Clinical legal education is at a crossroads. With studies like the Macrate Report, Carnegie Foundation Report “Educating Lawyers,” and Best Practices for Legal Education there is greater focus on experiential learning. Consequently, clinics are at an inflection point regarding their future. Three distinct generations will determine the path forward: Baby Boomers, Generation X, and Millennials. Each generation brings a different set of preferences, biases, perspectives and strengths to the table. Given the changes in legal academia, what will the future hold for clinical legal education?

Before You Take A Collaborative Law Case, John M. Lande

Under the Model Rules of Professional Conduct, lawyers have a duty to screen potential Collaborative Law (CL) cases for appropriateness and obtain clients' informed consent to use CL. The duty to screen cases is based on the "reasonableness" requirement of Rule 1.2(c) and the requirement to avoid conflicts of interest that might interfere with competent and diligent representation under Rule 1.7. Both rules require lawyers to obtain clients' informed consent to participate in a CL process. Although the Uniform Collaborative Law Act is not an ethical rule, sections 14 and 15 create relevant duties, including detailed provisions requiring lawyers to …

Law schools around the country seek to fill the legal needs of their communities in ways that are both innovative and mutually beneficial to clients and students. This article describes five pro bono and clinical programs, at the University of Richmond School of Law, The Earle Mack School of Law at Drexel University, Catholic University Columbus School of Law, the Thomas Jefferson School of Law, and Vermont Law School, where law students, under the supervision of law professors or community professionals, provide assistance or legal representation to underserved and often marginalized populations needing help with family law problems, including parents …

Seeking justice of Cambodians whose loved ones died at the hands of the Khmer Rouge. Searching for remedies for Mississippians whose rents doubled. Reviewing refugee claims in New Zealand. As awareness of trafficking in persons (TIP) and contemporary slavery has grown over the past twenty years, so has the number of organizations forming the modern abolition movement. From vast international organizations like the United Nations (UN) to local rehabilitation centers working with four to five trafficking victims in Nepal, organizations vary drastically in their mission, size, range of influence, and perspective. Among non-governmental organizations (NGO), common activities include raising awareness and financial support, researching TIP, providing victims services, and advocating for specific policy outcomes at local, national, and international levels. In 2009, the Illinois Supreme Court adopted a new set of rules of professional conduct for lawyers practicing in the state of Illinois.  These changes are the first complete revision of the rules since 1990 and bring a series of significant changes to the Illinois code of professional conduct.  While these new rules will not change the way a vast majority of lawyers practice on a daily basis, certain rule changes are significant and will affect practicing lawyer’s decisions regarding a variety of matters.  This comment provides a quick reference guide that will offer lawyers practicing in the state of …

A Tale Of Two Families -- Red Families V. Blue Families: Legal Polarization And The Creation Of Culture By Naomi Cahn & June Carbone, Rachel Rebouché

In their thought-provoking book, Red Families v. Blue Families: Legal Polarization and the Creation of Culture, Naomi Cahn and June Carbone examine conflicting views on family formation in the "culture war." Mirroring the electoral maps of 2004 and 2008, the authors contend that regional differences between Republican and Democrat voters correspond to deeply held beliefs about family values. The "blue" family paradigm is essentially liberal: It stresses individual equality, tolerance of diverse lifestyles, and a role for government in helping people achieve educational and economic success. Today, legal controversies are tried in the court of public opinion as much as in any court of law. Corporate lawyers' traditional tendency, however, has been to attempt to isolate legal activities from public relations activities. Accordingly, when providing legal advice, they have viewed media considerations as separate. Historically corporate counsels' typical media strategy often consisted of no more than, "no comment." Given today's saturated media culture, this is no longer a viable strategy.
