A. Rovin, Johnathan Lawrence, Justin J. Segula, Robert J. Winn

Journal Articles

INTRODUCTION: Human cytomegalovirus (HCMV) DNA and protein are found in gliomas but not in normal brain or other primary brain tumors. The role of HCMV infection in glioma biology is unclear. While it is unlikely that HCMV infection causes glioma, viral proteins might impart a proliferative and antiapoptotic phenotype that confers a survival advantage. Does this oncomodulation translate into a clinically relevant effect in glioma cells? To answer this question, we compared the response of the U87IE1 and U87MG malignant glioma cell lines to temozolomide. U87IE1 cells are U87MG cells that have been genetically engineered to produce HCMV IE1 protein. …

Braving Crocodiles With Kali: Being A Prawn Seed Collector And A Modern Woman In The 21st Century Sunderbans, Annu Jalais Jan 2010

Braving Crocodiles With Kali: Being A Prawn Seed Collector And A Modern Woman In The 21st Century Sunderbans, Annu Jalais

Socio-Legal Review

Globalisation has undoubtedly shaped popular conceptions of gender and society in innumerable ways. This article studies one such instance - the plight of tiger-prawn collectors in Sundarbans. The discovery of tiger- prawns - the 'living dollars of Sundarbans' - has certainly transformed the lives of women in the region beyond imagination. These women however have had to face strenuous attacks from many spheres. Based on her anthropological fieldwork, the author portrays the struggle of women in the area against patriarchy, traditional modes of exploitation and even urban notions of femininity. Braving crocodiles and even changing their religious allegiances, these women …

The first part of the study documents Blackwell's history and the major events that shaped his life while, at the same time, describing what kind of person Steve Blackwell was. The second part of the study examines Blackwell's career as a musical performer, the bands he played with, how those …

The Search For Theatre For Social Change, Britney Cooper Jan 2010

The Search For Theatre For Social Change, Britney Cooper

Electronic Theses and Dissertations

Throughout history people have sought to prompt social change through theatrical experiences. The theatre has moved the masses in ways that have frightened governments and religious establishments into closing down theatres and banning theatrical material. History proves that theatre which causes change exists and works, but it also proves there is no one definition or formula for this type of theatre. Depending on the culture, time period, issue, resources and people involved Theatre for Social Change takes a variety of forms. However, theatre affecting change does tend to maintain two common threads: the creation of a new work and the …

My, Claudius: A Case Against The King As Villain., Kevin Blackwelder Jan 2010

My, Claudius: A Case Against The King As Villain., Kevin Blackwelder

Electronic Theses and Dissertations

The role of Claudius in Shakespeare's The Tragedy of Hamlet has traditionally been affixed with the label of villain, coupled with a presumption of malice. This prejudice has plagued the role, relegating it to shallow melodrama throughout the majority of the play's 440 odd-year history. Although it has now become more commonplace to see him portrayed as a capable, intelligent, even initially likable king, this has only been the case for the past 50 years or so, and even so the label of villain and the assumption of malice persist and prevail even in contemporary practice. While the author is …

Once Upon A Time: Making Fairy Tales Relevant In Contemporary Theatre For Young Audiences, Amanda Kibler Jan 2010

Once Upon A Time: Making Fairy Tales Relevant In Contemporary Theatre For Young Audiences, Amanda Kibler

Electronic Theses and Dissertations

As a theatre for young audiences (TYA) practitioner and artist, I have noticed the prevalence of edited fairy tales on TYA stages. Artists tend to present versions of traditional tales that do not explore the dark places found in the original forms, the very same parts of humanity that young people often yearn to understand. Within TYA, fairy tales have become a safe option because many are well-known titles that generate audiences and income. Theatre practitioners and producers frequently present selections from the canon of fairy tales without exploring its many layers of meaning; failing to recognize the message that …

The Economics Of A Young Audience, Cicely Bosley Jan 2010

The Economics Of A Young Audience, Cicely Bosley

Electronic Theses and Dissertations

As a theatre for young audiences' (TYA) teacher, artist, and administrator, I seek to explore where and how TYA fits into business and economic models to open a dialogue between TYA practitioners and business administration professionals. Through this qualitative study, I endeavor to foster a new language for TYA practitioners to enhance fundraising and audience development. By its own definition, TYA is a hybrid field that strives for both artistic form and educative function. With a dual focus of form and function, administrators struggle to advocate for TYA organizations within existing models. To move through this challenge, I look to …

