The Role Of Governments In The Overindebtedness Of The Economically Disadvantaged, Stephanie Ben-Ishai, Saul Schwartz, Jeremy Barretto

In this article, Professors Stephanie Ben-Ishai and Saul Schwartz examine several ways in which the government becomes a creditor of economically disadvantaged Canadians and its role in limiting the options available for resolving the resulting overindebtedness. Specifically, the authors explore how government transfer programs, and the debts that result from benefit overpayment, affect those already marginalized by poverty. Ben-Ishai and Schwartz then argue that the two main remedies available to Canadians facing insolvency - credit counselling and bankruptcy - are simply too costly for low-income individuals, a term the authors use to describe those who are poor even before they …

This Note argues for the creation of a public interest recruiting and placement organization like Teach for America, in the tradition of Edgar and Jean Cahn's call for federally funded neighborhood legal services and TFA founder Wendy Kopp's call for the creation of a national teacher corps. Picked Apart: The Hidden Struggles Of Migrant Worker Women In The Maryland Crab Industry., Jayesh Rathod, Adrienne Lockie

Every year, hundreds of Mexican women travel thousands of miles from their impoverished, rural home communities to work on the Eastern Shore of Maryland in the state’s historic crab industry. Maryland crab companies have increasingly come to rely on these women, who enter the U.S. on temporary guestworker visas known as H-2B visas. This report describes these women’s experiences as H-2B migrant workers, and is the result of over 40 formal interviews conducted in both the U.S. and Mexico since 2008. By obtaining first-hand accounts from the workers, the report documents the forces and conditions that give rise to this …

In this short Article, I sketch the methodology my colleagues and I at Pace Law School use to incorporate practice standards into our clinical teach-ing and reflect on how a standards-based teaching paradigm could be adapted to the training, supervision, and evaluation of public defenders. Then, I briefly consider how standards and standards-based teaching assist in the administration of assigned counsel plans and in the evaluation of the performance of public defender organizations. Like most tabloid journalism, the truth about solos is a lot less titillating than the headlines. This group of lawyers makes up the largest segment of legal practitioners in New York and every other state in the United States. The role of the child's attorney is unique in American jurisprudence and not yet clearly defined by law or tradition. There is a growing consensus, however, that children in dependency cases should have lawyers who are as active and as involved in their cases as are lawyers for any other party in any other litigation. Collaborative Lawyering: A Process For Interest-Based Negotiation, Jim Hilbert

Hofstra Law Review

This article discusses the growing popularity of interest-based negotiation among attorneys and outlines an approach for implementing interest-based negotiating more effectively. The article begins with an overview of interest-based negotiation and its evolution in legal practice. The article addresses the barriers that often stand between lawyers and the practice of interest-based negotiation and how clients, too, may contribute their own limitations to the mix. The article then discusses particular aspects of interest-based approaches and outlines a step-by-step process for implementing interest-based negotiating.

A Comparative Study Of Chinese And Mexican Immigrants' Economic Incorporation In The United States, Miao Chunyu

Legacy Theses & Dissertations (2009 - 2024)

This dissertation research is a comparative study of the economic incorporation of the unskilled Chinese and Mexican immigrants in the United States. This comparative approach is justified by the fact that these two groups share striking similarities in human capital, social networks, and immigrant flow patterns, whereas they also differ significantly in their migration cost, transnational practice, and reception in the U.S. labor market. This research investigates three specific aspects of their labor market experience: participation in self-employment, job transition, and earnings growth.
