Frédéric Ozanam's Tactical Wisdom For Today's Consumer Society, Thomas Mckenna C.M. Oct 2010

Frédéric Ozanam's Tactical Wisdom For Today's Consumer Society, Thomas Mckenna C.M.

Vincentian Studies

From Thomas McKenna’s perspective, consumerism reduces everything, including religious tradition and altruism, to commodities that are removed from their original contexts and lacking in meaning. Elements of consumerism are identified; their combined effect leads individuals to only value short-term engagements with what appeals to them, makes them feel noble, or makes a statement about their identity. McKenna examines how Frédéric Ozanam’s life and work can be used to counteract this. According to Ozanam, Christians should mediate between the rich and the poor to alleviate class conflict and ensure justice for poor persons. His mandate for direct service means that neither …

What Would Ozanam Do?, David L. Gregory

Vincentian Studies

For Frédéric Ozanam, prayer and action were deeply intertwined. David Gregory speculates about what Ozanam would do to address the plight of impoverished workers. Ozanam’s influence can be seen in the first great encyclical on labor, Rerum Novarum, and his idea of the natural salary was a forerunner of the concept of the living wage. If he were alive in our time, he would be working toward that goal and toward universal health care without funding for abortion. Most of all, he would be praying.

Frédéric Ozanam―Beneficent Deserter: Mediating The Chasm Of Income Inequality Through Liberty, Equality, And Fraternity, Reverend Craig B. Mousin

Vincentian Studies

Frédéric Ozanam demonstrated how liberty, equality, and fraternity were Christian principles whose application was to safeguard the rights of poor persons and lessen the tremendous gap between rich and poor. He feared violent class warfare and insisted that Christians act as nonviolent mediators for as long as they could to prevent it from happening or at least ensure less disastrous results. If forced to take sides, Christians were to choose the poor, as the Gospel does. He urged charitable, pastoral, and civic engagement with the working poor, an often overlooked group. He campaigned for the Church and France to embrace …

Accessing Truth: Marketplaces Of Ideas In The Information Age, Nima Darouian Oct 2010

Accessing Truth: Marketplaces Of Ideas In The Information Age, Nima Darouian

Cardozo Public Law, Policy & Ethics Journal

The article argues that the Internet comprises numerous distinct virtual marketplaces, each with unique regulatory frameworks and dynamics, which are essential for the dissemination of information and public welfare. Current legal doctrines, such as those in the Uniform Commercial Code (UCC), the Uniform Computer Information Transactions Act (UCITA), and the Principles of the Law of Software Contracts (PLSC), are insufficient to protect the public interest in these virtual marketplaces. The article proposes that courts adopt the Reichman-Franklin standard, which requires mass-market contracts and non-negotiable access agreements to be fair, reasonable, and aligned with the public interest in education, science, research, …

Receiverships In The Prison Litigation Context: Factors Necessary For An Effective Judicial Remedy Of Last Resort, Liat Weingart Oct 2010

Receiverships In The Prison Litigation Context: Factors Necessary For An Effective Judicial Remedy Of Last Resort, Liat Weingart

Cardozo Public Law, Policy & Ethics Journal

This note examines the effectiveness of judicial receiverships as a last-resort remedy in institutional reform litigation, particularly in the context of prison systems. It argues that the success of receiverships depends on the court's ability to supervise effectively and ensure the receiver's independence from political influence. The analysis highlights that appointing executive agents as receivers often leads to conflicts of interest, undermining the remedy's effectiveness, and emphasizes the need for robust supervisory structures, such as Special Masters, to ensure accountability and alignment with court objectives.

Reaching Equilibrium In Tobacco Litigation, James A. Henderson Jr., Aaron Twerski Oct 2010

Reaching Equilibrium In Tobacco Litigation, James A. Henderson Jr., Aaron Twerski

Cornell Law Faculty Publications

Recent pro-plaintiff developments in tobacco litigation may lead to the conclusion that such litigation will go on endlessly and threaten the financial viability of the tobacco industry. This article takes the opposite position. Although the industry may take some near-term losses, it is far more likely that tobacco companies will survive short-term losses and that tobacco litigation will reach a stable equilibrium within the next fifteen to twenty years. The threat of third-party payer claims is no longer viable. Courts have unanimously rejected them. With the exception of cases pending in Florida and West Virginia, there are few individual personal …

A Distributive Theory Of Criminal Law, Aya Gruber Oct 2010

A Distributive Theory Of Criminal Law, Aya Gruber

William & Mary Law Review

In criminal law circles, the accepted wisdom is that there are two and only two true justifications of punishment―retributivism and utilitarianism. The multitude of moral claims about punishment may thus be reduced to two propositions: (1) punishment should be imposed because defendants deserve it, and (2) punishment should be imposed because it makes society safer. At the same time, most penal scholars notice the trend in criminal law to de-emphasize intent, centralize harm, and focus on victims, but they largely write off this trend as an irrational return to antiquated notions of vengeance. This Article asserts that there is in …

The Impact Of Gender On Voluntary And Involuntary Executive Departure, John R. Becker-Blease, Susan Elkinawy, Mark Stater

Finance Faculty Works

We examine the frequency and conditions of executive departure from S&P 1500 firms. Based upon published news reports, we find that female executives are more likely than male executives to depart their positions voluntarily and involuntarily in the presence of controls for firm performance, firm governance, and human capital. We also find that women are less likely than men to depart voluntarily as firm size increases or board size decreases but more likely to be dismissed as the board becomes more male dominated.