La Divina The Birth Of The Singer/Actor, Shelley Cooper Jan 2010

La Divina The Birth Of The Singer/Actor, Shelley Cooper

Electronic Theses and Dissertations

In the world of Musical Theatre and Opera, it is not acceptable to simply have a pretty voice; you must be able to portray the character you are singing and ground it in reality. Drama in music theatre was highlighted in the Early Romantic Movement by bel canto composers Rossini, Bellini and Donizetti who re-designed the opera scene format to better tell the story. Late Romantic composers, Puccini and Verdi, took it a step further by writing music to compliment the drama of the story. Twentieth- Century Opera singer Maria Callas is admired for her famous portrayals of title roles …

The Evolution Of Hate Crimes & Their Representation On Stage, Pietro Cortelli Jan 2010

The Evolution Of Hate Crimes & Their Representation On Stage, Pietro Cortelli

Electronic Theses and Dissertations

My thesis focuses on how true-life events resulting from hate crimes have been theatricalized for the stage. My research discusses hate crimes that have occurred throughout history. My primary research centers on Ragtime (1897-1918), The Diary of Anne Frank (1939-1945) and The Laramie Project (2002), which deal with racism, antiSemitism and homophobia, respectively. My intention is to highlight how theatre impacts the ideas and thoughts of audiences and transforms thinking and points of view forever, as well as impacting cultures and our world. In addition, I discuss the historical measures that led to these events and progression in modern times. …

A Self-Organizing Hybrid Sensor System With Distributed Data Fusion For Intruder Tracking And Surveillance, Ravishankar Palaniappan Jan 2010

A Self-Organizing Hybrid Sensor System With Distributed Data Fusion For Intruder Tracking And Surveillance, Ravishankar Palaniappan

Electronic Theses and Dissertations

A wireless sensor network is a network of distributed nodes each equipped with its own sensors, computational resources and transceivers. These sensors are designed to be able to sense specific phenomenon over a large geographic area and communicate this information to the user. Most sensor networks are designed to be stand-alone systems that can operate without user intervention for long periods of time. While the use of wireless sensor networks have been demonstrated in various military and commercial applications, their full potential has not been realized primarily due to the lack of efficient methods to self organize and cover the …

Bioinformatic And Sequence Analysis Of Four Resuscitation Promoting Factor (Rpf) Gene Homologues In Mycobacterium Avium Subsp. Paratuberculosis (Mpt), And Expression Of The Putative Mpt Rpfb In Escherichia Coli., David Dale Hedlund Jan 2010

Bioinformatic And Sequence Analysis Of Four Resuscitation Promoting Factor (Rpf) Gene Homologues In Mycobacterium Avium Subsp. Paratuberculosis (Mpt), And Expression Of The Putative Mpt Rpfb In Escherichia Coli., David Dale Hedlund

All Graduate Theses, Dissertations, and Other Capstone Projects

Mycobacterium avium subsp. paratuberculosis (Mpt), the causative agent of Johne's disease (JD), is a global problem in the agricultural industry. It is estimated that 25% of all U.S. dairy herds are JD positive. One obstacle in the management of JD is the lack a sensitive diagnostic test for use during the early stages of infection. Resuscitation promoting factors (Rpf) are proteins that promote the growth of many species of Actinobacteria. If Rpf proteins could enhance the growth of Mpt, the sensitivity of diagnostic fecal culture could be improved, and the impact of JD on the dairy industry would be significantly …

The article then assesses the functions and structure of the NCAA in light of the preogatives of a private, multi-state association and …

Guerrilla Radio: Has The Time Come For A Full Performance Right In Sound Recordings?, Lauren E. Kilgore Jan 2010

Guerrilla Radio: Has The Time Come For A Full Performance Right In Sound Recordings?, Lauren E. Kilgore

Vanderbilt Journal of Entertainment & Technology Law

Musicians and songwriters occupy a unique place in society as purveyors of composition and expression that impart an intangible benefit to society. Understanding the value of "Science and useful Arts," the Founders provided Constitutional protection for individuals spending time, money, and energy pursuing creative endeavors. Music defines generations and pivotal moments in history, and has rightfully taken its place at the forefront of human expression. When music began reaching the masses in the early twentieth century, both record labels and radio, even in its infancy, helped propel artists to the national spotlight. Johnny Cash, Ray Charles, and Pearl Jam all …

Copyright, Derivative Works, And The Economics Of Complements, Glynn S. Lunney, Jr. Jan 2010

Copyright, Derivative Works, And The Economics Of Complements, Glynn S. Lunney, Jr.

