Interrogation Is Not Ethnography: The Irrational Admission Of Gang Cops As Experts In The Field Of Sociology, Christopher Mcginnis, Sarah Eisenhart Jan 2010

Interrogation Is Not Ethnography: The Irrational Admission Of Gang Cops As Experts In The Field Of Sociology, Christopher Mcginnis, Sarah Eisenhart

UC Law Journal of Race and Economic Justice

Courts regularly qualify police officers as "gang experts" in prosecutions under California's Street Terrorism Enforcement and Prevention Act. This note argues that absent independent, scientifically-verifiable expertise, the use of police officers as gang experts violates even California courts' low standard for admitting expert evidence. The note begins by analyzing the language and the legislative intent of the Act, including its substantive offense components, sentence enhancement and alternative penalty sections. The note next discusses the evidentiary power of police officers when testifying as gang experts, focusing on the substantial risk of prejudice resulting from such testimony and the officers' ability to …

We've Been Waiting A Long Time - The Struggle To Pass The Filipino Veterans Equity Act And A Bittersweet Ending To A Sixty-Three-Year Battle, Paul Daniel Rivera Jan 2010

We've Been Waiting A Long Time - The Struggle To Pass The Filipino Veterans Equity Act And A Bittersweet Ending To A Sixty-Three-Year Battle, Paul Daniel Rivera

UC Law Journal of Race and Economic Justice

On February 17, 2009, President Barack Obama signed into effect the American Recovery and Reinvestment Act of 2009. Buried amidst the hundreds of pages and the billions of dollars given out by the bill was Title X, Section 1002, a diminutive two pages of text authorizing the federal government to give "Payments to Eligible Persons Who Served in the United States Armed Forces in the Far East During World War II." However, Section 1002 was neither designed nor included to create jobs or stimulate the economy. In reality, Section 1002 was included to authorize a long-deserved $198 million payout to …

An Insurrection Act For The 21st Century, Thaddeus A. Hoffmeister Jan 2010

An Insurrection Act For The 21st Century, Thaddeus A. Hoffmeister

School of Law Faculty Publications

As the Hurricane Katrina relief effort illustrates, both Governor Blanco and President Bush, like previous elected officials before them, struggled to properly and promptly deploy federal troops during a domestic emergency. This shortcoming was due to problems associated with: (1) interpreting the Insurrection Act; (2) federalism; and (3) public opinion. This article, divided into four parts, attempts to resolve those problems, or at least decrease the likelihood of their recurrence, by offering suggestive changes to the Insurrection Act. Part II provides a general overview of the Insurrection Act. It begins with a brief discussion of two early episodes of civil …

Eliminationist Discourse In A Conflicted Society: Lessons For America From Africa?, Phyllis E. Bernard Jan 2010

Eliminationist Discourse In A Conflicted Society: Lessons For America From Africa?, Phyllis E. Bernard

Marquette Law Review

For generations, Western society has taken pride in welcoming all types of discourse in the press, radio, or television; the livelier, the better. Outrage often awaits individuals or institutions suggesting that some passionate rhetoric in the public square invites danger that outweighs the theoretical value of free expression. This Article proceeds from the assumption that—from a less lofty, more grassroots perspective—modern, organized, formal, one-time venues for extremist political speech do not present the most potent threat to physical safety and a stable democracy. The greater danger emanates from pervasive right-wing extremist themes on radio, television, and some online news sources …

Danish Refugee Council 2010 Annual Report, Drc Jan 2010

Danish Refugee Council 2010 Annual Report, Drc

Global CWD Repository

In the international area, we help displaced people with identification papers and papers documenting their right of ownership, etc. In this way, DRC advocates the cause of displaced people applying a rights-based approach.

Advocacy can be complicated and may affect our programme activities. We live in a globalised world, and therefore, what we say in Denmark will be heard far and wide. A couple of years ago, DRC was critical of the forced return of Tamil asylum seekers at a time when the war was at its highest, which was why we were concerned about the fate of the Tamil …

Measuring The Elastic Modulus Of Polymers Using The Atomic Force Microscope, Daniel Hoffman Jan 2010

Measuring The Elastic Modulus Of Polymers Using The Atomic Force Microscope, Daniel Hoffman

Dissertations, Master's Theses and Master's Reports - Open

Testing a new method of nanoindentation using the atomic force microscope (AFM) was the purpose of this research. Nanoindentation is a useful technique to study the properties of materials on the sub-micron scale. The AFM has been used as a nanoindenter previously; however several parameters needed to obtain accurate results, including tip radius and cantilever sensitivity, can be difficult to determine. To solve this problem, a new method to determine the elastic modulus of a material using the atomic force microscope (AFM) has been proposed by Tang et al. This method models the cantilever and the sample as two springs …

Modeling Mechanical Response Of Heterogeneous Materials, Siladitya Pal Jan 2010

Modeling Mechanical Response Of Heterogeneous Materials, Siladitya Pal

Dissertations, Master's Theses and Master's Reports - Open

Heterogeneous materials are ubiquitous in nature and as synthetic materials. These materials provide unique combination of desirable mechanical properties emerging from its heterogeneities at different length scales. Future structural and technological applications will require the development of advanced light weight materials with superior strength and toughness. Cost effective design of the advanced high performance synthetic materials by tailoring their microstructure is the challenge facing the materials design community. Prior knowledge of structure-property relationships for these materials is imperative for optimal design. Thus, understanding such relationships for heterogeneous materials is of primary interest. Furthermore, computational burden is becoming critical concern in …

Technology And Its Role In Teacher Education, Zelda Mcmurtry, Candice Burkett

Teacher Education Faculty Publications

This chapter discusses technology and its role in teacher education. In order for technology to reach the early childhood classroom, it must first reach the classroom of the teacher education programs. The effect of self-efficacy on preschool teachers use and understanding of technology may influence their instructional applications. Early childhood faculty come from the same career pool as early childhood teachers and may share the same beliefs that practitioners have concerning technology. Teacher education programs have a responsibility to produce professionals who are literate in technology tools and applications.

Rethinking The Nagorno-Karabakh Conflict: Identity, Politics, Scholarship, Philip Gamaghelyan Phd Jan 2010

Rethinking The Nagorno-Karabakh Conflict: Identity, Politics, Scholarship, Philip Gamaghelyan Phd

School of Peace Studies: Faculty Scholarship

This article builds on the author’s research concerning the role of collective memory in identity- based conflicts, as well as his practical work as the co-director of the Imagine Center for Conflict Transformation and as a trainer and facilitator with various Azerbaijani-Armenian dialogue initiatives. It is not a comprehensive study of the Nagorno-Karabakh conflict, but presents a general overview of the Nagorno-Karabakh peace process, what has contributed to its failure, and which areas require major rethinking of conventional approaches. The discussion does not intend to present readers with a set of conclusions, but to provide suggestions for further critical research.