The Supreme Court's Post-Racial Turn Towards A Zero-Sum Understanding Of Equality, Helen Norton Oct 2010

The Supreme Court's Post-Racial Turn Towards A Zero-Sum Understanding Of Equality, Helen Norton

William & Mary Law Review

The Supreme Court—along with the rest of the country—has long divided over the question whether the United States has yet achieved a “post-racial” society in which race no longer matters in significant ways. How, if at all, this debate is resolved carries enormous implications for constitutional and statutory antidiscrimination law. Indeed, a post-racial discomfort with noticing and acting upon race supports a zero-sum approach to equality: if race no longer matters to the distribution of life opportunities, a decision maker’s concern for the disparities experienced by members of one racial group may be seen as inextricable from its intent to …

Correlation Of Diffusion Tensor Imaging Indices With Histological Parameters In Rat Cervical Spinal Cord Gray Matter Following Distal Contusion Spinal Cord Injury, Robin Easow Mottackel Oct 2010

Correlation Of Diffusion Tensor Imaging Indices With Histological Parameters In Rat Cervical Spinal Cord Gray Matter Following Distal Contusion Spinal Cord Injury, Robin Easow Mottackel

Master's Theses (2009 -)

The purpose of this study was to delineate the diffusion tensor imaging (DTI) parameters across the cervical spinal cord gray matter (GM) in a distal (T8) rat contusion spinal cord injury (SCI) model. DTI data were obtained from ex vivo rat spinal cords and registered to corresponding histological slices in samples from the acute through chronic stages of SCI including uninjured control, 2 weeks post injury, 15 weeks post injury and 25 weeks post injury groups (n = 5 in all groups). After imaging, samples were dehydrated, blocked in paraffin, sliced axially and stained with eriochrome cyanine R stain and …

Stateless Crimes, Legitimacy, And International Criminal Law: The Case Of Organ Trafficking, Leslie Francis, John Francis Oct 2010

Stateless Crimes, Legitimacy, And International Criminal Law: The Case Of Organ Trafficking, Leslie Francis, John Francis

Utah Law Faculty Scholarship

Organ trafficking—coercion for the purpose of removal of organs (United Nations 2000; GTZ 2004)—is recognized as a significant international problem. Yet unlike sex trafficking or trafficking in children, it is largely left out of international criminal law regimes and to some extent of domestic criminal law regimes as well. It does not come within the jurisdiction of the ICC, except in very special cases such as when it is conducted in a manner that conforms to the definitions of genocide or crimes against humanity. Although the United States Code characterizes trafficking as “a transnational crime with national implications,” (22 U.S.C. …

Characterization Of Metastasis-Associated Cell Surface Glycoproteins In Prostate Cancer, Lifang Yang Oct 2010

Characterization Of Metastasis-Associated Cell Surface Glycoproteins In Prostate Cancer, Lifang Yang

Theses and Dissertations in Biomedical Sciences

Prostate cancer (PCa) is a major health problem in males in the United States. Its lethality is mostly attributed to the primary tumor metastasizing to distant sites that are highly resistant to conventional therapies. Serum Prostate Specific Antigen (PSA) is the only protein biomarker used in clinic for prediction of prostate cancer recurrence following local therapies. Nonetheless, PSA lacks the ability to predict the behavior of an individual tumor in an individual patient. Therefore, development of reliable biomarkers for detection of metastatic potential in primary tumors, as well as discovery of new therapeutic targets, is in a great need for …

Emotional Intelligence And Its Potential In Engineering Management, Jesse Ray Toepfer Oct 2010

Emotional Intelligence And Its Potential In Engineering Management, Jesse Ray Toepfer

Engineering Management & Systems Engineering Theses & Dissertations

Assuming that the modern connotation of Emotional Intelligence (El) took shape with Wayne Leon Payne's 1986 dissertation, A Study of Emotion: Developing Emotional Intelligence, Self-Integration, Relating to Fear, Pain, and Desire, EI is nearing its thirtieth birthday. Relatively speaking, EI is still very young, and there are a handful of researchers who are still trying to explore and define El. Significant efforts have been made to develop the concept of EI, and the ramifications of EI on an individual's professional performance.

Often more technical and exacting in nature, the field of engineering management exhibits many aspects that are unique relative …

Akers' Social Learning Theory: Childhood Victimization, Witnessing Violence, Peer Violence And Later Violent Offending, Pamela Annette Styles Oct 2010

Akers' Social Learning Theory: Childhood Victimization, Witnessing Violence, Peer Violence And Later Violent Offending, Pamela Annette Styles

Sociology & Criminal Justice Theses & Dissertations

The literature linking abuse and later violent offending is extensive. More importantly, the effects of witnessing violence and peer violence on later violent offending have been well established. Drawing upon Akers' social learning theory, the current study explored the effects of victimization, witnessing violence, deviant peer association on later violent offending comparing Blacks and Whites. Using data from the National Survey of Adolescents (NSA), the sample was comprised of 2746 Whites and 572 Blacks. Bivariate and multivariate analyses revealed similar effects for Blacks and Whites. Examining social learning theory variables, the effects of witnessing violence, associating with violent peers and …

Toward A Cosmopolitan Ethic In Debt Restructuring, Carmen Amalia Corrales

Law and Contemporary Problems

Corrales discusses the sovereign debt restructuring process. Process -- or the series of actions, actors, and influences involved in a transaction -- is rarely examined in law. But the dynamics of process and the unspoken codes that affect it are, nonetheless, key to complex transactions and sovereign debt restructuring.