Vanderbilt Journal of Entertainment & Technology Law

From an economic perspective, copyright is irrational. In defining the scope of a copyright owner's exclusive rights, it treats situations that have similar economic consequences differently, as infringement in one case and not in the other, and situations that have radically different economic consequences similarly. This essay explores such area in which copyright exhibits economic irrationality: Copyright's treatment of complements. Where a lower price on a substitute reduces demand for the original, a lower price on a complement increases it. So defined, copyright addresses whether a copyright owner will control three different types of complements: (i) complementary products, such as …

A Preliminary First Amendment Analysis Of Legislation Treating News Aggregation As Copyright Infringement, Alfred C. Yen Jan 2010

A Preliminary First Amendment Analysis Of Legislation Treating News Aggregation As Copyright Infringement, Alfred C. Yen

Vanderbilt Journal of Entertainment & Technology Law

The newspaper industry has recently experienced economic difficulty. Profits have declined because fewer people read printed versions of newspapers, preferring instead to get their news through so-called "news aggregators" who compile newspaper headlines and provide links to stories posted on newspaper websites. This harms newspaper revenue because news aggregators collect advertising revenue that newspapers used to enjoy.

Some have responded to this problem by advocating the use of copyright to give newspapers the ability to control the use of their stories and headlines by news aggregators. This proposal is controversial, for news aggregators often do not commit copyright infringement. Accordingly, …

A Generation Of Racketeers? Eliminating Civil Rico Liability For Copyright Infringement, Julie L. Ross Jan 2010

A Generation Of Racketeers? Eliminating Civil Rico Liability For Copyright Infringement, Julie L. Ross

Vanderbilt Journal of Entertainment & Technology Law

This article addresses questions raised in recent years by the increasingly severe penalties for copyright infringement, focusing on potential civil RICO liability as illustrated by a hypothetical peer-to-peer file-sharing example. Because civil litigation has been, by a wide margin, the favored means for pursuing copyright violators, the criminal copyright infringement statute remains largely untested, and the few cases that address its provisions offer conflicting interpretations. Now that RICO penalties are available in civil copyright infringement cases, courts faced with resolving the ambiguities in the application of the criminal copyright infringement provisions will need to reconcile divergent policies. To effectuate its …

Google Books: Page By Page, Click By Click, Users Are Reading Away Privacy Rights, Kathleen E. Kubis Jan 2010

Google Books: Page By Page, Click By Click, Users Are Reading Away Privacy Rights, Kathleen E. Kubis

Vanderbilt Journal of Entertainment & Technology Law

Google Books will likely become the world's most extensive book and magazine search and browsing resource, library, and bookstore--combined. However, as users necessarily reveal personal identifying information through their book searches and reading habits, this service poses a significant threat to personal privacy.

Because the Google Books Amended Settlement Agreement neglects to meaningfully address user privacy, the only available privacy protections are the limited rights bestowed by the Google Books Privacy Policy and the Google Privacy Policy. Unfortunately, these Privacy Policies protect the interests of Google at the expense of users.

The enactment of federal privacy statutes, which include provisions …

7 An Interactive Installation: Explorations In The Digital, The Spiritual, And The Uncanny, Bradley Paul Lewter Jan 2010

7 An Interactive Installation: Explorations In The Digital, The Spiritual, And The Uncanny, Bradley Paul Lewter

Electronic Theses and Dissertations

This thesis explores the application of digital technologies in the creation of visionary or transformative artwork. The installation emphasizes number, color, symmetry, and the human form to create symbolic compositions patterned after ancient archetypes. Background research was done to inform the work through studies of the principles of visionary and transformative artwork as practiced by Ernst Fuchs, De Es Schwertberger, and Alex Grey. Connections between art and spirituality as explained by Kandinsky were studied to augment these principles. The sequence of artwork within the installation is comprised of both digital paintings and interactive triptych panels. To convey a sense of …
